Pipeline Safety: Random Drug Testing Rate, Contractor Management Information System Reporting, and Obtaining Drug and Alcohol Management Information System Sign-In Information
PHMSA has determined that the minimum random drug testing rate for covered employees will remain at 25 percent during calendar year 2015. Operators are reminded that drug and alcohol testing information must be submitted for contractors performing or ready to perform covered functions. For calendar year 2014 reporting, PHMSA will not attempt to mail the ``user name'' and ``password'' for the Drug and Alcohol Management Information System (DAMIS) to operators, but will make the user name and password available in the PHMSA Portal (https:// portal.phmsa.dot.gov/pipeline).
International Standards on the Transport of Dangerous Goods
This notice is to advise interested persons that on Wednesday, November 12, 2014, PHMSA will conduct a public meeting to discuss proposals in preparation for the 46th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) to be held December 1 to December 9, 2014, in Geneva, Switzerland. During this meeting, PHMSA is also soliciting comments relative to potential new work items, which may be considered for inclusion in its international agenda. Also, on Wednesday, November 12, 2014, the Department of Labor, Occupational Safety and Health Administration (OSHA) will conduct a public meeting (see Docket No. OSHA-H022k-2006-0062) to discuss proposals in preparation for the 28th session of the United Nations Sub-Committee of Experts on the Globally Harmonized System of Classification and Labelling of Chemicals (UNSCEGHS) to be held December 9 to December 11, 2014, in Geneva, Switzerland. Pipeline Safety: Renewal Requests for Special Permit
Pursuant to the Federal pipeline safety laws, PHMSA is publishing this notice of special permit renewal requests that we have received from two natural gas transmission pipeline operators, seeking relief from compliance with certain requirements in the Federal pipeline safety regulations. This notice seeks public comments on these requests, including comments on any safety or environmental impacts the renewal of these permits would have. For each listed Special Permit renewal request, an Environmental Assessment is also available for review and comment. At the conclusion of the 30-day comment period, PHMSA will evaluate the comments and the technical analysis of the renewal requests, to determine whether to grant or deny the renewals.

Safety Advisory: Packaging and Handling Ebola Virus Contaminated Infectious Waste for Transportation to Disposal Sites
PHMSA is issuing this safety advisory to provide guidance on the U.S. Department of Transportation's (DOT) Hazardous Materials Regulations (HMR; 49 CFR, parts 171-180) to persons who prepare, offer, and transport materials contaminated or suspected of being contaminated with the Ebola virus.
Pipeline Safety: Information Collection Activities

This revision updates the number of respondents used in the burden calculation but does not add to or change the type of information being collected.
Pipeline Safety: Guidance for Strengthening Pipeline Safety Through Rigorous Program Evaluation and Meaningful Metrics
PHMSA published Advisory Bulletin ADB-2012-10 in the Federal Register on December 5, 2012, to remind operators of gas transmission and hazardous liquid pipeline facilities of their responsibilities under current regulations to perform evaluations of their Integrity Management (IM) programs using meaningful performance metrics. PHMSA is issuing this Advisory Bulletin to expand that reminder by informing owners and operators of gas and hazardous liquid pipelines that PHMSA has developed guidance on the elements and characteristics of a mature program evaluation process that uses meaningful metrics.

Pipeline Safety: Request for Revision of a Previously Approved Information Collection: National Pipeline Mapping System Program
On July 30, 2014, (79 FR 44246) PHMSA published a notice and request for comments in the Federal Register titled: ``Pipeline Safety: Request for Revision of a Previously Approved Information Collection: National Pipeline Mapping System (NPMS) Program (OMB Control No. 2137- 0596)'' seeking comments on proposed changes to the NPMS data collection. PHMSA has received a request to extend the comment period in order to provide more time to evaluate the proposed revisions. PHMSA is extending the comment period from September 29, 2014, to December 1, 2014.

Information Collection Activities
In accordance with the Paperwork Reduction Act of 1995, PHMSA is inviting comments on an information collection under Office of Management and Budget (OMB) Control No. 2137-0586 entitled ``Hazardous Materials Public Sector Training and Planning Grants.'' In a previous 60-Day Notice published under Docket No. PHMSA-2013-0241, Notice No. 13-18, in the Federal Register on December 4, 2013 [78 FR 72972], PHMSA invited comments on its intent to collect additional information from Hazardous Materials Emergency Preparedness (HMEP) grantees on the ultimate recipients of HMEP grants. PHMSA is requesting the additional information to respond to a statutory requirement in the Moving Ahead for Progress in the 21st Century Act (Pub. L. 112-141, July 6, 2012) (MAP-21) to submit an annual report to Congress that identifies the ultimate recipients of HMEP grants and contains a detailed accounting and description of each grant expenditure by each grant recipient, including the amount of, and purpose for, each expenditure. This 30-Day Notice acknowledges comments received regarding the 60-Day Notice and provides details on the information PHMSA will be collecting in order to comply with MAP-21.
Hazardous Materials: Reverse Logistics (RRR).
PHMSA is notifying the public of its intent to extend the comment period by thirty days for a notice of proposed rulemaking entitled ``Hazardous Materials: Reverse Logistics'' under Docket Number PHMSA-2011-0143 (HM-253) published in the Federal Register on August 11, 2014.
Clarification on Fireworks Policy Regarding Display Aerial Shells With Attachments
This document clarifies PHMSA's policy regarding applications for classification approval of Display Aerial Shells with Attachments, provided they conform to the acceptable criteria described in this guidance, and otherwise comply with APA Standard 87-1 requirements. Although the APA Standard 87-1 provides requirements for Display Aerial Shells, it does not specifically address Display Aerial Shells with Attachments.
Clarification on Fireworks Policy Regarding Display Mines
This document clarifies PHMSA's policy regarding applications for classification approval of Display Mines provided they conform to the acceptable criteria described in this guidance, and otherwise comply with the APA Standard 87-1 requirements.
Pipeline Safety: Information Collection Activities
In accordance with the Paperwork Reduction Act of 1995, PHMSA published a notice with request for comments in the Federal Register on June 26, 2014; 79 FR 36378 on an information collection under Office of Management and Budget (OMB) Control No. 2137-0622, titled ``Pipeline Safety: Public Awareness Program.'' PHMSA received no comments. PHMSA is now forwarding the information collection request to OMB and providing an additional 30 days for comments.
Pipeline Safety: Meeting of the Technical Pipeline Safety Standards Committee and the Technical Hazardous Liquid Pipeline Safety Standards Committee
This notice announces a public meeting of the Gas Pipeline Advisory Committee (GPAC), also known as the Technical Pipeline Safety Standards Committee, and the Liquid Pipeline Advisory Committee (LPAC), also known as the Technical Hazardous Liquid Pipeline Safety Standards Committee. The committees will meet in joint session to discuss a variety of topics to keep committee members up-to-date on DOT's pipeline safety program.
Pipeline Safety: Guidance for Pipeline Flow Reversals, Product Changes and Conversion to Service
PHMSA is issuing this advisory bulletin to alert operators of hazardous liquid and gas transmission pipelines of the potential significant impact flow reversals, product changes and conversion to service may have on the integrity of a pipeline. Failures on natural gas transmission and hazardous liquid pipelines have occurred after these operational changes. This advisory bulletin describes specific notification requirements and general operating and maintenance (O&M) and integrity management actions regarding flow reversals, product changes and conversion to service. This advisory bulletin also recommends additional actions operators should take when these operational changes are made including the submission of a comprehensive written plan to the appropriate PHMSA regional office regarding these changes prior to implementation.
Pipeline Safety: Construction Notification
PHMSA is issuing this advisory bulletin to all owners and operators of gas and hazardous liquid pipelines to provide further clarification regarding the notification(s) required prior to certain construction-related events. PHMSA needs to be aware of certain construction-related events to have sufficient time to schedule reviews of pipeline construction plans and inspections. Moreover, timely construction plan reviews and inspections by PHMSA could help operators avoid costly modifications, repairs and/or additions to achieve compliance with the Federal pipeline safety regulations. Accordingly, PHMSA strongly encourages operators to provide the required construction-related notification(s) not later than 60 days prior to whichever of the following activities occurs first: Material purchasing and manufacturing; right-of-way acquisition; construction equipment move-in activities; onsite or offsite fabrications; or right-of-way clearing, grading and ditching. PHMSA also strongly encourages operators to provide the required notification(s) for the construction of 10 or more miles of a new pipeline for a pipeline that: (1) Did not previously exist; and (2) for the replacement of 10 or more contiguous miles of line pipe in an existing pipeline.
Hazardous Materials: Special Permit and Approvals Standard Operating Procedures and Evaluation Process
PHMSA is correcting language it issued in a notice of proposed rulemaking under this Docket on August 12, 2014, that proposes to include the standard operating procedures and criteria used to evaluate applications for special permits and approvals under the Hazardous Materials Regulations. The NPRM addresses certain matters identified in the Hazardous Materials Transportation Safety Act of 2012 related to these procedures as they are executed by PHMSA's Office of Hazardous Materials Safety's Approvals and Permits Division. This correction adds language to clarify that special permit and approval applications that undergo review by an Operating Administration (OA) will complete this review before they undergo an automated review. This proposed correction also clarifies that an OA review, depending on its completeness, may negate the need for the automated review.
Hazardous Materials: Revisions of the Emergency Response Guidebook
This notice advises interested persons that the Pipeline and Hazardous Materials Safety Administration (PHMSA) is accepting input on ways to improve the Emergency Response Guidebook (ERG) as it develops the 2016 version (ERG2016), particularly from those who have experience using the ERG. The ERG is for use by emergency services personnel to provide guidance for initial response to hazardous materials incidents. The development of the ERG2016 is a joint effort involving the transportation agencies of the United States, Canada, and Mexico.

Hazardous Materials: Harmonization With International Standards (RRR)
PHMSA proposes to amend the Hazardous Materials Regulations to maintain alignment with international standards by incorporating various amendments, including changes to proper shipping names, hazard classes, packing groups, special provisions, packaging authorizations, air transport quantity limitations, and vessel stowage requirements. These revisions are necessary to harmonize the Hazardous Materials Regulations with recent changes made to the International Maritime Dangerous Goods Code, the International Civil Aviation Organization's Technical Instructions for the Safe Transport of Dangerous Goods by Air, the United Nations Recommendations on the Transport of Dangerous GoodsModel Regulations and subsequently address three petitions for rulemaking.
Pipeline Safety: Information Collection Activities, Revision to Gas Distribution Annual Report
On April 28, 2014, in accordance with the Paperwork Reduction Act of 1995, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a notice in the Federal Register (79 FR 23403) of its intent to revise the gas distribution annual report (PHMSA F7100.1-1) to improve the granularity of the data collected. In addition to making several minor changes to the report, PHMSA will also request a new Office of Management and Budget (OMB) control number for this information collection. PHMSA received comments from one commenter in response to that notice. PHMSA is publishing this notice to respond to the comments, provide the public with an additional 30 days to comment on the proposed revisions to the forms and the instructions and announce that the revised information collection will be submitted to the OMB for approval.
Hazardous Materials: Special Permit and Approvals Standard Operating Procedures and Evaluation Process
PHMSA is proposing to address certain matters identified in the Hazardous Materials Transportation Safety Act of 2012 related to the Office of Hazardous Materials Safety's Approvals and Permits Division. Specifically, we propose to revise the regulations to include the standard operating procedures and criteria used to evaluate applications for special permits and approvals. These proposed amendments do not change previously established special permit and approval policies. This rulemaking also proposes to provide clarity regarding what conditions need to be satisfied to promote completeness of the applications submitted. An application that contains the required information reduces processing delays that result from rejection, and further facilitates the transportation of hazardous materials in commerce while maintaining an appropriate level of safety.
Hazardous Materials: Reverse Logistics (RRR)
PHMSA is proposing to revise the Hazardous Materials Regulations applicable to return shipments of certain hazardous materials by motor vehicle. PHMSA proposes a definition for ``reverse logistics'' for hazardous materials that are intended to be returned to or between a vendor, distributor, manufacturer, or other person for the purpose of returning for credit, recalling product, replacement, or similar reason (for instance, from a retail or wholesale outlet). PHSMA proposes to establish a new section in the regulations to provide an exception for materials that are transported in a manner that meets the definition of ``reverse logistics.'' In this exception, PHMSA proposes to clearly identify the hazardous materials authorized, packaging, hazard communication, and training requirements applicable to reverse logistics shipments. In addition to providing a new reverse logistics exception, this rulemaking also proposes to expand an existing exception for reverse logistics shipments of used automobile batteries that are being shipped from a retail facility to a recycling center.
Hazardous Materials: Failure To Pay Civil Penalties
PHMSA is amending its hazardous materials procedural regulations. Specifically, this final rule prohibits a person who fails to pay a civil penalty as ordered, or fails to abide by a payment agreement, from performing activities regulated by the Hazardous Materials Regulations until payment is made.
Hazardous Materials: Transportation of Lithium Batteries
PHMSA, in consultation with the Federal Aviation Administration (FAA), is modifying the requirements governing the transportation of lithium cells and batteries. This final rule revises hazard communication and packaging provisions for lithium batteries and harmonizes the Hazardous Materials Regulations (HMR) with applicable provisions of the United Nations (UN) Model Regulations, the International Civil Aviation Organization's Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO Technical Instructions) and the International Maritime Dangerous Goods (IMDG) Code.
Hazardous Materials: Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains
The Pipeline and Hazardous Materials Safety Administration (PHMSA or we), in coordination with the Federal Railroad Administration (FRA), is proposing: new operational requirements for certain trains transporting a large volume of Class 3 flammable liquids; improvements in tank car standards; and revision of the general requirements for offerors to ensure proper classification and characterization of mined gases and liquids. These proposed requirements are designed to lessen the frequency and consequences of train accidents/incidents (train accidents) involving certain trains transporting a large volume of flammable liquids. The growing reliance on trains to transport large volumes of flammable liquids poses a significant risk to life, property, and the environment. These significant risks have been highlighted by the recent instances of trains carrying crude oil that derailed in Casselton, North Dakota; Aliceville, Alabama; and Lac- M[eacute]gantic, Quebec, Canada. The proposed changes also address National Transportation Safety Board (NTSB) safety recommendations on the accurate classification and characterization of such commodities, enhanced tank car construction, and rail routing.
Hazardous Materials: Oil Spill Response Plans for High-Hazard Flammable Trains
PMHSA is issuing this ANPRM in conjunction with a notice of proposed rulemaking (NPRM)Hazardous Materials: Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains (2137-AE91), which PHMSA is also publishing today. In this ANPRM, PHMSA, in consultation with the Federal Railroad Administration (FRA), seeks comment on potential revisions to its regulations that would expand the applicability of comprehensive oil spill response plans (OSRPs) to high-hazard flammable trains (HHFTs) based on thresholds of crude oil that apply to an entire train consist.
Pipeline Safety: Request for Revision of a Previously Approved Information Collection-National Pipeline Mapping System Program (OMB Control No. 2137-0596).
In accordance with the Paperwork Reduction Act of 1995, PHMSA invites public comments on our intent to request the Office of Management and Budget's approval to revise and renew an information collection currently under OMB Control Number 2137-0596 titled: ``National Pipeline Mapping System Program.'' The collection currently requires operators to submit geospatial data, attributes, metadata, public contact information and a transmittal letter to the National Pipeline Mapping System (NPMS) program. The proposed revisions will require operators to submit additional information to the NPMS.

In accordance with the requirements of 49 U.S.C. 5117(c), PHMSA is publishing the following list of special permit applications that have been in process for 180 days or more. The reason(s) for delay and the expected completion date for action on each application is provided in association with each identified application.
Office of Hazardous Materials Safety; Notice of Applications for Modification of Special Permit
In accordance with the procedures governing the application for, and the processing of, special permits from the Department of Transportation's Hazardous Material Regulations (49 CFR part 107, Subpart B), notice is hereby given that the Office of Hazardous Materials Safety has received the applications described herein. This notice is abbreviated to expedite docketing and public notice. Because the sections affected, modes of transportation, and the nature of application have been shown in earlier Federal Register publications, they are not repeated here. Requests for modification of special permits (e.g., to provide for additional hazardous materials, packaging design changes, additional mode of transportation, etc.) are described in footnotes to the application number. Application numbers with the suffix ``M'' denote a modification request. These applications have been separated from the new application for special permits to facilitate processing.

Notice of Public Webinar on Implementation of Gas Pipeline Distribution Integrity Management Programs
Gas distribution pipeline operators were required to have prepared and implemented distribution integrity management programs (DIMP) by August 2, 2011. Federal and state regulators have been inspecting those programs and their implementation since that date. This webinar will be an opportunity for the regulators to share their experience with implementation topics with the public and the regulated community. The webinar will also include discussion of analyses of the 2013 submissions of data concerning mechanical fitting failures in gas distribution pipelines.
Hazardous Materials: Requirements for the Safe Transportation of Bulk Explosives (RRR)
The Pipeline and Hazardous Materials Safety Administration is proposing to amend the Hazardous Materials Regulations by establishing standards for the safe transportation of bulk explosives. This rulemaking would be responsive to two petitions for rulemaking submitted by industry representatives: P-1557 concerning the continued use of renewal applications, and P-1583 concerning the incorporation of an industry standard publication. Further, developing these requirements would provide wider access to the regulatory flexibility currently only offered by special permit and competent authorities. The requirements of this proposed rule would mirror the majority of provisions contained in nine widely used or longstanding special permits that have established safety records. These proposed revisions are intended to eliminate the need for future renewal requests, thus reducing paperwork burdens and facilitating commerce while maintaining an appropriate level of safety. As proposed, the requirements would authorize the transportation of certain explosives, ammonium nitrates, ammonium nitrate emulsions, and other specific hazardous materials in bulk packagings, which are not otherwise authorized under the regulations. These hazardous materials are used in blasting operations on specialized vehicles, known as multipurpose bulk trucks, which are used as mobile work platforms to create blends of explosives that are unique for each blast site. Finally, this rulemaking addresses the construction of new multipurpose bulk trucks.
