Notice of Request for a New Information Collection

Intent To Prepare an Environmental Impact Statement for the Southwest-to-Northeast Rail Corridor Project in Fort Worth, TX
The FTA and the Fort Worth Transportation Authority (The T) issue this notice to advise interested agencies and the public of their intent to prepare an EIS in accordance with the regulations implementing the National Environmental Policy Act (NEPA) for transit improvements in Fort Worth, and Tarrant County, Texas. Transit improvements from southwest Fort Worth, through downtown Fort Worth, to the northern entrance into the Dallas-Fort Worth International Airport (DFW Airport), are proposed along what is known as the Southwest-to- Northeast Rail Corridor. The proposed alignment will largely follow the Fort Worth & Western Railroad (FWWR), Union Pacific Railroad Company (UPRR), Burlington Northern Santa Fe Railroad (BNSF), and Dallas Area Rapid Transit-owned Cotton Belt rail lines that traverse Tarrant County. Transportation improvements are needed to meet current and future travel demand and to upgrade the transportation facilities in the corridor. The EIS will evaluate the future No-Build Alternative, a Transportation Systems Management (TSM) alternative, the preliminary Locally Preferred Alternative (LPA) from the recently completed planning Alternatives Analysis (AA), and any additional reasonable alternatives that emerge from the scoping process.
Final Guidance on New Starts/Small Starts Policies and Procedures and Notice of Availability of Updated Reporting Instructions
This notice conveys the Federal Transit Administration's (FTA) Final Guidance on New Starts/Small Starts Policies and Procedures. This Policy Guidance complements FTA's previous Guidance on New Starts Policies and Procedures, dated May 22, 2006, by providing further updates and enhancements to the procedures for project planning and development necessary to receive New or Small Starts funding. This notice also announces the availability of FTA's Reporting Instructions for the Section 5309 New Starts Criteria, which must be followed when reporting New Starts information for evaluation during the FY 2009 project evaluation cycle, as well as for any requests to enter into preliminary engineering, final design, or a full funding grant agreement until further notice. Finally, this notice provides the schedule for reporting of information for FTA's FY 2009 New Starts budget evaluations.
Notice of Limitation on Claims Against a Proposed Public Transportation Project
This notice announces a final agency action taken by the Federal Transit Administration (FTA) for the Dulles Corridor Metrorail Project, a public transportation project in the Washington, DC metropolitan area. The purpose of this notice is to announce the decision by FTA not to perform supplemental review under the National Environmental Policy Act (NEPA) on the subject project and to activate the limitation on any claims that may challenge this final agency action. This notice does not alter or extend the limitation period of 180 days for challenges of project decisions subject to a previous notice published in the Federal Register on December 4, 2006.

Public-Private Partnership Pilot Program
Section 3011(c) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (``SAFETEA-LU'') authorizes the U.S. Secretary of Transportation (the ``Secretary'') to establish and implement a pilot program to demonstrate the advantages and disadvantages of public-private partnerships (``PPPs'') for certain new fixed guideway capital projects (the ``Pilot Program''). This notice summarizes and responds to comments solicited by FTA by notice published in the Federal Register on March 22, 2006 (71 FR 14568). Notice of Final Title VI Circular
The Federal Transit Administration (FTA) has revised its Title VI Circular 4702.1 and is publishing a new Circular 4702.1A, ``Title VI and Title VIDependent Guidelines for Federal Transit Administration Recipients.'' The purpose of this circular is to provide recipients and subrecipients of Federal Transit Administration (FTA) financial assistance with guidance and instructions necessary to carry out the U.S. Department of Transportation's (``DOT'' or the ``Department'') Title VI regulations (49 CFR part 21) and to integrate into their programs and activities considerations expressed in the Department's Order on Environmental Justice (Order 5610.2), and Policy Guidance Concerning Recipients' Responsibilities to Limited English Proficient (``LEP'') Persons (70 FR 74087, December 14, 2005). Circular 4702.1A includes requirements and procedures which, if followed, will ensure that no person in the United States shall, on the basis of race, color, or national origin, be excluded from participation in, denied the benefits of, or be subjected to discrimination under any program or activity receiving financial assistance from FTA.
Intent to Prepare an Environmental Impact Statement on Transportation Improvements Within Downtown Dallas, TX
The Federal Transit Administration (FTA) and Dallas Area Rapid Transit (DART) have issued this notice to advise interested agencies and the public of their intent to prepare an Environmental Impact Statement (EIS) concurrent with a planning Alternatives Analysis (AA) for transportation improvements in the central business district (CBD) of Dallas, Texas. The EIS will be prepared in accordance with the National Environmental Policy Act of 1969 (NEPA), as amended. The EIS is being initiated to alleviate the capacity constraints on the LRT System within the Dallas CBD. The purpose of this Notice of Intent is to alert interested parties regarding the plan to prepare the EIS, to provide information on the purpose and need of the proposed transit project, to invite participation in the EIS process, including comments on the scope of the EIS proposed in this notice, and to announce that public scoping meetings will be conducted.
Public Transportation on Indian Reservations Program; Tribal Transit Program
This notice announces the availability of Fiscal Year (FY) 2007 funds for the Public Transportation on Indian Reservations Program, a program authorized by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). This notice also announces a national solicitation for Grant Applications for FY 2007 Tribal Transit Program (TTP) funds to be selected on a competitive basis; the grant terms and conditions that apply to this program; and grant application procedures and selection criteria for FY 2007 projects.

Notice of Request for the Extension of Currently Approved Information Collection
The Federal Transit Administration invites public comments about our intention to request the Office of Management and Budget's (OMB) approval to renew the following information collection: Pre-Award and Post-Delivery Review Requirements. The information to be collected for this program is necessary to certify that pre-award and post-delivery reviews will be conducted when using FTA funds to purchase revenue service vehicles.
Public-Private Partnership Pilot Program
FTA is extending the date by which it indicated it would respond to comments received on the establishment and implementation of the Public-Private Partnership Pilot Program.
Clean Fuels Grant Program
On June 9, 1998, the Transportation Equity Act for the 21st Century (TEA-21) was enacted requiring the Federal Transit Administration (FTA) to establish the Clean Fuels Formula Grant Program (the program). The program was developed to assist non-attainment and maintenance areas in achieving or maintaining the National Ambient Air Quality Standards for ozone and carbon monoxide (CO). Additionally, the program supports emerging clean fuel and advanced propulsion technologies for transit buses and markets for those technologies. Although the program was authorized as a formula grant program from its inception, Congress did not fund the program. The Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) changed the grant program from a formula-based to a discretionary grant program. The program, however, retains its initial purpose. FTA is publishing this final rule to revise the existing regulations to reflect the amendments made by SAFETEA-LU.
Elderly Individuals and Individuals With Disabilities, Job Access and Reverse Commute, and New Freedom Programs: Final Circulars
The Federal Transit Administration (FTA) has placed in the docket and on its website final guidance in the form of circulars to assist grantees in implementing the Elderly Individuals and Individuals with Disabilities (Section 5310), Job Access and Reverse Commute (JARC), and New Freedom Programs.
National Transit Database: Amendment To Reporting Requirements and Non-Substantive Technical Changes
This notice of proposed rulemaking (NPRM) provides interested parties with the opportunity to comment on proposed changes to the Federal Transit Administration's (FTA) National Transit Database (NTD) Uniform System of Accounts and Reporting System. The proposed changes will require recipients of formula grants for other than urbanized areas (Nonurbanized Area Formula Grants) to report annual transit data to the NTD. As mandated by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), this proposed rule will also require the annual reporting of rural transit data as a condition for receiving grant awards under the Nonurbanized Area Formula Program. Currently, FTA requires recipients of FTA Urbanized Area Formula Grants to provide an annual report to the Secretary of Transportation via the NTD using a uniform system of accounts and reporting system. This proposed rule will not affect existing mandatory reporting requirements for recipients of Urbanized Area Formula grants. In addition, this proposed rule makes non-substantive changes, technical corrections, and conforming amendments to 49 CFR part 630, ``Uniform System of Accounts and Reporting System.'' Technical corrections and conforming amendments are needed to update the regulation and make certain provisions clearer. These changes will have no substantive effect on the regulated public.

Solicitation of Applications for Certain Funding Available in Fiscal Year 2007 Under the Federal Transit Administration's Section 5309 Bus and Bus-Related Facilities Discretionary Grant Program To Support Urban Partnerships
This notice solicits applications for a significant portion of funds not ``earmarked'' by law and otherwise available in Fiscal Year 2007 under the Section 5309 Bus and Bus-Related Facilities Discretionary Grant Program (the ``Bus Program'') reserved by the Federal Transit Administration (``FTA'') for proposals selected in accordance with the terms of this notice. Under 49 U.S.C. 5309, the FTA Administrator, acting on behalf of the U.S. Secretary of Transportation (the ``Secretary''), has the discretion to award grants for bus and bus-related equipment and facilities. By this notice, the Department, acting through FTA, is seeking applications to the Bus Program that support the objectives of the National Strategy to Reduce Congestion on America's Transportation Network (the ``Congestion Initiative'') established in May 2006 by the U.S. Department of Transportation (the ``Department''). This Notice is one of four solicitations issued by the Department to date in connection with the Urban Partnership Program as part of the Congestion Initiative. See below ``Supplementary Information: Coordination with Other Urban Partnership Program Solicitations.''
Bus and Bus Facilities Discretionary Program Grants (Section 5309)
This notice invites applications for the discretionary funds available in Fiscal Year (FY) 2007 for the discretionary Bus and Bus Facilities Program, authorized by 49 U.S.C. 5309(b). The Bus and Bus Facilities Program makes funds available to public transit providers to finance capital projects to replace, rehabilitate, and purchase buses and related equipment and to construct bus-related facilities, including programs of bus and bus-related projects for assistance to subrecipients that are public agencies, private companies engaged in public transportation, or private non-profit organizations. The notice includes priorities established by the Federal Transit Administration (FTA) for the discretionary program, includes the criteria FTA will use in evaluating applications, and describes how to apply. Applications will be accepted from Designated Recipients for the FTA Urbanized Area Formula program and States, on behalf of nonurbanized or urbanized area transit providers. This announcement is available on the Internet on the FTA Web site at: https://www.fta.dot.gov. FTA will announce final selections on the Web site and in the Federal Register. A synopsis of this announcement will be posted in the FIND module of the government-wide electronic grants Web site at https://www.grants.gov. Proposals may be submitted to FTA electronically through the Grants.Gov APPLY function or through FTA's Transportation Electronic Award and Management (TEAM)-Web.
Alternatives Analysis Discretionary Program
This notice solicits proposals to compete for $12 million in Section 5339 funds to support technical work conducted within an alternatives analysis, in which one of the alternatives is a major transit capital investment. Under this authority, FTA will allocate the available discretionary funding for alternatives analysis. This analysis will support technical work that will improve and expand the information available to decision-makers considering potential New Starts and Small Starts funding. FTA will give priority to alternatives analyses that would add tasks to collect and analyze data on transit ridership patterns, the travel times of buses operating in mixed traffic, and/or other information on the current performance of the transit system. FTA will also give priority to proposals to develop and apply methods to estimate the time savings experienced by highway users that result from transit investments as well as proposals to develop and apply simplified travel forecasting approaches for Small Starts alternatives that cannot be addressed easily by the existing regional travel forecasting procedures. FTA encourages potential study sponsors to contact FTA to discuss the development of proposals under this section.
FTA Fiscal Year 2007 Apportionments and Allocations and Program Information
The ``Revised Continuing Appropriations Resolution, 2007,'' (Public Law 110-5), signed into law by President Bush on February 15, 2007, makes funds available for all of the surface transportation programs of the Department of Transportation (DOT) for the Fiscal Year (FY) ending September 30, 2007. This notice provides information on the FY 2007 funding available for the Federal Transit Administration (FTA) assistance programs, and provides program guidance and requirements, and information on several program issues important in the current year. The notice also includes tables that show unobligated carryover funding available in FY 2007 under certain discretionary programs from prior years. Finally, this notice also references separate Notices of Funding Availability (NOFA) published concurrently for discretionary opportunities under the Bus and Bus Facilities Program and the Alternatives Analysis Program.
Intent To Prepare an Environmental Impact Statement for High-Capacity Transit Improvements in the Leeward Corridor of Honolulu, HI
The Federal Transit Administration (FTA) and the City and County of Honolulu, Department of Transportation Services (DTS) intend to prepare an EIS on a proposal by the City and County of Honolulu to implement a fixed-guideway transit system in the corridor between Kapolei and the University of Hawai[revaps]i at M[amacr]noa with a branch to Waik[imacr]k[imacr]. Alternatives proposed to be considered in the draft EIS include No Build and two Fixed Guideway Transit alternatives. The EIS will be prepared to satisfy the requirements of the National Environmental Policy Act of 1969 (NEPA) and its implementing regulations. The FTA and DTS request public and interagency input on the purpose and need to be addressed by the project, the alternatives to be considered in the EIS, and the environmental and community impacts to be evaluated.
Notice of Granted Buy America Waivers
The following waiver will permit ticket vending machine manufacturers to install and count as domestic for purposes of the Buy America Act, 49 U.S.C. 5323(j), as implemented by the Federal Transit Administration at 49 CFR part 661, the CashCode BB-10XX, MBB-01XX, MBB- 03XX, MBB-04XX Bill Validators (collectively, the ``CashCode Bill Validators''). This waiver is valid for a period of two years, or until such time as a domestic source for the product becomes available, whichever occurs first. This notice shall ensure that the public is aware of the waiver. FTA requests that the public notify it if a domestic source for any of the above-listed products becomes available.
Formula Grants for Other Than Urbanized Areas Program (49 U.S.C. 5311): Notice of Final Circular
This notice announces the publication of final guidance in the form of a circular to assist grantees in implementing the Federal Transit Administration (FTA) Formula Grants for Other Than Urbanized Areas Program (commonly referred to as Section 5311). This notice provides a summary of the Section 5311 program circular, and addresses comments received in response to the July 31, 2006, Federal Register notice (71 FR 43280) announcing the availability of the proposed circular for comment.
Charter Service
Pursuant to the direction contained in the Joint Explanatory Statement of the Committee of Conference, for section 3023(d), ``Condition on Charter Bus Transportation Service'' of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) of 2005, the Federal Transit Administration (FTA) established a committee to develop, through negotiated rulemaking procedures, recommendations for improving the regulation regarding unauthorized competition from recipients of Federal financial assistance. The proposed revisions contained in this notice of proposed rulemaking (NPRM) represent a complete revision to the charter service regulations contained in 49 CFR part 604. The NPRM contains the consensus work product of the Charter Bus Negotiated Rulemaking Advisory Committee (CBNRAC), which was able to reach consensus on a majority of the regulatory language. Where the CBNRAC was unable to reach consensus, FTA proposes revisions to the charter service regulations based on the open, informed exchange of information that took place during meetings with the CBNRAC.
Statewide Transportation Planning; Metropolitan Transportation Planning
This final rule revises the regulations governing the development of metropolitan transportation plans and programs for urbanized areas, State transportation plans and programs and the regulations for Congestion Management Systems. The revision results from the passage of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Pub. L. 109-59, August 10, 2005), which also incorporates changes initiated in its predecessor legislation, the Transportation Equity Act for the 21st Century (TEA-21) (Pub. L. 105-178, June 9, 1998) and generally will make the regulations consistent with current statutory requirements.
Debt Service Reserve Reimbursement Pilot Program
The Federal Transit Administration published in the Federal Register of December 28, 2006, a notice establishing the Debt Service Reserve Pilot Program as authorized under the Safe, Accountable, Flexible, Efficient Transportation Equity Acta Legacy for Users. Inadvertently, an eligible class of participant in the pilot program was omitted. This document corrects that oversight.
Notice of Availability of Proposed Guidance on New and Small Starts Policies and Procedures
This notice announces the availability of the Federal Transit Administration's (FTA) Proposed Guidance on New and Small Starts Policies and Procedures and requests your comments on it. The guidance explains proposed changes to the New and Small Starts programs that will become effective upon the issuance of Final Guidance, which will be announced in a subsequent Federal Register notice. FTA requests comments on the Proposed Guidance, which is available in DOT's electronic docket and on FTA's Web site.
Preparation of an Environmental Impact Statement for the Berkeley/Albany Ferry Terminal Project in the Cities of Berkeley and Albany, California
The Federal Transit Administration and the San Francisco Bay Water Transit Authority (WTA) are planning to prepare an Environmental Impact Statement (EIS) for the proposed construction of a ferry terminal along the Berkeley/Albany waterfront that would link the San Francisco Ferry Terminal with communities in the East Bay. The project would serve commuters, visitors, and recreational users who desire an alternative way to cross San Francisco Bay to access nearby employment, entertainment, and recreational destinations. The EIS will be prepared in accordance with section 102(2)C of the National Environmental Policy Act of 1969 (NEPA) and pursuant to the Council on the Environmental Quality's regulations (40 CFR parts 1500-08) as well as provisions of the recently enacted Safe, Accountable, Flexible Efficient Transportation Equity Act: A Legacy for Users. (SAFETEA-LU). The purpose of this Notice of Intent (NOI) is to alert interested parties regarding the plan to prepare an EIS, to provide information on the proposed transit project, to invite participation in the EIS process, including comments on the scope of the EIS proposed in this notice, and to announce public scoping meetings will be conducted.
Intent To Prepare an Environmental Impact Statement for the Proposed Exposition Corridor Light Rail Transit Project Phase 2
The Federal Transit Administration (FTA) and the Exposition Metro Line Construction Authority (Authority), in cooperation with the Los Angeles County Metropolitan Transportation Authority (LACMTA), intend to prepare an Environmental Impact Statement (EIS) on the proposed Phase 2 of the Exposition Corridor Light Rail Transit Project. Phase 2 would extend from the current planned terminus of the Exposition Corridor Light Rail Transit Project Phase 1 in Culver City, California, approximately 6 to 8 miles to an end-of-line station near 5th Street and Colorado Boulevard in Santa Monica, California. The EIS will be prepared in accordance with the requirements of the National Environmental Policy Act (NEPA) and its implementing regulations. The purpose of this notice is to alert interested parties regarding the intent to prepare the EIS, to provide information on the nature of the proposed project and possible alternatives, to invite public participation in the EIS process, including comments on the scope of the EIS proposed in this notice, to announce that public scoping meetings will be conducted, and to identify participating agency contacts.
Buy America: Notice of Public Meeting and Agenda
On January 17, 2007, the Federal Transit Administration (FTA) announced a public meeting regarding the Buy America second notice of proposed rulemaking (SNPRM) to allow the public to ask questions regarding the SNPRM published on November 30, 2006. In the public meeting notice, FTA also extended the comment period to February 28, 2007, to allow affected parties time to carefully consider the changes made in the SNRM and the information presented at the public meeting. This Notice announces the agenda for the public meeting, and a conference call number for interested parties who cannot attend in person.
Notice of Final Agency Guidance on the Eligibility of Joint Development Improvements Under Federal Transit Law
This final Agency guidance describes the eligibility of ``joint development'' improvements under 49 U.S.C. 5301 et seq. (Federal transit law) by interpreting the definition and operation of the term ``capital project'' as defined at 49 U.S.C. 5302(a)(1)(G), and as amended by Section 3003(a) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). This final Agency guidance is the culmination of three notices issued by the Federal Transit Administration (FTA or Agency), the first of which appeared in the Federal Register on January 31, 2006. FTA intends to publish the text of this final Agency guidance as a stand-alone FTA Circular titled The Eligibility of Joint Development Improvements under Federal Transit Law.
Notice of Establishment of Emergency Relief Docket for Calendar Year 2007
As provided for in 49 CFR Part 601, Subpart D, (72 FR 910, Jan. 9, 2007), the Federal Transit Administration (FTA) must, by January 31 of each calendar year, establish an Emergency Relief Docket so grantees and subgrantees affected by national or regional emergencies may request relief from policy statements, circulars, guidance documents and regulations. By this notice, FTA is establishing an Emergency Relief Docket for calendar year 2007.
Public-Private Partnership Pilot Program

This notice is organized into three sections: (1) ``Background;'' (2) ``Overview of Pilot Program;'' and (3) ``Definitive Terms.''
Buy America Requirements; End Product Analysis and Waiver Procedures; Public Meeting and Extension of Comment Period
The Federal Transit Administration (FTA) is holding a public meeting on the Buy America second notice of proposed rulemaking (SNPRM). The purpose of this meeting is to allow the public to ask questions regarding the notice published on November 30, 2006 (71 FR 69411). Furthermore, due to the complexity of the issues presented in the SNPRM, FTA is extending the comment period to February 28, 2007, which will allow affected parties time to carefully consider the changes made in the SNPRM and the information presented at the public meeting.
Final Policy Statement on When High-Occupancy Vehicle (HOV) Lanes Converted to High-Occupancy/Toll (HOT) Lanes Shall Be Classified as Fixed Guideway Miles for FTA's Funding Formulas and When HOT Lanes Shall Not Be Classified as Fixed Guideway Miles for FTA's Funding Formulas
This notice supersedes the notice published in the Federal Register by FTA on December 27, 2006, at 71 FR 77862. This notice corrects certain typographical errors that appeared in the prior notice, makes non-substantive revisions to the prior notice and re- orders the sections of the prior notice. This final policy statement also describes when FTA will not classify HOT lanes as fixed guideway miles for purposes of the transit funding formulas administered by FTA.
Preparation of a Programmatic Environmental Impact Statement on the Jacksonville, Florida Rapid Transit System
The Federal Transit Administration, in cooperation with Jacksonville (Florida) Transportation Authority, is planning to prepare a programmatic environmental impact statement for the proposed expansion of and improvements to the Jacksonville Rapid Transit System, a busway serving the greater Jacksonville area. The programmatic environmental impact statement will be prepared in accordance with regulations implementing the National Environmental Policy Act, as supplemented by the joint Federal Transit AdministrationFederal Highway Administration National Environmental Policy Act procedures. The purpose of this notice of intent is to alert interested parties regarding the plan to prepare the programmatic environmental impact statement, to provide information on the nature of the proposed transit program, to invite public participation in the impact statement process, including comments on this notice, and to announce that public scoping meetings will be conducted.
