The FHWA is adding a new part to the Code of Federal Regulations, to add regulations specifying the interoperability requirements for automated toll collection systems for the facilities that are tolled under any of the tolling programs contained in section 1604 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). Specifically, this rulemaking requires facilities operating with authority under section 1604 of SAFETEA-LU to use electronic toll collection (ETC) systems and to maximize their system's interoperability with other toll facilities. Although a nationwide interoperability standard has not yet been established, this rule seeks to accelerate progress toward achieving nationwide interoperability by requiring these facilities to upgrade their ETC systems to the national standards whenever adopted.

The FHWA invites public comment regarding our intention to request the Office of Management and Budget (OMB) to approve a renewed information collection. The information we collect is provided by each State Department of Transportation (State) in its right-of-way operations manuals. The right-of-way manuals contain detailed descriptions of procedures the State will follow to show compliance with Federal regulations found in 23 CFR Part 710 and 49 CFR Part 24. 23 CFR 710.201(c) sets out the requirement for the right-of-way operations manual. Specifically, each manual shall describe functions and procedures for all phases of the real estate program, including appraisal and appraisal review, negotiation and eminent domain, property management, and relocation assistance. The State shall update the manual periodically to reflect changes in operations and submit the updated manual for approval by the FHWA. The Paperwork Reduction Act of 1995 required the FHWA to publish notice for this information collection in the Federal Register.

The FHWA is issuing this notice to advise the public that a Supplemental Environmental Impact Statement (SEIS) will be prepared for the proposed highway improvement project: US Route 219 Springville to Salamanca, NY Route 39 to NY Route 17 (I-86), Erie & Cattaraugus Counties, New York. A Reevaluation of the 2003 FEIS was completed in May 2009; NYSDOT and FHWA concluded that a SEIS for the un-built portion of the project was required due to (i) significant increase in the area of identified wetlands in the project corridor, and (ii) observed changes in traffic growth rates for some segments of existing Route 219 that may influence the safety and operational characteristics of the previously identified alternatives. These issues will be evaluated and presented through the development of the SEIS. FHWA intends to utilize the environmental review provisions afforded under Section 6002 of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A Legacy for Users (SAFETEA-LU) in the development of the SEIS.

This notice invites States, along with their local government partners and other public authorities, to apply to participate in the Value Pricing Pilot (VPP) program and presents guidelines for program applications for fiscal years 2009 and 2010. Unlike with previous notices, the purpose of this notice is to seek only applications for statewide, regionwide, or areawide transportation pricing studies and for transportation pricing implementation projects that do not entail tolling roadways.
