Notice of Final Federal Agency Action on a Proposed Highway Project in Wisconsin
The FHWA is issuing this notice to announce actions taken that are final Federal agency actions. The final agency actions relate to a proposed highway project, along Interstate 41 (I-41) in Outagamie and Brown counties, Wisconsin between State Highway (WIS) 96 (Wisconsin Avenue) in the City of Appleton and County F (Scheuring Road) in the City of De Pere. Those actions grant approvals for the project.
Broadband Infrastructure Deployment
FHWA amends its regulations governing the accommodation of utilities on the right-of-way (ROW) of Federal-aid or direct Federal highway projects to implement requirements of the Consolidated Appropriations Act, 2018, for broadband infrastructure deployment. Development of Guidance for Electric Vehicle Charging Infrastructure Deployment
The recently enacted Bipartisan Infrastructure Law invests in the deployment of electric vehicle (EV) charging infrastructure as one of many important ways to confront the climate crisis. Through a National Electric Vehicle Formula Program (EV Charging Program), the law provides funding to States to strategically deploy EV charging infrastructure and to establish an interconnected network to facilitate data collection, access, and reliability. The law also establishes a discretionary grant program for Charging and Fueling Infrastructure (Charging and Fueling Infrastructure Program) to strategically deploy publicly accessible EV charging infrastructure and hydrogen, propane, and natural gas fueling infrastructure along designated alternative fuel corridors or in certain other locations that are accessible to all drivers of such vehicles. The law directs DOT, in coordination or consultation with the Department of Energy (DOE), to develop guidance for both programs. Through this notice, FHWA invites public comments to inform the development of the guidance. FHWA is especially interested in comments suggesting ways that the guidance could promote equity in the deployment of EV charging infrastructure under these programs.

Surface Transportation Project Delivery Program; Arizona Department of Transportation Final FHWA Audit Report
The Moving Ahead for Progress in the 21st Century Act (MAP-21) established the Surface Transportation Project Delivery Program that allows a State to assume FHWA's environmental responsibilities for environmental review, consultation, and compliance under the National Environmental Policy Act (NEPA) for Federal highway projects. When a State assumes these Federal responsibilities, the State becomes solely responsible and liable for carrying out the responsibilities it has assumed, in lieu of FHWA. This program mandates annual audits during each of the first four years of State participation to ensure compliance with program requirements. This is the first audit of the Arizona Department of Transportation's (ADOT) performance of its responsibilities under the Surface Transportation Project Delivery Program (NEPA Assignment Program). This notice finalizes the first audit report for ADOT.

Re-Designation of the Primary Highway Freight System (PHFS)
The FHWA is extending the comment period for the Re- Designation of the PHFS notice. The original comment period is set to close on October 25, 2021. The extension is based on input received from DOT stakeholders that the October 25 closing date does not provide sufficient time for submission of comments to the docket. The FHWA agrees that the comment period should be extended. Therefore, the closing date for submission of comments is extended to December 15, 2021, which will provide others interested in commenting additional time to submit comments to the docket.

Re-Designation of the Primary Highway Freight System (PHFS)
The FHWA is re-designating the PHFS to meet the statutory requirements of the authorizing law. The Fixing America's Surface Transportation (FAST) Act designated the PHFS and provided for an update to the PHFS every 5 years. Beginning five years after the date of the enactment of the FAST Act, and every 5 years thereafter, using the designation factors described in FAST Act, the FHWA Administrator shall re-designate the primary highway freight system. Each re- designation may increase the mileage on the PHFS by not more than 3 percent of the total mileage of the system. The current PHFS consists of 41,518 centerline miles of roadway and is a component of the National Highway Freight Network (NHFN). The re-designation initiated through this RFI may add up to 1,246 miles of additional mileage to the current PHFS. State Freight Advisory Committees, represented by their States, are invited to submit comments. Other entities are encouraged to engage directly with their State Freight Advisory Committee or the State department of transportation (State DOT). Comments submitted by entities other than a State Freight Advisory Committee will be considered for general input into the process.
Proposed First Renewal of Memorandum of Understanding (MOU) Assigning Certain Federal Environmental Responsibilities to the State of Nebraska, Including National Environmental Policy Act (NEPA) Authority for Certain Categorical Exclusions (CEs)
The FHWA and the State of Nebraska, acting by and through its Department of Transportation (State), propose renewing the MOU providing participation of the State in the Categorical Exclusion Assignment program. This program allows FHWA to assign its authority and responsibility for determining whether certain designated activities within the geographic boundaries of the State, as specified in the proposed MOU, are categorically excluded from preparation of an environmental assessment or an environmental impact statement under the National Environmental Policy Act.

Emergency Temporary Closure of the Interstate 40 Hernando DeSoto Bridge Over the Mississippi River Between Arkansas and Tennessee
The Arkansas Department of Transportation (ARDOT) and the Tennessee Department of Transportation (TDOT) closed the I-40 Hernando DeSoto Bridge (I-40 Bridge) over the Mississippi River between Arkansas and Tennessee on May 11, 2021, for safety considerations when a mechanical fracture was discovered within the elements of a steel box beam. FHWA is providing notice that ARDOT and TDOT are continuing the temporary closure of the I-40 Bridge for an indefinite period of time. FHWA has approved a request by the Arkansas and the Tennessee Divisions of the FHWA for an emergency deletion of a segment of I-40 between the I-55 Split (Exit 279B) in West Memphis, Arkansas, and the I-240 Interchange (Exit 1E) in Memphis, Tennessee, from the National Network in accordance with applicable regulations due to the safety considerations discussed in this notice. FHWA is requesting comments from the public on the alternate routes selected by TDOT and ARDOT due to the closure.
