This final rule amends the CFR by removing a subpart that delineates internal responsibilities regarding indexing, public inspection, and Federal Register publication of Department of the Navy (DON) directives and other documents affecting the public. It has been determined that this subpart is no longer required, as the procedures outlined in it are internal to the DON.

Notice of Public Meetings for the Draft Environmental Impact Statement for the Modernization of the Fallon Range Training Complex, Nevada
Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969, as implemented by the Council on Environmental Quality, the Department of the Navy (DoN) has prepared and filed with the United States Environmental Protection Agency a Draft Environmental Impact Statement (EIS) to evaluate the potential environmental impacts of modernization of the Fallon Range Training Complex (FRTC), Naval Air Station Fallon, Nevada, to include renewing the current public land withdrawal, expanding land ranges, expanding and modifying airspace, and upgrading range infrastructure. The DoN is not proposing to change the level or type of training, rather activities would be redistributed across the expanded ranges. The DoN will hold seven public meetings to inform the public and receive oral and written comments on the Draft EIS. This notice announces the dates and locations of the public meetings and provides information about the environmental planning effort.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS CINCINNATI (LCS 20) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Privacy Act of 1974; System of Records
The Office of the Department of the Navy proposes to modify a system of records, Family and Unaccompanied Housing Program, NM1110-01. This system is used for Department of Defense (DoD) housing program management and therefore used to determine the eligibility of civilian and contract personnel to utilize government owned, leased and privatized housing for current and retired military and to provide housing services at military installations and enterprise reporting and performance metrics. The system also provides a public website for property owners and managers to advertise referral properties to Service members. This system is required to ensure timely and efficient DoD housing operations, products and services.

The Department of the Navy proposes to modify a system of records notice: Data Warehouse Business Intelligence System (DWBIS), N05220-1, to be compliant with the OMB Circular A-108; by updating contact information for the system manager; by expanding the categories of individuals covered by the system to include the Space and Naval Warfare Systems Command (SPAWAR) and its two systems centers; by updating the categories of records for these individuals, and by providing routine uses that are consistent within the Federal Government. This is necessary to allow a single system to be used for all of SPAWAR to manage workforce education, training, skills, and experience required for the development of its Acquisition Workforce, Cyber Security, and Information Warfare workforce.

Rules Governing Public Access
This final rule removes DoD's regulation requiring individuals wishing to visit Kaho`olawe Island, Hawaii, to receive advance authorization from the Commanding Officer of Naval Base, Pearl Harbor before doing so. This part provided entry procedures for individuals wishing to visit Kaho`olawe Island, Hawaii, and its adjacent waters due to ongoing military training operations and the presence of unexploded ordnance (UXO). On November 11, 2003, upon the completion of UXO clearance and environmental restoration, control of access to Kaho`olawe was passed from the United States to the State of Hawaii. Since that time, Navy has not exercised access control to Kaho`olawe Island or its adjacent waters. This part is no longer required.

Disposition of Property
This final rule removes Department of the Navy regulations governing disposition of property, including surplus real property, warships, other surface vessels, personal property, and strategic materials. The disposal of surplus property is governed by standing authorities found within the U.S. Code. Further, disposal of surplus property is also governed by Department of Defense regulations entitled ``Defense Material Disposition.'' Therefore, this rule can be removed from the CFR.
