The Bureau of Land Management (BLM) is proposing to amend the supplementary rules established in 2003 (68 FR 1858, January 14, 2003) for the public lands within the State of Colorado. The rules relate to the illegal use of alcohol and drugs on the public lands. The amended supplementary rules are necessary to protect natural resources and the health and safety of public land users. These amended supplementary rules will allow BLM personnel to continue enforcement of existing public land regulations pertaining to alcohol and drug use in a manner consistent with current state laws as contained in the Colorado Revised Statutes.

Notice is hereby given that certain public lands in Graham County, Arizona are temporarily closed to public use. This Closure Order restricts all public use on a year-round basis on public lands administered by the BLM Safford Field Office in the Watson Wash area. This Order is issued under the authority of 43 CFR 8364.1 and affects the following public lands: Gila and Salt River Meridian, Arizona, T. 6 S., R.25 E., Sec. 14, S\1/2\, SW\1/4\: Sec. 15, S\1/2\ SE\1/4\; Sec. 22, E\1/2\ NE\1/4\; Sec. 23, NW\1/4\. The affected lands contain conditions that compromised public health and safety due to illegal activities at the site that included murder, assaults, fights, disorderly conduct, drugs, under-age drinking, weapon offenses, motor vehicle accidents, vandalism, and littering. Public health and safety hazards have increased substantially and are expected to continue to do so unless immediate management action is taken. The restriction prohibiting public entry and use will help to mitigate public health and safety threats. The BLM's immediate removal of an unauthorized hot tub, which was an attractive nuisance, will reduce the area's appeal as a party spot.

Two public listening sessions will be held by the Bureau of Land Management ( BLM) to solicit views from the public on implementation of the Pilot Project provisions of the Energy Policy Act of 2005. Section 365 of the Energy Policy Act directs the Secretary of the Interior to establish seven BLM Field Offices as oil and gas streamlining Project Offices. The offices are: Rawlins, Wyoming; Buffalo, Wyoming; Miles City, Montana; Farmington, New Mexico; Carlsbad, New Mexico; Grand Junction/Glenwood Springs, Colorado; and Vernal, Utah. The Act directs that within 90 days from the date the Act was signed (August 8, 2005) that a Memorandum of Understanding be signed between the U.S. Department of the Interior and the U.S. Department of Agriculture, the Environmental Protection Agency, and the U.S. Army Corps of Engineers. The Memorandum of Understanding was signed October 24, 2005. In addition, Section 365 specifies that not later than 3 years after the date of enactment, the Secretary of the Interior shall submit to Congress a report that outlines the results of the Pilot Project, and makes recommendations to the President regarding whether the Pilot Project should be implemented throughout the United States. The public listening sessions will provide an opportunity for the public to comment on the progress made in the first year of the Pilot Project.

The Bureau of Land Management (BLM) has signed a Record of Decision (ROD) concerning two right-of-way applications filed by Private Fuel Storage (PFS), L.L.C, for an independent spent fuel storage installation on reservation lands of the Skull Valley Band of Goshute Indians (Band or Skull Valley Band). The installation is described in an Environmental Impact Statement (EIS) prepared by the Nuclear Regulatory Commission (NRC), entitled ``Final Environmental Impact Statement for the Construction and Operation of an Independent Spent Fuel Storage Installation on the Reservation of the Skull Valley Band of Goshute Indians and the Related Transportation Facility in Tooele County, Utah (December 2001).'' Spent nuclear fuel (SNF), the focus of the EIS, is the primary by- product from a nuclear reactor. As proposed, the fuel would be transported from an existing Union Pacific railroad site to the Reservation of the Skull Valley Band in Tooele County, Utah. The applications seek right-of-way grants under Title V of the Federal Land Policy and Management Act (FLPMA), 43 U.S.C. 1761, to transport SNF across public lands managed by the BLM. The BLM was a cooperating agency in the preparation of this EIS, as were the Bureau of Indian Affairs (BIA), U.S. Department of the Interior, and the U.S. Surface Transportation Board. This EIS is available online at https:// www.nrc.gov/reading-rm/doc-collections/nuregs/staff/sr1714/v1 /. Additional comments were received by the BLM following its publication on February 7, 2006, of a Federal Register notice at 71 FR 6286 requesting comments on the two right-of-way applications then pending before the agency. The BLM ROD is based on review of the draft EIS; the FEIS; comments received from the public, other Federal agencies, and State and local governments; and discussion of all the alternatives with the cooperating agencies. The BLM decision is to choose the No Action alternative from the EIS. The effect of this decision is to reject applications U 76985 and U 76986 for right-of-way grants filed by PFS, L.L.C.

The purpose of the emergency closure is to protect soils, vegetation and cultural resources that have been adversely impacted, or are at risk of being adversely impacted, by off-highway vehicle (OHV) use. Notice is hereby given of the Bureau of Land Management's (BLM's) implementation of the Recreation Resource Advisory Committee provisions of the Federal Lands Recreation Enhancement Act. Pursuant to the Federal Lands Recreation Enhancement Act and a signed Interagency Agreement between the Department of the Interior and the Department of Agriculture, the BLM will utilize existing BLM Resource Advisory Councils to make recommendations on BLM and Forest Service recreation fee issues in the following States: Arizona, Idaho, Montana, Nevada, New Mexico, North Dakota, South Dakota and Utah. Both the BLM and the FS will use new Recreation RACs, chartered by the FS, for the Pacific Northwest Region (Oregon and Washington), the Pacific Southwest Region (California), the State of Colorado, and for the Eastern and Southern Regions (these represent most States east of the Rockies). Any of the existing BLM Resource Advisory Councils or the new FS- chartered RRACs may also establish Subcommittees for recreation fee- related matters.

The purpose of this notice is to announce an upcoming meeting of the Gila Box Riparian National Conservation Area Advisory Committee Meeting. The purpose of the Advisory Committee is to provide informed advice to the Safford Field Manager on management of public lands in the Gila Box Riparian National Conservation Area in southeastern Arizona. The meeting will be held at the Bureau of Land Management Safford Field Office on October 18, 2006, commencing at 8 a.m. and ending at approximately 4 p.m. The meeting will serve as an orientation for the newly appointed representatives to the seven-member committee, and will include a field trip to the Gila Box. The entire meeting is open to the public, but those wishing to accompany the Committee on the field trip must provide their own transportation. The public can speak before the Committee at 9 a.m.

Per 30 U.S.C. 188(d), Baldwin Exploration Corp. timely filed a petition for reinstatement of oil and gas lease NDM 94458, Mountrail County, North Dakota, together with a request for a rental and royalty reduction allowed under 43 CFR 3108.2-3(f). The lessee paid the required rental at the rate provided in the original lease terms. No leases were issued that affect these lands. The lessee paid the $500 administration fee for the reinstatement of the lease and $163 cost for publishing this Notice. The lessee met the requirements for reinstatement of the lease per Sec. 31 (d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188). We are proposing to reinstate the lease, effective the date of termination subject to the original terms and conditions of the lease.

Notice is hereby given that effective immediately, the Bureau of Land Management (BLM), Richfield Field Office, is restricting OHV travel to designated routes on 142,023 acres of public lands near Caineville, Utah, known as the Factory Butte area. This restriction does not apply to State or private lands located in the area. Within the Factory Butte area 2,602 acres currently designated as open will remain open and 3,843 acres currently designated as closed will remain closed to OHV travel. The restriction to designated routes affects the remaining 142,023 acres of the area located in portions of T. 27 S., R. 6-10 E.; T. 28 S., R. 7-10 E.; T. 29 S., R. 7 & 8 E.; and T. 30 S., R. 7 & 8 E., Salt Lake Meridian. The purpose of the restriction is to protect threatened and endangered species that have been adversely impacted or are at risk of being adversely impacted by OHV use. This restriction will remain in effect until the conditions giving rise to the restriction have been sufficiently addressed or the Richfield Field Office Resource Management Plan that is currently being prepared is signed by the authorized officer and becomes final.

Alaska Native Veteran Allotments

The Bureau of Land Management (BLM) is amending its regulations governing Alaska Native veteran allotments. The existing regulations allowed certain Alaska Native veterans another opportunity to apply for a Native allotment under the repealed Native Allotment Act of 1906. This final rule will remove the requirement that veteran applicants must have posted the land by marking all corners on the ground with their name and address prior to filing an application with BLM. This change to the regulations will make the processing of Alaska Native veteran allotments more like that of allotments adjudicated under the 1906 act.

Notice is hereby given, in accordance with Public Laws 92-463 and 94-579, that the California Desert District Advisory Council to the Bureau of Land Management, U.S. Department of the Interior, will participate in a field tour of BLM-administered public lands on Friday, October 13, 2006 from 7:30 a.m. to 5 p.m., and meet in formal session on Saturday, October 14 from 8 a.m. to 3 p.m. in the Canyon Conference Center at the Spa Resort Casino located at 100 North Canyon Drive, Palm Springs, California. The Council and interested members of the public will depart for the field tour at 7:30 a.m. from the main lobby of the Spa Resort Casino. The public is welcome to participate in the tour but should plan on providing their own transportation, lunch, and beverage. Agenda topics for the formal session on Saturday will include updates by Council members and reports from the BLM District Manager and five field office managers. Additional agenda topics are being developed.
