BOEM and BSEE are announcing the availability of a Programmatic Environmental Assessment (PEA) and Finding of No Significant Impact (FONSI) for well stimulation treatments (WSTs) on the Pacific Outer Continental Shelf (OCS). This Notice of Availability (NOA) is published pursuant to implement the provisions of the National Environmental Policy Act (NEPA) of 1969, as amended. The PEA evaluates potential environmental effects of WSTs on the Pacific OCS. These activities include: fracturing WSTs (diagnostic fracture injection tests; hydraulic fracturing (e.g., frac pacs); and acid fracturing) and non-fracturing WSTs (matrix acidizing and polymer/surfactant injection). BOEM and BSEE are also issuing a FONSI supported by the analysis in the PEA. The FONSI concludes that the reasonably foreseeable environmental impacts associated with the proposed action and alternatives, as set forth in the PEA, would not significantly impact the quality of the human environment; therefore, the preparation of an Environmental Impact Statement is not required.

Notice is hereby given, pursuant to 25 CFR 514.2, that the National Indian Gaming Commission has adopted its 2016 final annual fee rates of 0.00% for tier 1 and 0.062% (.00062) for tier 2, which remain the same as the 2016 preliminary fee rates. The tier 2 annual fee rate represents the lowest fee rate adopted by the Commission in the last five years. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the 2016 final fee rate on Class II revenues shall be 0.031% (.00031) which is one-half of the annual fee rate. The final fee rates being adopted here are effective June 1, 2016, and will remain in effect until new rates are adopted. Pursuant to 25 CFR 514.16, the National Indian Gaming Commission has also adopted its fingerprint processing fees of $21 per card effective June 1, 2016.

The application includes a draft Safe Harbor Agreement to facilitate reintroduction and recovery of the Federally endangered Mitchell's satyr butterfly on non- Federal land in Michigan and Indiana. We have made a preliminary determination that the Safe Harbor Agreement and permit application are eligible for a categorical exclusion under the National Environmental Policy Act of 1969 (NEPA). The basis for this determination is contained in a low-effect screening form, which is available for public review. We are accepting comments on the permit application and draft Safe Harbor Agreement.

We, the U.S. Fish and Wildlife Service (Service), are listing the common snapping turtle (Chelydra serpentina), Florida softshell turtle (Apalone ferox), smooth softshell turtle (Apalone mutica), and spiny softshell turtle (Apalone spinifera) in Appendix III of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES or Convention), including live and dead whole specimens, and all readily recognizable parts, products, and derivatives. Listing these four native U.S. freshwater turtle species (including their subspecies, except Apalone spinifera atra, which is already included in Appendix I of CITES) in Appendix III of CITES is necessary to allow us to adequately monitor international trade in these species; to determine whether exports are occurring legally, with respect to State and Federal law; and to determine whether further measures under CITES or other laws are required to conserve these species and their subspecies.

BOEM is extending the public comment period to submit comments on the proposed rule entitled ``Air Quality Control, Reporting, and Compliance,'' which was published in the Federal Register on April 5, 2016. The original public comment period to submit comments on this rulemaking would have ended on June 6, 2016. However, BOEM has received public comments requesting an extension of the comment period. BOEM has reviewed the extension requests and has determined that a 14-day comment period extension to June 20, 2016, is appropriate. The proposed rule specified a separate, shorter period to submit comments to the Office of Management and Budget on the information collection (IC) burden in this rulemaking. That comment period ended on May 5, 2016, and will not be extended.

The boundary of Fredericksburg and Spotsylvania County Battlefields Memorial National Military Park is modified to include four tracts containing 25.55 acres of land, more or less, located in Orange County and Spotsylvania County, Virginia, immediately adjoining the boundary of Fredericksburg and Spotsylvania County Battlefields Memorial National Military Park. Subsequent to the proposed boundary revision, the National Park Service will acquire one tract by donation from the Civil War Trust and two tracts by purchase from the Central Virginia Battlefields Trust. The fourth tract, already owned by the United States and acquired as an uneconomic remnant, will be brought into the boundary so that it can be administered as part of the park.

This rule deletes the requirement for fee-to-trust applicants to furnish title evidence that meets the ``Standards for the Preparation of Title Evidence in Land Acquisitions by the United States'' issued by the U.S. Department of Justice (DOJ), and replaces the requirement with a more targeted requirement for title evidence, because adherence to the DOJ standards is not required for acquisitions of land in trust for individual Indians or Indian tribes.
