Notice of Availability of Draft South Coast Resource Management Plan Amendment and Draft Environmental Impact Statement for the Santa Ana River Wash Land Exchange, California

Migratory Bird Hunting; Proposed Frameworks for Early-Season Migratory Bird Hunting Regulations; Notice of Meetings
The U.S. Fish and Wildlife Service (hereinafter Service or we) is proposing to establish the 2009-10 early-season hunting regulations for certain migratory game birds. We annually prescribe frameworks, or outer limits, for dates and times when hunting may occur and the maximum number of birds that may be taken and possessed in early seasons. Early seasons may open as early as September 1, and include seasons in Alaska, Hawaii, Puerto Rico, and the U.S. Virgin Islands. These frameworks are necessary to allow State selections of specific final seasons and limits and to allow recreational harvest at levels compatible with population status and habitat conditions. This proposed rule also provides the final regulatory alternatives for the 2009-10 duck hunting seasons.
Notice of Proposed Supplementary Rules for Public Lands in Colorado: Bangs Canyon Special Recreation Management Area
The Bureau of Land Management's (BLM) Grand Junction Field Office is proposing supplementary rules to regulate conduct on public lands within Bangs Canyon Special Recreation Management Area (BCSRMA). These supplementary rules are needed to implement decisions found in the Bangs Canyon Management Plan Environmental Assessment (EA) and Resource Management Plan (RMP) revision that protects public lands, resources, and public health and provides public safety.
Notice of Proposed Reinstatement of Terminated Oil and Gas Lease NMNM 119267
Under the Class II provisions of Title IV, Public Law 97-451, The Bureau of Land Management (BLM) received a petition for reinstatement of oil and gas lease NMNM 119267 from the lessee, J Bar Cane Inc., for lands in Chaves County, New Mexico. The petition was filed on time and was accompanied by all the rentals due since the date the lease terminated under the law.
Notice of Intent To Prepare an Environmental Impact Statement and Amendment to the California Desert Conservation Area Plan for the Lucerne Valley Solar Project; San Bernardino County, CA
In compliance with the National Environmental Policy Act of 1969 (NEPA), as amended, and the Federal Land Policy and Management Act of 1976 (FLPMA), as amended, the Bureau of Land Management (BLM) Barstow Field Office, Barstow, California intends to prepare an Environmental Impact Statement (EIS) and by this notice is announcing the beginning of the scoping process to solicit public comments and identify issues. The EIS will analyze the impacts of the Lucerne Valley Solar Plant on public lands in San Bernardino County, California. The project is being proposed by Chevron Energy Solutions (the Applicant). The applicant has requested a right-of-way (ROW) authorization to construct and operate a 45 megawatt solar photovoltaic project and connect it to the existing Southern California Edison 33 kV distribution system. Within the 516-acre solar facility, the project would include a new switchyard, control/maintenance building, and parking area. The EIS will analyze the site-specific impacts to the environment from the proposed grant of the ROW.
Notice of Realty Action; Recreation and Public Purposes (R&PP) Act Classification; New Mexico
The Bureau of Land Management (BLM) has examined approximately 639 acres of public land in Dona Ana County, New Mexico and found them suitable for classification for lease and/or conveyance under the provisions of the Recreation and Public Purposes (R&PP) Act, as amended. New Mexico State Parks Division proposes to incorporate the public land for additional trails and visitor education as part of the Mesilla Valley Bosque State Park in Dona Ana County, New Mexico.

Rappahannock River Valley National Wildlife Refuge, Caroline, Essex, King George, Lancaster, Middlesex, Richmond, and Westmoreland Counties, VA
We, the U.S. Fish and Wildlife Service (Service), announce the availability of the draft comprehensive conservation plan (CCP) and draft environmental assessment (EA) for Rappahannock River Valley National Wildlife Refuge (NWR) for a 30-day public review and comment period. In this draft CCP/EA, we describe three alternatives, including our Service-preferred Alternative B, for managing this refuge for the next 15 years. Also available for public review and comment are the draft compatibility determinations, which are included as Appendix B in the draft CCP/EA.
Glen Canyon Dam Adaptive Management Work Group (AMWG)
The Glen Canyon Dam Adaptive Management Program (AMP) was implemented as a result of the Record of Decision on the Operation of Glen Canyon Dam Final Environmental Impact Statement to comply with consultation requirements of the Grand Canyon Protection Act (Pub. L. 102-575) of 1992. The AMP includes a federal advisory committee, the Adaptive Management Work Group (AMWG), a technical work group (TWG), a Grand Canyon Monitoring and Research Center, and independent review panels. The AMWG makes recommendations to the Secretary of the Interior concerning Glen Canyon Dam operations and other management actions to protect resources downstream of Glen Canyon Dam consistent with the Grand Canyon Protection Act. The TWG is a subcommittee of the AMWG and provides technical advice and recommendations to the AMWG.
Endangered and Threatened Wildlife and Plants; Permit Application; Greater Sage-Grouse; Washington, Adams, Gem, and Payette Counties, Idaho
We, the U.S. Fish and Wildlife Service (Service), announce receipt of an application for an enhancement of survival permit (permit) under section 10(a)(1)(A) of the Endangered Species Act of 1973, as amended (ESA). The permit application includes a proposed programmatic candidate conservation agreement with assurances (CCAA) for the Greater sage grouse (Centrocercus urophasianus; hereafter, sage-grouse) between us and the Idaho Department of Fish and Game (IDFG). The term of the proposed CCAA is 30 years, and the requested term of the permit is 30 years. Consistent with the requirements of the National Environmental Policy Act of 1969 (NEPA), we have prepared a draft environmental assessment (EA) of the impacts of the proposed CCAA and permit application. We are accepting comments on the application, the proposed CCAA, and the draft EA.
Invasive Species Advisory Committee
Pursuant to the provisions of the Federal Advisory Committee Act (FACA), as amended, 5 U.S.C., App., notice is hereby given of a meeting of the Invasive Species Advisory Committee (ISAC). The purpose of ISAC is to provide advice to the National Invasive Species Council (NISC), as authorized by Executive Order 13112, on a broad array of issues related to preventing the introduction of invasive species and providing for their control and minimizing the economic, ecological, and human health impacts that invasive species cause. NISC is co- chaired by the Secretary of the Interior, the Secretary of Agriculture, and the Secretary of Commerce. NISC provides national leadership regarding invasive species issues. A meeting of ISAC will be held on August 11, 2009 from 1 p.m. until 3 p.m. EDT. Members of the public are invited to attend. A teleconference call-in number will be established. The purpose of this meeting is to convene the full ISAC to discuss, modify, and consider for adoption the ISAC position paper concerning the use of plant species that may be invasive in Federal biofuel programs. Meeting space is limited to fifteen individuals and the number of telephone call-in lines is limited to seventy. Notice of Additional Tribal Consultation Meetings
Notice is hereby given of additional Tribal Consultation Sessions to be held between the Department of the Interior, Office of the Special Trustee for American Indians (DOI/OST) and tribal governments interested in, or currently operating the real estate appraisal services program. The purpose of these consultation sessions is to discuss ideas in developing new tribal share allocation formulas (TSAFs) to be used to apportion funds to tribes that perform the appraisal program pursuant to Public Law 93-638 (The Indian Self- Determination and Education Assistance Act of 1975, as amended) [25 U.S.C. 450j-1(a)]. Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the White-Sided Jackrabbit (Lepus callotis
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the white-sided jackrabbit (Lepus callotis) as an endangered species and designate critical habitat under the Endangered Species Act of 1973, as amended. Following a review of the petition, we find the petition provides substantial scientific or commercial information indicating that listing this species may be warranted. Therefore, with the publication of this notice, we are initiating a status review to determine if listing this species is warranted. To ensure that the status review is comprehensive, we are requesting the public to submit scientific and commercial data and other information regarding the white-sided jackrabbit. We will make a determination on critical habitat if and when we initiate a listing action for this species.

Final General Management Plan and Environmental Impact Statement, Governors Island National Monument, New York, NY
Pursuant to Sec. 102(2)(C) of the National Environmental Policy Act of 1969, as amended, the National Park Service (NPS) announces the availability of the Record of Decision for the Final General Management Plan and Environmental Impact Statement (GMP/EIS) for Governors Island National Monument, New York. On June 1, 2009, the Regional Director, Northeast Region, approved the Record of Decision for the GMP/EIS, selecting Alternative D, The Harbor Center, which was described as the preferred alternative in the Final GMP/EIS issued on April 26, 2009. As soon as practicable, the NPS will begin to implement the selected alternative. The National Monument will be developed as a Harbor Center with partners as a hub of activities and a jumping-off point for visitors exploring New York Harbor. This course of action and three other alternatives were presented and analyzed in the Draft and Final Environmental Impact Statements. The full range of foreseeable environmental consequences was assessed, and appropriate mitigating measures were identified.
General Management Plan, Environmental Impact Statement, Fredericksburg and Spotsylvania National Military Park, Virginia
Pursuant to section 102 (2)(C) of the National Environmental Policy Act (NEPA) of 1969, the National Park Service is preparing a General Management Plan and Environmental Impact Statement (GMP/EIS) for the Fredericksburg and Spotsylvania National Military Park (FSNMP). The park comprises approximately 8,382 acres, in the commonwealth of Virginia, in the city of Fredericksburg, and in the counties of Spotsylvania, Stafford, Orange, and Caroline.
Agency Information Collection Activities: Comment Request
To comply with the Paperwork Reduction Act of 1995 (PRA), we are notifying the public that we have submitted to the Office of Management and Budget (OMB) an information collection request (ICR) for the extension of the currently approved paperwork requirements for Bird Banding and Recovery Reports. This collection consists of two forms (Application for Federal Bird Banding or Marking Permit and Reporting Encounter of Marked Bird with a Metal Federal Band (Recovery Report) and an electronic database (Bandit). Subsistence Management Regulations for Public Lands in Alaska; Kenai Peninsula Subsistence Resource Region
We, the Federal Subsistence Board, are withdrawing the proposed rule to amend the regulations governing subsistence use of fish and wildlife in Alaska by creating an additional subsistence resource region for the Kenai Peninsula. We received significant adverse comments on our proposal, and we have decided not to pursue this action.
Guam National Wildlife Refuge, Yigo, Guam
We, the U.S. Fish and Wildlife Service (Service), announce the availability of our draft comprehensive conservation plan and environmental assessment (Draft CCP/EA) for the Guam National Wildlife Refuge (Refuge) for public review and comment. It describes our proposal for managing the Refuge for the next 15 years. In the Draft CCP/EA we describe alternatives, including our preferred alternative, to manage the Refuge for the 15 years following approval of the final CCP.
Migratory Birds; Take of Peregrine Falcons for Use in Falconry
In December 2008 we completed an Environmental Assessment on take of peregrine falcons for use in falconry. This notice is to inform the public of the allocation of take of nestling and migrant peregrine falcons in 2009 agreed on by the States. It also will inform interested individuals about which States will allow take of nestling or migrant peregrine falcons.
Migratory Bird Permits; Changes in the Regulations Governing Falconry
We, the U.S. Fish and Wildlife Service, published a final rule in the Federal Register on October 8, 2008, to revise our regulations governing falconry in the United States. With this action, we propose to make several changes to those regulations to correct inconsistencies and oversights and make the regulations clearer. Because a few of our changes are technically substantive, we are opening a comment period for this action.
West Virginia Regulatory Program
We are approving, on an interim basis, an amendment to the West Virginia regulatory program (the West Virginia program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). West Virginia revised its Surface Coal Mining and Reclamation Act to effect changes concerning its alternative bonding system. The tax provisions of the amendment are intended to increase and extend the special reclamation tax, subject to biennial review by the legislature, and remove the additional tax. We are approving the increase and extension of the special reclamation tax, at the rate of fourteen and four-tenths cents per ton of clean coal mined, for deposit in the Special Reclamation Fund and the Special Reclamation Water Trust Fund, on an interim basis, with our approval becoming effective upon publication of this interim rule.
Notice of Proposed Withdrawal and Opportunity for Public Meeting; Arizona
The Secretary of the Interior proposes to withdraw approximately 633,547 acres of public lands and 360,002 acres of National Forest System lands for up to 20 years from location and entry under the Mining Law of 1872, 30 U.S.C. 22 et seq., on behalf of the Bureau of Land Management and the United States Forest Service. The purpose of the withdrawal, if determined to be appropriate, would be to protect the Grand Canyon watershed from adverse effects of locatable hardrock mineral exploration and mining. This notice segregates the lands from location and entry under the 1872 Mining Law for up to 2 years to allow time for various studies and analyses, including appropriate National Environmental Policy Act analysis. These actions will support a final decision on whether or not to proceed with a withdrawal. The lands will remain open to the mineral leasing, geothermal leasing, mineral materials, and public land laws.
Eastern States: Filing of Plats of Survey

Endangered and Threatened Wildlife and Plants; Permit Application, Northern Spotted Owl, Oregon
The Oregon Department of Forestry (ODF) has applied to the U.S. Fish and Wildlife Service (Service) for an enhancement of survival permit (permit) pursuant to the Endangered Species Act of 1973, as amended. The permit application includes a proposed programmatic safe harbor agreement (Agreement) between ODF, the U.S. Department of AgricultureNatural Resources Conservation Service (NRCS), and the Service. The proposed term of the permit and Agreement is 50 years. The requested permit would authorize ODF to extend incidental take coverage with assurances through issuance of Certificates of Inclusion to eligible landowners who are willing to carry out habitat management measures that would benefit the northern spotted owl (Strix occidentalis caurina), which is federally listed as threatened. The covered area or geographic scope of this Agreement includes non-Federal forest lands within the range of the spotted owl in Oregon. Endangered Species Recovery Permit Applications
We, the U.S. Fish and Wildlife Service, invite the public to comment on the following applications to conduct certain activities with endangered species. With some exceptions, the Endangered Species Act (Act) prohibits activities with endangered and threatened species unless a Federal permit allows such activity. The Act also requires that we invite public comment before issuing these permits.

Subsistence Management Regulations for Public Lands in Alaska; Makhnati Island Area
This document corrects 36 CFR 242.3 and 50 CFR 100.3 of the subsistence management regulations for public lands in Alaska, subpart A, Makhnati Island Area, which were published in the Federal Register of August 24, 2006. That rule, which became effective September 25, 2006, inadvertently omitted 190 acres of the Makhnati Island Area in the regulatory text.

Privacy Act of 1974; Amendment of Existing Systems of Records
In accordance with the Privacy Act of 1974 (5 U.S.C. 552a), the Office of the Secretary of the Department of the Interior is issuing public notice of its intent to amend an existing Privacy Act system of records notice, Passport and Visa Records, OS-52. The revisions will update the categories of records kept, the manner in which the physical records are stored, the methods of securing the records, the system location, and the system manager. The system number is also being changed from OS-52 to DOI-52.

Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To Remove the Utah (Desert) Valvata Snail (Valvata utahensis) From the List of Endangered and Threatened Wildlife and Proposed Rule
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to remove the Utah (desert) valvata snail (Valvata utahensis) from the Federal List of Endangered and Threatened Wildlife (List) pursuant to the Endangered Species Act of 1973, as amended (Act) (16 U.S.C. 1531 et seq.). Based on a thorough review of the best available scientific and commercial data, the Utah valvata snail is more widespread and occurs in a greater variety of habitats in the Snake River than known at the time of listing in 1992. We now know that the Utah valvata snail is not limited to areas of cold-water springs or spring outflows; rather, it persists in a variety of aquatic habitats, including cold-water springs, spring creeks and tributaries, the mainstem Snake River and associated tributary stream habitats, and reservoirs influenced by dam operations. Given our current understanding of the species' habitat requirements and threats, the species does not meet the definition of a threatened or endangered species under the Act. Therefore, we are proposing to remove the Utah valvata snail from the List, thereby removing all protections provided by the Act.
Civil Monetary Penalties
This rule adjusts the penalty amount of certain civil monetary penalties authorized by the Surface Mining Control and Reclamation Act of 1977 (SMCRA). The rule implements the Federal Civil Penalties Inflation Adjustment Act of 1990 which requires that civil monetary penalties be adjusted for inflation at least once every four years.

Notice of Stay of Filing of Plat
On Wednesday, January 14, 2009, the Bureau of Land Management (BLM) published a Filing of Plats of Survey notice in the Federal Register (74 FR 2090). This notice provided the public notification that the plat was officially filed in the Colorado State Office, effective 10 a.m., December 31, 2008. The BLM is publishing this notice to inform the public of the setting aside of the plat filing and to afford all affected parties a proper period of time to protest this action, prior to the plat filing.
Delta-Mendota Canal/California Aqueduct Intertie, Alameda County, CA
The Bureau of Reclamation, as the National Environmental Policy Act Federal lead agency, has made available for public review and comment the Delta-Mendota Canal/California Aqueduct Intertie (Intertie) Draft EIS. The Intertie is a proposed action in the August 2000 CALFED Bay-Delta Program Programmatic Record of Decision. The Intertie Draft EIS evaluates constructing and operating a pipeline connecting the Delta-Mendota Canal (DMC) and the California Aqueduct. The purpose of the Proposed Action is to improve the DMC conveyance conditions that restrict the CVP Jones Pumping Plant to less than its authorized pumping capacity of 4,600 cubic feet per second. The Draft EIS describes and presents the environmental effects of the No-Action Alternative and three action alternatives. Two public hearings will be held to receive comments from agencies, individuals, and organizations on the Draft EIS.
