A determination has been made that thirteen foreign persons have engaged in activities that warrant the imposition of measures pursuant to Section 3 of the Iran, North Korea, and Syria Nonproliferation Act, which provides for penalties on entities and individuals for the transfer to or acquisition from Iran since January 1, 1999, the transfer to or the acquisition from Syria since January 1, 2005, or the transfer to or acquisition from North Korea since January 1, 2006, of equipment and technology controlled under multilateral control lists (Missile Technology Control Regime, Australia Group, Chemical Weapons Convention, Nuclear Suppliers Group, Wassenaar Arrangement) or otherwise having the potential to make a material contribution to the development of weapons of mass destruction (WMD) or cruise or ballistic missile systems. The latter category includes (a) Items of the same kind as those on multilateral lists but falling below the control list parameters, when it is determined that such items have the potential of making a material contribution to WMD or cruise or ballistic missile systems, (b) other items with potential of making such a material contribution, when added through case-by-case decisions, and (c) items on U.S. national control lists for WMD/missile reasons that are not on multilateral lists.

Uncertified Foreign Health-Care Workers

This rule adopts as final without change the Department's interim rule published on December 17, 2002, at 67 FR 77158. The rule changes the requirements pertaining to the issuance of visas to certain health care workers. Certain foreign health care workers now need to present certificates establishing competency in a specific health care field. Certification is issued by the Commission on Graduates of Foreign Nursing Schools (CGFNS) or other credentialing organizations that have been approved by the Secretary of Homeland Security (DHS) in consultation with the Secretary of Health and Human Services (HHS). This rule facilitates greater uniformity between the regulations of DHS and the Department of State.
Board of Appellate Review; Review of Loss of Nationality

This rule eliminates the Department's Board of Appellate Review (L/BAR), which had been authorized to review certain Department determinations, in particular those related to loss of citizenship and passport denials. Because L/BAR's jurisdiction has been superseded or made obsolete, and in large part replaced by review of loss of citizenship and passport matters by the Bureau of Consular Affairs, this rule eliminates L/BAR and authorizes on a discretionary basis an alternative, less cumbersome review of loss of nationality determinations by the Bureau of Consular Affairs.

International Narcotics and Law Enforcement Affairs Personnel Records System

Notice is hereby given that the Department of State proposes to create a new system of records, the International Narcotics and Law Enforcement Affairs Personnel Records System, which is currently in operation, pursuant to the provision of the Privacy Act of 1974 as amended (5 U.S.C. 552a) and Office of Management and Budget Circular No. A-130, Appendix I. The Department's report was filed with the Office of Management and Budget on October 8, 2008. It is proposed that the new system be named ``International Narcotics and Law Enforcement Affairs Personnel Records System.'' The new system description will specify that International Narcotics and Law Enforcement Affairs Personnel Records System maintains records primarily on contracted personnel serving in criminal justice roles for the purposes of documenting individuals' experience and skills relevant to International Narcotic Law Enforcement Affairs' funded programs; ensuring foreign policy sensitivity and maintenance of the public trust, personnel safety and accountability; providing aggregate statistical data for program management purposes; providing information related to employment suitability for service in high-risk environments, including authority to carry weapons; and capturing and validating flight mission data. The proposed routine uses provide for disclosure to private employers when necessary for contract administration and to Federal agencies and international organizations, upon their request, for the purpose of verifying information relating to employment eligibility. These proposed routine uses are compatible with the purpose of collecting information for the International Narcotics Law Enforcement Affairs Personnel Records System, as they facilitate the selection of suitable individuals to serve as contract personnel in operations organized and funded by the Department of State, or as contract personnel for other federal agencies or international organizations operating in high-risk environments where the selection of suitable individuals is essential for maintaining public trust, personnel safety and accountability. Any persons interested in commenting on the new International Narcotics and Law Enforcement Affairs Personnel Records system of records may do so by submitting comments in writing to Margaret P. The Community Relations Branch of the Office of International Visitors, Bureau of Educational and Cultural Affairs (ECA/PE/V/C/R) invites proposal submissions for the design and implementation of an airport arrival and departure program at New York's John F. Kennedy (JFK) International Airport and New Jersey's Newark International Airport. It is anticipated that a cooperative agreement for $195,000 will be awarded on or about January 1, 2009, pending availability of FY 2009 funds. This 18-month award will begin on or about January 1, 2009 and end September 30, 2010, and will be based on a combination of 500 incoming and outgoing flights between the two international points of entry stated above. Proposed funding would support the following specific activities: Meet incoming International Visitor Leadership Program (IVLP) participants at JFK International Airport, New York, and assist them to their connecting flights; meet incoming IVLP participants at Newark International Airport, New Jersey, and assist participants to their connecting flights; provide assistance to outgoing IVLP participants, through U.S. Customs, at JFK International Airport, New York, and Newark International Airport, New Jersey; and liaise with U.S. Customs and Border Protection (CBP), Transportation Security Administration (TSA) officials, and Port Authority officials at both points of international entry in order to carry out scope of work under the cooperative agreement.

Pursuant to section 309 of the United States Global Leadership Against HIV/AIDS, Tuberculosis, and Malaria Reauthorization Act of 2008, (``the Act''), Public Law 110-293, this is a notice of intent to establish the Global AIDS Coordinator's Expert Panel on Prevention of Mother-to-Child Transmission of HIV. Purpose: The objectives and scope of activities of the Expert Panel are to provide an objective review of activities to prevent mother-to- child transmission of HIV (human immunodeficiency virus, the pathogen that causes Acquired Immune Deficiency Syndrome (AIDS)), and to provide a report and recommendations to the Global AIDS Coordinator and to the appropriate congressional committees for scale-up of prevention of Mother-to-Child transmission prevention services. Membership: The Panel shall consist of not more than fifteen members appointed by the Global AIDS Coordinator. Members of the Panel shall be drawn from governmental and private sector organizations, in accordance with the requirements under section 309 of the Act. Executive Order 11423, as Amended; Notice of Receipt of Application To Amend Presidential Permit for an International Bridge on the U.S.-Mexico Border at Brownsville, TX and Matamoros, Tamaulipas, Mexico

The Department of State hereby gives notice that, on September 4, 2008, it received an application to amend the Presidential Permit that authorizes the construction, operation, and maintenance of the Veterans International Bridge at Los Tomates on the U.S.-Mexico border at Brownsville, Texas and Matamoros, Tamaulipas, Mexico. Cameron County, Texas filed the application and is acting as the project sponsor. Cameron County proposes to build a second bridge, essentially identical to the existing four-lane bridge, to accommodate increasing traffic volume, to improve pedestrian safety, and to allow more efficient separation of different types of traffic as it approaches the border station owned by the General Services Administration and operated by the Bureau of Customs and Border Protection of the Department of Homeland Security. The proposed second bridge would not require changes to the border station itself. The Department of State's jurisdiction over this application is based upon Executive Order 11423 of August 16, 1968, as amended. As provided in E.O. 11423, the Department is circulating this application to relevant federal and state agencies for review and comment. Under E.O. 11423, the Department has the responsibility to determine, taking into account input from these agencies and other stakeholders, whether this proposed amendment to the existing Presidential Permit is in the U.S. national interest.
