The Advisory Committee on Persons with Disabilities will conduct its fourth public meeting on Wednesday, May 2, 2007 from 9 a.m.-4 p.m. in the Ronald Reagan Building and International Trade Center, 1300 Pennsylvania Avenue, NW., Washington, DC 20004. Established on June 23, 2004, the Advisory Committee serves the Secretary and the Administrator in an advisory capacity with respect to the consideration of the interests of persons with disabilities in formulation and implementation of U.S. foreign policy and foreign assistance. The Committee is established under the general authority of the Secretary and the Department of State as set forth in Title 22 of the United States Code, in particular Sections 2656 and 2651a, and in accordance with the Federal Advisory Committee Act, as amended.

Notice is hereby given that persons convicted of violating Section 38 of the Arms Export Control Act, as amended, (``AECA'') (22 U.S.C. 2778) are statutorily debarred pursuant to Section 38(g)(4) of the AECA and Section 127.7(c) of the International Traffic in Arms Regulations (``ITAR'') (22 CFR 127.7(c)). On March 28, 2007, in the United States District Court for the Western District of Virginia, ITT Corporation entered a guilty plea to the willful export of defense articles without a license, in violation of Section 38 of the AECA and Sections 127.1(a) and 127.3 of the ITAR.

Pursuant to the Intercountry Adoption Act of 2000 (the IAA), the Department of State (the Department) is the Central Authority for the United States for implementation of the 1993 Hague Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption (the Convention). Once the Convention enters into force for the United States, agencies and persons that provide adoption services in cases covered by the Convention must be accredited, temporarily accredited, approved, or otherwise exempt. The Department previously announced in the Federal Register the establishment of the transitional application deadline (TAD) for accreditation and approval as November 17, 2006. The Department is now setting the deadline for initial accreditation or approval (DIAA) for February 15, 2008. All agencies and persons that applied by the TAD must complete the accreditation/ approval process by February 15, 2008, to be eligible for accreditation, temporary accreditation, or approval at the time the Convention enters into force for the United States.

Muskie Graduate Fellowship Program (Muskie Program). Public and private non- profit organizations meeting the provisions described in IRS regulation 26 CFR 1.501(c)(3) may submit proposals to administer the selection, placement, monitoring, evaluation, follow-on, and alumni activities for the Edmund S. Muskie Graduate Fellowship Program (Muskie Program). Organizations with less than four years experience in conducting international exchange programs are not eligible for this competition. The Muskie Program selects outstanding citizens from Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Ukraine, Uzbekistan, Tajikistan and Turkmenistan (herein referred to as Eurasia) to receive fellowships for Master's level study in the United States in the fields of business administration, economics, law, public administration, and public policy. Candidates from countries other than Russia and Ukraine will be also considered in additional fields of education, environmental management, international affairs, library and information science, journalism/mass communications, and public health per guidelines outlined in the Project Objectives, Goals, and Implementation (POGI). Muskie Program fellows will be enrolled in graduate degree, certificate, and non-degree programs lasting one to two academic years. Funding should support a minimum of 145 fellows for Master's level fellowships under the FY 2008 program. Every effort should be made to maximize the number of awards granted.

The United States will deny licenses, other approvals, exports or imports of lethal defense articles and services destined for or originating in Vietnam. Under this policy, the exports of lethal-end items, components of lethal-end items (unless those components are non-lethal, safety-of-use spare parts for lethal-end items), non-lethal crowd control defense articles and defense services, and night vision devices to end-users with a role in ground security will not be approved.

Department of State's Implementation of OMB Guidance on Nonprocurement Debarment and Suspension

The Department of State (DOS) is moving its regulations on nonprocurement debarment and suspension from their current location in title 22 of the Code of Federal Regulations (CFR) to title 2 of the CFR, and is adopting the format established by the Office of Management and Budget (OMB) in a document of interim final guidance on nonprocurement debarment and suspension published in the Federal Register on August 31, 2005. In today's rule, DOS establishes a new 2 CFR part 601 that adopts OMB's final government-wide guidance on nonprocurement debarment and suspension and contains supplemental DOS nonprocurement debarment and suspension provisions. In addition, this rule removes 22 CFR part 137, the existing DOS nonprocurement debarment and suspension regulations and updates references to 22 CFR part 137 in 22 CFR part 145 and 22 CFR part 133 to conform with this change. These changes constitute an administrative simplification that makes no substantive change in DOS policy or procedures for nonprocurement debarment and suspension.

This final rule amends the Department of States regulations related to students and exchange visitors to reflect changes introduced by Public Law108-441, and numerous administrative and procedural changes that have occurred with respect to these paragraphs following the transfer of the exchange visitor INA 212(e) waiver authority in 1999 from the United States Information Agency (USIA) to the Bureau of Consular Affairs in the Department of State. A number of these changes are non-substantive (i.e., agency name changes [the Department of Homeland Security in place of the Immigration and Naturalization Service], updating of office designations, etc.). Other changes reflect statutory amendments regarding waivers for the exchange visitor physicians and the proposed reconstitution of the Exchange Visitor Waiver Review Board.
