This proposed rule will add a new solicitation provision and contract clause to implement Department of State requirements regarding security issues for information technology systems, as required by the Federal Information Security Management Act of 2002 (FISMA).

The Department is proposing to revise its regulations regarding Fees and Charges for Exchange Visitor Program services. A new section will contain all of the fees and charges for Exchange Visitor Program services. The long-range goal of these changes is to recoup the full cost for providing such services.

The Department of State proposes to revise its regulations on fees to be charged for searching for information responsive to requests made under the Freedom of Information Act. The existing regulations have proved to be unworkable, particularly in terms of ascertaining the costs of electronic searches.

The Advisory Committee's study group is participating in an initiative by the United National Commission for International Trade Law (UNCITRAL) to revise the 1994 UNCITRAL Model Law on Procurement of Goods, Construction and Services (``Model Procurement Law''), and its Guide to Enactment, available at https://www.uncitral.org/uncitral/en/ uncitraltexts/procurementinfrastructure/1994Model.html. The UNCITRAL Model Procurement Law is not binding on the United States, but it is cited and relied upon in many other nations as a model procurement code. The reform effort regarding the Model Procurement Law is being undertaken by UNCITRAL's Working Group I, which has been meeting twice annually, in Vienna and New York, to develop new language for the UNCITRAL Model Procurement Law and the Guide to Enactment. The working papers that reflect this effort are gathered at the UNCITRAL Web site, at https://www.uncitral.org/uncitral/en/commission/workinggroups/ 1Procurement.html. As part of its broader effort to reform the UNCITRAL Model Procurement Law to reflect advances in electronic procurement, the UNCITRAL working group has made substantial progress in developing new provisions in the model law. At its May 2007 meeting in New York, the UNCITRAL working group addressed proposed provisions that would: (a) Set standards for the use of electronic communications in procurement under the UNCITRAL Model Procurement Law; (b) Describe when, and how, electronic reverse auctions might be used under the model law; and (c) Define rules for the use of indefinite-delivery, indefinite-quantity (``IDIQ'') contracts, generally referred to as ``frameworks agreements'' in the European Union and under the proposed changes to the Model Procurement Law. The provisions under consideration by the working group are described in, inter alia, working paper A/CN.9/WG.I/WP.51 (Mar. 13, 2007), available at the previously referenced Web site. A report on the May 2007 meeting is to be published by the UNCITRAL Secretariat at the same Web site. The Department of State is amending the International Traffic in Arms Regulations (ITAR) by revising Note (1)(i) of U.S. Munitions List (USML) Category VIII(e) to add the term ``primary'' to references to a commercial standby instrument system. As a result, Category XII(d) and Category VIII(e) do not include quartz rate sensors if such items are integrated into and included as an integral part of a commercial primary or standby instrument system for use on civil aircraft prior to export or exported solely for integration into such systems. After this exclusion was instituted in 2004 for such standby systems, it became apparent that some primary systems also include the subject quartz rate sensors.

The Department is hereby proposing to revise its regulations concerning College and University Students. The proposed Rule, if adopted, will create a new subcategory of the College and University Student category``Student Interns''. Participation in this new sub- category is open to foreign students enrolled and pursuing full-time studies at a post-secondary educational institution outside the United States. Student interns may participate in a student internship program for up to 12 months at each degree level.
