Comment Request
The Department of Labor, through the Bureau of Labor Statistics (BLS) and, specifically, the International Price Program (IPP), is soliciting comments on its plan to improve the Import and Export Price Indexes (MXPI) estimates by using administrative trade data acquired from the U.S. Census Bureau. IPP is responsible for the estimation and publication of the U.S. Principal Federal Economic Indicator of Import and Export Price Indexes (MXPI). The IPP collects data from companies on import and export prices and estimates price indexes for nearly all goods trade and some service trade for the United States. The data are primarily collected with a business survey. After completion of extensive research, and in response to a decline in data collected through traditional survey methods, BLS plans to implement improvements to the quality and quantity of import and export price indexes in fiscal year 2025 by replacing data directly collected from the business survey with administrative trade records for select homogeneous product areas.

Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales, and Computer Employees
In this proposal, the Department of Labor (Department) is updating and revising the regulations issued under the Fair Labor Standards Act implementing the exemptions from minimum wage and overtime pay requirements for executive, administrative, professional, outside sales, and computer employees. Significant proposed revisions include increasing the standard salary level to the 35th percentile of weekly earnings of full-time salaried workers in the lowest-wage Census Region (currently the South)$1,059 per week ($55,068 annually for a full-year worker)and increasing the highly compensated employee total annual compensation threshold to the annualized weekly earnings of the 85th percentile of full-time salaried workers nationally ($143,988). The Department is also proposing to add to the regulations an automatic updating mechanism that would allow for the timely and efficient updating of all the earnings thresholds.

DOL Acquisition Regulation: Department of Labor Acquisition Regulation System
The Department of Labor (DOL) is proposing to revise the Department of Labor Acquisition Regulations (DOLAR), in its entirety in order to update and streamline agency procurement regulations consistent with the Federal Acquisition Reform Act, and the Federal Acquisition Streamlining Act. The proposed updates remove provisions that are redundant or obsolete and codify the use of certain contractual provisions that DOL has developed and deployed in recent years in order to put potential contractors on notice of these provisions and to formalize their usage. The provisions address a range of matters, including: government property, continuity of operations, system requirements, records management, telework policy for contractor personnel, submission of invoices, mandatory training for contractors, organizational conflicts of interest, and changing the scope of a contract. Proposed edits have also been made to existing language for clarity and streamlining purposes and do not change the substantive meaning of those provisions. The proposed revision will also remove provisions in the current DOLAR that are DOL internal operating procedures, which need not be published in the Code of Federal Regulations in order for them to take effect. The current DOLAR supplements the executive branch-wide Federal Acquisition Regulations (FAR) to address matters specific to the Department of Labor relating to its procurement of goods and services. It also includes certain rules governing private entities doing business with DOL.

Worker Walkaround Representative Designation Process
OSHA is proposing to amend its Representatives of Employers and Employees regulation to clarify that the representative(s) authorized by employees may be an employee of the employer or a third party; such third-party employee representative(s) may accompany the OSHA Compliance Safety and Health Officer (CSHO) when they are reasonably necessary to aid in the inspection. OSHA is also proposing clarifications of the relevant knowledge, skills, or experience with hazards or conditions in the workplace or similar workplaces, or language skills of third-party representative(s) authorized by employees who may be reasonably necessary to the conduct of a CSHO's physical inspection of the workplace. OSHA has preliminarily determined that the proposed changes will aid OSHA's workplace inspections by better enabling employees to select a representative of their choice to accompany the CSHO during a physical workplace inspection. Employee representation during the inspection is critically important to ensuring OSHA obtains the necessary information about worksite conditions and hazards. The agency requests comments regarding the proposed revisions.
