In this document, the Bureau of Prisons (Bureau) proposes to amend its regulations on searching and detaining or arresting non- inmates. This revision reorganizes current rules and makes changes that would subject non-inmates to pat searches, either as random searches or based upon reasonable suspicion, as a condition of entry to a Bureau facility.

Implementation of the Private Security Officer Employment Authorization Act of 2004

The Department of Justice (the Department) hereby amends title 28 of the Code of Federal Regulations to authorize access to FBI- maintained criminal justice information systems to effectuate the Private Security Officer Employment Authorization Act of 2004, which was enacted as section 6402 of the Intelligence Reform and Terrorism Prevention Act of 2004. This law authorizes a fingerprint-based check of state and national criminal history records to screen prospective and current private security officers and requires the Attorney General to issue rules to regulate the ``security, confidentiality, accuracy, use, submission, dissemination, destruction of information and audits, and record keeping'' of the criminal history record information (CHRI) and related information; standards for qualifying as an authorized employer; and the imposition of fees.

The Department of Justice (DOJ), Justice Management Division (JMD), is exempting from certain subsections of the Privacy Act, a new Privacy Act system of records entitled ``Federal Bureau of Investigation Whistleblower Case Files, JMD-023.'' The system maintains all documents and evidence filed with the Director of the Office of Attorney Recruitment and Management (OARM), JMD, pertaining to requests for corrective action by employees of, or applicants for employment with, the Federal Bureau of Investigation (FBI) (or recommendations for corrective action by the Office of the Inspector General or Office of Professional Responsibility) brought under the FBI's whistleblower regulations. Effective Date: This final rule is effective January 3, 2006.
