60-Day Notice of Proposed Information Collection: Manufactured Home Construction and Safety Standards Act Reporting Requirements

The purpose of this notice is to allow for 60 days of public comment.
Notice of Extension of Time for Completion of Manufacturer Notification and Correction Plan
This notice advises the public that HUD received a request from Clayton Homes, Inc. (Clayton) for an extension of time to fully implement its plan to notify purchasers and correct certain manufactured homes that were installed with TruVent plastic range hood exhaust ducts, an item that Clayton agreed to recall after a HUD audit questioned whether the duct complied with HUD's Manufactured Home Construction and Safety Standards. The recall includes homes built by the following Clayton manufacturing subsidiaries: CMH Manufacturing, Inc.; CMH Manufacturing West, Inc.; Southern Energy Homes, Inc.; Giles Industries, Inc.; and Cavalier Homes, Inc. Clayton initiated the recall on April 6, 2015, and requested additional time to continue to complete repairs on affected homes on May 30, 2015. After reviewing Clayton's request, HUD determined that Clayton has shown good cause and granted its request for an extension. The requested extension is granted until August 3, 2015.

The Third United Nations Conference on Housing and Sustainable Urban Development (referred to as Habitat III) will be held in Quito, Ecuador, from October 17 through 20, 2016. HUD, in coordination with the U.S. Department of State and other Federal agencies, is leading the United States' preparatory efforts for Habitat III. As part of the preparatory process, the Secretary-General of Habitat III is seeking technical experts to serve as members of 10 policy units to co-lead those policy units. This notice seeks expressions of interest from technical experts who meet the criteria described in this notice, and from organizations wishing to co-lead policy units. Emergency Solutions Grants (ESG) Program, Solicitation of Comment on Specific Issues
On December 5, 2011, HUD published an interim rule entitled ``Homeless Emergency Assistance and Rapid Transition to Housing: Emergency Solutions Grants Program and Consolidated Plan Conforming Amendments'' (interim rule). The comment period for the interim rule ended on February 3, 2012. Because recipients and subrecipients have now had more experience implementing the interim rule, HUD recognizes that they may have additional input and comments for HUD to consider in its development of the ESG final rule (final rule). Therefore, this document takes comments for 60 days to allow additional time for public input, and for HUD to solicit specific comment on certain issues.
Establishing a More Effective Fair Market Rent (FMR) System; Using Small Area Fair Market Rents (SAFMRs) in Housing Choice Voucher Program Instead of the Current 50th Percentile FMRs; Advanced Notice of Proposed Rulemaking
Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires HUD to publish Fair Market Rents (FMRs) periodically, but not less than annually, adjusted to be effective on October 1 of each year. Some examples of uses of FMRs are to determine payment standard amounts for the Housing Choice Voucher (HCV) program, to establish a limit on the amount of rent to owner for project-based vouchers, to determine initial and renewal rents for some new and expiring project-based Section 8 contracts, to determine initial rents for housing assistance payment (HAP) contracts in the Moderate Rehabilitation Single Room Occupancy program (Mod Rehab), and to serve as a rent ceiling in the HOME rental assistance program. This document announces HUD's intention to amend HUD's FMR regulations applicable to the HCV program (24 CFR part 888) to provide HCV tenants with subsidies that better reflect the localized rental market, including subsidies that would be relatively higher if they move into areas that potentially have better access to jobs, transportation, services, and educational opportunities. Specifically, this document requests public comments on the use of small area FMRs (SAFMRs) for the HCV program within certain metropolitan areas. Small areas FMRs vary by ZIP code and support a greater range of payment standards than can be achieved under existing regulations.

Notice of Emergency Information Collection and Request for Comment: Assessment of Technology Needs in HUD-Subsidized Housing
Through this notice, and in accordance with the Paperwork Reduction Act of 1995, HUD invites comment on a proposed information collection for the purpose of helping HUD assess technology needs, such as access to high-speed Internet, in HUD-subsidized housing. HUD is requesting emergency processing of this request because philanthropic foundations, nonprofit organizations, private sector entities, and others have expressed interest in helping residents housed with HUD assistance to narrow their technology infrastructure and digital literacy gaps. The questions included in the information collection will enable HUD to assess the technology needs of residents housed with HUD assistance, the commitment of communities and Public Housing Agencies (PHAs) to narrowing these technology gaps, and the capacity of such jurisdictions to successfully utilize the type of assistance that is being offered. The earlier that HUD can obtain this information, the earlier that HUD may be able to benefit from the generosity of the various organizations that have offered assistance.
Notice of Extension of Time for Completion of Manufacturer Notification and Correction Plan
This notice advises the public that HUD received a request from Cavco Industries (Cavco) for an extension of time to fully implement its plan to notify purchasers and correct certain manufactured homes built and sold by Cavco that were installed with Kidde combined smoke and carbon monoxide alarms imported by Walter Kidde Portable Equipment Inc., that were subsequently recalled by the Consumer Product Safety Commission. After reviewing Cavco's request, HUD determined that Cavco has shown good cause and granted its request for an extension. The requested extension is granted until August 24, 2015.

Final Affordability Determination-Energy Efficiency Standards
The U.S. Department of Housing and Urban Development (HUD) and the U.S. Department of Agriculture (USDA) have determined that adoption of the 2009 edition of the International Energy Conservation Code (IECC) for single family homes and the 2007 edition of the American Society of Heating, Refrigerating and Air-conditioning Engineers (ASHRAE) 90.1 for multifamily buildings will not negatively affect the affordability and availability of certain HUD- and USDA-assisted housing specified in section 481 of the Energy and Independence and Security Act of 2007 (EISA). This determination fulfills a statutory requirement established under EISA that HUD and USDA adopt revisions to the 2006 IECC and ASHRAE 90.1-2004 subject to: A determination that the revised codes do not negatively affect the availability or affordability of new construction of single family and multifamily housing covered by EISA; and a determination by the Secretary of Energy that the revised codes ``would improve energy efficiency.'' For the more recent IECC and ASHRAE codes that have been published since the publication of the 2009 IECC and ASHRAE 90.1-2007, HUD and USDA intend to follow this Notice of Final Determination with an advance notice that addresses the next steps the agencies plan to take on the 2015 IECC and ASHRAE 90.1-2013 codes.

Section 8 Housing Assistance Payments Program-Fiscal Year (FY) 2015 Inflation Factors for Public Housing Agency (PHA) Renewal Funding
The Consolidated Appropriations Act, 2015 requires that HUD apply ``an inflation factor as established by the Secretary, by notice published in the Federal Register'' to adjust FY 2015 renewal funding for the Tenant-based Rental Assistance Program or Housing Choice Voucher (HCV) Program of each PHA. HUD began using Renewal Funding Inflation Factors in FY 2012. These Renewal Funding Inflation Factors incorporate economic indices to measure the expected change in per unit costs (PUC) for the HCV program. The methodology for FY 2015 is similar to that used in FY 2014.
Notice of Intent To Prepare an Environmental Impact Statement (EIS) for Coastal and Social Resiliency Initiatives for Tottenville Shoreline, Staten Island, NY
This provides notice that the State of New York, as the ``Responsible Entity,'' as that term is defined by 24 CFR 58.2(a)(7)(i), intends to prepare an Environmental Impact Statement (EIS) that will evaluate alternatives for increasing coastal and social resiliency along the Tottenville shoreline on the South Shore of Staten Island and help to avoid or minimize adverse impacts to the quality of the human environment (``Proposed Actions''). The State of New York is the Grantee of Community Development Block Grant Disaster Recovery (CDBG-DR) funds appropriated by the Disaster Relief Appropriations Act, 2013 (Pub. L. 113-2, approved January 29, 2013) related to disaster relief, long-term recovery, restoration of infrastructure and housing, and economic revitalization in the most impacted and distressed areas resulting from a major disaster declared pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1974 (Stafford Act) in calendar years 2011, 2012, and 2013. The Governor's Office of Storm Recovery (GOSR) implements the State's obligations under the National Environmental Policy Act (NEPA) through duly authorized Certifying Officers. GOSR was formed under the auspices of the New York State Homes and Community Renewal's Housing Trust Fund Corporation (HTFC), a public benefit corporation and subsidiary of the New York State Housing Finance Agency. The EIS will satisfy the requirements of NEPA and the State Environmental Quality Review Act (SEQRA). This notice is in accordance with the Council on Environmental Quality (CEQ) regulations at 40 CFR parts 1500-1508 and HUD regulations at 24 CFR part 58. Following a public scoping process, a Draft EIS will be prepared for the proposed actions described herein. Comments relating to the Draft Scope of Work for the EIS are requested and will be accepted by the contact person listed below. When the Draft EIS is completed, a notice will be sent to appropriate government agencies, individuals and groups known to have an interest in the Draft EIS and particularly in the environmental impact issues identified therein. Any person or agency interested in receiving notice and commenting on the Draft Scope of Work or Draft EIS should contact the person listed below no later than May 15, 2015. HUD has provided for assumption of its NEPA authority and responsibilities to New York State, as Responsible Entity, for the purposes of administering the Community Development Block Grant Disaster Recovery Program in New York State. Comments: Comments relating to the Draft Scope of Work for the EIS are requested and will be accepted by the contact person listed below until May 15, 2015. Comments will also be accepted at the scoping meeting described below on April 30, 2015. All interested agencies, tribes, groups, and persons are invited to submit written comments on the projects named in this notice and on the Draft Scope of Work for the EIS to the contact person listed below. All comments received before May 15, 2015 will be considered prior to the preparation and distribution of the Draft EIS. Commenters are asked to submit any information-related reports or other environmental studies planned or completed in the project area, major issues that the EIS should consider, recommended mitigation measures, and alternatives associated with the Proposed Actions. Federal, State and City agencies having jurisdiction by law, special expertise, or other special interest should report their interest and indicate their readiness to aid in the EIS effort as a ``Cooperating Agency.''
