On April 29, 2011, the OCC, Board, FDIC, Commission, FHFA and HUD (collectively, the ``Agencies'') published in the Federal Register a joint notice of proposed rulemaking for public comment to implement the credit risk retention requirements of section 15G of the Securities Exchange Act of 1934, as added by the Dodd-Frank Wall Street Reform and Consumer Protection Act (``Credit Risk NPR'' or ``proposed rule''). Due to the complexity of the rulemaking and to allow parties more time to consider the impact of the Credit Risk NPR on affected markets, the Agencies have determined that an extension of the comment period until August 1, 2011, is appropriate. This action will allow interested persons additional time to analyze the proposed rules and prepare their comments.

This notice clarifies the use of Small Area Fair Market Rents (SAFMRs) for Project-Based Vouchers (PBVs) located in the Dallas, TX, metropolitan area. This notice follows Federal Register notices published on August 4, 2010, and October 4, 2010, that proposed and established, respectively, Fiscal Year (FY) 2011 SAFMRs for the Housing Choice Voucher (HCV) program in the Dallas, TX, HUD Metropolitan Fair Market Rent Area (MHFA). The October 4, 2010, notice provides that all public housing agencies (PHAs) in the 8-county Dallas, TX, MHFA are required to use SAFMRs for the voucher program. Today's notice clarifies the use of the SAFMRs by PBV projects located in the 8-county Dallas, TX, MHFA.

This notice solicits public comment on certain key issues that will be addressed in HUD's forthcoming guidance on the Energy Performance Contracting (EPC) program. On April 8, 2011, HUD posted the Notice of Funding Availability (NOFA) for the Fiscal Year (FY) 2011 Lead-Based Paint Hazard Control Grant Program and Lead Hazard Reduction Demonstration Grant Program to Grants.gov (FR-5500-N-02). The NOFA announced the availability of information on applicant eligibility, submission deadlines, funding criteria, and other requirements for HUD's FY2011 Lead-Based Paint Hazard Control Grant Program and Lead Hazard Reduction Demonstration Grant Program. The posted NOFA indicated that the total amount of funding available was subject to enactment of HUD appropriations. On May 10, 2011, HUD posted an amendment to the NOFA which provided the funding available as a result of enactment of the HUD appropriations Act, the Department of Defense and Full-Year Continuing Appropriations Act, 2011, Public Law 112-10, approved April 15, 2011, and other technical Corrections. Based on the enactment of the FY2011 HUD appropriations, approximately $95.5 million is available for the programs in this NOFA. Of this amount, approximately $47.5 million is available for the Lead-Based Paint Hazard Control Program and $48 million for the Lead Hazard Reduction Demonstration Grant Program. The notice also amended the deadline date for applications and made other technical corrections to the NOFA. As a result of these technical corrections, the new deadline date for this NOFA is 11:59:59 p.m. June 10, 2011. The purpose of the Lead-Based Paint Hazard Control Grant Program and the Lead Hazard Reduction Demonstration Grant Program is to assist states, Native American Tribes, cities, counties/parishes, or other units of local government in undertaking comprehensive programs to identify and control lead-based paint hazards in eligible privately owned rental or owner-occupied housing with the exception that the Lead Hazard Reduction Demonstration Grant Program is targeted to urban jurisdictions with the greatest lead-based paint hazard control needs. The Consolidated Appropriations Act, 2010, directs Public and Indian Housing to ``provide renewal funding for each Public Housing Agency (PHA) based on Voucher Management System (VMS) leasing and cost data for the most recent Federal fiscal year and by applying the most recent Annual Adjustment Factors as established by the Secretary.'' The Department of Defense and Full-Year Continuing Appropriations Act, 2011, continues this requirement. This Notice announces Renewal Funding AAFs in response to that directive which was first applicable when FY2010 Renewal Funding AAFs were published. Consumer Price Index (CPI) data, similar to those used for ``Contract Rent AAFs'', are used, but semi-annual CPI data replaces annual CPI data. This makes the Renewal Funding AAFs six months more current than the CPI data used to derive Contract Rent AAFs. These CPI are the most current data available and reflect the economic circumstances most relevant to the Housing Choice Voucher (HCV) program in 2011 and the assumptions of the 2011 budget. Like the Contract Rent AAFs, these factors are based on a formula using residential rent and utility cost changes.
