The Act provided that public housing agencies (PHAs) could purchase insurance coverage without regard to competitive selection procedures, if the insurance was purchased from a nonprofit insurance entity owned and controlled by PHAs approved HUD, in accordance with standards established by regulation. A PHA-owned insurance entity selected by a PHA to provide coverage must submit a certification to HUD, stating that the entity management and underwriting staff have certain levels of experience.

On September 2, 2010, HUD posted on https://www.Grants.gov its Notice of Funding Availability (NOFA) for HUD's FY2010 Lead-Based Paint Hazard Control Grant Program and Lead Hazard Reduction Demonstration Grant Program. Today's Federal Register publication announces that HUD has posted on https://www.Grants.gov a technical correction that, among other things, corrects Appendix A of the NOFA. Appendix A of the NOFA inadvertently omitted listing three jurisdictions that are eligible to apply for the FY2010 Lead Hazard Reduction Demonstration NOFA. As a result, HUD is correcting Appendix A and establishing deadlines for the three affected eligible jurisdictions to submit an application and a waiver request to reduce the statutory match. HUD also posted an incorrect benchmark form for the FY2010 Lead Hazard Reduction Demonstration NOFA. As a result, HUD is extending the deadline for the submission of applications for other jurisdictions unaffected by the error in Appendix A. For jurisdictions eligible under the Lead-Based Paint Hazard Control Grant Program NOFA, there is no change to the deadline date for submission and timely receipt. The revised Appendix A and revised benchmark form for the Lead Hazard Reduction Demonstration Grant Program NOFA can be found and downloaded from https://www.grants.gov, using the CFDA number for that program, 14.905.

This Notice requests that eligible applicants intending to submit either a Planning or Implementation grant application under HUD's FY2010 Round 1 Choice Neighborhoods Grant Program Notice of Funding Availability (NOFA), which was posted on Grants.gov on August 26, 2010, notify HUD of their intent to apply by October 7, 2010. Eligible applicants under this NOFA are public housing authorities, local governments, nonprofits, and for profit developers that apply jointly with a public entity, as defined in the NOFA. Statutorily Mandated Designation of Difficult Development Areas and Qualified Census Tracts for 2011

On September 9, 2010 (75 FR 54902), HUD published a notice designating ``Difficult Development Areas'' (DDAs) for 2011. HUD makes new DDA designations annually for purposes of the Low-Income Housing Tax Credit (LIHTC) under Section 42 of the Internal Revenue Code of 1986 (IRC) (26 U.S.C. 42). HUD's September 9, 2010, notice also provided that designations of ``Qualified Census Tracts'' (QCTs) under IRC Section 42 published October 6, 2009 (74 FR 51304), remain in effect. HUD's September 9, 2010, notice included a summary of the LIHTC and an explanation of HUD's methodology in designating DDAs. HUD's September 9, 2010, notice, however, inadvertently omitted the tables listing the metropolitan and nonmetropolitan DDAs for 2011. For the convenience of the public, today's Federal Register notice republishes HUD's DDA notice in its entirety, and includes the tables listing metropolitan and nonmetropolitan DDAs.

Chapter 35, as amended). The Department is soliciting public comments on the subject proposal, to assure better understanding of the reporting requirements and consistency in the submission of data. Public Housing Agencies (PHA) application for funding of new Housing Choice Vouchers to promote family unification. The Family Unification Program (FUP) is a program under which vouchers are provided to families for whom the lack of adequate housing is a primary factor in the imminent placement of the family's child, or children, in out-of-home care; or the delay in the discharge of the child, or children, to the family from out-of-home care. Youths at least 18 years old and not more than 21 years old (have not reached 22nd birthday) who left foster care at age 16 or older and who do not have adequate housing are also eligible to receive housing assistance under the FUP. A FUP voucher issued to such a youth may only be used to provide housing assistance for the youth for a maximum of 18 months.

Pursuant to the authority granted by section 26 of the U.S. Housing Act of 1937 (42 U.S.C. 1437x) in connection with projects assisted under section 9 of that Act (42 U.S.C. 1437g), the City of Renton has assumed responsibility for compliance with the National Environmental Policy Act (NEPA) (42 U.S.C. 4321) in accordance with 24 CFR 58.1 and 58.4, and as the lead agency for compliance with the Washington State Environmental Policy Act (SEPA, RCW 43.21C), will perform the joint environmental review. This notice is in accordance with regulations of the Council on Environmental Quality at 40 CFR parts 1500-1508. Approximately $110 million is made available through this NOFA, by the Consolidated Appropriations Act, 2010 (Pub. L. 111-117, approved December 16, 2009). The purpose of these programs is to assist states, Native American Tribes, cities, counties/parishes, or other units of local government undertake comprehensive programs to identify and control lead-based paint hazards in eligible privately owned rental or owner-occupied housing. The Lead Hazard Reduction Demonstration Grant Program is targeted, however, to urban jurisdictions with the greatest lead-based paint hazard control needs. L. 111-05, approved February 17, 2009) (Recovery Act), and implementing guidance of the Office of Management and Budget (OMB), this notice advises that certain exceptions to the Buy American requirement of the Recovery Act have been determined applicable for work using Capital Fund Recovery Formula and Competition (CFRFC) grant funds. Specifically, an exception was granted to the Greene County Housing Authority, in White Hall, IL, for the purchase and installation of 50-amp range receptacles and thermostats for the conversion from gas to electric modification project.

This notice announces HUD's intention to sell certain unsubsidized multifamily and healthcare mortgage loans, without Federal Housing Administration (FHA) insurance, in a competitive, sealed bid sale (MHLS 2010-2). Additionally, HUD may extend the sale to include a supplementary pool of unsubsidized multifamily mortgage loan(s), without FHA insurance, limited to not-for-profit organizations and units of State and Local Government. This notice also describes generally the bidding process for the sale and certain persons who are ineligible to bid. The Qualification Statement in connection with the sale has the following new provisions and revisions: (1) Part II, Number 7 was revised to reflect that the Purchaser must also meet the requirements in Paragraph I of the Qualification Statement to become a qualified bidder with respect to the relevant Mortgage Loans; (2) Part II, Number 8 and Paragraph M were added to allow a limited partner or non-managing member (which may include a tax credit investor) to qualify to bid on a Mortgage Loan(s) in which Purchaser has made a financial investment; (3) paragraph K was revised to allow Purchaser the option to provide a complete listing or organizational chart of known Related Parties or affiliates which HUD will review, pursuant to its 2530 Previous Participation process, to determine whether a Purchaser is a Qualified Bidder; and (4) Paragraph L was added to descibe the status of, and limitations on bidding for, a Purchaser who has selected box 8. The Department has notified units of Local Governments of this planned sale and has provided each jurisdiction with the opportunity to purchase assets directly from the Department. It is anticipated that any direct sales of these notes to units of local governments would be offered and closed in the same timeframe as the competitive sale. The Department is also in the process of working with the California Housing Finance Agency for the direct sale of The Winery, a multifamily loan. It is anticipated that the sale of this asset will take place in the same timeframe as the competitive sale.

Federal Housing Administration Risk Management Initiatives: New Loan-to-Value and Credit Score Requirements

On July 15, 2010, HUD issued a notice seeking comment on three initiatives that HUD proposed would contribute to the restoration of the Mutual Mortgage Insurance Fund (MMIF) capital reserve account. This document is limited to implementation of HUD's proposal to introduce a minimum credit score threshold and reduce the maximum LTV. At the end of the public comment period on August 16, 2010, HUD received 902 comments. The overwhelming majority of these comments focused on HUD's proposal to cap seller concessions. HUD is continuing to review and consider the issues raised by commenters on capping seller concessions as well as those pertaining to HUD's proposal to tighten manual underwriting guidelines. HUD's final decision on these two proposals will be addressed separately.

Approximately $20 million is made available through this NOFA, by the Omnibus Appropriations Act, 2009 (Pub. L. 111-8, approved March 11, 2009). The purpose of the Section 202 Demonstration Pre-Development Grant Program is to assist Sponsors of projects that receive Fund Reservation Awards pursuant to the FY 2009 NOFA for the Section 202 Supportive Housing for the Elderly Program by providing pre-development grant funding for architectural and engineering work, site control, and other planning related expenses that are eligible for funding under the Section 202 Supportive Housing for the Elderly Program.
