Notice of Submission of Proposed Information Collection to OMB; Evaluation of the Rapid Re-Housing for Homeless Families Demonstration Program
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The FY 2008 budget for the U.S. Department of Housing and Urban Development (H.R. 2764) included a $25 million set-aside to implement a Rapid Re-housing for Families Demonstration (RRHD) Program ``expressly for the purposes of providing housing and services to homeless families.'' Also included in the legislation was a requirement that there be an evaluation of the demonstration program ``in order to evaluate the effectiveness of the rapid re-housing approach in addressing the needs of homeless families.'' The Notice of Funding Availability (NOFA) states that ``the Rapid Re-housing Demonstration program will include an evaluation phase, which will focus on determining the efficacy of the assessment process and the housing/ service intervention related to how successfully households are able to independently sustain housing after receiving short-term leasing assistance.'' The Participation Agreement (for the collection of informed consent and contact information), the 6-month Tracking Letter, and the Participant Follow-up Survey Instruments are all necessary to conduct the Congressionally-mandated evaluation of the Rapid Re-Housing for Families Demonstration Program.

Office of Inspector General; Privacy Act of 1974; Notification of the Office of Inspector General Intent To Consolidate, Update, Delete, and Implement Privacy Act Systems of Records
Pursuant to the Privacy Act of 1974 (5 U.S.C. 552a), notice is hereby given that HUD's Office of Inspector General (OIG) proposes to consolidate, update and delete Systems of Records (SORs) within its existing repository of SORs, and establish a new SORs to be maintained by the 13 Regional Special Agents in Charge nationwide and the Deputy Assistant Inspector General for Investigations in Washington, D.C. The OIG, pursuant to the Privacy Act of 1974, currently maintains six SORs: (1) Investigative Files of the Office of Inspector General (HUD/OIG-1); (2) Hotline Complaint Files of the Office of Inspector General (HUD/ OIG-2); (3) Name Indices System of the Office of Inspector General (HUD/OIG-3); (4) Independent Auditor Monitoring Files of the Office of Inspector General (HUD/OIG-4); (5) Auto Audit of the Office of Inspector General (HUD/OIG-5); and (6) Auto Investigation of the Office of Inspector General (HUD/OIG-6). The notice for these SORs was last published on May 22, 2000 (65 FR 33242). The OIG also proposes to create a seventh system of records, OIG Giglio Information File (HUD/ OIG-7). Accordingly, the notice, pursuant to 5 U.S.C. 552a(e)(4) and (11), of the establishment of a new system of records follows: HUD OIG is updating its Giglio Policy and is thereby creating a new system of records for which no public notice consistent with the provisions of 5 U.S.C. section 552(e)(4) and (11) has been published, OIG Giglio Information File, HUD/OIG-7. The file is being created to ensure that, upon the request of a Requesting Official within the Department of Justice, OIG Giglio Officials are able to provide the information necessary to allow the prosecuting attorneys to meet their constitutional obligations under the United States Supreme Court case of Giglio v. United States, 405 U.S. 150 (1972), and the case law following that decision. A new routine use was established for prior 6 SORs effective October 15, 2007, as noticed in the Federal Register on September 14, 2007 (72 FR 52572). The new routine use permits disclosure of records to respond to breach of personally identifiable information. This consolidation refers to that routine uses for all 7 OIG SORs. This consolidation and update amends routine use 3 for HUD/ OIG-1, HUD/OIG-2, HUD/OIG-3, HUD/OIG-4, HUD/OIG-5, and HUD/OIG-6 to allow release of records to assist housing authorities who take personnel actions based on an OIG audit or investigation. An eleventh routine use is added to HUD/OIG-1, HUD/OIG-2, HUD/OIG- 3, HUD/OIG/5, and HUD/OIG-6 to allow release of information to licensing authorities regulating professional services, when the records reveal conduct related to activities associated with a HUD program that is appropriate for possible administrative or disciplinary sanctions, such as license revocation. The OIG has also changed the name of HUD/OIG-6, Autoinvestigation of the Office of Inspector General to HUD/OIG-6 Autoinvestigation and the Case Management Information SubSystem (CMISS), while maintaining the same routine uses and attributes of HUD/OIG-6. CMISS is an updated data system of the investigative case files, formerly maintained in Auto Investigation, which will continue to maintain its information and data. This consolidation also updates routine use 9 due to legislation (IG Reform Act of 2008) enacted in 2008 changing the name of the President's Council on Integrity and Efficiency (PCIE) to the Council of Inspectors General on Integrity and Efficiency (CIGIE) and corrects the disposition schedule. The OIG also deletes two obsolete SORs from its inventory, the Investigation Files (HUD/DEPT 24) and Audit Planning and Operations systems (HUD/DEPT-77). This notice serves to update the OIG repository of SORs and reflects the current posture of each SOR. Additionally, this notice deletes and supersedes all prior notifications for the SORs referenced in this publication.
Notification of a New Privacy Act System of Records, Effort to Outcomes-Case Management System for the Disaster Housing Assistance Program (DHAP-IKE)
HUD proposes to create a new Privacy Act System of Records as required under the Privacy Act (5 U.S.C. 552a), as amended. The new records system is the Efforts to Outcomes (ETO) system, which contains the data on families transferred to HUD by the Federal Emergency Management Agency (FEMA) for participation in HUD's DHAP-Ike . Pursuant to FEMA these families are deemed eligible to receive rental housing assistance and on-going case management services, due to the catastrophic damage caused by Hurricanes Gustav or Ike . The purpose of the ETO application is to capture and monitor pertinent data relating to family self-sufficiency, permanent housing status, service needs, and to facilitate on-going tracking and management of these services, leading to greater self-sufficiency for participants when the DHAP-Ike ends.
Privacy Act of 1974: Notice of New System of Records, Single Family Computerized Homes Underwriting Management Systems
Modified the routine uses to identify the Federal Reserve as a Federal agency that receives CHUMS data for statistical research. The Computerized Homes Underwriting Management System supports Housing staff in the processing of single family mortgage insurance applications, from initial receipt through endorsement. F17/CHUMS processes loans for first time homebuyers, Home Equity Conversion Mortgages (HECM), Section 203(k) for the rehabilitation of existing properties, VA Certified FHA loans and other programs. F17/CHUMS also provide automated assistance in appraisal, mortgage credit evaluation, and FHA's TOTAL Scorecard, a standardized credit assessment tool. It supports the conditional commitment process from the Mortgagee's request for property appraisal through issuance of a conditional commitment, firm commitment, endorsement, and the automated production of the Mortgage Insurance Certificate.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for emergency review and approval, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This request is for the clearance of on-site data collection from public housing agencies (PHAs). The proposed data collection has three purposes: (1) To identify a sample of PHAs that are verified to be operating high-performing and efficient HCV programs, (2) to test alternative methods of measuring time spent on administrative functions in the HCV program, and (3) to collect information on the factors that affect administrative costs in the HCV program. The proposed data collection will take place through site visits to 60 PHAs and will include interviews with PHA staff, interviews with program partners, and reviews of client files and administrative data collected by the PHA, included documentation related to the HCV program budget. In addition, at 5 of the 60 sites the research team will beta-test three alternative methods of collecting data on PHA staff time spent on the range of activities required to administer the HCV program. The results of the site visits and beta-tests will be used to develop the research design, sampling approach, and data collection instruments for a national study of the costs of administering the HCV program based on direct measurement of staff and other program costs among a sample of high-performing HCV programs. The results of this national studyfor which separate OMB clearance will be soughtwill be used to estimate administrative fees and develop a new administrative fee allocation formula for the HCV program.

Information collected under this approval will be used to select the highest ranked applicants, and to conduct quarterly and annual performance assessments.

Buy American Exceptions Under the American Recovery and Reinvestment Act of 2009
In accordance with the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-05, approved February 17, 2009) (Recovery Act), and implementing guidance of the Office of Management and Budget (OMB), this notice advises that certain exceptions to the Buy American requirement of the Recovery Act have been determined applicable for work using Capital Fund Recovery Formula and Competition (CFRFC) grant funds. Specifically, an exception was granted to the Chicago Housing Authority for the purchase and installation of through-the-wall air conditioners, floor-mounted water closets, and low voltage electrical components at the Dearborn Homes project.

Each notice covers the quarterly period since the previous Federal Register notice. The purpose of this notice is to comply with the requirements of section 106 of the HUD Reform Act. HUD Multifamily Rental Project Closing Documents-Revisions and Updates Notice of Information Collection; 30-Day Notice
On January 21, 2010, and consistent with the Paperwork Reduction Act of 1995, HUD published for public comment, for a period of 60 days, a notice advising that HUD was updating and revising a set of closing documents used in Federal Housing Administration (FHA) multifamily rental projects. The 60-day notice published on January 21, 2010, started anew the process for updating the multifamily rental project closing documents, and obtaining approval of these documents under the Paperwork Reduction Act, a process that had originally commenced on August 2, 2004. This 30-day notice published today will complete the public comment process required by the Paperwork Reduction Act of 1995. With the issuance of this notice, HUD will submit the information collection for the closing documents to the Office of Management and Budget (OMB) for review and approval, and assignment of OMB control numbers. In accordance with the Paperwork Reduction Act, the closing documents will undergo the public comment process every three years to retain OMB approval. While complying with the Paperwork Reduction Act of 1995, this 30- day notice, as was the case with the 60-day notice, provides information beyond that normally provided in such notices. The 60-day notice published on January 21, 2010, responded to the public comments submitted on the proposed closing documents issued for comment on August 2, 2004, and summarized and responded to the public comments. Similarly, this notice issued today identifies substantive changes that HUD has made to the closing documents in response to public comment submitted on the January 21, 2010, notice, and responds to significant issues raised by commenters on the closing documents. Notice of Availability of a Draft Environmental Impact Statement for the Sunset Area Community Planned Action, City of Renton, WA
The Department of Housing and Urban Development (HUD) gives this notice to the public, agencies and Indian Tribes on the availability for public review and comment of the Draft Environmental Impact Statement (Draft EIS) for the redevelopment of the Sunset Terrace public housing community in Renton, WA. HUD gives this notice on behalf of the City of Renton acting as the Responsible Entity for compliance with the National Environmental Policy Act (NEPA). Pursuant to the authority granted by section 26 of the U.S. Housing Act of 1937 (42 U.S.C. 1437x) in connection with projects assisted under section 9 of that Act (42 U.S.C. 1437g), the City of Renton has assumed responsibility for compliance with NEPA (42 U.S.C. 4321) in accordance with 24 CFR 58.1 and 58.4, and is the lead agency for compliance with the Washington State Environmental Policy Act (SEPA, RCW 43.21C). The Draft EIS is a joint NEPA and SEPA document intended to satisfy requirements of Federal and State environmental statutes. This notice is given in accordance with the Council on Environmental Quality regulations at 40 CFR parts 1500-1508. Notice is also given that the City of Renton as Responsible Entity has decided to combine the National Historic Preservation Act, Section 106 process with the NEPA Environmental Impact Statement (EIS) in accordance with 36 CFR 800.8(c). Comments are also being requested on the Section 106 information presented in the Draft EIS as well as on the Section 106 process itself.
Federal Housing Administration (FHA): Notice of FHA PowerSaver Home Energy Retrofit Loan Pilot Program: Extension of Period Soliciting Expressions of Interest
On November 10, 2010, HUD published a notice that announced its proposal to conduct an FHA Home Energy Retrofit Loan Pilot Program (Retrofit Pilot Program or Pilot Program) known as FHA PowerSaver. The Consolidated Appropriations Act, 2010 directs HUD to conduct an Energy Efficient Mortgage Innovation pilot program targeted to the single family housing market, and the Retrofit Pilot Program is designed by HUD to meet this statutory directive and provides funding to support that effort. The November 10, 2010, notice solicited public comment and invited lenders interested in participating in the Pilot Program to submit Expressions of Interest. The deadline for both the submission of public comments and expressions of interest from lenders is December 27, 2010. This notice extends the date for submission of Expressions of Interest to January 31, 2011. The public comment deadline, however, remains December 27, 2010.

Underwriters are required to sign and submit a copy of the completed form to HUD for endorsement as part of the case binder; to provide a copy to the homebuyer; and to maintain a copy for the mortgagee.

This NOFA announces the availability of approximately $5 million in FY2010, grant funds to make emergency capital repairs to eligible multifamily projects owned by private nonprofit entities that are designated for occupancy by elderly tenants. The capital repair needs must relate to items that present an immediate threat to the health, safety, and quality of life of the tenants. The intent of these grants is to provide one-time assistance for emergency items that could not be absorbed within the project's operating budget and other project resources, and where the tenants' continued occupancy in the immediate near future would be jeopardized by a delay in initiating the proposed cure. Notice of Intent To Prepare Environmental Impact Statement for the HOPE SF Development at Alice Griffith Public Housing Development, San Francisco, CA
HUD gives notice to the public that the City and County of San Francisco's Mayor's Office of Housing (MOH) as the Responsible Entity in accordance with 24 CFR 58.2, intends to prepare a Draft Environmental Impact Statement (EIS) for redevelopment of the Alice Griffith Public Housing as part of its HOPE SF development program. Funding for the project may include HUD funds from programs subject to regulation by 24 CFR part 58; these include, but are not limited to, Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 and Home Investment Partnership Program (HOME) grants under Title II of the Cranston- Gonzales National Affordable Housing Act of 1990 as amended, Project Based Section 8 Vouchers under the United States Housing Act of 1937, Section 8(o)(13) and Public Housing operating subsidies for mixed income developments authorized under the U.S. Housing Act of 1937, Section 35. This notice is in accordance with regulations of the Council on Environmental Quality (CEQ). Federal agencies having jurisdiction by law, special expertise, or other special interest should report their interests and indicate their readiness to aid in the EIS effort as a ``Cooperating Agency.'' A Draft EIS will be prepared for the proposed action described herein. Comments relating to the Draft EIS are requested and will be accepted by the contact person listed below. When the Draft EIS is completed, a notice will be sent to individuals and groups known to have an interest in the Draft EIS and particularly in the environmental impact issues identified therein. Any person or agency interested in receiving a notice and making comment on the Draft EIS should contact the person listed below within 30-days after publication of this notice. This EIS will be a NEPA document intended to satisfy requirements of Federal environmental statutes. In accordance with specific statutory authority and HUD's regulations at 24 CFR part 58 (Environmental Review Procedures for Entities Assuming HUD Environmental Responsibilities), HUD has provided for assumption of its NEPA authority and NEPA lead agency responsibility by the City and County of San Francisco.
Conforming Changes to Applicant Submission Requirements; Implementing Federal Financial Report and Central Contractor Registration Requirements
This final rule follows publication of a July 15, 2010, interim rule that revised HUD regulations to reference the new governmentwide Federal Financial Report (FFR) approved by the Office of Management and Budget (OMB). The FFR consolidates requirements from the OMB-issued Standard Forms SF-269, SF-269A, SF-272, and SF-272A into a single governmentwide form. In incorporating reference to the new FFR in its regulations, HUD amended its regulations to remove references to old and outdated forms that are no longer in use. The July 15, 2010, interim rule also codified the requirement that applicants for HUD assistance possess an active Central Contractor Registration (CCR). HUD is adopting the interim rule without change.

Tax Credit Assistance Program-Reallocation of Funds
Through this notice, HUD announces the availability on its Web site of the application information, submission deadlines, funding criteria, and other requirements for the Reallocation of Tax Credit Assistance Program (TCAP) funds. This funding opportunity makes approximately $16 million available to assist housing projects that received Low Income Housing Tax Credit (LIHTC) awards between October 1, 2006, and September 30, 2009.
