In accordance with the Privacy Act of 1974, as amended, 5 U.S.C. 552a (Privacy Act), the Office of Federal Housing Enterprise Oversight (OFHEO) is issuing public notice of its intent to revise one existing system of records and delete one existing system of records. The systems are being revised or deleted as a result of reevaluation of the manner in which OFHEO maintains the records. OFHEO is combining these two systems of records into one expanded system, therefore, OFHEO-05, Senior Staff Biography System will be deleted, and the number OFHEO-05 reserved for future use. The revised system, OFHEO-03, Employee Identification Card System will be renamed the Staff Information and Identification System and will include information formerly maintained in OFHEO-05, Senior Staff Biography System. Revisions will incorporate administrative changes that have taken place since the last publication of OFHEO-03 at 63 FR 9007 on February 23, 1998. The revised system of records will consist of information on employees and contractors in order to issue temporary identification cards; provide biographical information to the media and other groups which request information on OFHEO staff as speakers or panel participants; and provide a resource to allow management to identify employees and contractors by their photograph, status and organizational office.

The Office of Federal Housing Enterprise Oversight (OFHEO) is amending its regulations related to Risk-Based Capital (Risk-Based Capital Regulation) to enhance the transparency, sensitivity to risk, and accuracy of the calculation of the risk-based capital requirement for the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac). OFHEO is amending the Risk-Based Capital Regulation by changing the current loss severity equations that understate losses on defaulted single-family conventional and government guaranteed loans and by changing the treatment of Federal Housing Administration insurance in the Risk-Based Capital Regulation to conform the treatment to current law.

Manufactured Home Installation Program

This final rule establishes a federal manufactured home installation program, as required by section 605(c)(2)(A) of the National Manufactured Housing Construction and Safety Standards Act of 1974. States that have their own installation programs that include the elements required by statute are permitted to administer, under their state installation programs, the new requirements established through this final rulemaking. The new elements required by statute to be integrated into an acceptable state manufactured home installation program are: The establishment of qualified installation standards; the licensing and training of installers; and the inspection of the installation of manufactured homes.

HUD has revised the ``records to be matched'' section of this notice to reflect the new HUD Privacy Act Systems of Records involved in the matching program. This update does not change the authority or objectives of the existing matching program.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The proposed information collection will collect household outcome data from families who have received housing under FEMA's Alternative Housing Pilot Program (AHPP). HUD is conducting an evaluation of AHPP. Four States affected by Hurricanes Katrina and Rita received AHPP grants to test out alternative approaches to providing temporary housing after a disaster. HUD is charged with measuring what benefits and costs are associated with each of the alternatives being implemented by the States. Measuring the program impact on health, satisfaction, and general well-being of the occupants is a key part of the evaluation. This household outcomes survey will collect information that will be used to evaluate the impact of various housing alternatives on the quality of life of households who participate in the program.

Proposed Fair Market Rents for the Housing Choice Voucher Program and Moderate Rehabilitation Single Room Occupancy Program Fiscal Year 2009

Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. Today's notice proposes FMRs for FY 2009 to be used: To determine payment standard amounts for the Housing Choice Voucher program, to determine initial renewal rents for some expiring project-based Section 8 contracts, and to determine initial rents for housing assistance payment (HAP) contracts in the Moderate Rehabilitation Single Room Occupancy program. Other programs may require use of FMRs for other purposes. The proposed FY 2009 FMR areas are based on current Office of Management and Budget (OMB) metropolitan area definitions and include HUD modifications that were first used in the determination of FY 2006 FMR areas. OMB changes to the metropolitan area definitions through November 2007 are incorporated. This means that there are six Metropolitan Statistical Area (MSA) name changes that reorder, add, or delete a primary city name.\1\ Proposed FY 2009 FMRs are based on 2000 Census data updated with more current survey data. For FY 2009, FY 2008 FMRs are updated using 2006 American Community Survey (ACS) data, Random Digit Dialing (RDD) telephone rent surveys conducted since the release of the final FY 2008 FMRs, and more recent Consumer Price Index (CPI) rent and utility indexes. HUD continues to use ACS data in different ways according to how many two-bedroom standard-quality and recent-mover sample cases are available in the FMR area or its Core- Based Statistical Area (CBSA). Revised 2006 FMRs based on Census and ACS data have been updated with CPI data through the end of 2007 and then trended to April 2009, the mid-point of FY 2009.

Federal Housing Administration: Acceptable Payment History for Late Request for Endorsement of Mortgage for Insurance

HUD's current regulations require that a mortgage show an acceptable payment history when submitted for late endorsement, but they are silent as to what constitutes an acceptable payment history. This proposed rule would provide factors that establish an acceptable payment history when a mortgage is submitted for Federal Housing Administration (FHA) insurance more than 60 days after closing, and would make one technical amendment pertaining to the submission of documentation for endorsement.
