On March 2, 2018, we published in the Federal Register (83 FR 8974) a notice inviting applications (NIA) for new awards for fiscal year (FY) 2018 for the CSP Grants to Developers for the Opening of New Charter Schools and for the Replication and Expansion of High-Quality Charter Schools, Catalog of Federal Domestic Assistance (CFDA) Numbers 84.282B and 84.282E. Since that time, Congress passed and the President signed the Consolidated Appropriations Act, 2018 (Act), which provides funding for the awards under this competition. This document amends the NIA by: (1) Stating that the Secretary may fund out of rank order applications proposing to open a new charter school or replicate or expand a high-quality charter school in underserved, high-poverty, rural areas; and (2) adding definitions related to funding such applications out of rank order. In addition, we are extending the deadline for transmittal of applications by two weeks, until April 30, 2018.

States also impose disclosure requirements on loan servicers with respect to loans made under title IV of the Higher Education Act of 1965, as amended (HEA). Finally, State regulations impact Federal Family Education Loan (FFEL) Program servicing. The Department believes such regulation is preempted by Federal law. In order to support and strengthen the work that educators do every day in collaboration with parents, advocates, and community members, the Secretary issues 11 priorities and related definitions for use in currently authorized discretionary grant programs or programs that may be authorized in the future. The Secretary may choose to use an entire priority for a grant program or a particular competition or use one or more of the priority's component parts. These priorities and definitions replace the supplemental priorities published in the Federal Register on December 10, 2014 and September 14, 2016. However, if a notice inviting applications (NIA) published before the applicability date of this notice of final priorities and definitions included priorities from the December 10, 2014 or September 14, 2016 notices, the included priorities would be in effect for the duration of the applicable competition.

The U.S. Department of Education (Department) seeks to ensure that the congressional mandate to except student loans from bankruptcy discharge except in cases of undue hardship is appropriately implemented while also ensuring that borrowers for whom repayment of their student loans would be an undue hardship are not inadvertently discouraged from filing an adversary proceeding in their bankruptcy case. Accordingly, the Department is requesting public comment on factors to be considered in evaluating undue hardship claims asserted by student loan borrowers in adversary proceedings filed in bankruptcy cases, the weight to be given to such factors, whether the existence of two tests for evaluation of undue hardship claims results in inequities among borrowers seeking undue hardship discharge, and how all of these, and potentially additional, considerations should weigh into whether an undue hardship claim should be conceded by the loan holder.
