Assistance to States for the Education of Children With Disabilities
The Secretary proposes to amend regulations under Part B of the Individuals with Disabilities Education Act (IDEA or Act). These regulations govern the Assistance to States for the Education of Children with Disabilities program, including the Preschool Grants program. The Secretary seeks public comment on these proposed amendments regarding the use of public benefits or insurance in which a child participates to provide or pay for services required under Part B of IDEA. Since the Part B regulations were amended in 2006, our experience with implementing the provisions on obtaining parental consent for the use of public benefits or insurance has raised two important issues. First, the current regulations do not require that public agencies inform parents specifically of all of the protections regarding access to public benefits or insurance, including their rights under the Family Educational Rights and Privacy Act (FERPA) and IDEA confidentiality provisions. Second, State educational agencies (SEAs) and local educational agencies (LEAs) have expressed concerns about the overall costs and administrative burdens imposed by requiring parental consent to access public benefits or insurance, in addition to the parental consent required by FERPA.
Early Intervention Program for Infants and Toddlers With Disabilities
The Secretary issues final regulations governing the Early Intervention Program for Infants and Toddlers with Disabilities. These regulations are needed to reflect changes made to the Individuals with Disabilities Education Act, as amended by the Individuals with Disabilities Education Improvement Act of 2004 (Act or IDEA).

Application and Approval Process for New Programs
The Secretary proposes to amend the regulations for Institutional Eligibility under the Higher Education Act of 1965, as amended (HEA), to streamline the application and approval process for new educational programs that qualify for student financial assistance under title IV of the HEA.
Race to the Top Fund Phase 3; Correction
On September 12, 2011, the Secretary of Education (Secretary) published a notice in the Federal Register proposing requirements for Phase 3 of the Race to the Top program (RTT-Phase 3 NPR) (76 FR 56183). The RTT-Phase 3 NPR was incomplete and included minor errors. Through this document, we correct the errors and add the information that was unintentionally omitted. Except as corrected by this notice, the RTT- Phase 3 NPR, including the date by which public comments are due, remains unchanged.
State Fiscal Stabilization Fund Program and Discretionary and Other Formula Grant Programs
The Secretary of Education (Secretary) established requirements for the State Fiscal Stabilization Fund (SFSF) program in a notice of final requirements, definitions, and approval criteria published in the Federal Register on November 12, 2009 (November 2009 Notice). In this notice, the Secretary proposes to revise some of those requirements. In a separate notice of interim final requirement, the Secretary is extending to January 31, 2012, the deadline by which a State must collect and publicly report data and information under the SFSF program. In addition, the Secretary proposes in this notice to establish a priority that the U.S. Department of Education (Department) may use, as appropriate, in any future discretionary grant competitions. The Department would give a priority to States that have developed and implemented the statewide longitudinal data system (SLDS) required under SFSF Indicator (b)(1) on or before the applicable deadline. Through this notice, we also remind grantees that under its current authority, the Department may identify grantees as high risk and impose sanctions on them for failing to meet programmatic requirements. In addition, the Department is proposing that it may take enforcement action against a State educational agency (SEA) under certain circumstances where a State fails to meet the requirements of Indicators (b)(1), (c)(11), or (c)(12).
State Fiscal Stabilization Fund Program
On November 12, 2009, the Secretary of Education (Secretary) published in the Federal Register a notice of final requirements, definitions, and approval criteria for the State Fiscal Stabilization Fund (SFSF) program (November 2009 Notice). In that notice, the Secretary established September 30, 2011 as the deadline by which States had to collect and publicly report data and other information on various SFSF indicators and descriptors. Since publication of the November 2009 notice, States have faced many challenges and competing priorities in trying to meet the requirements of some of the SFSF indicators by the September 30, 2011 deadline. As a result, a number of States will be unable to comply fully with the SFSF requirements by the September 30, 2011 deadline. Accordingly, in this interim final requirement, the Secretary extends that deadline to January 31, 2012.

Race to the Top Fund Phase 3
The Secretary of Education (Secretary) proposes requirements for Phase 3 of the Race to the Top program. In this phase the Department would make awards to States that were finalists but did not receive funding under the Race to the Top Fund Phase 2 competition held in fiscal year (FY) 2010. We take this action to specify the information and assurances that applicants must provide in order to receive funding under the Race to the Top Fund Phase 3 award process.
Reopening Notice: Promise Neighborhoods Program-Implementation Grant Competition; Promise Neighborhoods Program-Planning Grant Competition
The Department of Education (Department) reopens the competition for transmittal of applications for new awards for fiscal year (FY) 2011 under the Promise Neighborhoods Program Implementation and Planning grant competitions. The Department takes this action to allow more time for the preparation and submission of applications by prospective eligible applicants affected by the severe storms, flooding, property damage, and loss of electrical power that occurred as a result of Hurricane Irene on the East Coast of the United States, beginning on August 26, 2011, and continuing through the publication of this notice. The reopening of the competitions is intended to help affected eligible applicants compete fairly with other eligible applicants under this competition. Due to the widespread impact of Hurricane Irene, the competition is reopened to all eligible applicants.
