Improving Government Regulations; Unified Agenda of Federal Regulatory and Deregulatory Actions

This agenda announces the regulatory actions the Department of Defense (DoD) plans to take in the next 12 months and those regulatory actions completed since the publication of the spring 2021 Unified Agenda. It was developed under the guidelines of Executive Order 12866, ``Regulatory Planning and Review,'' and Executive Order 13563, ``Improving Regulation and Regulatory Review.'' This agenda includes regulatory actions that support or impact the Secretary of Defense's top priorities along with those of the National Defense Strategy to defend the Nation by taking care of our people, building a more lethal force, succeeding through teamwork, reforming business practices, and address the current worldwide pandemic. These include efforts to ensure TRICARE beneficiaries have access to the most up-to-date care required for the diagnosis and treatment of COVID-19. Members of the public may submit comments on individual proposed and interim final rulemakings at www.regulations.gov during the comment period that follows publication in the Federal Register. This agenda updates the report published on July 30, 2021, and includes regulations expected to be issued and under review over the next 12 months. The next agenda will publish in the spring of 2022. The complete Unified Agenda will be available online at www.reginfo.gov. Because publication in the Federal Register is mandated for the regulatory flexibility agendas required by the Regulatory Flexibility Act (5 U.S.C. 602), the Department of Defense's printed agenda entries include only: (1) Rules that are in the Agency's regulatory flexibility agenda, in accordance with the Regulatory Flexibility Act, because they are likely to have a significant economic impact on a substantial number of small entities; and (2) Any rules that the Agency has identified for periodic review under section 610 of the Regulatory Flexibility Act. In accordance with the Privacy Act of 1974, the DoD is modifying the system of records entitled, AFNConnect (AFNC) and AFN Now, DPA 02. The American Forces Network (AFN) services consists of two web-based automated information systems. The systems are used to document the eligibility and continued validation of authorized individuals who register an AFN-capable satellite decoder and/or access AFN Over the Top (OTT) Live Streaming and Video on Demand (VOD) Services via the AFNC and AFN Now applications. The AFN provides U.S. military commanders worldwide with a means to communicate internal information to DoD and other Federal agency audiences stationed outside of the United States, its territories or possessions. Records may also be used as a management tool for statistical analysis, tracking, reporting, and evaluating program effectiveness.

This Executive Order seeks to raise the hourly minimum wage paid by contractors to workers performing work on or in connection with covered Federal contracts to $15.00 per hour beginning January 30, 2022, and beginning January 1, 2023, and annually thereafter, an amount determined by the Secretary of Labor.

The U.S. Army Corps of Engineers (Corps) is proposing to revise its regulations to establish a restricted area within the Richardson Training Area on Joint Base Elmendorf-Richardson (JBER), at Eagle River. The United States Army, Alaska (USARAK) G3/5/7 Training and Support Activity-Alaska (TSA-AK) requested establishment of a restricted area which would be located in the area of navigable waters extending from the span on Bravo Bridge across Eagle River to the mouth of Eagle River Knik Arm (Eagle River channel). Establishment of the restricted area would prevent all watercraft navigations and individuals from entering an active military range munitions impact area at all times, except for authorized vessels and individuals engaged in support of military training and management activities. This restricted area is necessary to avoid inadvertent entry into the impact area during live-fire weapons training, exposure to hazardous noise, and inadvertent encounters with unexploded ordnance.

In accordance with the Privacy Act of 1974, the DoD is adding a new system of records, titled ``Office of Military Commissions (OMC) Victim and Witness Assistance Program Records,'' DGC 22. The system will be used to maintain the necessary information for victims, victim family members (VFMs), and witnesses to travel to Guantanamo Bay, Cuba (GTMO). The information will also be used to obtain clearance for victims and VFMs to travel to military installations for the purpose of viewing Closed Circuit Television of the GTMO trials.

In accordance with the Paperwork Reduction Act of 1995, and the Office of Management and Budget (OMB) regulations, DoD, GSA, and NASA invite the public to comment on an extension concerning subcontracting plans. DoD, GSA, and NASA invite comments on: Whether the proposed collection of information is necessary for the proper performance of the functions of Federal Government acquisitions, including whether the information will have practical utility; the accuracy of the estimate of the burden of the proposed information collection; ways to enhance the quality, utility, and clarity of the information to be collected; and ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. OMB has approved this information collection for use through March 31, 2022. DoD, GSA, and NASA propose that OMB extend its approval for use for three additional years beyond the current expiration date.
