The United States Air Force (Air Force) is issuing this amended and updated notice from the original notice published on March 6, 2020 (Federal Register, Vol. 85, No. 45, 13148) to advise the public of its continuing intent to prepare an Environmental Impact Statement (EIS) for the B-21 Main Operating Base 1 (MOB 1) Beddown at Dyess Air Force Base (AFB), Texas or Ellsworth AFB, South Dakota. As a direct result of the National Emergency declared by the President on Friday, March 13, 2020, in response to the coronavirus (COVID-19) pandemic in the United States and the Center for Disease Control's recommendations for social distancing and avoiding large public gatherings, the Air Force is now canceling six public scoping meetings between March 31, 2020 and April 9. In lieu of the public scoping meetings, the Air Force will use the alternative means set forth below to inform the public and stakeholders and to obtain input for scoping the proposed action.

The United States (U.S.) Department of the Navy (Navy), after carefully weighing the strategic, operational, and environmental consequences of the Proposed Action, announces its decision to select Alternative 3 (Preferred Alternative) from the Fallon Range Training Complex (FRTC) Final Environmental Impact Statement (EIS) Environmental), dated January 2020. This alternative will support the Navy's request for a legislative proposal in the National Defense Authorization Act for Fiscal Year 2021 for Congressional action and Presidential approval for renewal of the current federal land withdrawal and withdrawal of additional federal land to expand the range. It also includes the acquisition of non-federal land. While making this decision, the Navy carefully weighed its strategic and operational needs; potential impacts on the human, natural, and cultural environment; and comments from government officials and agencies, tribal governments, and the public on the proposal and environmental analysis. The Navy selected Alternative 3 because it best meets the purpose of and need for modernization while minimizing impacts on public access and land use. The Navy will implement management practices, monitoring, and mitigation measures to reduce potential impacts of the FRTC modernization.

The Office of the Under Secretary of Defense (Comptroller) proposes to add a System of Records titled, ``Defense Repository for Common Enterprise Data (DRCED),'' DUSDC 01. This system will automate financial and business transactions, perform cost-management analysis, produce oversight and audit reports, and provide critical data linking to improve performance of mission objectives. Congress mandated the creation of this system through the National Defense Authorization Act of 2018 and then codified it by statute as ``Defense Business Systems: Business Process Reengineering; Enterprise Architecture; Management.'' The DRCED's purpose is to improve the Department's defense business enterprise by synchronizing and normalizing data for affordability, performance, and mission readiness. To achieve this, the DRCED will optimize technology to provide an enterprise solution for integrating and analyzing targeted data from existing Department systems to develop timely, actionable, and insightful conclusions in support of national strategies. Also, DRCED is capable of creating predictive analytic models based upon specific data streams to equip decision makers with critical data necessary for execution of fiscal and operational requirements.

This final rule removes DoD's regulation concerning the National Guard Bureau Privacy Program. On April 11, 2019, the Department of Defense published a revised DoD-level Privacy Program rule, which contains the necessary information for an agency-wide privacy program regulation under the Privacy Act and now serves as the single Privacy Program rule for the Department. That revised Privacy Program rule also includes all DoD component exemption rules. Therefore, this part is now unnecessary and may be removed from the CFR.

The Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Debt Collection Improvement Act of 1996 and the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (the 2015 Act), requires the head of each agency to adjust for inflation its CMP levels in effect as of November 2, 2015, under a revised methodology that was effective for 2016 and for each year thereafter.

SCO, as lead agency, in partnership with DOE, as a cooperating agency, intends to prepare an Environmental Impact Statement (EIS) in accordance with the requirements of the National Environmental Policy Act (NEPA) and applicable implementing regulations for the Proposed Action. The EIS also will cover the planned disposition of the prototype microreactor following operation and demonstration. Through this EIS process, SCO will identify measures to avoid, minimize, or mitigate any negative impacts to human health or the environment associated with the Proposed Action.

Military Lending Act Limitations on Terms of Consumer Credit Extended to Service Members and Dependents

The Department of Defense (Department) is amending its interpretive rule for the Military Lending Act (the MLA). The MLA, as implemented by the Department, limits the military annual percentage rate (MAPR) that a creditor may charge to a maximum of 36 percent, requires certain disclosures, and provides other substantive consumer protections on ``consumer credit'' extended to Service members and their families. On July 22, 2015, the Department amended its regulation primarily for the purpose of extending the protections of the MLA to a broader range of closed-end and open-end credit products (the July 2015 Final Rule). On August 26, 2016, the Department issued the first set of interpretations of that regulation in the form of questions and answers. On December 14, 2017, the Department issued a second set of interpretations of that regulation in the form of amended questions and answers. The Department is now withdrawing the amended question and answer number 2 (Q&A #2), published in the December 14, 2017 Interpretive Rule, which discussed when credit is extended for the purpose of purchasing a motor vehicle or personal property and the creditor simultaneously extends credit in an amount greater than the purchase price of the motor vehicle or personal property. In withdrawing this amended question and answer, the Department is reverting back to the original Q&A #2 published in the August 26, 2016 Interpretive Rule. This will allow the Department to conduct additional analysis on this matter. The Department is also adding a new question and answer to address questions about the use of Individual Taxpayer Identification Numbers to identify covered borrowers in the Department's database.

The USA is rescinding a System of Records, A0385-1040 ASO, Army Safety Management Information System (ASMIS). These records consist of safety investigation case files retrieved by the report identification number, incident date, location, unit identification code, accident classification, or accident description. Personal information is collected during the investigation on individuals involved in or witness to an incident; however, their personal identifiers are not used to maintain or retrieve the records. To maintain the integrity of investigatory material, the USA established specialized procedures to restrict queries to descriptors of the incident, therefore these records are not subject to the Privacy Act of 1974. Individuals involved in or witness to the incident, and other interested parties may request information collected in safety investigations records under the provisions of the Freedom of Information Act (FOIA).
