TRICARE; Expansion of Geographic Scope of the TRICARE Retiree Dental Program (TRDP)

This proposed rule expands the geographic scope of the TRICARE Retiree Dental Program (TRDP) to overseas locations not currently covered by the program. At this time, TRDP is only applicable in the 50 United States and the District of Columbia, Canada, Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the U.S. Virgin Islands. Expanding the geographic scope of the program will ensure that all TRICARE-eligible retirees are eligible for the same dental benefits, regardless of their location. There are no additional Government costs associated with this proposed expansion of TRDP overseas as TRDP costs are borne entirely by enrollees through premium payments.

This notice provides submitter's notice pursuant to Executive Order 12600 that the Department of Defense, Office of the Secretary of Defense, Business Transformation Agency (BTA) has received several FOIA requests for access to the Central Contractor Registration (CCR) database. The CCR is an e-Gov initiative within the Integrated Acquisition Environment (IAE) and serves as the core system for the IAE's Business Partner Network (BRN). The Department of Defense manages the CCR on behalf of the IAE. The primary objective of the CCR is to provide a web-based application that provides a single source of vendor information in support of the contract award and the electronic payment process of the Federal Government. The CCR is also a registration system for grants and assistance awards. The CCR has 194 data fields, some of which are exempt from disclosure pursuant to Exemptions 2, and/ or 4 and/or 6 of Freedom of Information Act (FOIA), 5 U.S.C. 552(b)(2), (b)(4) & (b)(6). The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS SAMPSON (DDG 102) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The Department of Defense (the Department or DoD) proposes to amend our regulations by adding a new part to implement the consumer protections covered by Public Law 109-364, the John Warner National Defense Authorization Act for Fiscal Year 2007, section 670, ``Limitations on Terms of Consumer Credit Extended to Service Members and Dependents'' (October 17, 2006). Section 670 of Public Law 109-364 created 10 U.S.C. 987 and requires the Secretary of Defense to prescribe regulations to carry out the new section. The proposed regulation is intended to regulate the terms of consumer credit extended by creditors to active duty service members and their dependents.

The Strategic Advisory Group (SAG) will meet in closed session on 8-10 May 2007. The mission of the SAG is to provide timely advice on scientific, technical, intelligence, and policy-related issues to the Commander, U.S. Strategic Command, during the development of the Nation's strategic war plans. Full development of the topics will require discussion of information classified in accordance with Executive Order 12958, dated April 17, 1995. Access to this information must be strictly limited to personnel having requisite security clearances and specific need-to- know. Unauthorized disclosure of the information to be discussed at the SAG meeting could have exceptionally grave impact upon national defense. In accordance with Section 10(d) of the Federal Advisory Committee Act (5 U.S.C. App.), it has been determined that this SAG meeting concerns matters listed in 5 U.S.C. Under the provisions of the Federal Advisory Committee Act of 1972, (5 U.S.C. Appendix, as amended), the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is renewing the charter for the Board of Regents of the Uniformed Services University of the Health Sciences (hereafter referred to as the Board of Regents). The Board of Regents, pursuant to 10 U.S.C. 2113, is a non- discretionary Federal advisory committee established to assist the Secretary of Defense in an advisory capacity in carrying out the Secretary's responsibility to conduct the business of the Uniformed Services University of the Health Sciences. While 10 U.S.C. 2113(a) does not provide precise objectives and scope for the Board of Regents' assistance to the Secretary of Defense, past practice has been for the Board of Regents to assist in the areas of advice on academic and administrative matters that are critical to the full accreditation and successful operation of the University. Specific DoD expectations are outlined in DoD Instruction 5105.45 and in bylaws and policies developed by the Board of Regents. Pursuant to 10 U.S.C. 2113(a), the Board of Regents is composed of: (a) Nine persons in the fields of health and health education who shall be appointed from civilian life by the President, by and with the advice and consent of the Senate; (b) the Secretary of Defense, or his designee, who shall be an ex officio member; (c) the surgeons general of the uniformed services, who shall be ex officio members; and (d) the Dean of the University, who shall be a nonvoting ex officio member. The terms of the office for those members appointed by the President pursuant to 10 U.S.C. 2113(b) shall be six years except that: (a) any member appointed to fill a vacancy occurring before the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of such term; (b) the terms of office of the members first taking office shall expire, as designated by the President at the time of the appointment; and (c) any member whose term of office has expired shall continue to serve until his successor is appointed. The President shall designate one appointed member of the Board of Regents to serve as Chair. Members of the Board of Regents who are not full-time or permanent part-time Federal employees shall serve as Special Government Employees under the authority of 5 U.S.C. 3109, and, pursuant to 10 U.S.C. 2113(e), shall receive compensation of no more than $100 per day, as determined by the Secretary of Defense, in addition to travel expenses and per diem while serving away from their place of residence. The Board of Regents shall meet at the call of the Designated Federal Officer, in consultation with the Chair and the President of the University. The Designated Federal Officer shall be a full-time or permanent part-time DoD employee, and shall be appointed in accordance with established DoD policies and procedures. The Designated Federal Officer or Alternate Designated Federal Officer shall attend all Board of Regents' meetings and subcommittee meetings. The Board of Regents is authorized to establish subcommittees and workgroups, as necessary and consistent with its mission. Board of Regents subcommittees and workgroups shall operate under the provisions of 5 U.S.C., Appendix, as amended, the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended) and other appropriate Federal regulations. Board of Regents subcommittees and workgroups shall not work independently of the Board of Regents and shall report all their recommendations and advice to the Board of Regents for full deliberation and discussion. Board of Regents subcommittees and workgroups have no authority to make decisions on behalf of the Board of Regents and may not report directly to the Department of Defense or any Federal officers or employees who are not Board of regents members. Pursuant to 41 CFR 102-3.105(j) and 102-3.140, the public or interested organizations may submit written statements to the Board of Regents about its mission and functions. The Army intends to prepare an EIS to assess the potential environmental impacts associated with the stationing and training of increased numbers and types of aviation assets within Alaska. The proposed increase and reorganization will allow the Army to transition to a force that is capable of providing a broad range of integrated aviation training experience to the forces of USARAK and more aviation capabilities when the unit deploys to support operational missions abroad. Existing aviation units would potentially be reorganized and stationed at Fort Wainwright, Fort Richardson or other military installations to support the training of aviation assets on U.S. Army training lands in Alaska. The reorganized unit would be capable of providing first line air transport, air reconnaissance, and close air support. The new aviation unit would be built around the existing USARAK aviation fleet of 30 medium and heavy lift transport helicopters, and USARAK's 640 aviation personnel. To this the Army proposes to add helicopters capable of providing medical evacuation, air reconnaissance, close air support, and aviation attack capabilities. The proposed aviation unit, an Aviation Task Force or Combat Aviation Brigade (CAB), would potentially consist of up to 62 medium and heavy lift helicopters, 30 combat scout helicopter, 24 attack helicopters, and between 1,200 to 2,850 personnel. This proposed stationing and training of increased aviation assets involves construction of new facilities, execution of day-to-day support operations, and routine joint military training at nearby training lands and ranges. The action may have significant environmental impacts resulting from training and construction required as part of the proposed reorganization. Significant impacts resulting from this action may include impacts to air space, noise, and cultural resources. The EIS will analyze the impacts of the proposed action and a full range of reasonable alternatives upon Alaska's natural and man-made environments.
