The Department of Defense (DoD) is amending its regulations governing the disposal of property at installations being closed and realigned and how to address the impacts of realignment at receiving installations. This final rule contains amendments to address changes in the laws governing base closure and realignment (BRAC) made since the current regulations were promulgated. This final rule also amends DoD policy and addresses various environmental requirements not previously addressed in the regulations.

The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General of the Navy (Admiralty and Maritime Law) has determined that Causeway Ferry Power Modules (CFPM) and Warping Tugs (WT) are vessels of the Navy which, due to their special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with their special function as naval ships. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The Department of the Army (DA) and National Guard Bureau have proposed to transform the Pennsylvania Army National Guard (PAARNG) 56th Brigade into a Stryker Brigade Combat Team (SBCT). This Environmental Impact Statement (EIS) discusses in-depth three alternatives: The Preferred Alternative, the Train Using Existing Army Facilities Alternative, and the No-Action Alternative, Under the Preferred Alternative, the PAARNG proposes construction of new training and support facilities at the National Guard Training CenterFort Indiantown Gap (NGTC-FTIG); at Fort Pickett, VA; and at local PAARNG facilities across the State of Pennsylvania, as well as conducting Annual Training (AT) at Fort A.P. Hill, VA, in order to accomplish requisite training. Under the Train Using Existing Army Facilities Alternative, no construction at NGTC-FTIG, Pennsylvania or Fort Pickett, VA would occur; the statewide facilities improvements would occur. Required SBCT Inactive Duty Training (IDT) and AT would be conducted at select regional Army training installations, using existing facilities. Other alternatives considered but eliminated from detailed study are also addressed in the EIS.

The U.S. Army Corps of Engineers (Corps), Jacksonville District, intends to prepare an integrated Project Implementation Report/Draft Environmental Impact Statement (PIR/DEIS) for the Everglades National Park (ENP) Seepage Management Project. The study is a cooperative effort between the Corps and the South Florida Water Management District (SFWMD), which is also a cooperating agency for this DEIS. The project seeks to reduce eastward water seepage from the Everglades system for the benefit of wetland communities within ENP. The ENP Seepage Management Project is comprised of three components that were recommended as a part of the Central and Southern Florida (C&SF) Project Comprehensive Review Study Feasibility Report and Integrated Environmental Impact Statement (EIS) dated April 1999 (Restudy), and is part of the Comprehensive Everglades Restoration Plan (CERP). The project includes an aboveground recharge area, a wetland buffer area, relocation and enhancement of levee L-31N, a sheetflow delivery system, and other features located adjacent to ENP in Miami- Dade County.

In compliance with Section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), DoD announces the proposed extension of a public information collection requirement and seeks public comment on the provisions thereof. DoD invites comments on: (a) Whether the proposed collection of information is necessary for the proper performance of the functions of DoD, including whether the information will have practical utility; (b) the accuracy of the estimate of the burden of the proposed information collection; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. The Office of Management and Budget (OMB) has approved this information collection for use through June 30, 2006. DoD proposes that OMB extend its approval for use for 3 additional years.

The Acting Director of Defense Procurement and Acquisition Policy has suspended the use of the price evaluation adjustment for small disadvantaged businesses (SDBs) in DoD procurements, as required by 10 U.S.C. 2323(e)(3), because DoD exceeded its 5 percent goal for contract awards to SDBs in fiscal year 2005. The suspension will be in effect for 1 year and will be reevaluated based on the level of DoD contract awards to SDBs achieved in fiscal year 2006.

Chapter 212 of title 18, United States Code (Military Extraterritorial Jurisdiction Act of 2000 (MEJA)) establishes Federal criminal jurisdiction over whoever engages in conduct outside the United States that would constitute an offense punishable by imprisonment for more than one year (i.e., a felony offense) while employed by or accompanying the Armed Forces outside the United States, certain members of the Armed Forces subject to the Uniform Code of Military Justice (Chapter 47 of title 10, United States Code), and former members of the Armed Forces. This rule is established to correspond with the Department of Defense Instruction 5525.11, ``Criminal Jurisdiction Over Civilians Employed By or Accompanying the Armed Forces Outside the United States, Certain Service Members, and Former Service Members,'' that the Deputy Secretary of Defense approved on March 3, 2005.

The Defense Science Board Task Force on VTOL/STOL will meet in closed session on February 22, 2006; at Strategic Analysis Inc., 3601 Wilson Boulevard, Arlington, VA. This meeting continues the task force's work and will consist of classified and FOUO briefings on current technologies and programs. The mission of the Defense Science Board is to advise the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology & Logistics on scientific and technical matters as they affect the perceived needs of the Department of Defense. At these meetings, the Defense Science Board Task Force will: Assess the features and capabilities VTOL/STOL aircraft should have in order to support the nation's defense needs through at least the first half of the 21st century.
