Notice of Scope Rulings
The Department of Commerce (``Department'') hereby publishes a list of scope rulings completed between April 1, 2009, and June 30, 2009. In conjunction with this list, the Department is also publishing a list of requests for scope rulings and anticircumvention determinations pending as of June 30, 2009. We intend to publish future lists after the close of the next calendar quarter.
Pure Magnesium From the People's Republic of China: Rescission of New Shipper Review
In response to a request from Tianjin Xianghaiqi Resources Import & Export Trade Co., Ltd. (``TXR''), the Department of Commerce (``Department'') initiated a new shipper review of the antidumping duty order on pure magnesium from the People's Republic of China (``PRC'') for the period of review (``POR'') May 1, 2008, through April 30, 2009.\1\ On August 3, 2009, TXR submitted a letter to the Department withdrawing its request for the new shipper review.\2\ Accordingly, we are rescinding the new shipper review with respect to TXR.
Certain Frozen Fish Fillets From the Socialist Republic of Vietnam: Initiation of New Shipper Review
The Department of Commerce (``Department'') has determined that a request for a new shipper review of the antidumping duty order on certain frozen fish fillets from the Socialist Republic of Vietnam, received on July 31, 2009, meets the statutory and regulatory requirements for initiation. The period of review (``POR'') of this new shipper review is August 1, 2008, - July 31, 2009.
Certain Steel Nails From the People's Republic of China: Initiation of Antidumping Duty New Shipper Review
The Department of Commerce (``Department'') has determined that a request for a new shipper review of the antidumping duty order on certain steel nails from the People's Republic of China (``PRC''), received on August 24, 2009, meets the statutory and regulatory requirements for initiation. The period of review (``POR'') of this new shipper review is January 23, 2008, - July 31, 2009.
Wooden Bedroom Furniture From the People's Republic of China: Final Results of New Shipper Review
On June 30, 2009, the Department of Commerce (``Department'') published the preliminary results of the new shipper review (``NSR'') of the antidumping duty order on wooden bedroom furniture from the People's Republic of China (``PRC'') covering sales of subject merchandise made by Shanghai Fangjia Industry Co., Ltd. (``Fangjia''). See Wooden Bedroom Furniture from the People's Republic of China: Preliminary Results of New Shipper Review, 74 FR 31244 (June 30, 2009) (``Preliminary Results''). In accordance with 19 CFR 351.309(c)(ii), we gave interested parties an opportunity to comment on the Preliminary Results and received none. Accordingly, we have not made changes to the Preliminary Results and continue to determine that Fangjia has not made sales at less than normal value (``NV'').
Certain Activated Carbon from the People's Republic of China: Notice of Rescission of Changed Circumstances Review
On April 30, 2009, the Department of Commerce (``Department'') published a notice of initiation of changed circumstance review (``CCR'') of the antidumping duty order on certain activated carbon from the People's Republic of China (``PRC''). See Certain Activated Carbon From the People's Republic of China: Notice of Initiation of Changed Circumstances Review, 74 FR 19934 (April 30, 2009) (``Initiation''). The Department is now rescinding this CCR because Hebei Foreign Trade and Advertising Corporation (``Hebei Foreign'') because the factual information upon which the Department relied in the initiation of this change circumstances review was later found to be false, and we find there was not a change in circumstances to warrant this review.
Certain Cut-to-Length Carbon-Quality Steel Plate From the Republic of Korea: Preliminary Results of Antidumping Duty Administrative Review and Intent To Rescind Administrative Review in Part
On March 24, 2009, in response to a request from interested parties, the Department of Commerce (the Department) published a notice of initiation of the administrative review of the antidumping duty order on certain cut-to-length carbon-quality steel plate (CTL plate) from the Republic of Korea (Korea). The review covers four manufacturers/exporters. The period of review is February 1, 2008, through January 31, 2009. We have preliminarily determined that sales have been made below normal value by certain companies subject to this review. We invite interested parties to comment on these preliminary results. Parties who submit comments in this review are requested to submit with each argument a statement of the issue and a brief summary of the argument.
Export Trade Certificate of Review
On September 16, 2009, the Export Trading Company Affairs Office, International Trade Administration, U.S. Department of Commerce, issued an amended Export Trade Certificate of Review (``Certificate'') to Northwest Fruit Exporters (``NFE'').
Initiation of Antidumping and Countervailing Duty Administrative Reviews and Request for Revocation in Part
The Department of Commerce (``the Department'') has received requests to conduct administrative reviews of various antidumping and countervailing duty orders and findings with August anniversary dates. In accordance with the Department's regulations, we are initiating those administrative reviews. The Department also received a request to revoke one antidumping duty order in part.
Ni-Resist Piston Inserts from the Republic of Korea: Final Negative Countervailing Duty Determination
The Department of Commerce (the Department) determines that countervailable subsidies are not being provided to producers and exporters of Ni-resist piston inserts from the Republic of Korea (Korea).

Pressure Sensitive Plastic Tape From Italy: Notice of Initiation of Antidumping Duty Changed Circumstances Review
In response to a request from Evotape Packaging S.r.l. (Evotape Packaging), a producer/exporter of pressure sensitive plastic tape from Italy, and pursuant to section 751(b) of the Tariff Act of 1930, as amended (the Act), and 19 CFR 351.216 and 351.221(c)(3), the Department is initiating a changed circumstances review of the antidumping duty finding on pressure sensitive plastic tape from Italy. This review is being conducted to determine whether there is a successor-in-interest to Tyco Adhesives Italia S.p.A. (Tyco) for purposes of determining antidumping liability.
Certain Frozen Warmwater Shrimp From Thailand: Final Results and Partial Rescission of Antidumping Duty Administrative Review
On March 9, 2009, the Department of Commerce (the Department) published the preliminary results of the administrative review of the antidumping duty order on certain frozen warmwater shrimp (shrimp) from Thailand. This review covers 135 \1\ producers/exporters of the subject merchandise to the United States. The POR is February 1, 2007, through January 31, 2008.
The Manufacturing Council: Meeting of The Manufacturing Council
The Manufacturing Council will hold a meeting to deliberate a letter of recommendation regarding the U.S. manufacturing industry. The Board was re-chartered on April 10, 2008, to advise the Secretary of Commerce on matters relating to the U.S. manufacturing industry.
Certain Frozen Warmwater Shrimp from the Socialist Republic of Vietnam: Extension of Preliminary Results of Antidumping Duty New Shipper Review
The Department of Commerce (``Department'') is extending the time limit for the preliminary results of the new shipper review of certain frozen warmwater shrimp (``shrimp'') from the Socialist Republic of Vietnam (``Vietnam''). This review covers the period February 1, 2008 through January 31, 2009.
Certain Pasta From Turkey: Preliminary Results of Countervailing Duty Changed Circumstances Review
On January 28, 2009, the Department of Commerce (``the Department'') published a notice of initiation of a changed circumstances review (``CCR'') of the countervailing duty (``CVD'') order on certain pasta from Turkey as requested by Marsan Gida Sanayi ve Ticret A.S. (``Marsan'') See Notice of Initiation of Countervailing Duty Changed Circumstances Review: Certain Pasta from Turkey, 74 FR 4938 (January 28, 2009) (``Initiation Notice''). As stated in the Initiation Notice, we are not applying the antidumping (``AD'') successor-in-interest methodology to determine whether Marsan is the successor to Gidasa Sabanci Gida Sanayi ve Ticaret A.S. (``Gidasa'') for CVD purposes. Id. at 4939. After receiving additional information regarding the circumstances which warranted the CCR of Gidasa, pursuant to the new criteria outlined in the ``Preliminary Results of Changed Circumstances Review'' section below, we preliminarily find that Marsan is not the successor to Gidasa, for purposes of the CVD cash deposit rates, and therefore its merchandise should continue to enter under the ``all others'' cash deposit rate. Interested parties are invited to comment on these preliminary results.
Certain Pasta from Italy: Final Results of the 12th (2007) Countervailing Duty Administrative Review
The U.S. Department of Commerce (``the Department'') has completed its administrative review of the countervailing duty (``CVD'') order on certain pasta from Italy for the period January 1, 2007, through December 31, 2007. On May 28, 2009, we published the Preliminary Results of this review. See Certain Pasta from Italy: Preliminary Results of the 12th (2007) Countervailing Duty Administrative Review, 74 FR 25489 (May 28, 2009) (``Preliminary Results''). We did not receive any comments on the Preliminary Results and have made no revisions. We find that De Matteis Agroalimentare S.p.A. (``De Matteis'') received countervailable subsidies. The final net subsidy rate for De Matteis is listed below in the section entitled ``Final Results of Review.''
Certain Frozen Warmwater Shrimp From the Socialist Republic of Vietnam: Final Results and Final Partial Rescission of Antidumping Duty Administrative Review
On March 9, 2009, the Department of Commerce (``the Department'') published in the Federal Register the preliminary results of the third administrative review of the antidumping duty order on certain frozen warmwater shrimp from the Socialist Republic of Vietnam (``Vietnam''). Certain Frozen Warmwater Shrimp from the Socialist Republic of Vietnam: Preliminary Results, Preliminary Partial Rescission and Request for Revocation, In Part, of the Third Administrative Review, 74 FR 10009 (March 9, 2009) (``Preliminary Results''). We gave interested parties an opportunity to comment on the Preliminary Results. Based upon our analysis of the comments and information received, we made changes to the margin calculations for the final results. We find that certain manufacturers/exporters have not sold subject merchandise at less than normal value (``NV'') during the period of review (``POR'') February 1, 2007, through January 31, 2008.

Certain Frozen Warmwater Shrimp from Ecuador: Final Results of Antidumping Duty Administrative Review
On March 9, 2009, the Department of Commerce (the Department) published the preliminary results of the administrative review of the antidumping duty order on certain frozen warmwater shrimp (shrimp) from Ecuador. This review covers 81 producers/exporters of the subject merchandise to the United States. The period of review (POR) is February 1, 2007, through August 14, 2007.
Stainless Steel Bar From India: Final Results of Antidumping Duty Administrative Review
On March 6, 2009, the Department of Commerce (``Department'') published the preliminary results of the administrative review of the antidumping duty order on stainless steel bar (``SSB'') from India. This review covers sales of SSB from India with respect to one producer/exporter: Venus Wire Industries Pvt. Ltd. (``Venus'') during the period February 1, 2007, through January 31, 2008.
Certain Kitchen Appliance Shelving and Racks from the People's Republic of China: Amended Final Determination of Sales at Less Than Fair Value and Notice of Antidumping Duty Order
Based on affirmative final determinations by the Department of Commerce (the ``Department'') and the International Trade Commission (``ITC''), the Department is issuing an antidumping duty order on certain kitchen appliance shelving and racks from the People's Republic of China (``PRC''). On September 2, 2009, the ITC notified the Department of its affirmative determination of material injury to a U.S. industry. See Certain Kitchen Appliance Shelving and Racks from China (Investigation No. 731-TA-1154 (Final), USITC Publication 4098, (August 2009).
Certain Kitchen Appliance Shelving and Racks From the People's Republic of China: Countervailing Duty Order
On September 2, 2009, the U.S. International Trade Commission (``ITC'') notified the Department of Commerce (``Department'') of its affirmative determinations of material injury to the U.S. refrigeration shelving industry and threat of material injury to the U.S. oven racks industry. See Certain Kitchen Appliance Shelving and Racks from China, USITC Pub. 4098, Investigation 701-TA-458 and 731-TA-1154 (Final) (August 2009). Based on affirmative final determinations by the Department and the ITC, the Department is issuing this countervailing duty order on certain kitchen appliance shelving and racks from the People's Republic of China (``PRC'').
Third Administrative Review of Frozen Warmwater Shrimp From the People's Republic of China: Final Results and Partial Rescission of Antidumping Duty Administrative Review
On March 9, 2009, the Department of Commerce (the ``Department'') published in the Federal Register the Preliminary Results of the third administrative review of the antidumping duty order on certain frozen warmwater shrimp from the People's Republic of China (``PRC'').\1\ We gave interested parties an opportunity to comment on the Preliminary Results. Certain Corrosion-Resistant Carbon Steel Flat Products from the Republic of Korea: Notice of Preliminary Results of the Antidumping Duty Administrative Review
In response to timely requests, the Department of Commerce (the Department) is conducting the fifteenth administrative review of the antidumping order on corrosion-resistant carbon steel flat products (CORE) from the Republic of (Korea). This review covers seven manufacturers and/or exporters (collectively, the respondents) of the subject merchandise: LG Chem., Ltd. (LG Chem), Haewon MSC Co. Ltd. (Haewon), Dongbu Steel Co., Ltd., (Dongbu); Hyundai HYSCO (HYSCO); Pohang Iron & Steel Co., Ltd. (POSCO) and Pohang Coated Steel Co., Ltd. (POCOS) (collectively, POSCO); and Union Steel Manufacturing Co., Ltd. (Union). The period of review (POR) is August 1, 2007, through July 31, 2008. We preliminarily determine that Union made sales of subject merchandise at less than normal value (NV). We preliminarily determine that HYSCO and POSCO have not made sales below NV.
Floor-Standing, Metal-Top Ironing Tables and Certain Parts Thereof from the People's Republic of China: Preliminary Results of Antidumping Duty Administrative Review
In response to requests from interested parties, the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on floor-standing, metal-top ironing tables and certain parts thereof from the People's Republic of China (PRC). The period of review (POR) is August 1, 2007 through July 31, 2008. We have preliminarily determined an antidumping duty margin for Foshan Shunde Yongjian Housewares & Hardware Co., Ltd. (Foshan Shunde) based upon the application of facts available with adverse inference (AFA). We invite interested parties to comment on these preliminary results. We intend to issue final results no later than 120 days from the publication of this notice, pursuant to section 751(a)(3)(A) of the Tariff Act of 1930 as amended (the Act).
