The Department of Commerce (the Department) has preliminarily determined that sales by the respondents in this review, covering the period December 1, 2002, through November 30, 2003, have been made at prices less than normal value (NV). In addition, we are preliminarily rescinding this review with respect to Tianjin Custom Wood Processing Co., Ltd. (TCW), because TCW reported, and we confirmed, that it made no shipments of subject merchandise to the United States during the period of review (POR). If these preliminary results are adopted in the final results of this review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. The Department invites interested parties to comment on these preliminary results.

This rule would serve to carry out the purposes of Executive Order 13312 of July 29, 2003, which implemented the Clean Diamond Trade Act and the Kimberley Process Certification Scheme in the United States.

The National Institute of Standards and Technology announces that it plans to develop Federal Information Processing Standard (FIPS) 140-3, which will supersede FIPS 140-2, Security Requirements for Cryptographic Modules. FIPS 140-2, approved by the Secretary of Commerce and announced in the Federal Register (June 27, 2001, Volume 66, Number 124, Pages 34154-34155), identifies requirements for four levels of security for cryptographic modules that are utilized by Federal agencies to protect the security of Federal information systems. The Federal Information Security Management Act (FISMA) (Public Law 107-347) requires that all Federal agencies and their contractors use only those cryptographic-based security systems that were validated to FIPS 140-2 or to its predecessor, FIPS 140-1.

On July 7, 2004, the Department of Commerce (``Department'') published in the Federal Register the preliminary results of the administrative review of the order on certain stainless steel butt-weld pipe fittings from Taiwan. See Certain Stainless Steel Butt-Weld Pipe Fittings From Taiwan: Preliminary Results of Antidumping Duty Administrative Review and Notice of Intent To Rescind in Part, 69 FR 40859 (July 7, 2004) (``Preliminary Results''). This review covers one manufacturer/exporter of the subject merchandise. The period of review (``POR'') is June 1, 2002, through May 31, 2003. We gave interested parties an opportunity to comment on the preliminary results. Based upon our analysis of the comments received, we have made no changes in the margin calculation. Therefore, the final results have not changed from the Preliminary Results of this review. The final weight-averaged dumping margin is listed below in the section titled ``Final Results of the Review.''

NMFS issues a final rule to remove two technical revisions made in an April 2003 final rule to the northern right whale (Eubalaena sp.) listing under the Endangered Species Act (ESA). The technical revisions purported to change: the way right whales are listed by splitting the endangered northern right whale into two separate endangered species - North Pacific right whale and North Atlantic right whale; the definition of ``right whale'' as it applies to the right whale approach regulations; and the section heading for right whale critical habitat. NMFS has determined that issuance of the 2003 final rule did not comply with the requirements of the ESA. This final rule corrects these mistakes by removing these technical revisions to 50 CFR and reinstating the language that existed before April 2003.

The Cooperative Research and Technology Enhancement Act of 2004 (CREATE Act) amends the patent laws to provide that subject matter developed by another person shall be treated as owned by the same person or subject to an obligation of assignment to the same person for purposes of determining obviousness if three conditions are met: The claimed invention was made by or on behalf of parties to a joint research agreement that was in effect on or before the date the claimed invention was made; the claimed invention was made as a result of activities undertaken within the scope of the joint research agreement; and the application for patent for the claimed invention discloses or is amended to disclose the names of the parties to the joint research agreement. The United States Patent and Trademark Office (Office) is revising the rules of practice in patent cases to implement the CREATE Act.

The National Oceanic and Atmospheric Administration (NOAA) has been mandated to develop and implement a quality assurance program that is equally available to all applicants, under which the Administrator may certify hydrographic products that satisfy standards promulgated by the Administrator. ``Hydrographic products'' are any publicly or commercially available products produced by a non-Federal entity that include or display hydrographic data. The Administrator will fulfill this mandate by establishing procedures by which hydrographic products are proposed for certification; by which standards and compliance tests are developed, adopted, and applied for those products; and by which certification may be awarded or denied. These procedures would be the mandated Quality Assurance Program. The implementation of the program would be the execution of those procedures for specific hydrographic products.

In accordance with the National Environmental Policy Act, OCRM will conduct scoping meetings as an opportunity for federal and state agencies, local governments and their citizenry, and representatives of non-governmental organizations, American Indian tribes, or any other interest persons to identify to OCRM what impacts or issues should be addressed in the Environment Impact Statement (EIS).

In a proposed rule published in the Federal Register on October 12, 2004, NOAA requested comments on proposed revisions to its Civil Procedures which govern the Agency's administrative proceedings for the assessment of civil penalties; suspension, revocation, modification, or denial of permits; issuance and use of written warnings; and release or forfeiture of seized property. The comment period for the proposed rule closed on December 13, 2004. Comments addressed various issues and included requests to extend the comment period. The intent of this document is to announce the reopening of the public comment period.
