Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969 (NEPA), as amended (42 U.S.C. 4321 et seq.), the Natural Resources Conservation Service (NRCS) has prepared a draft programmatic environmental assessment (EA) for the Voluntary Public Access and Habitat Incentive Program (VPA-HIP). The purpose of the draft programmatic EA is to briefly review the effects of activities that are likely to occur when NRCS awards future VPA-HIP grant funds so NRCS can decide whether VPA-HIP is likely to result in significant adverse impacts requiring preparation of an Environmental Impact Statement (EIS). NRCS is soliciting comments on the draft programmatic EA from interested parties for 30 days from the date of this notice. Comments may be sent by mail or email to the contact listed below.
Changes to Existing Conservation Program Regulations

The Agricultural Act of 2014 (the 2014 Act) made several nondiscretionary changes to NRCS conservation programs. These conservation programs have existing regulations that required adjustments. These adjustments include addressing the required review of operating procedures of the State Technical Committee, adding reference of the Regional Conservation Partnership Program (RCPP) to the Watershed Protection and Flood Prevention Act program regulations, adding reference of RCPP to the Healthy Forests Reserve Program (HFRP), expanding the definition of ``acreage owned by Indian Tribes'' under HFRP, revising and simplifying the Regional Equity provision, and adjusting the Agricultural Management Assistance (AMA) Program to correspond with changes to payment provisions under the Environmental Quality Incentives Program (EQIP). Additionally, the Secretary of Agriculture delegated to NRCS administrative responsibility for implementing the Voluntary Public Access and Habitat Incentive Program (VPA-HIP), and internal NRCS administrative changes warrant updating the appropriate delegated official in the Technical Service Provider (TSP) provision. NRCS published an interim rule with a request for comments on August 1, 2014, to implement changes to these NRCS conservation program regulations that were either necessitated by enactment of the 2014 Act, or required to implement administrative streamlining improvements and clarifications. NRCS received six comments on the interim rule. In this document, NRCS issues a final rule to make permanent these changes and to incorporate two minor mandatory changes in two of the affected parts.

This action supplements our proposed amendments to the national emission standards for hazardous air pollutants (NESHAP) for the Primary Aluminum Production source category published in the Federal Register on December 6, 2011. In that action, the Environmental Protection Agency (EPA) proposed amendments based on the initial residual risk and technology reviews (RTR) for this source category, and also proposed certain emission limits reflecting performance of Maximum Achievable Control Technology (MACT). Today's action reflects a revised technology review and a revised residual risk analysis for the Primary Aluminum Production source category and proposes new and revised emission standards based on those analyses, newly obtained emissions test data, and comments we received in response to the 2011 proposal, including certain revisions to the technology-based standards reflecting performance of MACT. This action also proposes new compliance requirements to meet the revised standards. This action, if adopted, will provide improved environmental protection regarding potential emissions of hazardous air pollutant (HAP) emissions from primary aluminum production facilities.

In each of the listed States, NRCS is proposing to issue its State Offsite Methods which will replace existing State wetland mapping conventions. The State Offsite Methods will be used as part of the technical documents and procedures to conduct wetland determinations on agriculture land as part of the Food Security Act of 1985 (as amended). Conservation Innovation Grants Fiscal Year (FY) 2014 Announcement for Program Funding

The Natural Resources Conservation Service (NRCS), an agency under the United States Department of Agriculture (USDA), is announcing availability of Conservation Innovation Grants (CIG) to stimulate the development and adoption of innovative conservation approaches and technologies. Applications will be accepted from all 50 States, District of Columbia, Caribbean Area (Puerto Rico and U.S. Virgin Islands), and the Pacific Islands Area (Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands). NRCS anticipates that the amount available for support of this program in FY 2014 will be up to $15 million. Applications are requested from eligible governmental or non-governmental organizations or individuals for competitive consideration of grant awards for projects between 1 and 3 years in duration. Funds will be awarded through a two-phase nationwide competitive grants process that will include: (1) A pre-proposal process, and (2) a full proposal process. The full proposal process will only be open to applicants whose pre-proposal applications are selected by NRCS. Both phases are described in the full announcement found at Grants.gov. The purpose of this supplement is to address changes which have occurred since the NRCS prepared the Little Otter Creek Watershed Plan and Environmental Impact Statement in 2003. The SEIS will update the original EIS with more recent relevant environmental information and expand the alternatives analysis beyond those previously considered. The SEIS will evaluate reasonable and practicable alternatives and their expected environmental impacts.

In the Monday, November 21, 2011, Federal Register, Vol. 76. No. 224, the Natural Resources Conservation Service (NRCS) announced its intension to prepare an Environmental Impact Statement (EIS) for the rehabilitation of the Upper Deckers Creek Site 1, in Preston County, West Virginia. Preparation of an EIS is no longer planned at this time. The purpose of the project is to bring the dam up to current dam safety standards. NRCS policy requires that an EIS be prepared for watershed project activities that include stream channel realignment, increases in channel capacity, or projects that require congressional action or that have the potential to significantly affect the quality of the human environment. Upon review, it now appears that none of these conditions apply to the Upper Deckers Creek Site 1 dam rehabilitation project. Therefore, NRCS is withdrawing its Notice of Intent to prepare an EIS.

The Natural Resources Conservation Service (NRCS) announces the availability of financial assistance funds in fiscal year (FY) 2012 for up to $11.74 million in the Cooperative Conservation Partnership Initiative (CCPI) and up to $25 million in the Wetlands Reserve Enhancement Program (WREP) through MRBI. These funding levels are available for new MRBI proposals only. However, CCPI and WREP will not be the only funding mechanisms for MRBI in FY 2012. The Chief of NRCS reserves discretion in utilizing other NRCS conservation program funds and mechanisms in support of the objectives of MRBI. Through agreements, partners and NRCS will provide assistance to eligible participants in the 54 designated focus areas (8-digit hydrologic unit codes (HUCs)) in the following 13 States: Arkansas, Illinois, Indiana, Iowa, Kentucky, Louisiana, Minnesota, Mississippi, Missouri, Ohio, Tennessee, South Dakota, and Wisconsin. The purpose of this notice is to solicit proposals from potential partners to enter into agreements with NRCS and to inform agricultural producers and landowners of the future availability of program funds through approved partnership projects. Proposals must be based on one or more 12-digit HUCs within the 54 designated focus areas. Partners who are currently involved in approved MRBI agreements through CCPI or WREP and want to work in other 12-digit watersheds must submit new proposals for a new project.
