Notice of Decision to Issue Permits for the Importation of Sweet Cherries From Australia Into the Continental United States and Hawaii
We are advising the public of our decision to begin issuing permits for the importation into the continental United States and Hawaii of sweet cherries from Australia. Based on the findings of a pest risk analysis, which we made available to the public for review and comment through a previous notice, we believe that the application of one or more designated phytosanitary measures will be sufficient to mitigate the risks of introducing or disseminating plant pests or noxious weeds via the importation of sweet cherries from Australia.
Cotton Research and Promotion Program: Determination of Whether To Conduct a Referendum Regarding the 1990 Amendments to the Cotton Research and Promotion Act
This notice announces the U.S. Department of Agriculture's (USDA) determination not to conduct a continuance referendum regarding the 1991 amendments to the Cotton Research and Promotion Order (Order) provided for in the Cotton Research and Promotion Act (Act) amendments of 1990. This determination is based on the results of a sign-up period conducted September 3 through November 30, 2007, during which eligible cotton producers and importers were provided an opportunity to request a continuance referendum.
Summer Food Service Program for Children; Program Reimbursement for 2008
This notice informs the public of the annual adjustments to the reimbursement rates for meals served in the Summer Food Service Program for Children (SFSP). These adjustments reflect changes in the Consumer Price Index and are required by the statute governing the Program. In addition, further adjustments are made to these rates to reflect the higher costs of providing meals in the States of Alaska and Hawaii, as authorized by the William F. Goodling Child Nutrition Reauthorization Act of 1998.
Change in Disease Status of Surrey County, England, Because of Foot-and-Mouth Disease
We are amending the regulations governing the importation of certain animals, meat, and other animal products by removing Surrey County, England, from the list of regions considered to be free of foot-and-mouth disease (FMD). We are taking this action because the existence of FMD has been confirmed in that area. This action is necessary to prevent the introduction of FMD into the United States. As a result of this interim rule the importation of ruminants and swine and the fresh meat and other animal products of ruminants and swine from Surrey County, England, is restricted.
Hiawatha National Forest; Michigan; Niagara EIS
The East Administrative Unit of the Hiawatha National Forest intends to prepare an environmental impact statement (EIS) to disclose the environmental consequences of a vegetation and transportation management project. See the SUPPLEMENTARY INFORMATION section for the purpose of and need for the action.
Notice of Request for Revision of a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995, this notice announces Rural Development's intention to request a revision for a currently approved information collection in support of loan programs administered by the Rural Housing Service, Business- Cooperative Service, and Rural Utilities Service.
Irish Potatoes Grown in Colorado; Modification of the Handling Regulation for Area No. 2
This rule modifies the minimum size requirements under the Colorado potato marketing order, Area No. 2. The marketing order regulates the handling of Irish potatoes grown in Colorado, and is administered locally by the Colorado Potato Administrative Committee, Area No. 2 (Committee). The minimum size requirements for Area No. 2 potatoes specify that potatoes handled under the marketing order must be at least 2 inches in diameter or 4 ounces in weight, with exceptions allowing the handling of round potatoes of any weight, and Russet Burbank, Russet Norkotah, and Silverton Russet potato varieties with a minimum of 1\7/8\ inches in diameter or 4 ounces in weight. This rule removes the exception that Russet Burbank, Russet Norkotah, and Silverton Russet potato varieties may be 1\7/8\ inches in diameter, thus requiring these varieties to also meet the minimum requirements of 2 inches in diameter or 4 ounces in weight. This change is intended to facilitate the handling and marketing of Colorado Area No. 2 potatoes.

The Southern Region Recreation Resource Advisory Committee will hold its third meeting at Staybridge SuitesAtlanta Perimeter Center East, 4601 Ridgeview Road in Atlanta, Georgia. Citrus Canker; Interstate Movement of Regulated Nursery Stock From Quarantined Areas
We are reopening the comment period for our interim rule that amended the citrus canker quarantine regulations to explicitly prohibit, with limited exceptions, the interstate movement of regulated nursery stock from a quarantined area. One of those exceptions was a provision that allows calamondin and kumquat plants, two types of citrus plants that have been considered to be highly resistant to citrus canker, to be moved interstate from a quarantined area under a protocol designed to ensure that they are free of citrus canker prior to movement. However, following publication of the interim rule, several samples from calamondin plants growing in a quarantined area were found to be infected with citrus canker. Based on that finding, it appears that it will be necessary to remove calamondin plants from the protocol when we publish an upcoming rule that will finalize the interim rule. Before we publish that final rule, however, we are reopening the comment period for the interim rule to provide interested persons with an opportunity to prepare and submit comments regarding calamondin plants and the interstate movement protocol.
Importation of Cattle From Mexico; Addition of Port at San Luis, AZ
We are proposing to amend the regulations regarding the importation of cattle from Mexico by adding San Luis, AZ, as a port through which cattle that have been infested with fever ticks or exposed to fever ticks or tick-borne diseases may be imported into the United States. A new facility for the handling of animals is to be constructed on the Mexican side of the border at the port of San Luis, AZ, that will be equipped with facilities necessary for the proper chute inspection, dipping, and testing that are required for such cattle under the regulations. We would also amend the regulations to remove provisions that limit the admission of cattle that have been infested with fever ticks or exposed to fever ticks or tick-borne diseases to the State of Texas. The statutory requirement that limited the admission of those cattle to the State of Texas has been repealed. These proposed changes would make an additional port of entry available and relieve restrictions on the movement of imported Mexican cattle within the United States.
Announcement of Value-Added Producer Grant Application Deadlines
The Rural Business-Cooperative Service (RBS) announces the availability of approximately $18.4 million in competitive grant funds for fiscal year (FY) 2008 to help independent agricultural producers enter into value-added activities. Awards may be made for planning activities or for working capital expenses, but not for both. The maximum grant amount for a planning grant is $100,000 and the maximum grant amount for a working capital grant is $300,000.
Mexican Fruit Fly; Removal of Quarantined Area
We are amending the Mexican fruit fly regulations by removing Willacy County, TX, from the list of quarantined areas and thus removing restrictions on the interstate movement of regulated articles from this area. This action is necessary to relieve restrictions that are no longer needed to prevent the spread of the Mexican fruit fly into noninfested areas of the United States. We have determined that the Mexican fruit fly no longer exists in Willacy County, TX, and that the quarantine and restrictions are no longer necessary.
Notice of Request for Extension of Approval of an Information Collection; Gypsy Moth Identification Worksheet
In accordance with the Paperwork Reduction Act of 1995, this notice announces the Animal and Plant Health Inspection Service's intention to request an extension of approval of an information collection associated with the gypsy moth program.
Request for Proposals (RFP): Farm Labor Housing Technical Assistance Grants
This RFP announces an availability of funds and the timeframe to submit proposals for Farm Labor Housing Technical Assistance (FLH- TA) grants. USDA Rural Development administers the programs of the Rural Housing Service. Section 516(i) of the Housing Act of 1949 as amended, authorizes the Rural Development to provide financial assistance (grants) to eligible private and public nonprofit agencies, which includes faith-based organizations, and to encourage the development of domestic and migrant farm labor housing projects. This RFP solicits proposals from qualified private and public nonprofit agencies on how they will provide technical assistance to groups who qualify for FLH loans and grants. Work performed under these grants is expected to result in an increased submission of applications for farm labor housing loans and grants under the section 514 and 516 programs.
Oranges, Grapefruit, Tangerines, and Tangelos Grown in Florida; Hearing on Proposed Amendment of Marketing Agreement 84 and Order No. 905
Notice is hereby given of a public hearing to receive evidence on proposed amendments to Marketing Agreement No. 84 and Order No. 905 (order), which regulate the handling of oranges, grapefruit, tangerines, and tangelos (citrus) grown in Florida. Four amendments are proposed by the Citrus Administrative Committee (committee), which is responsible for local administration of the order. These proposed amendments would: modify committee representation by cooperative entities; allow additional alternates to represent absent members of the committee to better meet quorum requirements; add authority to conduct committee meetings by telephone or other means of communication; and add authority for marketing promotions, including paid advertising, and production research for fresh Florida citrus. In addition, the Agricultural Marketing Service (AMS) proposes to make any such changes as may be necessary to the order to conform to any amendment that may result from the hearing. These proposed amendments are intended to improve the operation and administration of the order.
National Fluid Milk Processor Promotion Program: Invitation To Submit Comments on Proposed Amendments to the Fluid Milk Promotion Order
This document invites comments on a proposed amendment to the Fluid Milk Promotion Order (Order). The proposed amendment, requested by the National Fluid Milk Processor Promotion Board (Board), which administers the Order, would reduce the burden of late-payment charges applied to processors who underreport the amount of assessments which they owe to the Board, provided that the processor has not made more than two reporting errors in the prior 12 months. This amendment would reduce the burden of late-payment charges on processors who underpay assessments due to unintentional errors or miscalculations. The Board believes the late-payment charge is a necessary provision of the Order to encourage payment by all processors subject to the assessment and helps ensure the receipt of assessments owed to the Board. However, the Board also believes that there are instances when unintentional errors and miscalculations occur, and in such cases, the late-payment charge could be viewed as excessive. All other provisions of the Order would remain unchanged.
Salmonella Verification Sampling Program: Response to Comments and New Agency Policies
The Food Safety and Inspection Service (FSIS) is announcing new policies for the Agency's Salmonella Verification Sampling Program and related activities conducted in meat and poultry establishments. These changes include publication of completed FSIS verification sample set results for establishments that show inconsistency in their ability to meet Salmonella performance standards, beginning with those from young chicken slaughter establishments; a voluntary incentive-based program for meat and poultry establishments that should yield significant data on attribution of human illness to FSIS-regulated products; and increasing the Agency's use of targeted sampling approaches and collaborative serotype and subtype data. FSIS is taking these actions to advance its efforts to achieve the Agency's public health goal of significantly reducing human cases of salmonellosis. This Notice explains the basis for these actions and responds to comments received by the Agency on its Federal Register Notice of February 27, 2006 (71 FR 9772-9777) on Salmonella policy.
Announcement of Grant Application Deadlines and Funding Levels for the Assistance to High Energy Cost Rural Communities
The Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or the Agency, announces the availability of $6.8 million in Fiscal Year 2008 for competitive grants to assist communities with extremely high energy costs. This grant program is authorized under section 19 of the Rural Electrification Act of 1936 (RE Act) (7 U.S.C. 918a) and program regulations at 7 CFR part 1709. The grant funds may be used to acquire, construct, extend, upgrade, or otherwise improve energy generation, transmission, or distribution facilities serving communities in which the average residential expenditure for home energy exceeds 275 percent of the national average. Eligible applicants include persons, States, political subdivisions of States, and other entities organized under State law. Federally-recognized Indian tribes and tribal entities are eligible applicants. This notice describes the eligibility and application requirements, the criteria that will be used by the Agency to award funding, and information on how to obtain application materials. Household Water Well System Grant Program Announcement of Application Deadlines and Funding
The Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development, announces its Household Water Well System (HWWS) Grant Program application window for Fiscal Year (FY) 2008. In addition to announcing the application window, Rural Development announces the available funding and maximum amounts for HWWS competitive grants for the fiscal year. The HWWS Grant Program is authorized under Section 6012 of the Farm Security and Rural Investment Act of 2002 (the Act), Public Law 107- 171. The Act authorizes Rural Development to make grants to qualified private non-profit organizations to establish lending programs for household water wells. For FY 2008, the HWWS grant funding available is $993,000. Non-profit organizations will use the grants to make loans to individual homeowners to construct or upgrade a household water well system for an existing home. The organizations must contribute an amount equal to at least 10 percent of the grant request to capitalize the loan fund. Applications may be submitted in paper or electronic format. The HWWS Grant Program regulations are contained in 7 CFR part 1776.
Announcement of Funding Availability and Solicitation of Applications
The Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or Agency, announces its Distance Learning and Telemedicine (DLT) grant, combination loan-grant and loan program application windows for Fiscal Year (FY) 2008. In addition to announcing the application windows, the Agency announces the available funding and the minimum and maximum amounts for DLT grants, combination loan-grants and loans applicable for the fiscal year. The Distance Learning and Telemedicine Grant Program was authorized by the 1990 Farm Bill to provide grants to rural schools and health care providers. The 1996 Farm Bill reauthorized the Distance Learning and Telemedicine Grant Program and established a new loan component. The Distance Learning and Telemedicine (DLT) Program is specifically designed to meet the educational and health care needs of rural America through the use of advanced telecommunications technologies.

The Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or Agency, announces its Public Television Digital Transition Grant Program application window for Fiscal Year (FY) 2008. In addition to announcing the application window, Rural Development announces the available funding and maximum amounts for the Public Television Station Digital Transition Grant Program competitive grants for the fiscal year. The Public Television Digital Transition Grant Program is authorized through the Distance Learning and Telemedicine Grant Program. Funds from the Public Television Digital Transition Grant Program are awarded to public television stations which are a noncommercial educational television broadcast station that qualify for Community Service Grants by the Corporation for Public Broadcasting under section 396(k) of the Communications Act of 1934. These grants enable public television stations in rural areas to replace current analog television broadcasting equipment with digital television broadcasting equipment as part of the national transition to digital television service.

The Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development, announces its Revolving Fund Program (RFP) application window for Fiscal Year (FY) 2008. In addition to announcing the application window, Rural Development announces the available funding and maximum amounts for RFP competitive grants for the fiscal year. The RFP is authorized under the 2002 Farm Bill (the Farm Security and Rural Investment Act of 2002), Public Law 107-171. Qualified private non-profit organizations will receive RFP grant funds to establish a lending program for eligible entities. Eligible entities for the revolving loan fund will be the same entities eligible to obtain a loan, loan guarantee, or grant from the Rural Development Utilities Programs Water and Waste Disposal loan and grant programs.

Resurrection Creek Restoration Phase II Project Environmental Impact Statement
The Chugach National Forest, Seward Ranger District will prepare an environmental impact statement for the implementation of a stream and riparian restoration project along a two-mile segment of Resurrection Creek within active mining claims. The environmental impact statement will evaluate the environmental consequences of the proposed restoration project and will also address a supplemental mining plan of operations proposing mining adjacent to the restoration corridor.
Superior National Forest, LaCroix Ranger District, MN; Border Project Environmental Impact Statement
The Department of Agriculture, Forest Service, will prepare an environmental impact statement (EIS) for the Border Project. The proposed activities would manage forest vegetation composition, structure, and spatial patterns. Proposed activities also address the transportation system associated with vegetation activities and long- term federal, non-federal, and public access needs. The Project Area encompasses about 57,000 acres of National Forest System land. The Proposed Action would create young forest through timber harvest on about 8,617 acres; improve stand structure and within-stand diversity with harvests such as thinning on about 3,730 acres; and restore stand conditions without harvest on about 1,904 acres. Managing the minimum road system needed for long-term vegetation management would involve adding 1.6 miles of system road and decommissioning 9.2 miles of road. A range of alternatives, including a no-action alternative, will be developed to respond to significant issues. The proposed project is located on the LaCroix Ranger District, Cook, Minnesota, Superior National Forest.

National Advisory Committee on Meat and Poultry Inspection
The Food Safety and Inspection Service (FSIS) is announcing, pursuant to the Federal Advisory Committee Act, 5 U.S.C. App. 2, that the National Advisory Committee on Meat and Poultry Inspection (NACMPI) will hold a public meeting on February 5-6, 2008, to review and discuss: (1) The planned public health-based slaughter inspection system for young chickens and (2) how a similar approach could be used for inspection in processing and other slaughter establishments. Both issues will be presented to the full Committee. The Committee will then divide into two subcommittees to discuss both issues. Each subcommittee will provide a report of their comments and recommendations to the full committee before the meeting concludes on February 6, 2008.
Wasatch-Cache National Forest, UT; West Bear Landscape Management Project
The USDA Forest Service announces its intent to prepare a Supplemental Environmental Impact Statement (SEIS) to the West Bear Vegetation Management Project Final Environment Impact Statement (FEIS). The West Bear Vegetation Management Project FEIS evaluated three alternatives using timber harvest and prescribed fire as management tools to treat vegetation. The treatment is intended to move the West Bear landscape towards properly functioning condition (PFC).
Notice of Funds Availability: Inviting Applications for the Emerging Markets Program
The Commodity Credit Corporation (CCC) announces the availability of funding for the Emerging Markets Program (EMP) for fiscal year (FY) 2008. The intended effect of this notice is to solicit applications from the private sector and from government agencies for FY 2008 and award funds in early 2008. The EMP is administered by personnel of the Foreign Agricultural Service (FAS).
Notice of Proposed Changes to the Natural Resources Conservation Service's National Handbook of Conservation Practices
It is NRCS's intention to issue a series of new or revised conservation practice standards in its National Handbook of Conservation Practices. These standards include: ``Filter Strip (Code 393),'' ``Hillside Ditch (Code 423),'' ``Access Control (formerly titled Use Exclusion) (Code 472),'' ``Drainage Water Management (Code 554),'' ``Vegetated Treatment Area (formerly titled Wastewater Treatment Strip) (Code 635),'' and ``Constructed Wetland (Code 656).'' NRCS State Conservationists who choose to adopt these practices for use within their States will incorporate them into Section IV of their respective electronic Field Office Technical Guides. These practices may be used in conservation systems that treat highly erodible land (HEL) or on land determined to be a wetland.
Request for Extension With Revision of a Currently Approved Information Collection; Representation for CCC and FSA Loans Authorization To File a Financing Statement
In accordance with the Paperwork Reduction Act of 1995, the Commodity Credit Corporation (CCC) and the Farm Service Agency (FSA) is seeking from all interested individuals and organizations on an extension with revision of a currently approved information collection associated with form CCC-10 used to support the CCC and FSA Farm Loan Programs (FLPs).
Bull Run Watershed Management Unit Agreement, Multnomah County, OR
The Mt. Hood National Forest (Forest) in coordination with the City of Portland Water Bureau (City) has prepared a new Bull Run Watershed Management Unit Agreement pursuant to Public Law 95-200, section 2(d). This Agreement will guide and be applicable to all occupancy, use, and management of the Bull Run Watershed Management Unit by the City and the Forest. This Agreement replaces the 1979 Memorandum of Understanding (MOU). This new Agreement provides the revised administrative direction and agreements needed to structure the parties' roles, responsibilities, business processes, and working relationships for the coming decades. The Agreement was approved on December 17, 2007. Umpqua National Forest, Douglas County, Oregon; D-Bug Hazard Reduction Timber Sale Project
The USDA Forest Service will prepare an environmental impact statement (EIS) for reducing fuels, improving forest stand conditions, salvaging present and future bark beetle mortality, and creating fuel breaks around the Diamond Lake and Lemolo Lake Wildland Urban Interface (WUI) areas, and along evacuation routes that lead to and from these areas. Fuel loadings have increased due to fire exclusion and an ongoing bark beetle outbreak in both lodgepole and mixed conifer stands throughout the area. This EIS will be prepared under the authority of the Healthy Forest Restoration Act (HFRA). The project proposes variable density commercial thinning on about 3,146 acres of lodgepole pine, leaving between 20-50 trees per acre (TPA), interspersed with 10% of the area with no treatment; commercial thinning from below on about 2,244 acres of mixed conifer stands, leaving 50-200 TPA; overstory removal on 59 acres of lodgepole pine stands, leaving about 20 TPA; non-commercial treatment of fuels using pre-commercial thinning, mastication, whip felling, chipping, piling and burning on about 2,013 acres; treating all activity-created fuels by underburning, crushing, machine piling, masticating, handpile burning, and/or yarding tops attached; using 25 miles of existing unclassified roads to access thinning/treatment areas, then decommissioning about 5 miles that are not used for trails or as the old highway; building 15 miles of new temporary spur roads for access, then decommissioning them after use; road reconstruction and maintenance throughout the planning area; and use of existing rock pits; all acreages and miles are approximate and are refined during sale layout. The project includes amending the 1990 Umpqua National Forest Land and Resource Management Plan (LRMP). The planning area is located approximately 75 miles east of Roseburg, Oregon. The project is expected to be implemented starting in Fiscal Year 2009. The agency gives notice of the full environmental analysis and decision-making process that will occur on the proposal so that interested and affected people may become aware of how they can participate in the process and contribute to the final decision.
