Tennessee Valley Authority, Combined License Application for Bellefonte Units 3 and 4 Exemption from the Requirements to Submit an Update to the Departures Report Submitted With a Combined License Application
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an October 28, 2013, request from Tennessee Valley Authority (TVA). On September 29, 2010, TVA requested that the NRC suspend review of its combined license (COL) application until further notice. On October 28, 2013, TVA requested an exemption from certain regulatory requirements that require them to submit a departures report that describes the generic changes and plant-specific departures from the generic Design Certification Document (DCD) (departures report) until requesting the NRC to resume its review of their COL application. The NRC staff reviewed this request and determined that it is appropriate to grant the exemption, but stipulated that the departures report must be submitted prior to requesting the NRC resume its review of the COL application or by December 31, 2014, whichever comes first.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an October 28, 2013, request from Tennessee Valley Authority (TVA). Tennessee Valley Authority: Exemption From Requirements To Revise Combined License Application To Address Enhancements to Emergency Preparedness Rules
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an October 28, 2013, request from Tennessee Valley Authority (TVA). On September 29, 2010, TVA requested that the NRC suspend review of its combined license application until further notice. On October 28, 2013 TVA requested an exemption from certain regulatory requirements which, if granted, would allow them to revise their combined license (COL) application in order to address enhancements to the Emergency Preparedness (EP) rules at the same time as requesting the NRC to resume the review of their COL application rather than by December 31, 2013 as the regulations currently require. The NRC staff reviewed this request and determined that it is appropriate to grant the exemption but stipulated that the revised application must be submitted prior to requesting the NRC resume its review of the COL application or by December 31, 2014 whichever comes first.

The Nuclear Regulatory Commission (NRC) is rescheduling a public meeting that was cancelled due to inclement weather and extending the public comment period for a proposed rule and draft guidance on material control and accounting (MC&A) of special nuclear material (SNM). The public meeting has been rescheduled for January 9, 2014. The public comment period has been extended to March 10, 2014, in response to a request by stakeholders.

We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR Part 19, Notices, Instructions, and Reports to Workers: Inspection and Investigations. 2. Current OMB approval number: 3150-0044. 3. How often the collection is required: As necessary in order that adequate and timely reports of radiation exposure be made to individuals involved in NRC-licensed activities. 4. Who is required or asked to report: Licensees authorized to receive, possess, use, or transfer material licensed by the NRC. 5. The number of annual respondents: 700. 6. The number of hours needed annually to complete the requirement or request: 213,517.5 7. Abstract: Title 10 of the Code of Federal Regulations, Part 19, requires licensees to advise workers on an annual basis of any radiation exposure in excess of 1mSv (100 mrem) they may have received as a result of NRC-licensed activities or when certain conditions are met. These conditions apply during termination of the worker's employment, at the request of the workers, former workers, or when the worker's employer (the NRC licensee) must report radiation exposure information on the worker to the NRC. Part 19 also establishes requirements for instructions by licensees to individuals participating in licensed activities and options available to these individuals in connection with Commission inspections of licensees to ascertain compliance with the provisions of the Atomic Energy Act of 1954, as amended, Title II of the Energy Reorganization Act of 1974, and regulations, orders and licenses there under regarding radiological working conditions. The worker should be informed of the radiation dose he or she receives because: (a) That information is needed by both a new employer and the individual when the employee changes jobs in the nuclear industry; (b) the individual needs to know the radiation dose received as a result of the accident or incident (if this dose is in excess of the 10 CFR Part 20 limits) so that he or she can seek counseling about future work involving radiation, medical attention, or both, as desired; and (c) since long-term exposure to radiation may be an adverse health factor, the individual needs to know whether the accumulated dose is being controlled within NRC limits. The worker also needs to know about health risks from occupational exposure to radioactive materials or radiation, precautions or procedures to minimize exposure, worker responsibilities and options to report any licensee conditions which may lead to or cause a violation of Commission regulations, and individual radiation exposure reports which are available to him. The number of annual respondents: 37 (14 Agreement States respondents with sites of interest + 23 Agreement States respondents with no sites of interest). 6. The number of hours needed annually to complete the requirement or request: 469 (400 hours from Agreement States with sites of interest + 69 hours from Agreement States with no sites of interest). 7. Abstract: Agreement States will be asked to provide information about uranium recovery and complex sites undergoing decommissioning regulated by the Agreement States on an annual basis. The information request will allow the NRC to compile, in a centralized location, more complete information on the status of decommissioning and decontamination in the United States in order to provide a national perspective on decommissioning. The information will be made available to the public by the NRC in order to ensure openness and promote communication to enhance public knowledge of the national decommissioning program. This does not apply to information, such as trade secrets and commercial or financial information provided by the Agreement States, that is considered privileged or confidential. Information such as financial assurance and the status of decommissioning funding would need to be identified by the Agreement State as privileged or confidential, whereupon the NRC would withhold such information from public access and treat it as sensitive or non- sensitive, per the considerations in 10 CFR 2.390 and 9.17. This does not apply to financial assurance or decommissioning funding information that is already available to the public. Although specific details of the funding mechanisms are treated as confidential, beneficial lessons learned regarding the improvement of decommissioning-related funding will be shared with the Agreement States. The U.S. Nuclear Regulatory Commission (NRC) is correcting a direct final rule that appeared in the Federal Register on December 6, 2013, and is delaying the effective date. The direct final rule amends the NRC's spent fuel storage regulations by revising the Holtec International HI-STORM 100 Cask System listing within the ``List of Approved Spent Fuel Storage Casks'' to include Amendment No. 9 to Certificate of Compliance (CoC) No. 1014. This action is necessary to correct the NRC's Agencywide Documents Access and Management System (ADAMS) accession numbers for the CoC, the safety evaluation report (SER), and the ADAMS document package containing the CoC, SER, and the Technical Specifications (TSs) for this amendment.
Consideration of Approval of Transfer of Renewed Facility Operating Licenses, Materials Licenses, and Conforming Amendments Containing Sensitive Unclassified Non-Safeguards Information
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by Constellation Energy Nuclear Group, LLC (Constellation) on August 6, 2013, as supplemented on August 14 and September 23, 2013. The application seeks NRC approval of the transfer of operating licenses for nuclear power plants and spent fuel storage facilities from the current holder, Constellation, to Exelon Generation Company, LCC (Exelon). The facilities are Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2, Renewed Facility Operating License Nos. DPR-53 and DPR-69; Calvert Cliffs Independent Spent Fuel Storage Installation (ISFSI) Materials License No. SNM-2505; Nine Mile Point Nuclear Station, Unit Nos. 1 and 2, Renewed Facility Operating License Nos. DPR-63 and NPF-69; Nine Mile Point Nuclear Station ISFSI General License; R.E. Ginna Nuclear Power Plant Renewed Facility Operating License No. DPR-18; and R.E. Ginna ISFSI General License.

The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of four amendment requests. The amendment requests are for H.B. Robinson Steam Electric Plant, Unit 2; Peach Bottom Atomic Power Station, Units 2 and 3; St. Lucie Plant, Units 1 and 2; and Diablo Canyon Nuclear Power Plant, Units 1 and 2. For each amendment request, the NRC proposes to determine that they involve no significant hazards consideration. In addition, each amendment request contains sensitive unclassified non-safeguards information (SUNSI).

The NRC staff reviewed this request and determined that it is appropriate to grant the exemption, but stipulated that the updates to the FSAR must be submitted by December 31, 2014.
Security Requirements for Facilities Storing Spent Nuclear Fuel
The U.S. Nuclear Regulatory Commission (NRC), published, on December 16, 2009, a notice of availability and request for comment on the NRC's draft regulatory basis [previously known as the technical basis] document for a proposed rulemaking that would revise the security requirements for storing spent nuclear fuel (SNF) in an independent spent fuel storage installation (ISFSI), and for storing SNF and/or high-level radioactive waste (HLW) in a monitored retrievable storage installation (MRS). The draft regulatory basis, comments on the draft regulatory basis, and the NRC staff's responses to these comments, are located on the Federal e-Rulemaking Web site at https://www.rulemaking.gov under Docket ID: NRC-2009-0558 and copies may also be obtained using the other methods specified below.
Exelon Generation Company, LLC Three Mile Island Nuclear Station, Unit 1
Exelon Generation Company, LLC (Exelon, the licensee) is the holder of Renewed Facility Operating License No. DPR-50, which authorizes operation of the Three Mile Island Nuclear Station, Unit 1 (TMI-1). The license provides, among other things, that the facility is subject to all rules, regulations, and orders of the Nuclear Regulatory Commission (NRC) now or hereafter in effect.

The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of a license amendment to special nuclear material (SNM) license number SNM-33 issued to Westinghouse Electric Company, LLC for the former Hematite Fuel Cycle Facility in Festus, Missouri authorizing alternative disposal of soil and soil-like wastes at the US Ecology Idaho, Inc. (USEI) disposal facility located near Grand View, Idaho. In addition, the NRC is considering the issuance of an exemption to USEI so that it may accept the waste for disposal. This exemption is required so that USEI may accept NRC regulated material under its Idaho Department of Environmental Quality license. The NRC has prepared an Environmental Assessment (EA) for this proposed action and has concluded that a Finding of No Significant Impact is appropriate with respect to the proposed action.

License Renewal Application for Grand Gulf Nuclear Station, Unit 1
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft, plant-specific, supplement 50 to the Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, NUREG-1437, regarding the renewal of operating license NPF-29 for an additional 20 years of operation for Grand Gulf Nuclear Station, Unit 1 (GGNS). The GGNS is located in Claiborne County, Mississippi. Possible alternatives to the proposed action (license renewal) include no action and reasonable alternative energy sources. The NRC staff plans to hold two public meetings during the public comment period to present an overview of the draft plant-specific supplement to the GEIS and to accept public comments on the document.

The NRC staff reviewed this request and determined that it is appropriate to grant the exemption, but stipulated that the updates to the FSAR must be submitted prior to requesting the NRC resume its review of the COL application, or by December 31, 2014, whichever comes first.

On July 29, 2013, DEP requested an exemption from certain regulatory requirements which, if granted, would allow them to revise their COL application in order to address enhancements to the Emergency Preparedness (EP) rules within six months of requesting the NRC to resume the review of their COL application, rather than by December 31, 2013, as the regulations currently require. The NRC staff reviewed this request and determined that it is appropriate to grant the exemption, but stipulated that the revised application must be submitted prior to requesting the NRC resume its review of the COL application or by December 31, 2014, whichever comes first.
