Agency Information Collection Activities: Submission for the Office of Management and Budget (OMB) Review; Comment Request
The NRC has recently submitted to OMB for review the following proposal for the collection of information under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The title of the information collection: NRC Form 313, ``Application for Materials License'' and NRC Forms 313A (RSO), 313A (AMP), 313A (ANP), 313A (AUD), 313A (AUT), and 313A (AUS). 3. Current OMB approval number: 3150-0120. 4. The form number if applicable: NRC Forms 313 and 313A. 5. How often the collection is required: There is a one-time submittal of the NRC form 313 (which may include the NRC form 313A series of forms) with information to receive a license. Once a specific license has been issued, there is a 10-year resubmittal of the NRC Form 313 (which may include the NRC form 313A series of forms) with information for renewal of the license. Amendment requests are submitted as needed by the licensee. There is a one-time submittal for all limited specific medical use applicants of a NRC Form 313A series form to have each new individual identified as a Radiation Safety Officer (RSO), authorized medical physicist (AMP), authorized nuclear pharmacist (ANP), or authorized user or a subsequent submittal of additional information for one of these individuals to be identified with a new authorization on a limited specific medical use license. NRC Form 313A (RSO) is also used by medical broad scope licensees when identifying a new individual as an RSO or adding an additional RSO authorization for the individual. This submittal may occur when applying for a new license, amendment, or renewal. NRC Form 313A (ANP) is also used by commercial nuclear pharmacy licensees when requesting an individual be identified for the first time as ANP. This submittal may occur when applying for a new license, amendment, or renewal. 6. Who will be required or asked to report: All applicants requesting a license, amendment or renewal of a license for byproduct or source material. 7. An estimate of the number of annual responses: 15,127 (2,365 NRC licensees and 12,762 Agreement State licensees). 8. Abstract: Applicants must submit NRC Form 313, which may include the six forms in the 313A series, to obtain a specific license to possess, use, or distribute byproduct or source material. These six forms in the 313A series are: (1) NRC Form 313A (RSO), (``Radiation Safety Officer Training and Experience and Preceptor Attestation;'' (2) NRC Form 313A (AMP), (``Authorized Medical Physicist Training and Experience and Preceptor Attestation;'' (3) NRC Form 313A (ANP), ``Authorized Nuclear Pharmacist Training and Experience and Preceptor Attestation;'' (4) NRC Form 313A (AUD), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.100, 35.200, and 35.500);'' (5) NRC Form 313A (AUT), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.300);'' and (6) NRC Form 313A (AUS), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.400 and 35.600).'' Office of New Reactors; Supplement to Interim Staff Guidance; Limited Work Authorizations Solicitation of Public Comment
The NRC is issuing a supplement to its Proposed Interim Staff Guidance (ISG) COL/ESP-ISG-004 for use and comment. This supplemental guidance would be added, along with the resolution of other issues identified in comments received from the public, to COL/ESP-ISG-004 to provide clarifications and examples related to the definition of construction. This additional guidance is intended to clarify the delineation of preconstruction activities and those activities that require prior NRC approval (i.e., construction activities). Upon receiving public comments, the NRC staff will evaluate and disposition the comments, as appropriate. Once the NRC staff completes the COL/ESP-ISG, including this supplemental information, the staff will issue it for use. The NRC staff will also incorporate the approved COL/ESP-ISG-004 into the next revisions of the Regulatory Guide 1.206, ``Combined License Applications for Nuclear Power Plants,'' and related guidance documents.
Steering Committee on Multimedia Environmental Modeling
The annual public meeting of the Federal Interagency Steering Committee on Multimedia Environmental Modeling (ISCMEM) will convene to discuss new operational initiatives for FY 2009 among the participating agencies. The meeting is open to the public and all interested parties may attend.
Natural Resources Defense Council; Receipt of Petition for Rulemaking; Reopening of Public Comment Period
On May 27, 2008 (73 FR 30321), the Nuclear Regulatory Commission (NRC) published for public comment a notice of receipt of a petition for rulemaking, dated March 24, 2008, which was filed with the Commission by Thomas B. Cochran and Matthew G. McKinzie on behalf of the Natural Resources Defense Council. The petition was docketed by the NRC on April 3, 2008, and has been assigned Docket No. PRM-50-90. On August 4 and August 6, 2008, several external stakeholder groups requested a 45 day extension of the public comment period owing to the details provided in the initial petition, short initial comment period, importance of the rulemaking, and the need for directly impacted stakeholders to provide substantive comments to the rulemaking process. The NRC is reopening the comment period on the petition for an additional 45 days from the original August 11, 2008 deadline. The comment period closes on September 25, 2008.
Office of New Reactors; Interim Staff Guidance on Assessment of Normal and Extreme Winter Precipitation Loads on the Roofs of Seismic Category I Structures
The NRC is soliciting public comment on its Proposed Interim Staff Guidance (ISG) DC/COL-ISG-07 (ADAMS Accession No. ML081980084). The purpose of this ISG is to clarify the NRC position on identifying winter precipitation events as site characteristics and site parameters for determining normal and extreme winter precipitation loads on the roofs of Seismic Category I structures. This ISG revises the previously issued staff guidance in March 2007 in the Standard Review Plan (SRP) NUREG-0080, ``Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants.'' The NRC staff issues DC/COL-ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for design certifications (DCs) and combined licenses (COLs) by the Office of New Reactors. The NRC staff will also incorporate the approved DC/COL-ISG- 007 into the next revision of the SRP and related guidance documents.
Notice of Availability of Regulatory Issue Summary 2008-18; Information on Requests for Extending Use of Expiring Transportation Packages
The NRC staff has issued Regulatory Issue Summary (RIS) 2008- 18, Information on Requests for Extending Use of Expiring Transportation Packages. The RIS is intended to provide information to licensees and certificate holders who may request NRC consideration on a case-by-case basis for limited domestic use of transportation packages beyond the October 1, 2008, expiration date. The RIS does not impose any additional regulatory requirements on NRC licensees.

Abstract: 10 CFR Part 20 establishes standards for protection against ionizing radiation resulting from activities conducted under licenses issued by the NRC. These standards require the establishment of radiation protection programs, maintenance of radiation protection programs, maintenance of radiation records recording of radiation received by workers, reporting of incidents which could cause exposure to radiation, submittal of an annual report to NRC of the results of individual monitoring, and submittal of license termination information. These mandatory requirements are needed to protect occupationally exposed individuals from undue risks of excessive exposure to ionizing radiation and to protect the health and safety of the public. Abstract: 10 CFR Part 9 prescribes procedures for individuals making requests for records under the Freedom of Information Act (FOIA) or Privacy Act (PA). It contains information collection requirements for requests to waive or reduce fees for searching for and reproducing records in response to FOIA requests; appeals of denied requests; and requests for expedited processing. The information required from the public is necessary to justify requests for waivers or reductions in searching or copying fees; or to justify expedited processing. Section 9.28(b) provides that if the submitter of information designated to be trade secrets or confidential commercial or financial information objects to the disclosure, he must provide a written statement within 30 days that specifies all grounds why the information is a trade secret or commercial or financial information that is privileged or confidential. Clarified Requirements When Licensees Depart From a License Condition or Technical Specification in an Emergency; Proposed Generic Communication
The U.S. Nuclear Regulatory Commission (NRC) is proposing to issue a regulatory issue summary (RIS) to clarify the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.54(y) when licensees implement 10 CFR 50.54(x) to depart from a license condition or technical specification in an emergency. Alternate Fracture Toughness Requirements for Protection Against Pressurized Thermal Shock Events
The Nuclear Regulatory Commission (NRC) is considering the adoption of provisions regarding applicability of the rule and new provisions regarding procedures to perform surveillance data checks related to the updated fracture toughness requirements for protection against pressurized thermal shock (PTS) events for pressurized water reactor (PWR) pressure vessels. The NRC is considering these provisions as an alternative to the provisions previously noticed for public comment on October 3, 2007 (72 FR 56275).
The Attorney General of Commonwealth of Massachusetts, The Attorney General of California; Denial of Petitions for Rulemaking
The NRC is denying two petitions for rulemaking (PRM), one filed by the Attorney General of the Commonwealth of Massachusetts (Massachusetts AG) and the other filed by the Attorney General for the State of California (California AG), presenting nearly identical issues and requests for rulemaking concerning the environmental impacts of the high-density storage of spent nuclear fuel in large water pools, known as spent fuel pools (SFPs). The Petitioners asserted that ``new and significant information'' shows that the NRC incorrectly characterized the environmental impacts of high-density spent fuel storage as ``insignificant'' in its National Environmental Policy Act (NEPA) generic environmental impact statement (EIS) for the renewal of nuclear power plant licenses. Specifically, the Petitioners asserted that spent fuel stored in high-density SFPs is more vulnerable to a zirconium fire than the NRC concluded in its NEPA analysis.
Dominion Nuclear Connecticut, Inc.; Millstone Power Station, Unit 3; Final Environmental Assessment and Finding of No Significant Impact Related to the Proposed License Amendment To Increase the Maximum Reactor Power Level
The NRC has prepared a final Environmental Assessment (EA) as its evaluation of a request by the Dominion Nuclear Connecticut, Inc., (DNC or the licensee), for a license amendment to increase the maximum thermal power at the Millstone Power Station, Unit 3 (Millstone 3), from 3,411 megawatts thermal (MWt) to 3,650 MWt. The NRC staff did not identify any significant impact from the information provided in the licensee's stretch power uprate (SPU) application for Millstone 3 or from the NRC staff's independent review. Therefore, the NRC staff is documenting its environmental review in a final EA. The final EA and Finding of No Significant Impact are being published in the Federal Register. The NRC published a draft EA and finding of no significant impact on the proposed action for public comment in the Federal Register on June 4, 2008 (73 FR 31894). There were no comments received by the comment period expiration date of July 7, 2008.
Medical Use of Byproduct Material-Amendments/Medical Event Definitions
The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations that govern medical use of byproduct material related to reporting and notifications of medical events (MEs) to clarify requirements for permanent implant brachytherapy. The proposed amendments would change the criteria for defining an ME for permanent implant brachytherapy from dose-based to activity-based; add a requirement to report, as an ME, any administration requiring a written directive (WD) if a WD was not prepared; clarify requirements for WDs for permanent implant brachytherapy; and make certain administrative and clarification changes. These amendments regarding permanent implant brachytherapy are being proposed in response to several incidents involving therapeutic use of byproduct material. The proposed changes are based in part on recommendations from NRC's Advisory Committee on the Medical Use of Isotopes (ACMUI) and the NRC's Medical Radiation Safety Team. This proposed rule would affect all medical licensees that perform procedures using byproduct material that require completion of a WD.
Office of New Reactors;
The NRC is soliciting public comment on its Proposed Interim Staff Guidance (ISG) DC/COL-ISG-06 (ADAMS Accession No. ML081850160). This ISG is to clarify the U.S. Nuclear Regulatory Commission (NRC) position on what is an acceptable level of detail and content for demonstrating compliance with Title 10 of the Code of Federal Regulations Section 20.1406 (10 CFR 20.1406). Regulatory Guide (RG) 4.21, ``Minimization of Contamination and Waste Generation: Life Cycle Planning,'' provides an acceptable method of demonstrating compliance. This ISG provides further clarification on the evaluation and acceptance criteria that will be used by NRC staff in reaching a reasonable assurance finding that a Design Certification (DC) or Combined License (COL) applicant has complied with the requirements of 10 CFR 20.1406. The NRC staff issues DC/COL-ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for DC and COLs by the Office of New Reactors. The NRC staff will also incorporate the approved DC/COL-ISG-006 into the next revision of the Standard Review Plan and related guidance documents.
