Proposed Generic Communication; Clarification of Post-Fire Safe-Shutdown Circuit Regulatory Requirements

The U.S. Nuclear Regulatory Commission (NRC) is proposing to issue a regulatory information summary (RIS) to clarify regulatory requirement issues associated with post-fire safe-shutdown circuit analyses and protection, particularly the requirements of Title 10 of the Code of Federal Regulations, Part 50 (10 CFR 50), Appendix R, which have been interpreted by licensees in a manner that is not consistent with regulatory expectations. The industry and NRC regional inspectors have requested clarification of regulatory expectations with respect to post-fire safe-shutdown circuits. In addition, clarification of these requirements will assist licensees in evaluating the transition to a risk-informed, performance-based fire protection program. Three terms are to be addressed in this RIS: ``any-and-all'' (with respect to spurious actuations), ``associated circuits,'' and ``emergency control station.'' Clarification of the term ``one-at-a- time'' (with respect to spurious actuations) will be provided in a separate generic communication. For each term addressed, this RIS identifies the applicable NRC regulatory requirement, provides the regulatory expectation with respect to the requirement, and specifies one acceptable approach to achieving regulatory compliance. Attachment 1 to this RIS provides additional discussion that explains the basis for the regulatory expectations, including a discussion of the various ways in which each term or phrase has been interpreted by stakeholders. This RIS also gives the staff's views on the use of Nuclear Energy Institute (NEI) guidance document NEI 00-01, ``Guidance for Post-Fire Safe Shutdown Circuit Analysis,'' Revision 1 (ML050310295), in complying with Appendix R. The deterministic methodology presented in NEI 00-01, in conjunction with the guidance in this RIS, is one acceptable approach to achieving regulatory compliance with post-fire safe-shutdown circuit protection requirements. Note that RIS 2004-03, Revision 1, ``Risk-Informed Approach for Post-Fire Safe-Shutdown Circuit Inspections'' (ML042440791) provides guidance on conducting risk-informed circuit inspections, whereas this RIS clarifies the regulatory requirements for compliance with Appendix R. Abstract: 10 CFR part 52 establishes requirements for the granting of early site permits, certifications of standard nuclear power plant designs, and licenses which combine in a single license a construction permit, and an operating license with conditions (combined licenses), manufacturing licenses, standard design approvals, and pre-application reviews of site suitability issues. Part 52 also establishes requirements for renewal of those approvals, permits, certifications, and licenses; amendments to them; exemptions from certifications; and variances from early site permits. NRC uses the information collected to assess the adequacy and suitability of an applicant's site, plant design, construction, training and experience, and plans and procedures for the protection of public health and safety. The NRC review of such information and the findings derived from that information from the basis of NRC decisions and actions concerning the issuance, modification, or revocation of site permits, design certifications, combined licenses, and manufacturing licenses for nuclear power plants. Notice is hereby given that the staff of the Nuclear Regulatory Commission (NRC) has prepared a model safety evaluation (SE) relating to changes in Combustion Engineering (CE) plant required action end state requirements in technical specifications (TS). The NRC staff has also prepared a model no-significant-hazards-consideration (NSHC) determination relating to this matter. The purpose of these models is to permit the NRC to efficiently process amendments that propose to adopt technical specifications changes, designated as TSTF- 422, related to Topical Report CE NPSD-1186, Rev. 00, ``Technical Justification for the Risk Informed Modification to Selected Required Action End States for CEOG PWRs,'' which was approved by an NRC SE dated July 17, 2001. Licensees of CE nuclear power reactors to which the models apply could then request amendments, confirming the applicability of the SE and NSHC determination to their reactors. The NRC staff is requesting comment on the model SE and model NSHC determination prior to announcing their availability for referencing in license amendment applications.

This Federal Register notice announces the availability of two final reports, prepared by the Sewage Sludge Subcommittee of the Interagency Steering Committee on Radiation Standards (ISCORS), addressing radioactivity in sewage sludge and ash at publicly owned treatment works (POTWs). The first report, ``ISCORS Assessment of Radioactivity in Sewage Sludge: Modeling to Assess Radiation Doses,'' assesses the potential levels of radiation doses to people from radioactivity in sewage sludge, by modeling the transport of radioactivity from sludge into the local environment. The report also provides a complete description and justification of the dose assessment methodology. The second report, ``ISCORS Assessment of Radioactivity in Sewage Sludge: Recommendations on Management of Radioactive Materials in Sewage Sludge and Ash at Publicly Owned Treatment Works,'' is written for POTW operators. This report is intended to (1) alert POTW operators and others to the possibility of radioactive materials concentrating in sewage sludge and incinerator ash, (2) inform operators how to determine if there are elevated levels of radioactivity in their sludge, and (3) assist POTW operators in identifying further actions that may be taken to reduce potential radiation exposures from sludge and ash.
