Federal Acquisition Regulation: Inflation Adjustment of Acquisition-Related Thresholds
DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to further implement the statute which requires an adjustment every five years of statutory acquisition- related thresholds for inflation. The adjustment uses the Consumer Price Index for all urban consumers, and does not apply to the Construction Wage Rate Requirements statute (Davis-Bacon Act), Service Contract Labor Standards statute, and trade agreements thresholds. DoD, GSA, and NASA are also proposing to use the same methodology to adjust nonstatutory FAR acquisition-related thresholds in 2020.

DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to implement statutory and regulatory changes regarding joint ventures made by the Small Business Administration (SBA) in its final rule published in the Federal Register on July 25, 2016, and to clarify that 8(a) joint ventures are not certified into the 8(a) program and that 8(a) joint venture agreements need only be approved by the SBA prior to contract award.

DoD, GSA, and NASA are issuing a final rule amending the Federal Acquisition Regulation (FAR) to withhold a 2 percent tax on contract payments made by the United States Government to foreign persons pursuant to certain contracts. This rule applies to Federal Government contracts for goods or services that are awarded to foreign persons.

Office of Acquisition Policy; Establishment of Online Portal for GSA Guidance Documents
In accordance with Executive Order (E.O.) 13891, ``Promoting the Rule of Law Through Improved Agency Guidance Documents,'' dated October 9, 2019, and Office of Management and Budget (OMB) Memorandum M-20-02, dated October 31, 2019, GSA established an online portal for the public to access GSA guidance documents. Although GSA did not identify agency guidance that falls under the auspices of E.O. 13891 in terms of effecting the behavior of regulated parties, the portal provides links to GSA program web pages, which contain internal GSA guidance documents, in support of the intent of E.O. 13891.

Notice of Availability of the Revised Draft Environmental Impact Statement for the Expansion and Modernization of the San Luis I Land Port of Entry, San Luis, Arizona
This notice announces the availability, and opportunity for public review and comment, of the revised Draft Environmental Impact Statement (DEIS), which analyzes the potential environmental impacts of a proposal by the General Services Administration (GSA) to expand and modernize the San Luis I Land Port of Entry (LPOE) located in San Luis, Arizona along the U.S.-Mexico international border. During the draft EIS review period in April 2019, multiple comments were received, including one comment which identified a new alternative to be included in the analysis. Therefore, GSA determined that the Draft EIS would be re-released for public review that includes the new alternative. The revised DEIS describes the project purpose and need, the alternatives being considered, and the potential impacts of each alternative on the existing environment. As the lead agency for this undertaking, GSA is acting on behalf of its major tenant at the facility, the Department of Homeland Security's U.S. Customs and Border Protection (CBP).
Premium Class Transportation Reporting Requirements
GSA is publishing the reporting requirements for the use of other than coach class, also known as ``premium class'' transportation by Government employees on official travel. This bulletin also clarifies which accommodations are not considered premium class, and are therefore not reportable. Revision to Foreign Gift Minimal Value
GSA, in consultation with the U.S. Department of State, must redefine the minimal value of foreign gift items to reflect changes in the Consumer Price Index (CPI) for the preceding 3-year period, as specified under the law concerning the Receipt and Disposition of Foreign Gifts and Decorations. The minimal value was last defined effective January 1, 2017, and must be redefined effective as of January 1, 2020. This bulletin cancels FMR Bulletin B-41, ``Foreign Gift and Decoration Minimal Value,'' issued January 12, 2017, as this bulletin provides updated information on the same topic.

Federal Management Regulation (FMR); Utility Services
GSA is issuing a final rule to amend the Federal Management Regulation (FMR) part regarding utility services. The rule clarifies the authority an agency must have in order to procure utility services and describes in detail agencies' responsibilities concerning the procurement of such services. To better direct agencies that operate under a utility service delegation from GSA, the rule adds a reference to the section of the Federal Acquisition Regulation (FAR) that addresses the acquisition of utility services and other procurement guidance. Additionally, the rule clarifies responsibilities for the Department of Defense and the Department of Energy for compliance.
