Special Local Regulations, Choptank River, Cambridge, MD
The Coast Guard is proposing to establish special local regulations for certain waters of the Choptank River. This action is necessary to provide for the safety of life on navigable waters located at Cambridge, MD, during a high-speed power boat racing event on October 9, 2021, and October 10, 2021. This proposed rulemaking would prohibit persons and vessels from being in the regulated area unless authorized by the Captain of the Port Maryland-National Capital Region or Coast Guard Event Patrol Commander. We invite your comments on this proposed rulemaking.
Airworthiness Directives; Airbus Helicopters Deutschland GmbH Helicopters
The FAA proposes to supersede Airworthiness Directive (AD) 2019-05-06, which applies to Airbus Helicopters Deutschland GmbH (Airbus Helicopters) Model EC135P1, EC135P2, EC135P2+, EC135P3, EC135T1, EC135T2, EC135T2+, and EC135T3 helicopters. AD 2019-05-06 requires replacing the retaining ring, inspecting the hoist cable hook assembly, and, if necessary, replacing the elastomeric energy absorber. Since the FAA issued AD 2019-05-06 the design approval holder (DAH) has designed an updated hook assembly, which, when installed, terminates the repetitive inspections required by AD 2019-05-06. This proposed AD would continue to require the actions specified in AD 2019-05-06, and would also require a modification or replacement of the hoist cable hook assembly that would terminate the repetitive inspections and retaining ring replacements, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Diamond Aircraft Industries GmbH Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for all Diamond Aircraft Industries GmbH Models DA 42, DA 42 NG, and DA 42 M-NG airplanes. This proposed AD was prompted by mandatory continuing airworthiness information (MCAI) originated by an aviation authority of another country to identify and correct an unsafe condition on an aviation product. The MCAI describes the unsafe condition as failure of the nose landing gear (NLG) actuator attachment lever and detachment from the NLG leg. This proposed AD would require repetitively inspecting the NLG actuator attachment lever for cracks and damage and taking any necessary corrective actions. The FAA is proposing this AD to address the unsafe condition on these products.
Safety Zone; Brandon Road Lock and Dam to Lake Michigan Including Des Plaines River, Chicago Sanitary and Ship Canal, Chicago River, and Calumet-Saganashkee Channel; Chicago River Between the Michigan Avenue Bridge and Columbus Drive Bridge, Chicago, IL
The Coast Guard will enforce a safety zone, on the main branch of the Chicago River between the Michigan Avenue Bridge and the Columbus Drive Bridge for the Chicago Ducky Derby Marine Event. During the enforcement period, entry into, transiting, mooring, laying-up, or anchoring within the established safety zone is prohibited unless authorized by the Captain of the Port Lake Michigan or an on-scene designated representative.
Airworthiness Directives; Airbus Canada Limited Partnership (Type Certificate Previously Held by C Series Aircraft Limited Partnership (CSALP); Bombardier, Inc.) Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Airbus Canada Limited Partnership Model BD-500-1A10 and BD- 500-1A11 airplanes. This proposed AD was prompted by a report indicating that during production, the manual opening and closing of the over-wing emergency exit door (OWEED) prior to the installation of the OWEED interior panel could have resulted in damaged insulation blankets below the left and right OWEEDs. This proposed AD would require a one-time inspection for damage of the insulation blankets below the left and right OWEEDs, and replacement if necessary, as specified in a Transport Canada Civil Aviation (TCCA) AD, which is proposed for incorporation by reference. The FAA is proposing this AD to address the unsafe condition on these products.
Amendment of Area Navigation (RNAV) Route Q-34; Northeastern United States
This action amends Area Navigation (RNAV) route Q-34 in the northeastern United States in support of the Northeast Corridor Atlantic Coast Route Project (NEC ACR) for improved efficiency of the National Airspace System (NAS) while reducing the dependency on ground based navigational systems.
Airworthiness Directives; De Havilland Aircraft of Canada Limited (Type Certificate Previously Held by Bombardier, Inc.) Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain De Havilland Aircraft of Canada Limited Model DHC-8-400, - 401, and -402 airplanes. This proposed AD was prompted by a report of cracking found on a main landing gear (MLG) drag strut assembly. This proposed AD would require a records review to determine if an affected MLG drag strut assembly is installed, repetitive detailed inspections for cracking of affected strut assemblies, a one-time magnetic particle inspection for cracking, and on-condition actions if necessary. The FAA is proposing this AD to address the unsafe condition on these products.
Medicaid Program; Reassignment of Medicaid Provider Claims
This proposed rule would reinterpret the scope of the general requirement that state payments for Medicaid services under a state plan must be made directly to the individual practitioner providing services, in the case of a class of practitioners for which the Medicaid program is the primary source of revenue. Specifically, this proposal, if finalized, would explicitly authorize states to make payments to third parties to benefit individual practitioners by ensuring health and welfare benefits, training, and other benefits customary for employees, if the practitioner consents to such payments to third parties on the practitioner's behalf.

This action amends the Class D airspace and Class E airspace at Carbondale, IL, and Marion, IL; revokes the Class E airspace area designated as an extension to Class D airspace at Veterans Airport of Southern Illinois, Marion, IL; and establishes Class E airspace extending upward from 700 feet above the surface at Southern Illinois Airport, Carbondale/Murphysboro, IL. This action is the result of an airspace review caused by the decommissioning of the Marion very high frequency (VHF) omnidirectional range (VOR) navigation aid as part of the VOR Minimum Operational Network (MON) Program. The names and geographic coordinates of the airports are also being updated to coincide with the FAA's aeronautical database.
Amendment of Class D and Class E Airspace and Revocation of Class E Airspace; Columbus, OH
This action amends the Class D airspace and Class E airspace at Columbus, OH, and revokes the Class E airspace extending upward from 700 feet above the surface at Darby Dan Airport, Columbus, OH. This action is the result of an airspace review caused by the decommissioning of the Rickenbacker International Airport runway 5R middle marker and the cancellation of the instrument procedures at Darby Dan Airport. The name and geographic coordinates of the various airports are also being updated to coincide with the FAA's aeronautical database.

This action amends Class E surface area and Class E airspace extending upward from 700 feet above the surface at Massena International-Richards Field Airport, Massena, NY. The FAA is taking this action as a result of an airspace review caused by the decommissioning of the Massena Very High Frequency Omnidirectional Range (VOR) Tactical Air Navigation (VORTAC) navigation aid as part of the VOR Minimum Operational Network (MON) Program. This action also updates the geographic coordinates of Massena International-Richards Field Airport, Massena, NY, to coincide with the FAA's database. Controlled airspace is necessary for the safety and management of instrument flight rules (IFR) operations in the area.

This action amends Class D airspace by removing unnecessary verbiage from the description, and Class E surface airspace in Savannah, GA, by updating the dividing line between Savannah/Hilton Head International Airport and Hunter Army Airfield, and separating the descriptions of the two airports under the surface E airspace. Controlled airspace is necessary for the safety and management of instrument flight rules (IFR) operations in the area.
Effluent Limitations Guidelines and Standards for the Steam Electric Power Generating Point Source Category.
In accordance with President Biden's Executive Order 13990, Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis (January 25, 2021), the U.S. Environmental Protection Agency (EPA) announces its decision to undertake a rulemaking that will propose to revise the Steam Electric Power Generating Effluent Limitations Guidelines and Standards. As part of the rulemaking process, EPA will determine whether more stringent limitations and standards are appropriate and consistent with the technology-forcing statutory scheme and the goals of the Clean Water Act. EPA intends to sign the notice of proposed rulemaking for public comment in the Fall of 2022.

Conservation Stewardship Program (CSP); Corrections
The Commodity Credit Corporation (CCC) revised the Conservation Stewardship Program (CSP) regulation in the final rule published in the Federal Register on October 9, 2020, in response to public comments. Changes were published in the final rule that revised the definition for resource-conserving crop. As part of a recent review, a technical error in the definition of ``resource-conserving crop'' was discovered. This document corrects the error. In addition, there was an inadvertent error and the definition for ``resource- conserving crop rotation'' needs to be reinstated; the definition remains unchanged from the interim rule as published in the Federal Register on November 12, 2019.
Endangered and Threatened Wildlife and Plants; Endangered Species Status for the Sierra Nevada Distinct Population Segment of the Sierra Nevada Red Fox
We, the U.S. Fish and Wildlife Service (Service), determine endangered species status under the Endangered Species Act of 1973 (Act), as amended, for the Sierra Nevada Distinct Population Segment (DPS) of the Sierra Nevada red fox (Vulpes vulpes necator) (hereafter referred to in this rule as the Sierra Nevada DPS). The Sierra Nevada red fox is a small mammal occurring in California and Oregon, with the Sierra Nevada DPS of this broader taxon inhabiting the highest elevations of the Sierra Nevada mountain range in California. This rule adds the Sierra Nevada DPS of Sierra Nevada red fox to the List of Endangered and Threatened Wildlife.
Endangered and Threatened Wildlife and Plants; 12-Month Determination on a Petition To Revise Critical Habitat for the Mount Graham Red Squirrel
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month determination on a petition to revise critical habitat for the Mount Graham red squirrel (Tamiasciurus hudsonicus grahamensis) under the Endangered Species Act of 1973, as amended (Act). The petition requests that the Service expand the subspecies' critical habitat designation to include currently occupied mixed conifer habitat and all historically occupied habitat outside the current critical habitat designation. Our 12-month determination is that we intend to assess revisions to the subspecies' critical habitat after a species status assessment and revised recovery plan for the Mount Graham red squirrel are completed.
Energy Conservation Program: Test Procedure for Microwave Ovens
On November 14, 2019, the U.S. Department of Energy (``DOE'') published a notice of proposed rulemaking (``NOPR'') for the test procedure for microwave ovens. Following receipt of comments, DOE is publishing this supplemental notice of proposed rulemaking (``SNOPR'') for the limited purpose of clarifying the current procedure for testing a microwave oven that has a connected (i.e., network) function, which is generally to disable the connected function when measuring standby mode power consumption. Further, DOE proposes to explicitly specify in its test procedure that standby power be measured with the connected function enabled if the means for disabling the network function are not provided in the manufacturer's user manual. DOE is seeking comment from interested parties on the proposal.
Air Plan Approval; WA; Update to Materials Incorporated by Reference
The Environmental Protection Agency (EPA) is updating the regulatory materials incorporated by reference into the Washington State Implementation Plan (SIP). The regulations addressed in this action were previously submitted by the Washington Department of Ecology and approved by the EPA in prior rulemakings. This action is an administrative change that updates the SIP materials available for public inspection at the National Archives and Records Administration and the EPA Regional Office.
Simplification of Deposit Insurance Rules
The Federal Deposit Insurance Corporation is seeking comment on proposed amendments to its regulations governing deposit insurance coverage. The proposed rule would simplify the deposit insurance regulations by establishing a ``trust accounts'' category that would provide for coverage of deposits of both revocable trusts and irrevocable trusts, and provide consistent deposit insurance treatment for all mortgage servicing account balances held to satisfy principal and interest obligations to a lender.
Air Plan Approval; Nevada, Las Vegas Valley; Second 10-Year Carbon Monoxide Limited Maintenance Plan
The Environmental Protection Agency (EPA) is proposing to approve a Nevada State Implementation Plan (SIP) revision submitted by the Nevada Department of Environmental Protection (NDEP). On September 27, 2010, the EPA redesignated the Las Vegas Valley area from nonattainment to attainment for the carbon monoxide (CO) national ambient air quality standard (NAAQS or ``standard'') and approved the State's CO maintenance plan ensuring the area would maintain the NAAQS for ten years through 2020. On June 18, 2019, NDEP submitted to the EPA a second 10-year limited maintenance plan (LMP) for the Las Vegas Valley area for the CO NAAQS. The LMP addresses maintenance of the CO NAAQS for a second 10-year period ending in 2030.
Extension of Expiration Date for Neurological Disorders Body System Listings
We are extending the expiration date of the body system, Neurological Disorders, in the Listing of Impairments (listings) in our regulations. We are making no other revisions to this body system in this final rule. This extension ensures that we will continue to have the criteria we need to evaluate neurological impairments at step three of the sequential evaluation processes for initial claims and continuing disability reviews.
Wireline Competition Bureau Sets Service Delivery Date for Emergency Connectivity Fund Program Initial Application Filing Window and Modifies Funding Application Certification Language
In this document, the Wireline Competition Bureau (Bureau) establishes a June 30, 2022, service delivery date for equipment and other non-recurring services funding requests filed during the initial application filing window of the Emergency Connectivity Fund Program, if the equipment or services have not been received at the time the funding request is made. The Bureau also modifies the certification language of the Commission's rules to clarify that applicants may request funding for eligible equipment and services that have not yet been ordered for the upcoming school year (i.e., July 1, 2021 through June 30, 2022).
Proposed Amendment of Class E Airspace; Mooresville, NC
This action proposes to amend Class E airspace extending upward from 700 feet above the surface for Lake Norman Airpark, Mooresville, NC, by removing Lowe's Mooresville Heliport from the description, as the heliport has closed and airspace is no longer required. This action would enhance the safety and management of controlled airspace within the national airspace system. Also, during the airspace review the FAA determined a radius increase was required at Lake Norman Airpark. In addition, the FAA proposes to remove unnecessary verbiage that references Class E airspace in Statesville, NC, and Concord, NC. Controlled airspace is necessary for the safety and management of instrument flight rules (IFR) operations in the area.
Airworthiness Directives; Embraer S.A. Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Embraer S.A. Models EMB-500 and EMB-505 airplanes. This proposed AD was prompted by a report that the operational envelope does not contain airspeed limitations and procedures for operating the airplane at static air temperatures below -54 [deg]C. This proposed AD would require revising the airplane flight manual (AFM) to incorporate new and revised airspeed limitations and procedures. The FAA is proposing this AD to address the unsafe condition on these products.

In this rulemaking action, EPA is proposing to approve source-specific (also referred to as ``case-by-case'') RACT determinations for sources at fourteen major sources submitted by PADEP. These RACT evaluations were submitted to meet RACT requirements for the 1997 and 2008 8-hour ozone national ambient air quality standards (NAAQS). This action is being taken under the Clean Air Act (CAA).

Air Plan Approval; Missouri; Restriction of Emissions From Lithographic and Letterpress Printing Operations
The Environmental Protection Agency (EPA) is taking final action to approve a State Implementation Plan (SIP) revision submitted by the State of Missouri on November 10, 2020. This final action will amend the SIP to revise a Missouri regulation which restricts volatile organic compound emissions from lithographic and letterpress printing operations in the St. Louis Metropolitan Area. Specifically, the State has revised this rule in order to clarify rule applicability, update incorporation by reference information, update test method references, clarify definitions, and remove unnecessary words to improve clarity. Approval of these revisions will ensure consistency between State and federally-approved rules.
Temporary Safety Zone; Loveless Wedding Fireworks, Omena, MI
The Coast Guard is establishing a temporary safety zone for a fireworks display off the shore of the Omena Traverse Yacht Club in Omena, MI. The safety zone is needed to protect personnel, vessels, and the marine environment from potential hazards created by fireworks display. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Captain of the Port Sault Sainte Marie or a designated representative.

The Coast Guard is establishing temporary safety zones in all navigable waters extending 420 feet in all directions around fireworks barges at eight different locations on the Lake of the Ozarks. These safety zones are needed to protect personnel, vessels, and the marine environment from potential hazards created by the fireworks displays. Entry of vessels or persons into these zones is prohibited unless specifically authorized by the Captain of the Port Sector Upper Mississippi River or a designated representative.
Implementing Certain Provisions of the TICKETS Act and Revisions to Denied Boarding Compensation and Domestic Baggage Liability Limits
The U.S. Department of Transportation (Department or DOT) published a final rule to, among other things, raise the liability limits for denied boarding compensation that U.S. and foreign air carriers may impose from the current figures of $675 and $1,350 to $775 and $1,550. That final rule became effective on April 13, 2021. This document corrects an editorial error in the rule text of that final rule. This document also makes several technical corrections to the regulation regarding oversales reporting.

The U.S. Department of Transportation (Department or DOT) published a final rule to amend the Department's Air Carrier Access Act (ACAA) regulation on the transport of service animals by air in the Federal Register on December 10, 2020. This document corrects the omission of an example in the applicability section of the rule text by adding it.
Endangered and Threatened Wildlife and Plants; Revision of Critical Habitat for the Southern Resident Killer Whale Distinct Population Segment
We, NMFS, issue a final rule to revise the critical habitat designation for the Southern Resident killer whale (Orcinus orca) distinct population segment (DPS) under the Endangered Species Act (ESA) by designating six additional coastal critical habitat areas along the U.S. West Coast. Specific newly designated areas along the U.S. West Coast include 15,910 square miles (mi\2\) (41,207 square kilometers (km\2\)) of marine waters between the 20-feet (ft) (6.1- meter (m)) depth contour and the 656.2-ft (200-m) depth contour from the U.S. international border with Canada south to Point Sur, California. We have excluded one area, the Quinault Range Site (including a 10-km buffer around a portion of the site), comprising 1,400.4 mi\2\ (3627 km\2\), from the critical habitat designation because we have determined that the benefits of exclusion outweigh the benefits of inclusion, and exclusion will not result in extinction of the species.

In accordance with section 110 of the Clean Air Act (CAA), the Environmental Protection Agency (EPA) is proposing to approve State Implementation Plan (SIP) revisions submitted by North Dakota on August 3, 2020. The revisions contain amendments to the State's Air Pollution Control Regulations and to the State's Legal Authority.

The Food and Drug Administration (FDA, the Agency, or we) is issuing a final rule to amend its medical product ``intended use'' regulations. This final rule amends FDA's regulations describing the types of evidence relevant to determining whether a product is intended for use as a drug or device under the Federal Food, Drug, and Cosmetic Act (FD&C Act), the Public Health Service Act (PHS Act), and FDA's implementing regulations, including whether a medical product that is approved, cleared, granted marketing authorization, or exempted from premarket notification is intended for a new use. This action also withdraws and replaces the portions of a final rule issued on January 9, 2017, that never became effective.
Business Loan Program Temporary Changes; Paycheck Protection Program-COVID Revenue Reduction Score, Direct Borrower Forgiveness Process, and Appeals Deferment
This interim final rule implements changes related to the forgiveness of loans made under the Paycheck Protection Program (PPP), which was originally established under the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) to provide economic relief to small businesses nationwide adversely impacted by the Coronavirus Disease 2019 (COVID-19), as amended. SBA has issued a number of interim final rules implementing the PPP Program. This interim final rule further streamlines the forgiveness process for PPP loans of $150,000 or less by allowing lenders to use a COVID Revenue Reduction Score at the time of forgiveness to document the required revenue reduction for Second Draw PPP Loans, and establishing a direct borrower forgiveness process for lenders that choose to opt-in as an alternative method of processing loan forgiveness applications. This interim final rule also extends the loan deferment period for those PPP loans where the borrower timely files an appeal of a final SBA loan review decision with the SBA Office of Hearings and Appeals.

Endangered and Threatened Wildlife and Plants; Lesser Prairie-Chicken; Threatened Status With Section 4(d) Rule for the Northern Distinct Population Segment and Endangered Status for the Southern Distinct Population Segment
We, the U.S. Fish and Wildlife Service (Service), are extending the comment period on our June 1, 2021, proposed rule to list two distinct population segments (DPSs) of the lesser prairie-chicken (Tympanuchus pallidicinctus), a grassland bird known from southeastern Colorado, western Kansas, eastern New Mexico, western Oklahoma, and the Texas Panhandle under the Endangered Species Act of 1973, as amended (Act). We are extending the proposed rule's comment period for 30 days to give all interested parties an additional opportunity to comment on the proposed rule. Comments previously submitted need not be resubmitted as they are already incorporated into the public record and will be fully considered in the final rule.

The rulemaking was initiated to establish a special local regulation during the ``Chesapeake Challenge/Solomons Offshore Grand Prix,'' a marine event to be held on certain waters of the Patuxent River, between the Governor Thomas Johnson (MD Route 4) Bridge and the West Patuxent Basin at U.S. Naval Air Station Patuxent River, MD. The proposed rule is being withdrawn because it is no longer necessary. The event sponsor has cancelled the power boat racing event.
Endangered and Threatened Wildlife and Plants; Removing Adiantum vivesii From the Federal List of Endangered and Threatened Plants
We, the U.S. Fish and Wildlife Service (Service), propose to remove the plant Adiantum vivesii (no common name) from the Federal List of Endangered and Threatened Plants (List). Our review of the best available scientific and commercial data, including peer reviewer comments received on the 5-year status review (2008), indicate that A. vivesii is not a distinct species, but rather a sterile hybrid that does not have the capacity to establish a lineage that could be lost to extinction. Therefore, A. vivesii is not a listable entity under the Endangered Species Act of 1973, as amended (Act).
Airworthiness Directives; Airbus SAS Airplanes
The FAA is adopting a new airworthiness directive (AD) for certain Airbus SAS Model A350-941 and -1041 airplanes. This AD was prompted by a determination that new or more restrictive airworthiness limitations are necessary. This AD requires revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations, as specified in two European Union Aviation Safety Agency (EASA) ADs, which are incorporated by reference. The FAA is issuing this AD to address the unsafe condition on these products.

This AD was prompted by a determination that new or more restrictive airworthiness limitations are necessary. This AD requires revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations, as specified in a European Union Aviation Safety Agency (EASA) AD, which is incorporated by reference. This AD also requires, for certain airplanes, an update of the hydraulic monitoring system to include additional redundancy. The FAA is issuing this AD to address the unsafe condition on these products.
Airworthiness Directives; MHI RJ Aviation ULC (Type Certificate Previously Held by Bombardier, Inc.) Airplanes
The FAA is adopting a new airworthiness directive (AD) for certain MHI RJ Aviation ULC Model CL-600-2D15 (Regional Jet Series 705) and CL-600-2D24 (Regional Jet Series 900) airplanes. This AD was prompted by a report that the lower aft outboard supporting structure of galley 2 does not meet certification requirements for all flight and/or emergency landing loads. This AD requires modifying the floor structure between certain fuselage stations. The FAA is issuing this AD to address the unsafe condition on these products.
Airworthiness Directives; Brantly Helicopters Industries U.S.A. Co., Ltd., and Brantly International, Inc., Helicopters
The FAA proposes to adopt a new airworthiness directive (AD) for certain Brantly Helicopters Industries U.S.A. Co., Ltd., Model 305 helicopters and Brantly International, Inc., Model B-2, B-2A, and B-2B helicopters. This proposed AD was prompted by a report of a crack in the tail rotor (T/R) hub. This proposed AD would require repetitive inspections of the T/R hub and depending on the results, removing the T/R hub from service. The FAA is proposing this AD to address the unsafe condition on these products.
Fisheries of the Caribbean, Gulf of Mexico, and South Atlantic; 2021 Commercial Accountability Measure and Closure for South Atlantic Blueline Tilefish
NMFS implements an accountability measure (AM) for commercial blueline tilefish in the exclusive economic zone (EEZ) of the South Atlantic. Commercial landings of blueline tilefish are projected to reach the commercial sector annual catch limit (ACL) by August 1, 2021. Therefore, NMFS is closing the commercial sector for blueline tilefish in the South Atlantic EEZ on August 1, 2021, and it will remain closed until the start of the next fishing year on January 1, 2022. This closure is necessary to protect the blueline tilefish resource.
