Notice of Request for an Extension of a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995, this notice announces the intention of the Rural Housing Service, Rural Business-Cooperative Service, and the Rural Utilities Service, agencies of the Rural Development (RD) mission area within the U.S. Department of Agriculture, hereinafter collectively referred to as the Agency(ies) to request Office of Management and Budget's (OMB) approval for a an extension of a currently approved information collection in support of compliance with Civil Rights laws.
Updates to the Off-Farm Labor Housing (Off-FLH), Loan and Grant Rates and Terms; Clarification of Grant Agreement Terms; Announcement of Enforcement Date
On October 25, 2024, Rural Development's Multifamily Housing (MFH or Agency), an Agency of the United States Department of Agriculture (USDA), published a final rule. The final rule amended the current regulation for the Off-Farm Labor Housing (Off-FLH) program to clarify the grant agreement term and adopted the period of performance as required by Federal award information requirements. The changes clarified for applicants and grantees their obligations and requirements as Federal award recipients. The effective date set out in the preamble of the final rule was October 25, 2024 (the date the final rule published in the Federal Register). The effective date should have been November 25, 2024 (30 days after the final rule published in the Federal Register). This document sets November 25, 2024, as the enforcement date for the amendments in the October 25, 2024, final rule.
Clarification on the Requirement To Record the Guaranteed Rural Rental Housing Program Deed Restriction
The Rural Housing Service (RHS or the Agency), a Rural Development agency of the United States Department of Agriculture (USDA), proposes to amend the current regulation for the Multifamily Housing (MFH) Guaranteed Rural Rental Housing Program (GRRHP). The intent of this proposed rule is to codify the restrictive use language within the GRRHP regulation to clarify that a separate deed restriction must be recorded. This change will allow the Agency to maintain and preserve affordable housing for low- and moderate-income households.
Updates to the Off-Farm Labor Housing (Off-FLH), Loan and Grant Rates and Terms; Clarification of Grant Agreement Terms

Single Family Housing Section 502 Direct and Guaranteed Manufactured Housing Pilots

Single Family Housing Guaranteed Loan Program
The Rural Housing Service (RHS or Agency), a Rural Development agency of the United States Department of Agriculture (USDA), proposes to amend the current Single Family Housing Guaranteed Loan Program (SFHGLP) regulation to change the requirements for the length of time a prior Agency loss is considered significant derogatory credit and address seasoning requirements and payment performance for refinance transactions. This proposed rule intends to establish a seven-year time frame for the applicant to re-establish credit after a prior loss claim with the Agency before that loss would no longer be considered significant derogatory credit. This proposed rule also intends to clarify the seasoning requirements and expected payment history requirements for all three refinance submission types within the SFHGLP and identify when applicants are eligible to refinance their current mortgage.

Single Family Housing Guaranteed Loan Program Changes Related to Special Servicing Options
The Rural Housing Service (RHS or Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), is implementing changes to the Single-Family Housing Guaranteed Loan Program (SFHGLP) to amend the current regulations regarding Special Servicing Options and adjust the Mortgage Recovery Advance (MRA) process. This final rule is intended to benefit borrowers and lenders by providing lenders more flexibility in their servicing options, offering a less expensive and less cumbersome MRA process, and reduce program risk of the guaranteed loan portfolio.

Announcement of the Availability of Community Facilities Program Disaster Grants
The Rural Housing Service (RHS or Agency), a Rural Development (RD) mission area of the United States Department of Agriculture (USDA), announces the availability of up to $38 million in grant funding through its Community Facilities Program (CF) to repair essential community facilities damaged by Presidentially Declared Disasters in Calendar Year (CY) 2022 or to repair or replace essential community facilities damaged by Presidentially Declared Disasters in CY 2023 and Other Disasters in CY 2023, to remain available until expended. RHS may at its discretion, increase the total level of funding available from any available source provided the awards meet the requirements of the statute which made the funding available to the Agency. This Notice supersedes the prior Disaster Grant Notice published in the Federal Register on July 20, 2023.
Single Family Housing Guaranteed Housing Payment Supplement Account Demonstration Program
The Rural Housing Service (RHS or the Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), is issuing this document for a demonstration program that will establish a new loss mitigation retention option, referred to as the Payment Supplement Account (PSA). The Agency's intention of this demonstration program is to assist borrowers who have experienced a documented hardship that led to an involuntary inability to pay their mortgage obligation, require payment reduction to resume making a monthly payment, and currently have a below market interest rate. This document briefly discusses a special servicing option for servicers to utilize to continue assisting struggling borrowers who seek loss mitigation alternatives, regardless of the nature of their hardship.

Notice of Funding Availability for the Native Community Development Financial Institution Relending Demonstration Program FY 2024
The Rural Housing Service (RHS, Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), announces the availability of funding for applications under its Native Community Development Financial Institution (NCDFI) Relending Demonstration Program for fiscal year (FY) 2024. The purpose of this notice is to announce the opening and closing dates for receipt of applications for the NCDFI Relending Demonstration Program from eligible applicants, as well as submission requirements. These loans will be made to qualified NCDFIs to relend funds to low- and very low- income ultimate recipients to acquire, build, rehabilitate, improve, or relocate dwellings on Tribal Land in rural areas. This program has the amount of $5,000,000 available for FY 24. Applicants are responsible for any expenses incurred in developing their applications.
OneRD Annual Notice of Guarantee Fee Rates, Periodic Retention Fee Rates, Loan Guarantee Percentage and Fee for Issuance of the Loan Note Guarantee Prior to Construction Completion for Fiscal Year 2025
The Rural Business-Cooperative Service (RBCS), Rural Housing Service (RHS), and the Rural Utilities Service (RUS), agencies of the Rural Development mission area within the U.S. Department of Agriculture (USDA), hereinafter collectively referred to as the Agency, offer loan guarantees through four programs: Community Facilities (CF) administered by the RHS; Water and Waste Disposal (WWD) administered by the RUS; and Business and Industry (B&I) and Rural Energy for America Program (REAP) administered by the RBCS. This notice provides applicants with the Guarantee Fee rates, Guarantee percentage for Guaranteed Loans, the Periodic Retention Fee, and Fee for Issuance of the Loan Note Guarantee Prior to Construction Completion for Fiscal Year (FY) 2025. These fees are to be used when applying for loan note guarantees under the guaranteed loan types listed above during FY2025. This notice is being published prior to the passage of a FY 2025 appropriation. Should the fees need to be adjusted after passage of the FY 2025 appropriations, the agency will publish a subsequent notice in the Federal Register.

This notice announces the opening and closing dates for receipt of preapplications for HPG funds, including the availability of calendar year 2022 disaster assistance, from eligible applicants, as well as submission requirements. Announcement of the Availability of Puerto Rico Rural Partners Network Rural Community Development Initiative
The Rural Housing Service (RHS or the Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), announces the acceptance of applications under the Puerto Rico Rural Partners Network (RPN) Rural Community Development Initiative (RCDI) program to provide authorized activities in Puerto Rico areas affected by a disaster declared by the President or the Secretary of Agriculture. These grants will be made to qualified intermediary organizations that will provide financial and technical assistance to recipients to develop their capacity and ability to undertake projects related to housing, community facilities, or community and economic development that will support the community. The maximum grant award amount available to an intermediary is $250,000. The Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009, created the Disaster Assistance Fund (DAF) and the Secretary of Agriculture has authorized $1,000,000 of DAF funds to be utilized in Puerto Rico for the RCDI program for the purposes described in this NOFA.

The purpose of this document is to correct the inadvertent errors to the commitment letter requirements published in the Federal Register on April 19, 2024.
Notice of Solicitation of Applications (NOSA) for the Strategic Economic and Community Development Program for Fiscal Year (FY) 2024; Correction
The Rural Business-Cooperative Service, Rural Housing Service, and Rural Utilities Service, agencies that comprise the Rural Development Mission Area within the United States Department of Agriculture, published a notice of solicitation of applications in the Federal Register on February 13, 2024, entitled "Notice of Solicitation of Applications (NOSA) for the Strategic Economic and Community Development Program for Fiscal Year (FY) 2024." The NOSA provides requirements to applicants submitting applications for Strategic Economic and Community Development (SECD) points through Secretary of Agriculture designated covered programs. Based on funding availability guidance published in the NOSA, this Correction Notice is issued to clarify that Community Facilities Grant Program funds will not be reserved for SECD in FY 2024. This Correction Notice also clarifies that approved USDA Rural Partners Network (RPN) networks are considered multi-jurisdictional entities for purposes of SECD and that community and economic development plans created in association with an RPN network will be accepted as plans under SECD.
Rural Development Regulations With the Unique Entity Identifier (UEI) for Federal Awards

30-Day Notification of Nonpayment of Rent in Multi-Family Housing Direct Loan Programs
The Rural Housing Service (RHS or Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), is issuing a final rule to amend its regulations for the Multi-Family Housing Direct Loans and Grants Programs to require that Section 515, 514, and 516 Multi-Family Housing program borrowers provide tenants with written notification a minimum of 30 days prior to a lease termination or eviction action for nonpayment of rent, as statutorily required by the Coronavirus Aid, Relief, and Economic Security Act, (CARES Act). The ``30-day notice'' requirement applies regardless of the existence of a presidentially declared national emergency or the availability of emergency rental assistance funds. This rule will require this notice to include instructions on how a tenant can cure the nonpayment to avoid eviction, and how to recertify household income. This final rule also adds that the Secretary of Agriculture (Secretary) may require MFH Section 515 and 514 borrowers and Section 516 grantees to issue information as provided by the Secretary during a presidential declaration of a public health emergency.

Notice of Solicitation of Applications for the Strategic Economic and Community Development Program for FY 2024
The Under Secretary for Rural Development (RD or Agency) is seeking applications for the Strategic Economic and Community Development (SECD) priority, as reauthorized by section 6401 of the Agriculture Improvement Act of 2018 (2018 Farm Bill) for projects that support multi-jurisdictional and multi-sectoral strategic community investment plans. In fiscal year (FY) 2024, the covered RD programs will implement SECD by reserving loan and/or grant funds from the appropriations of the programs covered by this funding priority. This notice describes the requirements by which the RD programs will consider projects eligible for the covered programs' reserved appropriated funds and the information needed to submit an application. This NOSA is being issued prior to passage of a final appropriations act for FY 2024 to allow potential applicants time to submit applications for financial assistance under the covered programs and to give the RD programs time to process applications. Information on estimated FY 24 funding amounts can be found under SUPPLEMENTARY INFORMATION, section B. Federal Award Information of this notice.
Revisions to the Smoke Alarm Requirements in the Section 515 Rural Rental Housing and Section 514/516 Farm Labor Housing Direct Loan Programs
The Rural Housing Service (RHS or Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), proposes to amend its regulation to implement changes related to the smoke alarm requirements for properties that receive funding from the MFH Section 515 Rural Rental Housing and the Section 514/516 Farm Labor Housing Direct Loan and Grant programs. These proposed changes are intended to align the Agency's smoke alarm requirements with the new qualifying smoke alarm standards set forth in the Consolidated Appropriations Act of 2023 (Act). The Act requires each unit of federally assisted housing to contain hardwired or 10-year non- rechargeable, sealed, tamper-resistant, battery-powered smoke alarm devices.
Single Family Housing Section 502 Direct Loan Program-Community Land Trust Pilot
The Rural Housing Service (RHS or the Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), is announcing a pilot for the Section 502 Direct Home Loan program to test alternative eligibility criteria related to community representation for Community Land Trust (CLT) organizations. The Agency intends to evaluate the impact of allowing eligibility criteria other than membership open to all residents of the geographic area which could meet the intent of the statutory requirements for CLTs to have specific community representation. This notification outlines the pilot parameters and provides contact information for additional details about the pilot.
Streamlining and Improvement of Single Family Housing Direct Programs
The Rural Housing Service (RHS or the Agency), an agency in the Rural Development (RD) mission area of the United States Department of Agriculture (USDA), proposes to amend the current regulation for the following Single Family Housing (SFH) Direct Programs: Section 502 Direct Loan Program and the Section 504 Loan and Grant Program. The Agency also intends to update the Section 306C Loan and Grant Programs which is a program administered under the Rural Utilities Service (RUS), and where RHS is designated to make grants to eligible individuals. The intent of this proposed rule is to reduce the regulatory burdens on applicants, borrowers, and partners by enhancing program delivery, expanding customer service, promoting consistency between the direct and guaranteed SFH loan programs where feasible and aligning the programs with current housing market conditions and mortgage loan practices.
Community Facilities Program: Virtual Public Listening Session
The Community Facilities Loan and Grant program (Community Facilities) of the Rural Housing Service (RHS or the Agency), a Rural Development agency of the United States Department of Agriculture (USDA), is consolidating the existing regulations that govern Community Facility direct loans and grants, fire and rescue and other small community facilities projects; as well as codifying the Tribal College Initiative, and Economic Impact Initiative grant programs that will incorporate all the necessary loan and grant making information into one streamlined final rule. The result will be an up-to-date comprehensive regulation that will be used to administer the programs. Community Facilities is hosting a virtual listening session to obtain stakeholder input on key proposed areas for changes and/or updates to the proposed consolidated Community Facilities Direct Loan and Grant regulation. This session is open to the public.
Changes Related to Insurance Requirements in Multi-Family Housing (MFH) Direct Loan and Grant Programs
The Rural Housing Service (RHS or the Agency), a Rural Development (RD) agency of the United States Department of Agriculture (USDA), proposes to amend its regulation to implement changes related to insurance requirements under the Multi-Family Housing (MFH) Direct Loan and Grant programs. The intent of this proposed rule is to align RD insurance coverage types, amounts, and deductibles with affordable housing industry standards to simplify the coverage amounts, deductible limits, and improve the customer experience with updated and understandable insurance requirements.
Special Authority To Enable Funding of Broadband and Smart Utility Facilities Across Select Rural Development Programs
The Rural Utilities Service, Rural Business-Cooperative Service, and Rural Housing Service, agencies that comprise the Rural Development (RD) Mission Area within the United States Department of Agriculture, published a final rule with comment in the Federal Register on September 15, 2020, to establish the special authority authorized by Section 6210 of the Agriculture Improvement Act of 2018, which will assist rural families and small businesses in gaining access to broadband service by permitting recipients of loans, grants, and loan guarantees from RD to use up to 10 percent of the amount provided to construct broadband infrastructure in areas not served by the minimum acceptable level of broadband service. The final rule described the procedures by which these agencies will consider projects eligible for special broadband authority. Through this action, the agencies are confirming the final rule as it was published and providing responses to the public comments that were received.
