Arms Sales Notification; Withdrawal
On Thursday, June 6, 2024, the DoD published the unclassified text of an arms sales notification in the Federal Register. The published notice contained a Policy Justification for the North Atlantic Treaty Organization (NATO) and a Policy Justification for the Taipei Economic and Cultural Representative Office in the United States (TECRO). The Policy Justification for NATO was erroneously included. DoD is withdrawing the notice and will resubmit a corrected TECRO notice for publication at a later date.

21st Century Cures Act: Establishment of Disincentives for Health Care Providers That Have Committed Information Blocking
This final rule implements the provision of the 21st Century Cures Act specifying that a health care provider determined by the HHS Inspector General to have committed information blocking shall be referred to the appropriate agency to be subject to appropriate disincentives set forth through notice and comment rulemaking. This rulemaking establishes, for certain health care providers, a set of appropriate disincentives using authorities under applicable Federal law.
Privacy Act of 1974; System of Records
In accordance with the Privacy Act of 1974, the DoD is modifying and reissuing a current system of records titled, "Pentagon Facilities Access Control System," DPFPA 01. This system of records was originally established by the Pentagon Force Protection Agency (PFPA) to collect and maintain a listing of personnel who are authorized to access Pentagon Facilities and verify the identity of approved individuals with access to such facilities and offices. The system name is changing from "Pentagon Facilities Access Control System" to "Pentagon Facilities Access Control Records." This system of records notice (SORN) is being updated to expand the purpose for which the system of records was established and incorporate the DoD standard routines uses (A through J). The DoD is also modifying various other sections within the SORN to improve clarity or update information that has changed.

Privacy Act of 1974; System of Records
In accordance with the Privacy Act of 1974, the United States Department of Transportation (DOT), Office of the Secretary (OST), proposes to modify and reissue an existing system of records notice titled "Department of Transportation, Office of the Secretary; DOT/OST 035 Personnel Security Record System." The system collects information on DOT employees, contractors, and members of the public to track and manage the information and records necessary to conduct employee suitability background investigations and determine eligibility for clearances. It is also used to maintain documentation for DOT employees who attend classified briefings outside of DOT, and non-DOT individuals attending meetings at DOT.
Revised Non-Foreign Overseas Per Diem Rates; Correction
On Wednesday, June 12, 2024, DoD published a notice in the Federal Register announcing the per diem rates that were effective on June 1, 2024. Subsequent to publication, DoD discovered a typographical error in the table. This notice corrects that error.
Notice of Submission of Proposed Information Collection to OMB of Agency Request for Revision of a Previously Approved Collection: Online Complaint Form and Related Uses of a Modernized Aviation Consumer Protection Information Technology System
In accordance with the Paperwork Reduction Act of 1995, this notice announces the Department of Transportation's intention to revise an information collection request (ICR) related to an OMB control number for an online complaint form by which a consumer can electronically submit a service-related complaint against an airline and other air travel-related companies. The complaint form has been revised as part of the Department's Office of Aviation Consumer Protection's (OACP) information technology (IT) system modernization project. A Federal Register Notice with a 60-day comment period soliciting comments on the following information collection was published on November 1, 2023: Online Complaint Form for Service- Related Issues in Air Transportation. One comment was received by Airlines for America (A4A). This notice responds to that comment and adds two new ICRs to capture additional functionalities of the modernized IT system. The new ICRs are related to external users, such as regulated entities and other users, that may use the modernized IT system to set up and manage individual accounts and access complaints and other submissions and/or submit complaint responses, reports, or other information into that system.

The U.S. Department of Transportation is making a series of technical amendments to its drug testing procedures rule, which was effective June 1, 2023. The purpose of these technical amendments is to clarify certain provisions of the rule and address omissions of which we have become aware since the publication of the final rule.
Procedures for Transportation Workplace Drug and Alcohol Testing Programs
The U.S. Department of Transportation (DOT) is proposing to revise its drug and alcohol testing procedures final rule published on May 2, 2023, to provide temporary qualification requirements for mock oral fluid monitors, provide for consistent privacy requirements by identifying which individuals may be present during an oral fluid collection, and clarify how collectors are to specify that a sufficient volume of oral fluid was collected. In the "Rules and Regulations" section of this issue of the Federal Register, DOT is simultaneously publishing the revision of DOT's drug testing regulation as a direct final rule without a prior proposed rule. If DOT receives no adverse comment, it will not take further action on this proposed rule.
