Findings of Scientific Misconduct
Notice is hereby given that on February 28, 2006, the Department of Health and Human Services (HHS) Debarring Official, on behalf of the Secretary of HHS, issued a final notice of debarment based on the scientific misconduct findings of the U.S. Public Health Service (PHS) in the following case: Susan M. Aronica, PhD, Indiana University Purdue University Indianapolis: Based on the evidence and findings of an investigation report by Indiana University Purdue University Indianapolis (IUPUI) and additional analysis conducted by the Office of Research Integrity (ORI) in its oversight review, ORI found that Susan M. Aronica, Ph.D., former Postdoctoral Student/Fellow, IUPUI, committed 21 acts of scientific misconduct by knowingly and intentionally falsifying and fabricating data in her notebooks, in 17 figures and figure panels, in two tables published in the Journal of Biological Chemistry (J. Biol. Chem. 270:21998-22007, 1995) and Blood (Blood 89:3582-3595, 1997), and in two figures in a manuscript submitted for publication to Blood in August 1997. ORI issued a charge letter enumerating the above findings of scientific misconduct. However, Dr. Aronica requested a hearing to dispute these findings to the Departmental Appeals Board. Based upon the insufficiency of Dr. Aronica's hearing request, ORI filed a Motion to Dismiss. On February 10, 2006, the Administrative Law Judge (ALJ) ruled in ORI's favor by dismissing Dr. Aronica's request for a hearing. ORI's research misconduct regulation specifically delineates the requisite content for an acceptable hearing request. A sustainable hearing request must admit or deny each finding of research misconduct, and each denial must be detailed and substantive. 42 CFR 93.501(c). Dr. Aronica's hearing request contained only a general denial of the proposed findings. The regulation states that a general denial is not sufficient to establish a genuine dispute. 42 CFR 93.503. The regulation also states that the ALJ must dismiss a hearing request if the respondent does not raise a genuine dispute over facts or law material to the research misconduct findings. 42 CFR 93.504(a)(2). The ALJ concluded that the determination of whether the hearing request raises a genuine dispute is a threshold jurisdictional determination. Thus, the ALJ decided that Dr. Aronica's request did not show a genuine dispute, because it did not specifically deny any allegation. As a result, the ALJ concluded that Dr. Aronica's hearing request could not be granted, but was required to be dismissed pursuant to 42 CFR 93.504(a)(2). Meeting of the Defense Policy Board Advisory Committee

U.S. Strategic Command Strategic Advisory Group
The Strategic Advisory Group (SAG) met in closed session on March 23, 2006. The mission of the SAG is to provide timely advice on scientific, technical, intelligence, and policy-related issues to the Commander, U.S. Strategic Command, during the development of the Nation's strategic war plans. Full development of the topics will require discussion of information classified in accordance with Executive order 12958, dated April 17, 1995. Access to this information must be strictly limited to personnel having requisite security clearances and specific need-to-know. Unauthorized disclosure of the information to be discussed at the SAG meeting could have exceptionally grave impact upon national defense. In accordance with Section 10(d) of the Federal Advisory Committee Act (5 U.S.C. App. 2), it has been determined that this SAG meeting concerns matters listed in 5 U.S.C. 552b(c), and that, accordingly, this meeting will be closed to the public. This notice was not published within the 15-day timeframe because of a recent determination that this meeting is deliberative in nature.
Threat Reduction Advisory Committee
The Threat Reduction Advisory Committee will meet in closed session on Thursday, June 1, 2006, at the Defense Threat Reduction Agency (DTRA), and on Friday, June 2, 2006, in the Pentagon, Washington, DC. The mission of the Committee is to advise the Under Secretary of Defense (Acquisition, Technology and Logistics) on technology security, combating weapons of mass destruction, chemical and biological defense, transformation of the nuclear weapons stockpile and other matters related to the Defense Threat Reduction Agency's mission. In accordance with Section 10(d) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C. Certain Business Aviation Activities Using U.S.-Registered Foreign Civil Aircraft
In response to a petition by the National Business Aircraft Association (NBAA), this final rule amends the requirements governing the licensing and operation in the United States of ``foreign civil aircraft'' which are not engaged in common carriage. The rule provides that certain types of operations by business aircraft operators using U.S.-registered foreign civil aircraft (such as carriage of a company's own officials and guests, or aircraft time-sharing, interchange or joint ownership arrangements between companies) do not constitute operations ``for remuneration or hire'' and, therefore, do not require a DOT permit. This document also dismisses, without prejudice, the request of NBAA that the regulation be amended so that reimbursement by political candidates carried on foreign civil aircraft is not considered ``remuneration or hire'' under the rule.

Critical Infrastructure Partnership Advisory Council
In order to facilitate an effective defense of our Nation's critical infrastructure, the Department of Homeland Security is creating the Critical Infrastructure Partnership Advisory Council. Pursuant to the Homeland Security Act of 2002, the Department is taking measures to facilitate strategic planning and effective discussion of critical infrastructure issues and to protect sensitive critical infrastructure information while also observing appropriate public disclosure procedures for the council. Findings of Scientific Misconduct
Notice is hereby given that the Office of Research Integrity (ORI) and the Assistant Secretary for Health have taken final action in the following case: Hiwot A. Woreta, Duke University Medical Center: Based on the report of an inquiry into admitted fabrication of data conducted by the Duke University Medical Center (DUMC) and additional analysis conducted by ORI in its oversight review, the U.S. Public Health Service (PHS) found that Hiwot A. Woreta, former medical student, DUMC, engaged in research misconduct while supported by National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK), National Institutes of Health (NIH), grant P30 DK034987. Specifically, PHS found that Ms. Woreta engaged in research misconduct by fabricating data included in Figure 2 of her third year Medical School Thesis at DUMC. These data were also included in a poster presented during the Alpha Omega Alpha Honor Society symposium in May 2004. Ms. Woreta has entered into a Voluntary Exclusion Agreement in which she has voluntarily agreed, for a period of three (3) years, beginning on February 24, 2006: (1) To exclude herself from serving in any advisory capacity to PHS including but not limited to service on any PHS advisory committee, board, and/or peer review committee, or as consultant; and (2) That any institution that submits an application for PHS support for a research project on which the Respondent's participation is proposed or which uses the Respondent in any capacity on PHS supported research, or that submits a report of PHS-funded research in which the Respondent is involved, must concurrently submit a plan for supervision of the Respondent's duties to the funding agency for approval. The supervisory plan must be designed to ensure the scientific integrity of the Respondent's research contribution. Respondent agreed to ensure that a copy of the supervisory plan is also submitted to ORI by the institution. Respondent agreed that she will not participate in any PHS-supported research until such a supervisory plan is submitted to ORI.
Board of Visitors Meeting
The next meeting on the Defense Acquisition University (DAU) Board of Visitors (BoV) will be held at Defense Acquisition University, Fort Belvoir, VA. The purpose of this meeting is to report back to the BoV on continuing items of interest.
Meeting of the Advisory Committee Council on Dependents' Education
Pursuant to the Federal Advisory Committee Act, Appendix 2 of title 5, United States Code, Public Law 92-463, notice is hereby given that a meeting of the Advisory Council on Dependents' Education (ACDE) is scheduled to be held on May 5, 2006, from 8 a.m. to 5 p.m. The meeting will be held at the Hotel Oranien Wiesbaden, Platter Strasse 2, 65193 Wiesbaden, Germany. The purpose of the ACDE is to recommend to the Director, DoDEA, general policies for the operation of the Department of Defense Dependents Schools (DoDDS); to provide the Director with information about effective educational programs and practices that should be considered by DoDDS; and to perform other tasks as may be required by the Secretary of Defense. The meeting emphases will be the current operational qualities of schools and the institutionalized school improvement processes, as well as other educational matters. Transformation Advisory Group Meeting of the U.S. Joint Forces Command
The Transformation Advisory Group (TAG) will meet in closed session on 17-18 April 2006. The establishment date was already published in the Federal Register on 28 May 2003, in accordance with 41 CFR part 102-3.150. The mission of the TAG is to provide timely advice on scientific, technical, and policy-related issues to the Commander, U.S. Joint Forces Command as he developes and executes the DOD transformation strategy. Full development of the topics will require discussion of information classified in accordance with Executive Order 12958, dated 17 April 1995, as amended March 2003. Access to the information must be strictly limited to personnel having the requisite clearances and specific need-to-know. Unauthorized disclosure of the information to be discussed at the TAG meetings could cause serious damage to our national defense. The meeting will be closed for security reasons, pursuant to 5 U.S.C. 552, Exemption (b)1, Protection of National Security, and Exemption (b)3 regarding information protected under the Homeland Security Act of 2002. In accordance with Section 10d of the Federal Advisory Committee Act and 41 CFR 102-3.155 this meeting will be closed.
Regulations Governing Practice Before the Internal Revenue; Correction
This document contains corrections to a notice of proposed rulemaking and notice of public hearing that was published in the Federal Register on Wednesday, February 8, 2006 (71 FR 6421). These proposed regulations affect individuals who practice before the Internal Revenue Service (Circular 230). The proposed amendments modify the general standards of practice before the Internal Revenue Service.
Child Labor Education Initiative
The U.S. Department of Labor (USDOL), Bureau of International Labor. Affairs (ILAB), intends to obligate up to approximately U.S. $15 million to support cooperative agreement awards to organizations to develop and implement formal, non-formal, and vocational education projects as a means to combat exploitive child labor in the following three countries: (1) Egypt, (2) Peru, and (3) Tanzania. ILAB intends to solicit cooperative agreement applications from qualified organizations (i.e., any commercial, international, educational, or non-profit organization capable of successfully developing and implementing education projects) to implement projects that focus on innovative ways to provide educational services to children engaged, or at risk of engaging, in exploitive labor. The projects should address the gaps and challenges to basic education found in the countries mentioned above. Gulf Coast Business Investment Mission
The Department of Commerce publishes this notice to invite applications to participate in a business investment mission to the Gulf Coast Region. Secretary of Commerce Carlos M. Gutierrez in coordination with Federal Coordinator Donald E. Powell, Gulf Coast Rebuilding, Department of Homeland Security, will lead a senior-level business delegation to the Gulf Coast, with stops in Louisiana and Mississippi, on May 4-5, 2006. The focus of the trip will be to highlight opportunities for investment in the Gulf Coast, including the incentives in the recently-enacted Gulf Opportunity Zone Act of 2005. During this trip, business delegation members will be briefed by ranking federal, state, and local officials on the opportunities available for investment in the Gulf Coast, including the advantages of using the region as a platform for export production or shipping. This mission is geared specifically to businesses with a strong interest in, and capable of, making capital investments (of at minimum $5 Million) in the Gulf Coast region and companies which already have significant (at least $5 Million) investments in the region.
Department of Labor's Fleet Alternative Fuel Vehicle Acquisition
In compliance with the Energy Policy Act of 1992 and Executive Order 13149, this notice announces the availability of the 2005 report that summarizes the U.S. Department of Labor's (DOL) compliance with the annual alternative fuel vehicle acquisition requirement for its vehicle fleet. The Web site also contains the Department's annual reports for fiscal years 1999-2004. Additionally, the reports include data relative to the agency's effort in reducing petroleum consumption.
Notice of Intent To Fund the International Labor Organization
Benchmarking/verification: The free trade agreement between the United States and the CAFTA-DR countries establishes a commitment to effectively enforce domestic labor laws. This program will measure and evaluate progress by the CAFTA-DR countries as they strive to improve implementation of their labor laws consistent with international standards. Specifically, the program will create a series of benchmarks and measurements related to compliance with internationally recognized labor rights. These tools will be used to evaluate the implementation of the recommendations established in the ``White Paper'' (developed by the Trade and Labor Ministry officials of the countries), as well as improvements to institutional capacities of government mechanisms for the sustainable implementation of labor law. A verification report will be produced and made publicly available on a semi-annual basis. Labor Justice Training: Increasing knowledge throughout the judicial system of core labor standards and the laws and regulations in place to support them is critical to success. An efficient and effective labor justice system is also of great importance. Training needed to assure these outcomes may include: Training in internationally recognized labor standards of the International Labor Organization, as well as training on the ILO's system for overseeing labor rights; Training in the national level obligations entailed in country ratification of ILO conventions. Training in the application of ILO core labor standards through domestic legislation and regulation. This includes relevant (a) Training in oral litigation procedures, legal writing and proper jurisprudence procedures; (b) Training and technical assistance to support linkages between the formal court system, alternative dispute resolution systems, and the enforcement process taking place within labor ministries to ensure consistency with international standards; and (c) Training and technical assistance to strengthen alternative dispute systems, or other arbitration and mediation mechanisms dealing with labor issues that are specifically associated with the judicial system.
Meeting of the Defense Department Advisory Committee on Women in the Services (DACOWITS)
Pursuant to section 10(a), Public Law 92-463, as amended, notice is hereby given of a forthcoming meeting of the Defense Department Advisory Committee on Women in the Services (DACOWITS). The purpose of the Committee meeting is to introduce new members and conduct orientation training. The meeting is open to the public, subject to the availability of space. Interested persons may submit a written statement for consideration by the Committee and make an oral presentation of such. Persons desiring to make an oral presentation or submit a written statement to the Committee must notify the point of contact listed below no later than 5 p.m., 22 March 2006. Defense Science Board
The Defense Science Board Task Force on Technology Vectors will meet in closed session on March 13 and 14, 2006; at Strategic Analysis, Inc. (SAI), 3601 Wilson Boulevard, Suite 500, Arlington, VA. This meeting will be a plenary meeting used to map the study's direction and begin discussion on what will be the Technology Vectors DoD will need for the 21st century. The mission of the Defense Science Board is to advise the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology & Logistics on scientific and technical matters as they affect the perceived needs of the Department of Defense. At these meetings, the Defense Science Board Task Force will: Review previous attempts by DoD to identify critical technologies in order to derive lessons that would help illuminate the current challenge; identify the National Security objectives for the 21st century and the operational missions that U.S. military will be called upon to support these objectives; identify new operational capabilities needed for the proposed missions; identify the critical science technology, and other related enablers of the desired capabilities; assess current S&T investment plans' relevance to the needed operational capabilities and enablers and recommend needed changes to the plans; identify mechanisms to accelerate and assure the transition into U.S. military capabilities; and review and recommend changes as needed, the current processes by which national security objectives and needed operational capabilities are used to develop and prioritize science, technology, and other related enablers, and how those enablers are then developed. In accordance with section 10(d) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C. App. II), it has been determined that these Defense Science Board Task Force meetings concern matters listed in 5 U.S.C. 552b(c)(1) and that, accordingly, the meetings will be closed to the public.

The Defense Science Board Task Force on Software Assurance will meet in closed session on March 22, 2006; at Science Applications International Corporation (SAIC), 4001 N. Fairfax Drive, Arlington, VA. This meeting is to chart the direction of the study and begin assessing the current capabilities and vulnerabilities of DoD software. The mission of the Defense Science Board is to advise the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology & Logistics on scientific and technical matters as they affect the perceived needs of the Department of Defense. At these meetings, the Defense Science Board Task Force will: Assess the risk that DoD runs as a result of foreign influence on its software and to suggest technology and other measures to mitigate the risk. In accordance with section 10(d) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C. App. II), it has been determined that these Defense Science Board Task Force meetings concern matters listed in 5 U.S.C. 552b(c)(1) and that, accordingly, the meetings will be closed to the public.

The Defense Science Board Task Force on VTOL/STOL will meet in closed session on March 21-22, 2006; at Strategic Analysis Inc., 3601 Wilson Boulevard, Arlington, VA. This meeting continues the task force's work and will consist of classified and proprietary briefings on current technologies and programs. The mission of the Defense Science Board is to advise the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology & Logistics on scientific and technical matters as they affect the perceived needs of the Department of Defense. At these meetings, the Defense Science Board Task Force will: assess the features and capabilities VTOL/STOL aircraft should have in order to support the nation's defense needs through at least the first half of the 21st century. In accordance with section 10(d) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C. App. II), it has been determined that these Defense Science Board Task Force meetings concern matters listed in 5 U.S.C. 552b(c)(1) and that, accordingly, the meetings will be closed to the public.
