Notice of Lodging of Consent Decree
Under the Clean Water Act
Notice is hereby given that on March
8, 2006, a proposed Second Modified
Consent Decree (‘‘proposed Decree’’) in
United States v. Puerto Rico
Administration of Corrections, Civil
Action No. 90–2119, was lodged with
the United States District Court for the
District of Puerto Rico.
In this action the United States sought
penalties and injunctive relief for
violations by the Puerto Rico
Administration of Corrections (‘‘PRAC’’)
of a Supplemental Consent Decree
entered on February 14, 1997 (‘‘1997
Decree’’). The 1997 Decree resolved
claims for violations by PRAC of a
Consent Decree entered in this action on
June 3, 1992, of National Pollutant
Discharge Elimination System permits,
and of Sections 301, 309 and 402 of the
Clean Water Act, 33 U.S.C. 1311, 1319
and 1342. The proposed Decree requires
PRAC to: (1) Pay $500,000 in stipulated
penalties for violations of the 1997
Decree; (2) complete a previously
required safe drinking water supply
system for a rural Puerto Rican
community; and (3) conduct inspections
of a component of a wastewater pump
station.
For a period of thirty (30) days
following the date of this publication,
the U.S. Department of Justice will
accept comments relating to the
proposed Decree. Comments should be
