The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 3 to Regulatory Guide (RG)1.91, ``Evaluations of Explosions Postulated to Occur at Nearby Facilities and on Transportation Routes Near Nuclear Power Plants.'' The revision of RG 1.91 describes methods that the NRC finds acceptable for applicants and licensees of nuclear power reactors to use in evaluating postulated accidental explosions at nearby facilities and transportation routes.
Holtec Decommissioning International, LLC, Palisades Nuclear Plant
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an exemption in response to the December 23, 2020, request from Holtec Decommissioning International, LLC (HDI) related Palisades Nuclear Plant (PNP), located in Van Buren County, Michigan. The exemption would permit HDI to use funds from the PNP nuclear decommissioning trust (NDT) for spent fuel management and site restoration activities for PNP. The exemption would also allow such withdrawals without prior notification to the NRC. The NRC staff is issuing an environmental assessment (EA) and finding of no significant impact (FONSI) associated with the proposed exemption.

In the Matter of Arizona Public Service Company, Salt River Project Agricultural Improvement and Power District Public Service Company of New Mexico, Palo Verde Nuclear Generating Station, Units 1 and 2 and Independent Spent Fuel Storage Installation
On October 21, 2021, and published in the Federal Register on October 27, 2021, the U.S. Nuclear Regulatory Commission (NRC) issued an Order approving the application dated May 19, 2021, as supplemented by letter dated September 14, 2021, filed by Arizona Public Service Company (APS), on behalf of Salt River Project Agricultural Improvement and Power District (SRP) and Public Service Company of New Mexico (PNM). The application sought NRC consent to the partial transfers of Renewed Facility Operating License Nos. NPF-41 and NPF-51 for Palo Verde Nuclear Generating Station (Palo Verde), Units 1 and 2, respectively, and the general license for the Palo Verde Independent Spent Fuel Storage Installation (ISFSI). Specifically, it sought NRC consent to the transfers from PNM to SRP of a 7.9333330 percent share of the undivided interests in Palo Verde, Unit 1, and of a 0.7933333 percent share of the undivided interests in Palo Verde Unit 2. No physical changes or operational changes were proposed in the application. The NRC is issuing an Order correcting and superseding the Order of October 21, 2021.

The U.S. Nuclear Regulatory Commission (NRC) is considering amending the NRC's Materials License No. 24-16273-01, issued to Sigma- Aldrich Company (the licensee), for possession of byproduct material incident to radiological survey, storage of waste awaiting disposal, and decontamination, and remediation of the Fort Mims Site. The proposed amendment is to revise the decommissioning plan and terminate the license for the licensee's Fort Mims Site in Maryland Heights, Missouri. Extending the Duration of the AP1000 Design Certification

This direct final rule amends the NRC's regulations to update the design to reflect changes provided by Westinghouse Electric Company LLC and to extend the duration of the AP1000 design certification for an additional 5 years.
New York State Energy Research and Development Authority; Irradiated Nuclear Fuel Processing Plant; Western New York Nuclear Service Center
The U.S. Nuclear Regulatory Commission (NRC) has issued an amendment to Facility Provisional Operating License No. CSF-1, issued to New York State Energy Research and Development Authority (NYSERDA), the licensee, for the provisional operation of the Irradiated Nuclear Fuel Processing Plant located at the Western New York Nuclear Service Center (WNYNSC), in Cattaraugus and Erie Counties, New York. The provisional operating license was amended to update the Radiation Protection Program for the Retained Premises of the Licensed Area for ``modernization'' and as requested by the licensee, to clarify the licensee's health and safety responsibilities as the sole licensee.
Controlled Unclassified Information Program
The U.S. Nuclear Regulatory Commission (NRC) is issuing this Statement of Policy to set forth its expectation regarding the treatment of controlled unclassified information (CUI). This final policy statement describes how the NRC will comply with regulations issued by the National Archives and Records Administration (NARA) that direct agencies to minimize the risk of unauthorized disclosure of controlled unclassified information while allowing timely access by authorized holders. This policy statement aligns with similar actions taken by other Federal agencies to communicate changes in agency CUI policy to align with NARA requirements. During the transition to the CUI program, all elements of the NRC's existing Sensitive Unclassified Non-Safeguards Information (SUNSI) program will remain in place.

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft plant-specific Supplement 23, Second Renewal, to the Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, NUREG-1437, regarding the proposed subsequent renewal of Renewed Facility Operating License Nos. DPR-24 and DPR-27 for an additional 20 years of operation for Point Beach Nuclear Plant, Units 1 and 2 (Point Beach). The Point Beach facility is located on the western shore of Lake Michigan (approximately 15 miles NNE of Manitowoc, WI). Possible alternatives to the proposed action (subsequent license renewal) include no action and reasonable replacement power alternatives.
Acceptable Standard Format and Content for the Fundamental Nuclear Material Control Plan Required for Special Nuclear Material of Moderate Strategic Significance
On September 23, 2021, the U.S. Nuclear Regulatory Commission (NRC) issued for public comment draft NUREG, NUREG-2159, Revision 1, ``Acceptable Standard Format and Content for the Fundamental Nuclear Material Control Plan Required for Special Nuclear Material of Moderate Strategic Significance.'' The public comment period was originally scheduled to close on November 22, 2021. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.
Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors
On November 6, 2020, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on preliminary proposed rule language for a risk-informed, technology-inclusive framework for reactor licensing. The renewal of the initial certificate and Amendment No. 1 revises the certificate of compliance's conditions and technical specifications to address aging management activities related to the structures, systems, and components of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The scope of the Certificate of Compliance No. 1021 renewal includes spent fuel storage cask models TN-32, TN-32A, and TN-32B.

The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the Tier 1 certification information in the generic design control document (DCD) for the AP1000 design certification and is issuing License Amendment Nos. 188 and 186 to Combined Licenses (COLs), NPF-91 and NPF-92, respectively. The COLs were issued to Southern Nuclear Operating Company, Inc. (SNC), and Georgia Power Company, Oglethorpe Power Corporation, MEAG Power SPVM, LLC, MEAG Power SPVJ, LLC, MEAG Power SPVP, LLC, and the City of Dalton, Georgia; for the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, located in Burke County, Georgia. SNC is the entity that is licensed to construct and operate VEGP Units 3 and 4. The granting of the exemption allows the departures from Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to a request dated August 30, 2021, as supplemented on September 23, 2021, from Holtec Decommissioning International, LLC (HDI), for the Pilgrim Nuclear Power Station (Pilgrim), from the requirement to investigate, trace, and report to the NRC any low-level radioactive waste shipment or part of a shipment for which acknowledgement of receipt is not received by HDI within 20 days after transfer from Pilgrim. HDI requested that this time period be extended from 20 to 45 days. HDI requested this change to avoid the administrative burden of investigating, tracing, and reporting on shipments that continue to be under requisite controls.
Notice of Intent To Conduct Scoping Process and Prepare Environmental Impact Statement; Florida Power & Light Co.; St. Lucie Plant Units 1 and 2

The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption and associated license amendment related to a request from Westinghouse Electric Company, LLC (WEC) from NRC regulations with respect to a request for alternate disposal and exemptions for specified low-activity radioactive waste from the Columbia Fuel Fabrication Facility (CFFF) in Hopkins, South Carolina for waste containing byproduct material and special nuclear material (SNM) under License Number SNM-1107. Additionally, the NRC is taking the related action of approving exemptions to US Ecology, Inc. (USEI) from the applicable licensing requirements to allow USEI to receive and dispose of the material from CFFF without an NRC license. The USEI disposal facility, located near Grand View, Idaho, is a Subtitle C Resource Conservation and Recovery Act (RCRA) hazardous waste disposal facility permitted by the State of Idaho to receive low-level radioactive waste and is not licensed by the NRC. Approval of the alternate disposal request from WEC and the exemptions and license amendment requested by WEC and associated exemptions for USEI would allow WEC to transfer the specific waste from CFFF for disposal at USEI.

The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of October 26, 2021, for the direct final rule that was published in the Federal Register on August 12, 2021. The direct final rule amended the TN Americas LLC, NUHOMS[supreg] EOS Dry Spent Fuel Storage System listing in the ``List of approved spent fuel storage casks'' to include Amendment No. 2 to Certificate of Compliance No. 1042. Amendment No. 2 revises the certificate of compliance to add a dry shielded canister for storage, add new heat load zone configurations, and make other changes to the storage system. Amendment No. 2 also changes the certificate of compliance and technical specifications, and updates the final safety analysis report for consistency and clarity.
Updates on the Export of Deuterium
The U.S. Nuclear Regulatory Commission (NRC) is revising its regulations to remove the NRC's licensing authority for exports of deuterium for non-nuclear end use. The responsibility for the licensing of exports of deuterium for non-nuclear end use is being transferred to the Department of Commerce's Bureau of Industry and Security. The Bureau of Industry and Security is publishing a final rule in this edition of the Federal Register to include such exports under its export licensing jurisdiction. The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of October 27, 2021, for the direct final rule that was published in the Federal Register on August 13, 2021. The direct final rule amended the NRC's spent fuel storage regulations by revising the TN Americas, LLC, Standardized Advanced NUHOMS[supreg] Horizontal Modular Storage System listing within the ``List of approved spent fuel storage casks'' to renew, for an additional 40 years, the initial certificate and Amendment Nos. 1, 3, and 4 of Certificate of Compliance No. 1029.
