Updates to the Uniform Standard for Waiver of the Ryan White HIV/AIDS Program Core Medical Services Expenditure

The Ryan White HIV/AIDS Program (RWHAP) statute of the Public Health Service Act requires that RWHAP Parts A, B, and C recipients expend 75 percent of Parts A, B, and C grant funds on core medical services for individuals who are identified with HIV/AIDS and eligible for RWHAP services under the statute, after reserving statutorily permissible amounts for administrative and clinical quality management costs. The statute also grants the Secretary authority to waive this requirement if certain factors are met. HRSA is proposing to update Policy Notice 21-01, "Waiver of the Ryan White HIV/AIDS Program Core Medical Services Expenditure Requirement," pertaining to the associated data collection form to clarify applicants' proposed allocation of resources between core medical and support services.

The lists are available on the shortage area topic page on HRSA's data.hrsa.gov website. All currently designated HPSAs remain designated until final lists are published later this fall. HPSA designations that are currently proposed for withdrawal will remain in this status until the publication of the HPSA Federal Register notice on or before November 1, 2024. HPSAs proposed for withdraw will be re-evaluated before final publication if additional information is made available to HPSA by states. The Health Resources and Services Administration published a document in the Federal Register of May 28, 2024, concerning an Information Collection Request titled "Implement Maternal, Infant, and Early Childhood Home Visiting Program 2022 Legislative Changes: Assessment of Administrative Burden." The document contained an incorrect "Total Estimated Annualized Burden Hours." The published Federal Register Notice had an estimated average burden per response of 27 hours for the "State and Jurisdiction [Maternal, Infant, and Early Childhood Home Visiting (MIECHV)] Funding Recipient Survey," with the total burden hours for the form being 1,512 hours. The published total estimated burden for the collection was 1,628 hours. This document corrects the estimate so that the average burden per response for the State and Jurisdiction MIECHV Funding Recipient Survey is 14 hours per response, 784 hours for the total estimated burden hours, and 900 hours for the collection.

HRSA's Federal Office of Rural Health Policy (FORHP) utilizes clear, consistent, and data-driven methods of defining rural areas in the United States for the purposes of determining eligibility for its rural health grant programs. FORHP monitors ongoing national research and, as appropriate, considers updates to its definition. Because access to needed health care is likely to be reduced when roads are most difficult to traverse, with this notice, FORHP proposes to modify the definition of rural areas by integrating the new Road Ruggedness Scale (RRS) released in 2023 by the Economic Research Service (ERS) of the U.S. Department of Agriculture, which characterizes topographic variability, or ruggedness, of roads. This proposal does not impact rural areas included in the current FORHP definition. This notice seeks public comment on FORHP's proposal. This notice also includes a technical clarification explaining how FORHP will use Census data to identify outlying Metropolitan Statistical Area counties that qualify as rural in future updates given the U.S. Census Bureau's 2020 Census terminology changes that removed the categories of Urban Clusters and Urbanized Areas.

HRSA is updating income levels used to identify a "low-income family" for the purpose of determining eligibility for programs that provide health professions and nursing training to individuals from disadvantaged backgrounds. These various programs are authorized in titles III, VII, and VIII of the Public Health Service Act. HHS periodically publishes in the Federal Register low-income levels to be used by institutions receiving grants or cooperative agreement awards to determine eligibility for programs providing training for disadvantaged individuals, individuals from disadvantaged backgrounds, or individuals from low-income families.
