Notice of Intent To Grant Buy America Waiver to Illinois Department of Transportation To Use Three Non-Domestic Component Parts, in the Incremental Train Control System

FRA is issuing this notice to advise the public that it intends to grant the Illinois Department of Transportation (``IDOT'') a waiver from FRA's Buy America requirement for the use of three component parts that are not produced in the United States for the Incremental Train Control System (``ITCS''). The three component parts included in IDOT's waiver request are: (1) An ethernet cable; (2) an omni directional antenna; and (3) a router/server combination. FRA believes a waiver is appropriate because off-the-shelf domestically produced components meeting the specific technical and design needs of the ITCS are not available, and custom-designed components are not ``reasonably available'' given the short timeframe associated with Positive Train Control (PTC) implementation and the low dollar value of the two components as installed on just twenty (20) locomotives, and only one router/server combination needed for the entire project. The total cost of the non-domestically produced components is approximately $20,000, out of the $2.5 million cost for the ITCS.
Safety Advisory 2013-01; Passing Stop Signals Protecting Movable Bridges

FRA is issuing Safety Advisory 2013-01 to remind track owners, railroads, and their employees of the importance of ensuring that rails are properly aligned and movable spans are secured before permitting a train to pass a signal that is displaying a stop indication and protecting a movable bridge. FRA is issuing this notice in response to a recent train accident involving a derailment in which there was an unsecured swing span that moved laterally during the passage of a train. This notice recommends that track owners and railroads: (1) Evaluate the design and construction of existing movable bridges to determine if effective span locking is being provided; (2) review current operating rules and procedures to ensure that these instructions adequately protect movable bridges during the operation of trains; and (3) ensure that employees authorized to determine whether movable bridges are correctly aligned and secured are adequately trained to perform these duties.

In response to Safety Recommendation R-12-04 issued by the National Transportation Safety Board (NTSB), FRA is issuing this Advisory Notice to inform railroads of the circumstances surrounding the June 19, 2009, derailment of eastbound Canadian National Railway (CN) Freight Train U70691-18 in Cherry Valley, IL, and to remind railroads of the need to immediately notify pipeline operators of rail accidents occurring in railroad rights-of-way where pipelines are present and the need to ensure that pipeline inspections are accomplished prior to resumption of service.

FRA is revising its regulations to reflect amendments to certain statutory civil monetary penalty provisions effected by the Moving Ahead for Progress in the 21st Century Act (MAP-21), which was enacted on July 6, 2012. These statutory amendments became effective on October 1, 2012. Pursuant to the Act, FRA is eliminating the minimum penalty for other than a training violation and adjusting both the ordinary maximum penalty and the aggravated maximum penalty that applies when assessing a civil monetary penalty for a violation of the Federal hazardous materials transportation laws or a regulation, special permit, or approval issued under those laws. FRA is also revising references to these minimums and maximums in its civil penalty assessment guidelines to conform to these statutory changes.

In response to a petition for rulemaking, FRA proposed, in a notice of proposed rulemaking (NPRM) dated December 11, 2012, amendments to regulations implementing a requirement of the Rail Safety Improvement Act of 2008 that certain passenger and freight railroads install positive train control (PTC) systems. The present document clarifies FRA's responses to several elements of the Association of American Railroads' (AAR) petition for rulemaking and which elements of the petition for rulemaking FRA is considering, and asks specific questions concerning those elements. This document does not alter FRA's proposal as issued December 11, 2012, but it does extend the comment period in this proceeding to March 11, 2013.

FRA announces the third meeting of the NECSC, a Federal Advisory Committee mandated by Section 212 of the Passenger Rail Investment and Improvement Act of 2008 (PRIIA). The Committee is made up of stakeholders operating on the Northeast Corridor (NEC), and the purpose of the Committee is to provide annual recommendations to the Secretary of Transportation. The NECSC meeting topics will include: Status of the frequency spectrum recommendation to the Secretary of Transportation, impacts of Hurricane Sandy on NEC infrastructure and lessons learned, and a general discussion of safety issues.
