The FHWA is issuing this rescinded notice to advise the public that the FHWA will not be preparing an Environmental Impact Statement (EIS) for the proposed project involving approximately 3.8 miles of the Brooklyn-Queens Expressway (BQE), Interstate 278 (I-278) in Kings County, New York (Project Identification Number X729.94). This segment of the BQE referred to as the Gowanus Expressway, extends from Sixth Avenue to the Brooklyn Battery Tunnel and contains 23 structures with a total deck area of approximately 2,000,000 square feet. A Notice of Intent to prepare an EIS was published in the Federal Register in November 1996.

Emergency Temporary Closure of the I-64 Sherman-Minton Bridge Over the Ohio River Between Indiana and Kentucky

Pursuant to section 658.11 of title 23, Code of Federal Regulations, the Indiana Division of the Federal Highway Administration (FHWA) announces the continued closure of the I-64 Sherman-Minton Bridge over the Ohio River between Indiana and Kentucky which the Indiana Governor closed on September 9, 2011, for safety considerations. After consultation with the Indiana Department of Transportation (INDOT), the Kentucky Transportation Cabinet (KYTC), and the FHWA, it was recommended that the bridge be closed after the discovery of a crack in a critical load-carrying element of the bridge. The closure is for an indefinite period of time. The INDOT is detouring eastbound I-64 traffic onto I-265 eastbound to I-65 southbound to cross the Ohio River and rejoin I-64 eastbound in Kentucky. The KYTC is detouring westbound I-64 traffic, bound for destinations beyond Louisville, onto northbound I-264 (or I-265) to southbound I-71 to northbound I-65 to cross the Ohio River and follow the Indiana detour. Under title 23 of the Code of Federal Regulations, section 658.11 (Additions, deletions, exceptions, and restrictions), the FHWA can grant the closing of the Interstate system or other National Network route based upon specified justification criteria in section 658.11(d)(2). The FHWA is also authorized to delete any route from the National Network on an emergency basis based on safety considerations pursuant to section 658.11(e). The FHWA has decided to approve the request by the Indiana Division of the FHWA as an emergency deletion in accordance with section 658.11(e) due to the safety considerations discussed in this notice. The FHWA is requesting comments from the general public on the alternate routes selected by Indiana due to the closure.

This notice announces actions taken by the FHWA that are final within the meaning of 23 U.S.C. 139(l)(1). The actions relate to a proposed highway project, US 41 (Memorial Drive to County M) in Brown County, Wisconsin. Those actions grant approvals for the project. The project will widen the US 41 freeway mainline from 4 to 6 lanes and add auxiliary lanes at certain locations along US 41 northbound and southbound from Memorial Drive to County M, The project will also reconstruct I-43 from US 41 to Atkinson Drive and reconstruct the Velp Avenue, I-43, and County M interchanges. The I-43/US 41 interchange will be reconstructed as a System Interchange with directional ramps and will include a realignment of the US 41 mainline, raising of the northbound gradeline, and elimination of existing access between Velp Avenue and I-43 via US 41. The project limits on US 41 extend from Memorial Drive to County M, a distance of approximately 3.5 miles and the project limits on I-43 extend from US 41 to Atkinson Drive, a distance of approximately 2 miles. The project also includes construction of roundabouts, construction of new bridges and replacement of existing bridges.
Multistate Corridor Operations and Management Program

This notice invites existing and potential multistate organizations, coalitions, or other arrangements or entities engaged in corridor transportation activities and research to apply for participation in the Multistate Corridor Operations and Management (MCOM) Program authorized by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) Intelligent Transportation Systems (ITS) Research program. The purpose of the MCOM program is to promote regional cooperation, planning, and shared project implementation for research programs and projects to improve multimodal transportation system management and operations. This notice seeks applications for available fiscal year (FY) 2011 funding ($7 million), which will be provided to cover a maximum of 80 percent of proposed program/project costs. L. 109-59; 119 Stat. 1144) continued the highway bridge program to enable States to improve the condition of their highway bridges over waterways, other topographical barriers, other highways, and railroads. Section 1114(f) amended 23 United State Code (U.S.C.) 144 by adding subsection (r), requiring the Secretary of Transportation to publish in the Federal Register a report describing construction materials used in new Federal-aid bridge construction and bridge rehabilitation projects. As part of the SAFETEA-LU Technical Corrections Act of 2008 (Pub. L. 110-244), 23 U.S.C. 144 subsection (r) became subsection (q), but the reporting requirement remained the same.

The FHWA has approved a request from Maryland Transportation Authority (MDTA) to temporarily close a portion of I-395 (just south of Conway Street in Baltimore City) from approximately 7 p.m. on Thursday, September 1, 2011, until approximately 6 a.m. on Tuesday, September 6, 2011. The closure is requested to accommodate the construction and operation of the Baltimore Grand Prix (BGP), which will use the streets of downtown Baltimore as a race course. The approval is granted in accordance with the provisions of 23 CFR 658.11 which authorizes the deletion of segments of the federally designated routes that make up the National Network designated in Appendix A of 23 CFR Part 658. The FHWA published a Notice and Request for Comment on June 28, 2011, seeking comments from the general public on this request submitted by the MDTA for a deletion in accordance with 23 CFR 658.11(d). No public comments were received.

Section 5207 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) established the Surface Transportation Environment and Planning Cooperative Research Program (STEP). The FHWA anticipates that the STEP or a similar program to provide resources for national research on issues related to planning, environment, and realty will be included in future surface transportation legislation. In Fiscal Year (FY) 2012, the FHWA expects to seek partnerships that can leverage limited research funding in the STEP with other stakeholders and partners in order to increase the total amount of resources available to meet the Nation's surface transportation research needs.
