The Environmental Protection Agency (EPA or Agency) is seeking public comment on the manufacture of certain per- and polyfluoroalkyl substances (PFAS), including perfluorooctanoic acid (PFOA), perfluorononanoic acid (PFNA), and perfluorodecanoic acid (PFDA), during the fluorination of high-density polyethylene (HDPE) and other plastic containers to inform regulations as appropriate under the Toxic Substances Control Act (TSCA). This request for public comment follows the Agency's grant on July 10, 2024, of a TSCA petition received on April 11, 2024, which requested that EPA address via TSCA the regulation of PFOA, PFNA, and PFDA formed during the fluorination of plastic containers used for a variety of household consumer, pesticide, fuel, automotive, and other industrial products.

Air Plan Approval; Connecticut; State Implementation Plan Revisions Required by the 2015 Ozone NAAQS

These revisions (1) certify the adequacy of the SIP to satisfy the nonattainment new source review (NNSR) permitting requirements of the Clean Air Act (CAA) for the reclassification of the Greater Connecticut area to moderate nonattainment for the 2015 ozone NAAQS, and (2) certify the emission statement program satisfies the requirements of CAA section 182(a)(3)(B) for the initial nonattainment designations and the reclassification to moderate nonattainment for the 2015 ozone NAAQS. This action is being taken in accordance with the CAA.
Air Plan Approval; Connecticut; New Haven and Fairfield Counties Second 10-Year Limited Maintenance Plan for the 2006 24-Hour PM2.5 Standard

The Environmental Protection Agency (EPA) is proposing to approve, under the Clean Air Act (CAA), the limited maintenance plan (LMP) for the 2006 PM2.5 national ambient air quality standard (NAAQS) for New Haven and Fairfield Counties, which comprise the Connecticut portion of the New York-N. New Jersey-Long Island (NY- NJ-CT) 2006 PM2.5 NAAQS maintenance area. This LMP was submitted on May 9, 2023, and supplemented on February 21, 2024, by the Connecticut Department of Energy and Environmental Protection (CT DEEP). The plan addresses the second 10-year maintenance period for particulate matter with an aerodynamic diameter less than or equal to a nominal 2.5 micrometers, known as PM2.5. EPA is proposing approval of Connecticut's LMP submission because it provides for the maintenance of the 2006 24-hour PM2.5 NAAQS through the end of the second 10-year portion of the maintenance period. In addition, EPA is initiating the process to find the Connecticut PM2.5 LMP adequate for transportation conformity purposes.

This extension is for the 2024 submission period only. The TSCA CDR regulations require manufacturers (including importers) of certain chemical substances included on the TSCA Chemical Substance Inventory (TSCA Inventory) to report data on the manufacturing, processing, and use of the chemical substances.

EPA is approving changes allowing the option for aerospace parts and products coating operations in Florida to comply with Federal National Emission Standards for Hazardous Air Pollutants (NESHAP) requirements in lieu of the volatile organic compound (VOC) standards in Florida's Surface Coating of Miscellaneous Metal Parts and Products (MMPP) rule (hereinafter referred to as FL MMPP Rule) in the Florida SIP. EPA has determined that the changes included in Florida's October 12, 2022, submission are consistent with the applicable provisions of the Clean Air Act (CAA or Act) and its implementing regulations.
Significant New Use Rules on Certain Chemical Substances (21-3.F)

EPA is proposing significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for chemical substances that were the subject of premanufacture notices (PMNs). The chemical substances received "not likely to present an unreasonable risk" determinations pursuant to TSCA. The SNURs require persons who intend to manufacture (defined by statute to include import) or process any of these chemical substances for an activity that is proposed as a significant new use by this rulemaking to notify EPA at least 90 days before commencing that activity. The required notification initiates EPA's evaluation of the conditions of use for that chemical substance. In addition, the manufacture or processing for the significant new use may not commence until EPA has conducted a review of the required notification, made an appropriate determination regarding that notification, and taken such actions as required by that determination.

On July 25, 2024, the State of Washington (WA) submitted a request for the Environmental Protection Agency (EPA) to redesignate to attainment a portion of Whatcom County immediately surrounding the now permanently closed aluminum smelter, Intalco Aluminum LLC, which the EPA designated nonattainment for the 2010 sulfur dioxide (SO2) primary National Ambient Air Quality Standard (NAAQS). Washington also submitted a request for the EPA to approve a State Implementation Plan (SIP) revision containing a maintenance plan for the area. In response to this submittal, the EPA is proposing to take the following actions: determine that the Whatcom County (partial) SO2 nonattainment area (NAA) is attaining the 2010 SO2 primary NAAQS; approve Washington's plan for maintaining attainment of the 2010 SO2 primary NAAQS in the area; and redesignate the Whatcom County (partial) SO2 NAA to attainment for the 2010 1-hour primary SO2 NAAQS.

Determination of Attainment by the Attainment Date; Michigan; St. Clair 2010 Sulfur Dioxide Nonattainment Area

This determination is based on annual SO2 emissions data, modeled data, and certified ambient air quality data from EPA's December 7, 2021, Clean Data Determination for St. Clair, as well as publicly available additional supporting 2020 data. This action, if finalized, will address EPA's obligation under the Clean Air Act (CAA) to determine whether the St. Clair SO2 nonattainment area (referred to hereafter as the St. Clair area, or simply the area) attained the 2010 SO2 NAAQS by the September 12, 2021, attainment date.

The Environmental Protection Agency (EPA or Agency) is announcing the availability of the final risk evaluation under the Toxic Substances Control Act (TSCA) for tris(2-chloroethyl) phosphate (TCEP). The purpose of risk evaluations under TSCA is to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment, without consideration of costs or non-risk factors, including unreasonable risk to potentially exposed or susceptible subpopulations identified as relevant to the risk evaluation by EPA, under the conditions of use. The Agency used the best available science to prepare this final risk evaluation and determined, based on the weight of scientific evidence, that TCEP poses unreasonable risk to human health and the environment. Under TSCA, EPA must initiate risk management actions to address the unreasonable risk.
Cross-Media Electronic Reporting: Electronic Submission of Reports, Notifications, and Other Submission Types

This notice announces the Environmental Protection Agency's (EPA) allowance of the electronic submission of reports, notifications, or other required submission types (in an acceptable digital format) in certain Clean Air Act (CAA) regulations that do not already have electronic reporting requirements (i.e., reports, notifications, or other submission types required to be submitted in paper format or as specified in this notice, an email). This action is consistent with the provisions of the Cross-Media Electronic Reporting Rule (CROMERR) and streamlines reporting requirements by allowing regulated entities to submit specified reports, notifications, or other submission types electronically via the Compliance and Emissions Data Reporting Interface (CEDRI) on the EPA's Central Data Exchange (CDX) (see https:/ /cdx.epa.gov), or to another EPA managed electronic document receiving system that may be designated for the receipt of specified submissions in the future. Additionally, performance test reports that do not already have CROMERR compliant electronic reporting requirements may utilize the Electronic Reporting Tool (ERT) (see https://www.epa.gov/ electronic-reporting-air-emissions/electronic-reporting-tool- ert) to submit those reports to CEDRI in the form of an ERT submission package. The authority for the designation of alternative EPA electronic document receiving systems may not be redelegated to state, local, or tribal authorities. When a report, notification, or other submission type submitted under this new electronic submission option contains confidential business information (CBI), a file with the CBI omitted or redacted must be submitted to the CEDRI system and a separate, complete submission containing the claimed CBI information must be submitted through the described CBI submission process.

The Environmental Protection Agency (EPA) is requesting comment on an application from Jaguar Land Rover North America, LLC ("JLR") for off-cycle carbon dioxide (CO2) credits under EPA's light-duty vehicle greenhouse gas emissions standards. "Off- cycle" emission reductions can be achieved by employing technologies that result in real-world benefits, but where that benefit is not adequately captured on the test procedures used by manufacturers to demonstrate compliance with emission standards. EPA's light-duty vehicle greenhouse gas program acknowledges these benefits by giving automobile manufacturers several options for generating "off-cycle" CO2 credits. Under the regulations, a manufacturer may apply for CO2 credits for off-cycle technologies that result in off-cycle benefits. In these cases, a manufacturer must provide EPA with a proposed methodology for determining the real-world off-cycle benefit. JLR submitted their application describing a methodology for determining off-cycle credits from the technology described in their application. Pursuant to applicable regulations, EPA is making this off-cycle credit calculation methodology available for public comment.

The Environmental Protection Agency (EPA) is approving a revision to the State of New York's State Implementation Plan (SIP) for the ozone National Ambient Air Quality Standard (NAAQS) related to a Source-specific SIP (SSSIP) revision for the Sylvamo Ticonderoga Mill (formerly known as International Paper), located at 568 Shore Airport Rd., Ticonderoga, New York (the Facility). The control options in this SSSIP revision implement Reasonably Available Control Technology (RACT) for nitrogen oxide (NOX) emissions from the relevant Facility sources, which include one power boiler, one lime kiln, and one recovery furnace. This SSSIP revision is intended to implement NOX RACT for the relevant Facility sources in accordance with the requirements for implementation of the 2008 and 2015 ozone NAAQS. This action will not interfere with ozone NAAQS requirements and meets all applicable requirements of the Clean Air Act (CAA). The EPA proposed to approve this rule on May 23, 2024, and received two comments, neither of which were relevant to the rulemaking.

Approval and Promulgation of Air Quality Implementation Plans; Connecticut; Regional Haze State Implementation Plan for the Second Implementation Period

The Environmental Protection Agency (EPA) is approving the regional haze State implementation plan (SIP) revision submitted by Connecticut on January 5, 2022, as satisfying applicable requirements under the Clean Air Act (CAA) and EPA's Regional Haze Rule for the program's second implementation period. Connecticut's SIP submission addresses the requirement that States must periodically revise their long-term strategies for making reasonable progress towards the national goal of preventing any future, and remedying any existing, anthropogenic impairment of visibility, including regional haze, in mandatory Class I Federal areas. The SIP submission also addresses other applicable requirements for the second implementation period of the regional haze program. The EPA is taking this action pursuant to sections 110 and 169A of the Clean Air Act.

The U.S. Environmental Protection Agency is undertaking this rulemaking to assess the eligibility of six applications to receive priority access to allowances allocated pursuant to the American Innovation and Manufacturing Act of 2020. This rulemaking proposes the framework for how EPA will assess whether to renew the eligibility of applications to receive application-specific allowances; decisions to renew or not renew each of the six applications that currently receive application-specific allowances; revisions to the Technology Transitions regulations as relevant to the specific applications under review; a procedural process for submitting a petition to designate a new application as eligible for priority access to allowances; narrow revisions to the methodology used to allocate allowances to application-specific allowance holders for calendar years 2026 and beyond; and limited revisions to existing regulations. EPA is also proposing to authorize an entity to produce regulated substances for export. Lastly, EPA is proposing certain confidentiality determinations for newly reported information if this rulemaking is finalized as proposed.
Notification of Request for Nominations to the National Environmental Justice Advisory Council

The U.S. Environmental Protection Agency (EPA) invites nominations from a diverse range of qualified candidates to be considered for appointment to its National Environmental Justice Advisory Council (NEJAC). The NEJAC was chartered to provide advice regarding broad, cross-cutting issues related to environmental justice. This notice solicits nominations to fill approximately seven (7) new vacancies for terms through February 2026. To maintain the representation outlined by the charter, nominees will be selected to represent: academia, business and industry; community-based; non- governmental organizations; State and local governments; and Tribal governments and indigenous organizations. We are interested in adding members located in all EPA regions. Vacancies are anticipated to be filled by January 31, 2025. Sources in addition to this Federal Register Notice will be utilized in the solicitation of nominees.
