On November 20, 2015, the Environmental Protection Agency (EPA) proposed a rule titled, ``Treatment of Data Influenced by Exceptional Events.'' The EPA is extending the comment period on the proposed rule and the notice of availability of the related draft guidance that was scheduled to close on January 19, 2016. The new comment closing date will be February 3, 2016. We are extending the comment period at the request of several stakeholders to allow interested parties additional time to thoroughly review and analyze the noted documents and provide meaningful comments.

Determination of Attainment; Texas; Houston-Galveston-Brazoria 1997 Ozone Nonattainment Area; Determination of Attainment of the 1997 Ozone Standard

The Environmental Protection Agency (EPA) has determined that the Houston-Galveston-Brazoria (HGB) 8-hour ozone nonattainment area is currently attaining the 1997 ozone National Ambient Air Quality Standard (NAAQS). This determination is based upon certified ambient air monitoring data that show the area has monitored attainment of the 1997 ozone NAAQS for the 2012-2014 monitoring period and continues to monitor attainment of the NAAQS based on preliminary 2015 data. Thus, the requirements for this area to submit an attainment demonstration, a reasonable further progress (RFP) plan, contingency measures, and other State Implementation Plan (SIP) documents related to attainment of the 1997 ozone NAAQS shall be suspended for so long as the area continues to attain the 1997 ozone NAAQS.

This notice announces the availability of EPA's proposed interim registration review decision for alpha-chlorohydrin and opens a public comment period on this proposed interim decision. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, that the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment.

Revisions to the Public Notice Provisions in Clean Air Act Permitting Programs

The U.S. Environmental Protection Agency (EPA) proposes to revise the public notice rule provisions for the New Source Review (NSR), title V and Outer Continental Shelf (OCS) permit programs of the Clean Air Act (CAA) and the corresponding onshore area (COA) determinations for implementation of the OCS air quality regulations. This action would remove the mandatory requirement to provide public notice of a draft air permit, as well as certain other program actions, through publication in a newspaper and would instead allow for electronic noticing (e-notice) of these actions. The proposed rule revisions would apply to major source air permits issued by the EPA, by EPA-delegated air agencies, and by air agencies with EPA-approved programs (with the exception of permits that are issued pursuant to the Tribal NSR Rule, which already allows for e-notice methods).

Air Plan Approval; Indiana; Temporary Alternate Opacity Limits for American Electric Power, Rockport

The Environmental Protection Agency (EPA) is proposing to approve a revision to the Indiana State Implementation Plan (SIP), authorizing temporary alternate opacity limits (TAOLs) at the American Electric Power, Rockport (AEP Rockport) facility during periods of unit startup and shutdown. This action is consistent with the Clean Air Act (CAA) and EPA policy regarding emissions during periods of startup and shutdown. Indiana has provided an air quality analysis demonstrating that this revision will continue to protect the applicable National Ambient Air Quality Standards (NAAQS) for fine particulate matter (PM2.5) in Spencer County.
Pesticides; Revisions to Minimum Risk Exemption

EPA is revising its regulations to more clearly describe the active and inert ingredients that are permitted in products eligible for the minimum risk pesticide exemption. EPA is improving the clarity and transparency of the minimum risk exemption by codifying the inert ingredients list and by adding specific chemical identifiers, where available, for all eligible active and inert ingredients. These specific identifiers will make it easier for manufacturers, the public, and Federal, state, and tribal inspectors to determine the specific chemical substances that are permitted in minimum risk pesticide products. EPA is also modifying the labeling requirements in the exemption to require products to list ingredients on the label with a designated label display name and to provide the producer's contact information on the product's label. These changes will provide more consistent information for consumers and clearer regulations for producers, and will simplify compliance determination by states, tribes, and EPA.
Spinosad; Pesticide Tolerances

This regulation establishes tolerances for residues of spinosad in or on multiple commodities that are identified and discussed later in this document. In addition, this regulation removes a number of existing tolerances for residues of spinosad that are superseded by tolerances being established in this action. Interregional Research Project #4 (IR-4) requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Texas: Final Authorization of State-Initiated Changes and Incorporation by Reference of State Hazardous Waste Management Program

During a review of Texas' regulations, the Environmental Protection Agency (EPA) identified a variety of State-initiated changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). We have determined that these changes are minor and satisfy all requirements needed to qualify for Final authorization and are authorizing the State-initiated changes through this direct Final action. In addition, this document corrects technical errors made in the September 3, 2014, Federal Register authorization document for Texas. The Solid Waste Disposal Act, as amended, commonly referred to as the Resource Conservation and Recovery Act (RCRA), allows the Environmental Protection Agency (EPA) to authorize States to operate their hazardous waste management programs in lieu of the Federal program. The EPA uses the regulations entitled ``Approved State Hazardous Waste Management Programs'' to provide notice of the authorization status of State programs and to incorporate by reference those provisions of the State statutes and regulations that will be subject to the EPA's inspection and enforcement. The rule codifies in the regulations the prior approval of Texas' hazardous waste management program and incorporates by reference authorized provisions of the State's statutes and regulations.

During a review of Texas' regulations, the Environmental Protection Agency (EPA) identified a variety of State-initiated changes to Texas' hazardous waste program under the Resource Conservation and Recovery Act, as amended (RCRA), for which the State had not previously sought authorization. The EPA proposes to authorize the State for the program changes. In addition, the EPA proposes to codify in the regulations entitled ``Approved State Hazardous Waste Management Programs, ``Texas' authorized hazardous waste program''. The EPA will incorporate by reference into the Code of Federal Regulations (CFR) those provisions of the State regulations that are authorized and that the EPA will enforce under RCRA.

The Environmental Protection Agency (EPA) is announcing a 30- day extension of the public comment period for the draft document titled, ``External Review Draft Integrated Science Assessment for Sulfur OxidesHealth Criteria'' (EPA/600/R-15/066). The original Federal Register notice announcement provides a 60-day public comment period and was published on November 24, 2015. The EPA subsequently received a request to extend this comment period. With the 30-day extension announced in this notice, the comment period ends on February 24, 2016. The draft document was prepared by the National Center for Environmental Assessment (NCEA) within the EPA's Office of Research and Development as part of the review of the primary (health-based) National Ambient Air Quality Standards for sulfur dioxide.
Notice of Availability of Electronic Reporting; Federal Air Rules for Reservations Online Reporting System

The Environmental Protection Agency (EPA) is notifying the public that electronic emissions reporting is now available for sources covered by the Federal Air Rules for Reservations (FARR). The FARR requires certain sources of air pollution on Indian Reservations in Idaho, Oregon, and Washington to register and report emissions to the EPA. Any person who owns or operates a source of air pollution with the potential to emit two or more tons per year of an air pollutant, with certain exceptions, must register annually and report those emissions. Registration and emissions reports are due within 90 days of commencing operations, and annually thereafter. The EPA created the FARR Online Reporting System (FORS) to help make registration and emissions reporting easier. The FORS, operated through the agency's Central Data Exchange (CDX), is CROMERR compliant, which means the electronic signature meets the EPA's regulatory electronic signature requirements.

The United States Environmental Protection Agency (EPA) is hereby providing notice of a proposed administrative settlement with two parties for recovery of response costs concerning the Riverside Chrome Plating Superfund Site in Riverside County, California (the Site). The proposed settlement requires Settling Parties Cleon Benson and SP Group, who own the Site property, to pay $86,388.99 to reimburse EPA for funds expended in performing and overseeing response actions at the Site. For thirty (30) days following the date of publication of this Notice in the Federal Register, EPA will receive written comments relating to the proposed settlement. EPA will consider all comments received and may modify or withdraw its consent to the settlement if comments received disclose facts or considerations which indicate the proposed settlement is inappropriate, improper, or inadequate. EPA's response to any comments received will be available for public inspection at 75 Hawthorne Street, San Francisco, CA 94105.

Pesticide Registration Review; Draft Human Health and Ecological Risk Assessments for Certain Organophosphates; Extension of Comment Period

EPA issued a notice in the Federal Register of September 25, 2015, opening a comment period on draft human health and ecological risk assessments for certain organophosphate pesticides listed in Table 1, along with additional chemicals. Following this, EPA issued a notice in the Federal Register of November 20, 2015, extending the comment period for an additional 45 days, until January 8, 2016. This document extends the close of the comment period for an additional 45 days for only the chemicals listed in Table 1, from January 8, 2016 to February 23, 2016. This comment period is being extended in response to comments received by the Agency. The Agency is also taking comments on the document entitled, ``Literature Review on Neurodevelopment Effects & FQPA Safety Factor Determination for the Organophosphate Pesticides'' in conjunction with this comment period and not through a separate comment period.

No. 1477613-46-9) when used as an inert ingredient in a pesticide chemical formulation. Spring Trading Company on behalf of Lamberti USA, Incorporated submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2-propenoic acid, homopolymer, ester with [alpha]-[2,4,6-tris(1-phenylethyl)phenyl]- [omega]-hydroxypoly(oxy-1,2-ethanediyl), compd. with 2,2',2''- nitrilotris[ethanol] on food or feed commodities.
Chlorinated Paraffins; Request for Available Information on PMN Risk Assessments

This regulation establishes an exemption from the requirement of a tolerance for residues of ammonium acetate (CAS No. 631-61-8) when used as an inert ingredient (buffering agent) limited to 15% in pesticide formulations applied to pre-harvested crops. Exponent Inc., 1150 Connecticut Ave., Suite 1100, Washington, DC 20036 on behalf of the Gowan Company LLC., 370 South Main Street, Yuma, AZ 85364 submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of ammonium acetate.
