The revisions will incorporate the Early Action Compact (EAC) Clean Air Action Plan (CAAP) into the New Mexico SIP. EPA is approving the photochemical modeling in support of the attainment demonstration for the 8-hour ozone standard within the San Juan County EAC area. These actions strengthen the SIP in accordance with the requirements of sections 110 and 116 of the Federal Clean Air Act (the Act), and will result in emission reductions needed to help ensure continued attainment and maintenance of the 8-hour National Ambient Air Quality Standard (NAAQS) for ozone.

Notice of availability for public review for a 90 day comment period is hereby given for the Draft Environmental Sampling, Analysis and Results (ESAR) Data Standards. The Draft Environmental Sampling, Analysis, and Results Data Standards are a collection of 14 standards that are based on the business processes used to collect and analyze environmental data. The collection is comprised of an Overview, four primary standards and nine supporting components. The fourteen ESAR data standards are designed to provide implementation flexibility and improve the exchange of environmental data across the nation. States and U.S. EPA completed a technical review of these data standards in the Spring of 2004. That review lead to the formation of Air, Waste, and Water teams, which reviewed the comments and produced this final collection of draft data standard documents. Reviewers will see that the standards may not use the specific terminology for a given environmental program. In order to make the standards work for the broadest audience, terms were specifically chosen for relevance to the broadest audience. Similarly, the standards do not address all details of each environmental program. These standards, when final, are intended to serve as a foundation for information exchange across environmental media (water, air, waste). Media or program specific data elements may need to be added in an exchange. Reviewers please note that the draft data standards are based on and incorporate related efforts such as other data standards, electronic data deliverables, and systems data dictionaries in media specific areas including: the EDSC data standard ``Reporting Water Quality Results for Chemical and Microbiological Analytes;'' exchange specifications such as the ``Staged Electronic Data Deliverable'' (SEDD); data dictionaries such as the Air Quality Monitoring System (AQS); as well as specifications from the National Environmental Laboratory Accrediting Council (NELAC) and the Laboratory Information Management System (LIMS).

In accordance with section 122(h) of the Comprehensive Environmental Response, Compensation, and Liability Act as amended (``CERCLA''), 42 U.S.C. 9622(h), notice is hereby given of a proposed administrative settlement for recovery of past response costs concerning the General Motors CorporationCentral Foundry Division Superfund Site located in Massena, St. Lawrence County, New York with the settling party, the General Motors Corporation. The settlement requires the settling party to pay $897,690.88, plus an additional sum for Interest on that amount calculated from April 21, 2004 through the date of payment to the General MotorsCentral Foundry Division Superfund Site Special Account within the EPA Hazardous Substance Superfund in reimbursement of EPA's past response costs incurred with respect to the Site. The settlement includes a covenant not to sue the settling party pursuant to Section 107(a) of CERCLA, 42 U.S.C. 9607(a) for past response costs. For thirty (30) days following the date of publication of this notice, the Agency will receive written comments relating to the settlement. The Agency will consider all comments received and may modify or withdraw its consent to the settlement if comments received disclose facts or considerations which indicate that the settlement is inappropriate, improper, or inadequate.

This proposed regulation would amend the ``Guidelines Establishing Test Procedures for the Analysis of Pollutants'' under section 304(h) of the Clean Water Act (CWA), by adding analytical test procedures for enumerating the bacteria, Escherichia coli (E. coli) and enterococci, in wastewater; and by adding analytical test procedures for enumerating fecal coliforms and Salmonella in sewage sludge to the list of Agency-approved methods. Specifically, EPA is proposing both membrane filter (MF) and multiple-tube fermentation (MTF, i.e., multiple-tube, multiple-well) methods for E. coli and enterococci bacteria in wastewater, and MTF methods for fecal coliforms and Salmonella in sewage sludge. EPA's approval of these methods will help Regions, States, communities, and environmental laboratories better assess public health risks from microbiological pollutants.

The EPA is approving a revision to the Oklahoma State Implementation Plan (SIP) submitted by the Secretary of the Environment on December 22, 2004 for Central Oklahoma. This revision will incorporate a Memorandum of Agreement (MOA) between the Oklahoma Department of Environmental Quality (ODEQ) and the Association of Central Oklahoma Governments (ACOG) into the Oklahoma SIP and includes a demonstration of attainment and maintenance for the 8-hour National Ambient Air Quality Standard (NAAQS) for ozone. The MOA outlines duties and responsibilities of each party for implementation of pollution control measures for the Central Oklahoma Early Action Compact (EAC) area. EPA is approving the photochemical modeling in support of the attainment demonstration for the 8-hour ozone standard within the Central Oklahoma EAC area and is approving the associated control measures. These actions strengthen the SIP in accordance with the requirements of sections 110 and 116 of the Federal Clean Air Act (the Act) and will result in emission reductions needed to help ensure attainment and maintenance of the 8-hour NAAQS for ozone.

In accordance with section 113(g) of the Clean Air Act, as amended (``Act''), 42 U.S.C. 7413(g), notice is hereby given of a proposed settlement agreement to address a lawsuit filed by the Interstate Natural Gas Association of America: Interstate Natural Gas Association of America v. EPA, No. 04-1296 (DC Cir.). On September 1, 2004, the Interstate Natural Gas Association of America (``Petitioner'') filed a Petition for Review of EPA's final rule pursuant to 42 U.S.C. 7607 and Rule 15 of the Federal Rules of Appellate Procedure. Petitioner challenged the EPA's final rule entitled ``Standards of Performance for Stationary Gas Turbines'' published on July 8, 2004 (69 FR 41346). The standards of performance for stationary gas turbines are set forth in 40 CFR part 60, subpart GG. Under the terms of the proposed settlement agreement, EPA will undertake rulemaking to make certain amendments to the rule at issue. No later than 60 days after the date this Agreement becomes final, EPA shall sign either a notice of proposed rulemaking or a notice of direct final rulemaking and concurrent proposal to amend certain provisions of 40 CFR 60.334 and 60.335. The amendments to these sections of subpart GG will be made in order to clarify our intent that nothing in the amendments to subpart GG was meant to impose new requirements for turbines constructed after 1977, when subpart GG was initially promulgated, that do not use water or steam injection to control NOX emissions.

This notice announces the availability of Guidance for 2006 Assessment, Listing, and Reporting Requirements Pursuant to Sections 303(d), 305(b) and 314 of the Clean Water Act. This biennial guidance is for states, territories, authorized tribes, and interstate commissions (hereinafter referred to as ``jurisdictions'') that help states prepare and submit section 305(b) reports to EPA. Sections 303(d), 305(b), and 314 of the Clean Water Act (CWA) require states, territories, and authorized tribes (not interstate commissions) to provide biennial reports to EPA on the condition of waters within their boundaries. This guidance outlines the development of Integrated Reports (IR) that support EPA's strategy for achieving a broad-scale, national inventory of water quality conditions. The objective of this guidance is to provide jurisdictions a recommended reporting format and suggested content to be used in developing a single document that integrates the reporting requirements of sections 303(d), 305(b), and 314. Use of the IR format will allow jurisdictions to report the water quality standards attainment status of all waters, document the availability of data and information for each segment, identify certain trends in the water quality conditions, and provide information to managers in setting priorities for future actions to protect and restore the health of our nation's aquatic resources.

In accordance with section 113(g) of the Clean Air Act, as amended (``Act''), 42 U.S.C. 7413(g), notice is hereby given of a proposed settlement agreement, to address a lawsuit filed by Sierra Club: Sierra Club v. Johnson, No. 05CV00750 (ESH) (D.D.C.). On or about April 13, 2005, Sierra Club filed a complaint alleging that EPA had a mandatory duty to provide a valid response within 60 days to Sierra Club's Title V petition and to respond to the remand of the United States Court of Appeals for the Eleventh Circuit in the case of Sierra Club v. Leavitt, 368 F.3d 1300 (11th Cir. 2004). Sierra Club had filed a petition seeking EPA's objection to the Clean Air Act Title V operating permit for the Oglethorpe Power Corporation's Wansley Combined Cycle Energy Facility issued by the Georgia Environmental Protection Division. EPA denied the petition in an Order dated November 15, 2002. Sierra Club appealed to the Eleventh Circuit, which vacated EPA's Order and remanded to the agency for further consideration. Under the terms of the proposed settlement agreement, EPA has agreed to respond to the remand by September 15, 2005, and Sierra Club has agreed to dismiss its suit with prejudice. In addition, under the proposed settlement, EPA would make a payment to Sierra Club in settlement of its claims for attorneys' fees in this matter.

EPA is proposing to approve the Maryland Department of the Environment's (MDE) request for delegation of authority to implement and enforce the Federal plan (68 FR 5144, January 31, 2003) for small municipal waste combustor (MWC) units under sections 111(d) and 129 of the Clean Air Act (the ``Act''). The request for delegation was submitted as a means to fulfill requirements of the Clean Air Act (the Act). In the Final Rules section of this Federal Register, EPA is approving Maryland's delegation request as a direct final rule without prior proposal because the Agency views this as a noncontroversial action and anticipate no adverse comments. A detailed rationale for the approval is set forth in the direct final rule. If no adverse comments are received in response to this action, no further activity is contemplated. If EPA receives adverse comments, the direct final rule will be withdrawn and all public comments received will be addressed in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period. Any parties interested in commenting on this action should do so at this time.

EPA is taking direct final action to approve the Maryland Department of the Environment's (MDE) request for delegation of authority to implement and enforce the Federal plan (68 FR 5144, January 31, 2003) for small municipal waste combustor (SMWC) units under sections 111(d) and 129 of the Clean Air Act (the ``Act''). The plan establishes emissions limits, compliance schedules, monitoring, operating, and recordkeeping requirements for existing SMWC units for which construction commenced on or before August 30, 1999. The request for delegation was submitted to EPA on March 28, 2005. EPA and the MDE signed a Memorandum of Agreement (MOA) which is the mechanism for the transfer of authority from EPA to the MDE. The MOA defines policies, responsibilities, and procedures pursuant to 40 CFR 62 subpart JJJ (the ``Federal plan'') and 40 CFR 60 subpart BBBB (Emission Guidelines), by which the Federal plan will be administered by both the EPA and the MDE.

Public Water System Supervision Program Revision for the State of Texas

Notice is hereby given that the State of Texas is revising its approved Public Water System Supervision Program. Texas has adopted the Arsenic Rule and the Radionuclides Rule. EPA has determined that these revisions are no less stringent than the corresponding Federal regulations. Therefore, EPA intends to approve these program revisions. All interested parties may request a public hearing. A request for a public hearing must be submitted by September 12, 2005, to the Regional Administrator at the EPA Region 6 address shown below. Frivolous or insubstantial requests for a hearing may be denied by the Regional Administrator. However, if a substantial request for a public hearing is made by September 12, 2005, a public hearing will be held. If no timely and appropriate request for a hearing is received and the Regional Administrator does not elect to hold a hearing on his own motion, this determination shall become final and effective on September 12, 2005. Any request for a public hearing shall include the following information: the name, address, and telephone number of the individual organization, or other entity requesting a hearing; a brief statement of the requesting person's interest in the Regional Administrator's determination and a brief statement of the information that the requesting person intends to submit at such hearing; and the signature of the individual making the request, or, if the request is made on behalf of an organization or other entity, the signature of a responsible official of the organization or other entity.
Certain New Chemicals; Receipt and Status Information

Section 5 of the Toxic Substances Control Act (TSCA) requires any person who intends to manufacture (defined by statute to include import) a new chemical (i.e., a chemical not on the TSCA Inventory) to notify EPA and comply with the statutory provisions pertaining to the manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of TSCA, EPA is required to publish a notice of receipt of a premanufacture notice (PMN) or an application for a test marketing exemption (TME), and to publish periodic status reports on the chemicals under review and the receipt of notices of commencement to manufacture those chemicals. This status report, which covers the period from June 21, 2005 to July 22, 2005, consists of the PMNs pending or expired, and the notices of commencement to manufacture a new chemical that the Agency has received under TSCA section 5 during this time period.
Order Denying Objections to Issuance of Tolerances

On four occasions in the first half of 2002, the Natural Resources Defense Council (NRDC) and various other parties filed objections with EPA to final rules under section 408 of the Federal Food, Drug, and Cosmetic Act (FFDCA), (21 U.S.C. 346a), establishing pesticide tolerances for various pesticides. The objections apply to 14 pesticides and 112 separate pesticide tolerances. Although the objections raise numerous pesticide-specific issues, they all focus on the potential risks that the pesticides pose to farm children. This Order responds to NRDC's objections as to all of the challenged tolerances with the exception of the objections pertaining to the imidacloprid tolerance on blueberries which were previously denied. The objections to the other tolerances are denied for the reasons stated herein.
Protections for Test Subjects in Human Research; Notification to the Secretaries of Agriculture and Health and Human Services

This document notifies the public that the Administrator of EPA has forwarded to the Secretaries of Agriculture and Health and Human Services a draft proposed rule under sections 21 and 25(a) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The draft proposed rule will formalize and clarify EPA's policies on the use of intentional human exposure studies under FIFRA and the Federal Food Drug and Cosmetic Act (FFDCA). The proposed rule would establish stringent ethical protections for human subjects in certain types of research conducted or sponsored by entities other than the Federal government (i.e., ``third-parties''). These protections are consistent with requirements currently in place under the Federal Policy for the Protection of Human Subjects of Research (the ``Common Rule''), which has been adopted by 17 Federal agencies. The draft proposed rule is not available to the public until after it has been signed by EPA.

This regulation amends the established exemption from the requirement of a tolerance under 40 CFR 180.1065 for 2-amino-4,5- dihydro-6-methyl-4-propyl-s-triazolo(1,5-alpha)pyrimidin-5-on e, which is also known as ``PP796'', by increasing the amount that can be used to not more than 0.3 percent in formulation of paraquat dichloride. Syngenta Crop Protection submitted a pesticide petition ((PP) 5E6929) requesting this amendment.

The Environmental Protection Agency (EPA) is proposing to amend certain provisions of the regulations establishing effluent limitations guidelines, pretreatment standards and new source performance standards for the Iron and Steel Manufacturing Point Source Category. Prior to 2002, regulations applicable to the Iron and Steel Manufacturing Point Source Category had authorized the establishment of limitations applicable to the total mass of a pollutant discharged from more than one outfall. The effect of such a ``water bubble'' was to allow a greater or lesser quantity of a particular pollutant to be discharged from any single outfall so long as the total quantity discharged from the combined outfalls did not exceed the allowed total mass limitation. In 2002, EPA revised the water bubble to prohibit establishment of alternative oil and grease effluent limitations. Based on consideration of new information and analysis, EPA proposes to reinstate the provision authorizing alternative oil and grease limitations with one exception. Today's notice also proposes to correct errors in the effective date of new source performance standards.
Approval and Promulgation of Air Quality Implementation Plans; Texas; Texas Low-Emission Diesel Fuel Program

EPA is proposing to approve revisions to the State Implementation Plan (SIP) for the state of Texas. This revision makes changes to the Texas Low-Emission Diesel (TXLED) Fuel program. On April 6, 2005 EPA approved the compliance date change that was part of this submittal. None of the revisions being proposed for approval change the ultimate requirements regarding the reductions to be achieved. As a result and in accordance with section 110(l) of the Act, 42 U.S.C. section 7410(l), these revisions will not interfere with attainment, reasonable further progress or any other applicable requirement of the Clean Air Act.
National Emission Standards for Gasoline Distribution Facilities (Bulk Gasoline Terminals and Pipeline Breakout Stations)

On December 14, 1994, we promulgated National Emission Standards for Gasoline Distribution Facilities (Bulk Gasoline Terminals and Pipeline Breakout Stations) (59 FR 64318). The national emission standards limit and control hazardous air pollutants (HAP) that are known or suspected to cause cancer or have other serious health or environmental effects. Section 112(f)(2) of the Clean Air Act (CAA) directs EPA to assess the risk remaining (residual risk) after the application of national emission standards controls. Also, CAA section 112(d)(6) requires us to review and revise the national emission standards as necessary by taking into account developments in practices, processes, and control technologies. The proposal announces a decision and requests public comments on the residual risk assessment and technology review for the national emission standards. We are proposing no further action at this time to revise the national emission standards.

National Emission Standards for Hazardous Air Pollutants: Cellulose Products Manufacturing

The EPA is proposing amendments to the national emission standards for hazardous air pollutants (NESHAP) for cellulose products manufacturing, which were issued on June 11, 2002, under section 112 of the Clean Air Act (CAA). This action proposes to improve implementation of the emission standards by revising the work practice standards, general and initial compliance requirements, definitions, and General Provisions applicability, as well as correcting typographical, formatting, and cross-referencing errors in the final rule. In the Rules and Regulations section of this Federal Register, we are issuing the amendments as a direct final rule, without prior proposal, because we view the revisions as noncontroversial and anticipate no adverse comments. We have explained our reasons for the revisions in the preamble to the direct final rule. If we receive any adverse comment on one or more distinct amendments in the direct final rule, we will publish a timely notice of withdrawal in the Federal Register informing the public which provisions will become effective and which provisions are being withdrawn due to adverse comment. We will address all public comments in a subsequent final rule. We will not institute a second comment period on this action. Any parties interested in commenting must do so at this time. If no adverse comments are received, no further action will be taken on the proposal, and the direct final rule will become effective as provided in that action. The regulatory text for the proposal is identical to that for the direct final rule published in the Rules and Regulations section of this Federal Register.
