This airplane will have a novel or unusual design feature when compared to the state of technology envisioned in the airworthiness standards for transport-category airplanes. This design feature is the installation of a therapeutic oxygen distribution system that provides a shared source of oxygen between the flightcrew and passengers. The applicable airworthiness regulations do not contain adequate or appropriate safety standards for this design feature. These special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to that established by the existing airworthiness standards.

This final rule adopts permanent amendments and a Special Federal Aviation Regulation (SFAR) for a period of ten years to: facilitate the certification of powered-lift pilots, clarify operating rules applicable to operations involving a powered-lift, and finalize other amendments which are necessary to integrate powered-lift into the National Airspace System (NAS). In this final action, the FAA finalizes its alternate framework to stand-up initial groups of powered-lift pilots and flight instructors. Most notably, the FAA adopts alternate frameworks to facilitate the certification of pilots seeking qualifications in a powered-lift with single functioning flight controls and a single pilot station. In response to commenters, the FAA provides clarification for certain operating rules and adopts a performance-based approach to certain operating rules to enable powered-lift operations. In addition to finalizing provisions for powered-lift, this action also makes changes to practical tests in aircraft that require type ratings, including airplanes and helicopters, training center rotorcraft instructor eligibility, training and testing requirements, and training center use of rotorcraft in flight training.

The FAA is adopting a new airworthiness directive (AD) for certain Embraer S.A. Model EMB-545 and EMB-550 airplanes. This AD was prompted by reports of corrosion, damage, and rupture on the down lock spring assemblies of the main landing gear (MLG) and nose landing gear (NLG). This AD requires inspecting for affected MLG and NLG down lock springs and replacing affected down lock springs, and prohibits the installation of affected parts, as specified in an Ag[ecirc]ncia Nacional de Avia[ccedil][atilde]o Civil (ANAC) AD, which is incorporated by reference. The FAA is issuing this AD to address the unsafe condition on these products.

This notification announces a limited, conditional policy for prioritizing returned operations at Newark Liberty International Airport (EWR) due to a construction-related runway closure at EWR for purposes of establishing a carrier's operational baseline in the next corresponding scheduling seasons. A "returned operation" is any planned operation included in the initially approved schedules that a carrier moved or will not operate due to the effort to reach the targeted reduced schedule throughout the construction period at EWR. In addition, the FAA will provide similar limited, conditional relief at Chicago O'Hare International Airport (ORD), Los Angeles International Airport (LAX), and San Francisco International Airport (SFO) under the FAA's Level 2 schedule facilitation process as well as a limited, conditional waiver of minimum usage requirements at Ronald Reagan Washington National Airport (DCA), for impacted flights between EWR and the listed airports.

This final rule implements, without interpretation, the provisions of sections 815 and 828 of the FAA Reauthorization Act of 2024 ("the Act"). To conform the FAA's regulations to the self- enacting provisions in the Act, this final rule amends certain regulations to: align aircraft conditions and limitations with the term "covered aircraft" as defined in section 2307(j) of the FAA Extension, Safety, and Security Act of 2016 to increase the number of allowable passengers from 5 to 6, increase the number of occupants from 6 to 7, and increase the maximum takeoff weight from 6,000 pounds to 12,500 pounds, while excluding certain transport category rotorcraft. This final rule facilitates updates to current standards the medical form a State-licensed physician uses in completing a comprehensive medical examination. Further, this final rule amends regulations to incorporate the statutory expansion of BasicMed medical eligibility to examiners conducting practical tests or proficiency checks if they meet the requirements for operating covered aircraft under BasicMed, as provided in the Act.

Requirements To File Notice for Meteorological Towers and Other Wind Energy Systems

The FAA is proposing to amend requirements applicable to meteorological towers and permanent wind energy systems. This rule would require any person that owns (sponsor) any proposed, altered, or existing meteorological tower to file notice with the Federal Aviation Administration (FAA) if the highest point of the structure is at least 50 feet above ground level (AGL) up to and including 200 feet AGL at its site. The FAA is also proposing marking requirements for meteorological towers constructed or altered after the effective date of a final rule if the highest point of the structure is at least 50 feet AGL up to and including 200 feet AGL at its site. Additionally, the FAA proposes making certain pertinent information about any meteorological tower with the highest point of the structure at least 50 feet AGL up to and including 200 feet AGL at its site available on the FAA's official database. The FAA expects these changes to lower the collision risk for aircraft during low-altitude operations. Moreover, these requirements would partially address two statutory mandates and two National Transportation Safety Board (NTSB) recommendations.

The FAA proposes to adopt a new airworthiness directive (AD) for certain The Boeing Company Model 747-400, 747-400F, 747-8F, and 747-8 series airplanes. This proposed AD was prompted by a report that, during potable water servicing, there were multiple engine indicating and crew alerting system messages. The cause was the separation of a fitting and steel water supply tube above an electronics equipment cooling air filter, behind the forward cargo compartment left sidewall. This proposed AD would require, depending on configuration, installing at certain locations: conduits on exposed potable water supply lines, envelope assemblies over all exposed potable water line fittings and exposed potable water supply lines, a slitted spray shield, a 2-piece deflector shield around the equipment cooling system air inlet, and/or a shroud on exposed potable water supply lines. The FAA is proposing this AD to address the unsafe condition on these products.

The FAA proposes to supersede Airworthiness Directive (AD) 2022-01-02, which applies to certain De Havilland Aircraft of Canada Limited Model DHC-8-400, -401, and -402 airplanes. AD 2022-01-02 requires inspecting for corrosion of the nacelle to wing rear spar attachment pins, and the nacelle to landing gear attachment pins, and doing all applicable corrective actions. Since the FAA issued AD 2022- 01-02, it was discovered that some operators were unable to identify the airplanes subject to each requirement. This proposed AD would continue to require the actions specified in AD 2022-01-02, clarify the affected airplanes for each required action, and revise the applicability by removing Model DHC-8-400 airplanes, as specified in a Transport Canada AD, which is proposed for incorporation by reference (IBR). This proposed AD would also revise a certain compliance time. The FAA is proposing this AD to address the unsafe condition on these products.

The FAA is superseding Airworthiness Directive (AD) 2021-09- 03, which applied to certain Airbus Canada Limited Partnership Model BD-500-1A10 and BD-500-1A11 airplanes. AD 2021-09-03 required repetitive replacements of the emergency locator transmitter (ELT) antenna and repetitive inspections of the exterior fuselage skin around the ELT antenna attachment area. This AD was prompted by a report that there was an in-service failure of an ELT antenna that occurred before the repetitive replacement interval required by AD 2021-09-03, and that a terminating action was developed. This AD continues to require the actions in AD 2021-09-03 and requires replacement of the ELT antenna with a new ELT antenna, inspection of the exterior fuselage skin around the ELT antenna attachment holes, and repair if necessary; as specified in a Transport Canada AD, which is incorporated by reference. The FAA is issuing this AD to address the unsafe condition on these products.

This proposed AD was prompted by further analysis of an event involving an IAE AG Model V2533-A5 engine that had an uncontained failure of a high-pressure turbine (HPT) 1st- stage hub that resulted in high-energy debris penetrating the engine cowling. This proposed AD would require revising the airworthiness limitations section (ALS) of the existing maintenance manual or instructions for continued airworthiness and the existing approved maintenance or inspection program, as applicable, to include new inspections of certain critical rotating parts. The FAA is proposing this AD to address the unsafe condition on these products.

Waiver of Launch Collective Risk Limit for a Near-Orbital Trajectory

This notice concerns a petition for waiver submitted to the Federal Aviation Administration (FAA) by Space Exploration Technologies Corporation (SpaceX) to waive the launch collective risk limit of 1 x 10-4 expected casualties (Ec) for Starship Super Heavy missions that utilize a near-orbital trajectory. The near-orbital Starship Super Heavy missions have been deemed suborbital such that a single launch collective risk limit of 1 x 10-4 Ec has been applied to cover the aggregate of the risks from the suborbital launch and suborbital reentry phases of each mission. The SpaceX petition requests an increase to the collective risk limit, to not exceed 2 x 10-4 Ec, with the condition that neither the suborbital launch nor suborbital reentry risks exceed 1 x 10-4 Ec individually. The FAA grants the petition for near-orbital Starship Super Heavy missions to allow a risk budget that parallels but remains consistent with an orbital mission profile that has a separate risk limit of 1 x 10-4 Ec for both the launch and reentry phases.
