On December 18, 2019, the Bureau of Indian Affairs (BIA) amended its regulations governing Tribal Energy Resource Agreements (TERAs) between the Secretary of the Interior (Secretary) and Indian Tribes. That document inadvertently failed to include the statutory requirement that any application for a Tribal Energy Development Organization (TEDO) be submitted by the Tribe, rather than the TEDO itself, and incorrectly listed three cross- references. This interim final rule would correct that omission and cross-references.

We, the Office of Surface Mining Reclamation and Enforcement (OSMRE), are notifying the public that the recent decision of the United States Supreme Court in McGirt v. Oklahoma, 140 S. Ct. 2452 (2020), which legally recognized the on-going existence of the historic Muscogee (Creek) Nation Reservation in the State of Oklahoma, necessarily forecloses the State of Oklahoma's authority to implement the Surface Mining Control and Reclamation Act of 1977 (SMCRA) on Indian Lands within the exterior boundaries of the Muscogee (Creek) Nation Reservation. SMCRA designates OSMRE as the regulatory authority over surface coal mining and reclamation operations on Indian lands where a tribe has not obtained primacy. OSMRE has thus determined that Oklahoma cannot exercise its State program regulatory authority over surface coal mining and reclamation operations within the exterior boundaries of the Muscogee (Creek) Nation Reservation. Accordingly, for lands within the exterior boundaries of the Muscogee (Creek) Nation Reservation, OSMRE is assuming jurisdiction over the SMCRA Title IV reclamation and Title V regulatory programs. The Muscogee (Creek) Nation Reservation consists of lands, wholly or partially within the following counties: Creek, Hughes, Seminole, McIntosh, Muskogee, Okfuskee, Okmulgee, Tulsa, Rogers, Mayes, and Wagoner.

The joint ROD includes the decisions of the Department of the Interior (DOI), USACE, and NMFS regarding the Vineyard Wind COP. The USACE has adopted the FEIS to support its permitting actions under the River and Harbors Act of 1899 (RHA) and the Clean Water Act (CWA). NMFS has adopted the FEIS to support its decision to issue an incidental take authorization under the Marine Mammal Protection Act. We, the U.S. Fish and Wildlife Service (Service), announce the availability of a draft habitat conservation plan (HCP) and draft categorical exclusion (CatEx) for activities described in an application for an incidental take permit (ITP) under the Endangered Species Act of 1973, as amended. The ITP would authorize take of the Santa Barbara County distinct population segment of the California tiger salamander incidental to activities associated with oil production facilities and a solar photovoltaic system near the city of Orcutt in Santa Barbara County, California. The applicant developed the draft HCP as part of their application for an ITP. The Service prepared a draft CatEx in accordance with the National Environmental Policy Act to evaluate the potential effects to the natural and human environment resulting from issuing an ITP to the applicant. We invite public comment on these documents.

After a thorough review of the best available scientific and commercial information, we find that it is not warranted at this time to list Hall's bulrush (Schoenoplectiella hallii) or triangle pigtoe (formerly Fusconaia lananensis). However, we ask the public to submit to us at any time any new information relevant to the status of any of the species mentioned above or their habitats.
Endangered and Threatened Wildlife and Plants; 90-Day Findings for Three Species

We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on three petitions to add species to the Lists of Endangered and Threatened Wildlife and Plants under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that the petitions present substantial scientific or commercial information indicating that the petitioned actions may be warranted. Therefore, with the publication of this document, we announce that we plan to initiate status reviews of the Aztec gilia (Aliciella formosa), Clover's cactus (Sclerocactus cloverae), and Suckley's cuckoo bumble bee (Bombus suckleyi) to determine whether the petitioned actions are warranted. To ensure that the status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding the species and factors that may affect their status. Based on the status reviews, we will issue 12-month petition findings, which will address whether or not the petitioned actions are warranted, in accordance with the Act.
