Oil and Gas; Hydraulic Fracturing on Federal and Indian Lands; Rescission of a 2015 Rule

On March 26, 2015, the Bureau of Land Management (BLM) published in the Federal Register a final rule entitled, ``Oil and Gas; Hydraulic Fracturing on Federal and Indian Lands'' (2015 rule). With this final rule, the BLM is rescinding the 2015 rule because we believe it imposes administrative burdens and compliance costs that are not justified. This final rule returns the affected sections of the Code of Federal Regulations (CFR) to the language that existed immediately before the published effective date of the 2015 rule (June 24, 2015), except for changes to those regulations that were made by other rules published between the date of publication of the 2015 rule and now, and the phrase ``perform nonroutine fracturing jobs,'' which is not restored to the list of subsequent operations requiring prior approval. None of the changes by other rules are relevant to this rulemaking.

After a thorough review of the best available scientific and commercial information, we find that it is not warranted at this time to add the beaverpond marstonia to the Lists or remove the southwestern willow flycatcher from the List. However, we ask the public to submit to us at any time any new information that becomes available relevant to the status of either of the species listed above or their habitats.

The UKBCA contains measures to address the needs of water users in the Upper Klamath Basin, who are not affiliated with the Bureau of Reclamation's Klamath Project (Project). The UKBCA also contains conditions that must be achieved before the UKBCA can become permanent. Despite the efforts of the UKBCA parties, one or more conditions in subsection 10.1 of the UKBCA have failed to occur. We, the U.S. Fish and Wildlife Service (Service), announce a proposed rule and a 12-month finding on a petition to list the Yangtze sturgeon (Acipenser dabryanus) as an endangered species under the Endangered Species Act of 1973, as amended (Act). Loss of individuals due to overharvesting on the Yangtze River is the main factor that contributed to the historical decline of the species. Despite conservation efforts, this species is still currently in decline due primarily to the effects of dams and bycatch. If we finalize this rule as proposed, it would extend the Act's protections to this species. We seek information from the public on this proposed rule and the status review for this species.

We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on several petitions to list or reclassify wildlife or plants under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that the petitions present substantial scientific or commercial information indicating that the petitioned actions may be warranted with respect to the species mentioned in this notification. Therefore, with the publication of this document, we announce that we plan to initiate a review of the status of each of these species to determine if the petitioned actions are warranted. To ensure that these status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding these species. After completing the status reviews, we will issue 12-month findings on the petitions, which will address whether or not the petitioned action is warranted, in accordance with the Act. In addition, we announce a correction to information contained in the 90- day petition finding for the leopard (Panthera pardus), which clarifies the range and entity we are evaluating in our status review of the species.

We prepared the draft GCP to fulfill the requirements of the Endangered Species Act (ESA) for issuing permits to authorize take of Utah prairie dogs incidental to development activities within the range of the species in Utah. The draft GCP is designed to streamline incidental take permit authorization for many types of development activities while conserving the species. As required by the National Environmental Policy Act (NEPA), we also prepared a draft EA that analyzes the potential effects to the natural and human environment from issuing permits to Iron, Beaver, and Garfield Counties and from overall implementation of the GCP, including potential issuance of master or individual permits over the 10-year term of the proposed GCP.

The Bureau of Ocean Energy Management (BOEM) is announcing the availability of the Gulf of Mexico Outer Continental Shelf Lease Sale: Final Supplemental Environmental Impact Statement 2018 (2018 GOM Final Supplemental EIS). The 2018 GOM Final Supplemental EIS provides an analysis of the potential significant impacts of a proposed action (a regionwide lease sale), provides an analysis of reasonable alternatives to the proposed action, and identifies BOEM's preferred alternative. This Supplemental EIS is expected to be used to inform decisions on each of the two lease sales scheduled in 2018 (i.e., proposed Lease Sales 250 and 251) and to be supplemented as necessary for future Gulf of Mexico regionwide lease sales.

We, the U.S. Fish and Wildlife Service (Service), are proposing to update regulations for the Pittman-Robertson Wildlife Restoration and the Dingell-Johnson Sport Fish Restoration programs and subprograms, based on comments we received during the last rulemaking that were never resolved, existing guidance that we intend to move to regulation, and updates requested by States to improve the processes under license certification. We believe these changes will clarify and simplify the regulations and help ensure consistency in administering the programs across the Nation.

We, the Office of Surface Mining Reclamation and Enforcement (OSMRE), are approving an amendment to the Oklahoma regulatory program (Oklahoma program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Oklahoma proposed revisions to its regulations regarding: Permit eligibility for permits with violations on lands eligible for remining; permit suspension or rescission posting locations and appeal procedures; requiring GPS coordinates for aspects of permit maps; topsoil removal distances; blasting records requirements; annual reporting requirements; temporary cessation of operations requirements; casing and sealing temporary underground openings; right of entry requirements; surface drainage associated with auger mining; correcting reference errors; updating addresses; and correcting spelling and grammatical errors. Oklahoma intended to revise its program to be no less effective than the Federal regulations and to improve operational efficiency.

We, the U.S. Fish and Wildlife Service (Service), have received an application for an incidental take permit (ITP) under the Endangered Species Act of 1973, as amended (Act). Orange County Utilities (Applicant) is requesting a 10-year ITP. We request public comment on the permit application and accompanying proposed Malcolm Road Water Supply Habitat Conservation Plan (HCP), as well as on our preliminary determination that the plan qualifies as low effect under the National Environmental Policy Act. To make this determination, we used our environmental action statement and low-effect screening form, which are also available for review.
