The Bureau of Land Management (BLM) is proposing to amend its regulations in 43 CFR part 3500 for leasing of solid minerals other than coal and oil shale to distinguish fringe acreage lease requirements from lease modification requirements, and to describe acceptable justifications for a lease modification. The proposed rule would also identify changes in the associated procedural requirements and update the filing fees. The proposed changes are based on statutory authorities, which authorize the BLM to issue regulations for leasing of minerals and to charge for administrative processing costs, and on policy guidance from the Office of Management and Budget (OMB) and the Department of the Interior (DOI) requiring the BLM to charge these fees.

In accordance with Sec. 102(2)(C) of the National Environmental Policy Act (42 U.S.C. 4321 et. seq.), the National Park Service (NPS) will prepare an Environmental Assessment (EA) for transferring jurisdiction of a portion of NPS property within Fort Dupont Park, part of the Fort Circle Parks, to the District of Columbia (the District) for development of recreational facilities which may result in amending the NPS' 2004 Final Management Plan for Fort Circle Parks. This also serves as an announcement of a public scoping comment period to run until July 24, 2008. Comments submitted to the Park or through Planning, Environment and Public Comment (PEPC) during the public scoping period and at public meetings for this EA will be considered as part of the planning process for the current proposed action. Comments submitted at the public meeting held May 12, 2008, will be considered as part of the planning process for the current proposed action and do not need to be resubmitted. There is the possibility that the NPS might proceed to prepare an Environmental Impact Statement (EIS) in which case written comments submitted now on the scope of the alternatives and impacts will continue to be considered.

This final rule establishes regulations for seasons, harvest limits, methods, and means related to taking of wildlife for subsistence uses in Alaska during the 2008-09 and 2009-10 regulatory years. These regulations have been subject to an annual public review cycle, but starting in 2008 the Federal Subsistence Management Program will provide a public review process for subsistence hunting and trapping regulations in even-numbered years and subsistence fishing and shellfish regulations in odd-numbered years. The Program will also address customary and traditional use determinations during the applicable biennial cycle. This cycle adjustment does not affect the public's ability to submit special action requests or requests for reconsideration, as outlined in the regulations. This rulemaking replaces the subpart D subsistence taking of wildlife taking regulations which expire June 30, 2008. This rule also amends the customary and traditional use determinations of the Federal Subsistence Board.

In accordance with Section 102(2)(C) of the National Environmental Policy Act of 1969 (NEPA), the BLM in Oregon is beginning preparation of a programmatic Environmental Impact Statement (EIS) to analyze the use of 18 nationally approved herbicides to control noxious weeds; to treat invasive plants and other weeds in administrative sites, recreation sites, and rights-of-way; to treat forest pests and diseases; and to meet non-commodity landscape health objectives across nine BLM Districts in Oregon. This EIS will tier to, and adopt procedures from, the programmatic Vegetation Treatments Using Herbicides on BLM Lands in 17 Western States EIS and Record of Decision (ROD) completed by the BLM in 2007 for the same 18 herbicides. The EIS will not amend existing District Resource Management Plans (RMPs).

We, the Office of Surface Mining Reclamation and Enforcement (OSM), are proposing regulation changes to the Abandoned Mine Reclamation Fund (Fund) and the Abandoned Mine Land (AML) program. This proposed rule revises our regulations to be consistent with the Tax Relief and Health Care Act of 2006, Pub. L. 109-432, signed into law on December 20, 2006, which included the Surface Mining Control and Reclamation Act Amendments of 2006 (the 2006 amendments). The proposed rule reflects the extension of our statutory authority to collect reclamation fees for an additional fourteen years and to reduce the fee rates. This proposal also updates the regulations in light of the statutory amendments that change the activities State and Tribal reclamation programs may perform under the AML program, funding for reclamation grants to States and Indian tribes, and transfers to the United Mine Workers of America (UMWA) Combined Benefit Fund (CBF), the UMWA 1992 Benefit Plan, and the UMWA Multiemployer Health Benefit Plan (1993 Benefit Plan). Finally, our proposed rule extends incentives reauthorized by the 2006 amendments pertaining to the remining of certain lands and water adversely affected by past mining.

The County of Calaveras proposes to purchase under the Recreation and Public Purposes (R&PP) Act the Wilseyville landfill currently under R&PP lease CAS-056771-01. The R&PP conveyance proposal is for the existing landfill area, consisting of 12.5 acres. The 10 acre landfill area was classified for conveyance in the Federal Register, Vol. 62, No. 70, page 17853, on April 11, 1997. It was later discovered that the entrance gate to the transfer station was inadvertently located outside the original classified 10 acres. To remedy this situation, classification for conveyance under the R&PP Act is amended to add 2.5 acres to the 10 acre classification, for a total of 12.5 acres. The 2.5 acres has been examined and found suitable for conveyance for recreational or public purposes under the provisions of the Recreation and Public Purposes Act, as amended (43 U.S.C. 869 et seq.).

The Minerals Management Service (MMS) is promulgating new regulations that establish a process for a shipper transporting oil or gas production from Federal leases on the Outer Continental Shelf (OCS) to follow if it believes it has been denied open and nondiscriminatory access to pipelines on the OCS. The rule provides MMS with tools to ensure that pipeline companies provide open and nondiscriminatory access to their pipelines.

Per 30 U.S.C. 188(d), Marathon Oil Company timely filed a petition for reinstatement of oil and gas lease NDM 95212, Mountrail County, North Dakota. The lessee paid the required rental accruing from the date of termination. No leases were issued that affect these lands. The lessee agrees to new lease terms for rentals and royalties of $10 per acre and 16\2/3\ percent or 4 percentages above the existing competitive royalty rate. The lessee paid the $500 administration fee for the reinstatement of the lease and $163 cost for publishing this Notice. The lessee met the requirements for reinstatement of the lease per Sec. 31(d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188). We are proposing to reinstate the lease, effective the date of termination subject to: The original terms and conditions of the lease; The increased rental of $10 per acre; The increased royalty of 16\2/3\ percent or 4 percentages above the existing competitive royalty rate; and The $163 cost of publishing this Notice.

In accordance with the National Environmental Policy Act of 1969 and the Federal Land Policy and Management Act of 1976, the Bureau of Land Management (BLM) Burns District in Burns, Oregon, intends to amend the Three Rivers Resource Management Plan (RMP) with an associated Environmental Assessment (EA) that also analyzes effects of undertaking the Greater Sage-grouse Habitat Improvement Project (GSHIP) located in Harney County, Oregon. The objective of the proposal is to improve sage-grouse habitat and reestablish once open sagebrush habitats encroached upon by western juniper. The BLM also intends to consider allowance for harvest of downed western juniper trees south of U.S. Highway 20 and west of Oregon State Highway 205 for fuel wood, posts and poles, and for commercial harvest of juniper boughs for use in holiday decorating. Allowance for harvest of downed juniper trees and juniper boughs would amend the Three Rivers RMP. By this notice, the BLM is announcing the beginning of the public scoping process.

We, the Fish and Wildlife Service, announce the availability of the technical agency draft revised recovery plan for the Puerto Rican Parrot (Amazona vittata). The technical agency draft revised recovery plan includes specific recovery objectives and criteria to be met in order to reclassify this species to threatened status and delist it under the Endangered Species Act of 1973, as amended (Act). We solicit review and comment on this technical agency draft recovery plan from local, state, and Federal agencies, and the public.
