The Bureau of Reclamation (Reclamation), under the National Environmental Policy Act of 1969, is announcing the opportunity for the public to review and comment on a SIR for the SDS Draft EIS. A public hearing to supplement the opportunity to comment on the SIR is also being announced. Reclamation previously published a notice in the Federal Register (73 FR 50055) on August 25, 2008, providing for extended public commenting on the water quality portion of the Draft EIS. Since then Reclamation has completed additional water quality analysis and is providing an opportunity for the public to comment on the new analysis. With this notice Reclamation is therefore closing the comment period on the original water quality analysis as mentioned in the August 25, 2008, notice and opening the comment period for the new water quality analysis. Reclamation has included this analysis in a SIR for the Draft EIS that updates and provides additional information that was not in the Draft EIS. The additional information includes, but is not necessarily limited to, the following topics: water quality analyses, potential effects on the western slope of Colorado, potential effects of a failure of new dams, effects of physical changes to the alternatives and reasonably foreseeable actions, clarification of Reclamation's purpose and need statement, changes in the project sponsors' Proposed Action, and identification of Reclamation's preferred alternative. The new and additional information is contained in the report titled ``Supplemental Information Report for the Draft Environmental Impact Statement, Southern Delivery System Project, Colorado.'' We, the U.S. Fish and Wildlife Service, are announcing the location and time of a public hearing to receive public comments on the proposal to split the current listing under the Endangered Species Act of 1973, as amended, of the threatened flatwoods salamander (Ambystoma cingulatum) into two distinct species: frosted flatwoods salamander (Ambystoma cingulatum) and reticulated flatwoods salamander (Ambystoma bishopi), due to a change in taxonomy. We also propose to list reticulated flatwoods salamander as endangered and propose critical habitat for both species. We are extending the public comment period until November 3, 2008. If you submitted comments previously, then you do not need to resubmit them because we have already incorporated them into the public record and we will fully consider them in preparation of our final determination.

Notice of Recreation User Fee for Tours at Glen Canyon Dam

The Bureau of Reclamation (Reclamation) will begin charging a recreation user fee to take the guided tour of Glen Canyon Dam and Powerplant. Reclamation has determined that the new fee is reasonable and appropriate to specifically offset at least, in part, increased costs associated with public visitation to the Carl Hayden Visitor Center. The Visitor Center, located 700 feet above the Colorado River overlooking Glen Canyon Dam and Bridge, accommodates about one million visitors each year. The Visitor Center is jointly operated by Reclamation and the National Park Service. The new fee will initially be $5.00 per adult with a reduced fee schedule for certain groups as follows: seniors (age 62 and over) will be $4.00, children ages 7-16 will be $2.50, members of the U.S. military will be $4.00, and school groups will be $0.50 per person. There will be no fee charged for children six years of age and under. These fees will be reviewed and adjusted, as appropriate, in subsequent years.

The Fish and Wildlife Service (Service) announces the receipt of an application for an Enhancement of Survival Permit that would be issued pursuant to section 10(a)(1)(A) of the Endangered Species Act of 1973, as amended (Act). The application was developed in accordance with the Template Safe Harbor Agreement (Template SHA) for the Columbia Basin pygmy rabbit (Brachylagus idahoensis). The permit applicant is the Washington Department of Natural Resources (WDNR). Issuance of a permit to WDNR would exempt incidental take of the Columbia Basin pygmy rabbit, which would otherwise be prohibited by section 9 of the Act, that is above the baseline conditions of WDNR properties enrolled under the Template SHA and that may result from the permittee's otherwise lawful management activities. The Service requests comments from the public regarding the proposed issuance of a permit to WDNR. All comments received will become part of the public record. Migratory Bird Permits; Changes in the Regulations Governing Falconry

We, the U.S. Fish and Wildlife Service, change the regulations governing falconry in the United States. We have reorganized the regulations and added or changed some provisions in them. In particular, we have eliminated the requirement for a Federal permit to practice falconry. The changes will make it easier to understand the requirements for the practice of falconry, including take of raptors from the wild, and the procedures for obtaining a falconry permit. This rule also adds a provision allowing us to approve falconry regulations that Indian Tribes or U.S. territories adopt. State, tribal, or territorial laws and regulations governing falconry must meet the standards in these regulations by January 1, 2014, at which time the Federal permit program will be discontinued.

The NIWR cooperates with the USGS in establishing total programmatic direction, reporting on the activities of the Institutes, coordinating and facilitating regional research and information and technology transfer, and in operating the NIWR-USGS Student Internship Program. Royalty Relief for Deepwater Outer Continental Shelf Oil and Gas Leases-Conforming Regulations to Court Decision

This rule amends 30 CFR parts 203 and 260 to conform the regulations to the decision of the United States Court of Appeals for the Fifth Circuit in Santa Fe Snyder Corp., et al. v. Norton. That decision found that certain provisions of the MMS regulations interpreting section 304 of the Deep Water Royalty Relief Act are contrary to the requirements of the statute. MMS will determine lessees' royalty under leases subject to Deep Water Royalty Relief Act section 304, for both past and future periods, in a manner consistent with the Fifth Circuit's decision in the Santa Fe Snyder case and this rule.

The proposed term of the Agreement is 15 years, and the proposed term of the permit is 25 years. In accordance with regulation, the Service is completing the application process for this proposed permit. The requested permit would authorize the Service to extend incidental take coverage with assurances to eligible landowners who are willing to carry out habitat management measures that would benefit the federally-listed endangered Fender's blue butterfly (Icaricia icarioides fenderi) and the threatened Kincaid's lupine (Lupinus sulphureus ssp. kincaidii) by enrolling them under the Agreement as Cooperators through issuance of Certificates of Inclusion. The covered area or geographic scope of this Agreement includes the known and potential range of the Fender's blue butterfly, which occurs on prairie habitat within Benton, Lane, Linn, Marion, Polk, and Yamhill counties of Oregon. The Bureau of Reclamation (Reclamation) proposes this rule establishing eligibility criteria and program requirements for loan guarantees authorized by the Twenty-first Century Water Works Act (Title II of Pub. L. 109-451; 43 U.S.C. 2421-2434) (Act). This rule is intended to define for potential participants how the loan guarantees authorized by the Act will be administered. The Act authorizes the Secretary of the Interior (Secretary) to make loan guarantees for three categories of projects: Category (A) projects are rural water supply projects as defined in section 102(9) of the Reclamation Rural Water Supply Act of 2006 (Title I of Pub. L. 109-451; 43 U.S.C.2401-2409) (Rural Water Supply Act of 2006); A category (B) project is an extraordinary operation and maintenance activity for, or the rehabilitation or replacement of, a facility that is authorized by Federal reclamation laws and constructed by the United States under such law; or in connection with which there is a repayment or water service contract executed by the United States under Federal reclamation law; or A category (C) project is an improvement to water infrastructure directly associated with a reclamation project that, based on a determination of the Secretary improves water management; and fulfills other Federal goals. For purposes of this rule, these will be referred to as category (A), (B), or (C) projects. The Act provides that, subject to the availability of appropriations, the Secretary of the Interior may provide loan guarantees for eligible projects. The Act requires the Secretary to develop criteria for determining the eligibility of a project for financial assistance, and to publish them in the Federal Register. The intent of this rulemaking is to meet this requirement, as well as to define for potential participants how the loan guarantee will be administered. Reclamation will administer the program. Reclamation will take into account the comments on this rule in developing final regulations. Reclamation recognizes that the rule will be modified in the future to more specifically address category (A) projects and to address modifications in administration as a result of experience gained through the first requests.

In accordance with section 102(2)(c) of the National Environmental Policy Act of 1969, the National Park Service (NPS) is preparing an Environmental Impact Statement (EIS) for a Special Resource Study (SRS) of landscape features and sites that contribute to the understanding of the Blackstone River Valley National Heritage Corridor as the birthplace of the Industrial Revolution in the United States. This study was mandated by Public Law 109-338, the ``John H. Chafee Blackstone River Valley National Heritage Corridor Reauthorization Act of 2006.'' The Blackstone River Valley National Heritage Corridor encompasses 24 communities located along the Blackstone River and its tributaries spanning from Worcester, MA to Providence, RI. Within the boundaries of the heritage corridor lie approximately 400,000 acres of land and over 500,000 people. The waters of the Blackstone River powered the Slater Mill, a National Historic Landmark, in Pawtucket, RI, America's first successful textile mill. This creative spark contributed to the nation's historic evolution as a global industrial and technological power. The Blackstone River Valley National Heritage Corridor was established by Public Law 99-647 in November 1986 for the purpose of preserving and interpreting for educational and inspirational benefit of present and future generations the unique and significant contributions to our national heritage of certain historic and cultural lands, waterways and structures within the states of Massachusetts and Rhode Island. The heritage corridor was to provide a management framework to assist the states of Massachusetts and Rhode Island and their units of local government in the development and implementation of integrated cultural, historical and land resource management programs in order to retain, enhance and interpret the significant values of the lands, waters and structures of the corridor. The purpose of this Special Resource Study/EIS is to provide Congress with information about the national significance, suitability, and feasibility of sites and landscape features within the corridor that are associated with American industrial history for possible inclusion in the National Park System. The study will develop alternative options for management and interpretation of the sites and landscape features under consideration. The draft report of the study, with the draft EIS, is expected to be completed and available for public review by late 2009.

We, the U.S. Fish and Wildlife Service (Service) initiate 5- year reviews of three wildlife species and eight plant species under the Endangered Species Act of 1973, as amended (Act) (see Table 1 under SUPPLEMENTARY INFORMATION ). We request any new information on these species that may have a bearing on their classification as endangered or threatened. Based on the results of these 5-year reviews, we will make recommendations as to whether each of these species is properly classified under the Act.

This notice advises the public that the Bureau of Indian Affairs (BIA) has replaced the National Indian Gaming Commission (NIGC) as lead agency in the preparation of an Environmental Impact Statement (EIS) for a proposed casino and hotel project to be located near Friant, in Fresno County, California. The BIA, with the Big Sandy Rancheria Band of Western Mono Indians (Tribe) as a cooperating agency, intends to gather information necessary for preparing the EIS. The NIGC initiated the public scoping process, including a public scoping meeting on September 15, 2005, to determine the issues, concerns and alternatives to be included in the EIS. The BIA is hereby continuing that process, but as project plans have not changed since the September 15, 2005, meeting, will not be holding additional public scoping meetings.

Gunnison Aggregate Resources has submitted a proposal for a land use authorization to operate an asphalt batch plant and other materials processing and temporary storage pursuant to Section 302 of the Federal Land Policy and Management Act of 1976 and regulations at Title 43 CFR 2920. The land consists of approximately 1.25 acres of public lands approximately 5 miles southwest of Gunnison in Gunnison County, Colorado, within a portion of the SW\1/4\SW\1/4\SE\1/4\ of Section 17, T.49N., R.1W., New Mexico Principal Meridian. The land is within a 50-acre parcel of public land designated as the McCabe Lane community gravel pit. The proponent is a permit holder authorized to extract gravel from the McCabe Lane pit.

Endangered and Threatened Wildlife and Plants; Incidental Take Permits in Santa Cruz County, CA

We, the Fish and Wildlife Service (Service), announce the availability of five Incidental Take Permit applications and Habitat Conservation Plans (HCPs) under section 10(a)(1)(B) of the Endangered Species Act of 1973, as amended (Act). The applicants collectively anticipate removing a total of approximately 2.04 acres of Mount Hermon June beetle (Polyphylla barbata) occupied habitat, and one HCP also includes the federally endangered Ben Lomond spineflower (Chorizanthe pungens var. hartwegiana) as a covered species. We are requesting comments on the permit applications and on our preliminary determination that the proposed HCPs qualify as ``low effect'' HCPs, eligible for a categorical exclusion under the National Environmental Policy Act of 1969, as amended.
Gulf of Mexico (GOM), Outer Continental Shelf (OCS), Central Planning Area (CPA) and Western Planning Area (WPA), Oil and Gas Lease Sales for Years 2009-2012

The MMS has prepared a SEIS on oil and gas lease sales tentatively scheduled in 2009-2012 in the CPA and WPA offshore the States of Texas, Louisiana, Mississippi, and Alabama. As mandated in the Gulf of Mexico Energy Security Act of 2006 (GOMESA) (Pub. L. 109- 432, December 20, 2006), MMS shall offer, as soon as practicable, approximately 5.8 million acres located in the southeastern part of the CPA (``181 South Area''). The CPA Sale 208 (March 2009) will be the first sale to include the ``181 South Area.'' The SEIS analyzed newly available information for the potential environmental effects of oil and natural gas leasing, exploration, development, and production in the ``181 South Area.''

With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act, provides the affected States the opportunity to review the proposed Notice. The proposed Notice sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rentals.
Wyoming Abandoned Mine Land Reclamation Plan

We are approving an amendment to the Wyoming abandoned mine land reclamation (AMLR) plan (hereinafter referred to as the ``Wyoming plan'') under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Wyoming intended to revise its plan by submitting a revision to W.S. 35-11-1210 to correct an inadvertent error in the statute that was enacted during the 2007 Legislative Session. Specifically, the amendment clarifies that W.S. Sec. 35-11-1210 only applies to SMCRA section 411(h)(1) funds.

The Bureau of Land Management (BLM) proposes to amend its regulations to remove the Land and Water Conservation Fund Act (LWCFA) as one of the authorities of our Recreation regulations, in accordance with the Federal Lands Recreation Enhancement Act of 2004 (REA). The rule will also amend and reorder the prohibitions to separate those that apply specifically to campgrounds and picnic areas from those with more general applications. The reordering is necessary to broaden the scope to include all areas where standard amenity, expanded amenity, and special recreation permit fees are charged under REA. The proposed rule would remove an unnecessary provision that has been interpreted to require the BLM to publish supplementary rules concerning failure to pay fees established by the recreation regulations, thus relieving the BLM from publishing such separate specific supplementary rules for each area. Finally, it will make technical changes to maintain consistency with other BLM regulations.
