We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the long-tailed duck (Clangula hyemalis) as endangered under the Endangered Species Act of 1973, as amended (Act). We find that the petition does not present substantial scientific or commercial information indicating that listing the species may be warranted. Therefore, we will not initiate a further status review in response to this petition. We ask the public to submit to us any new information that becomes available concerning the status of the long-tailed duck or threats to it or its habitat at any time. This information will help us monitor and encourage the conservation of the species.

The County of Calaveras proposes to purchase under the Recreation and Public Purposes (R&PP) Act the Wilseyville landfill currently under R&PP lease CAS-056771-01. The R&PP conveyance proposal is for the existing landfill area, consisting of 12.5 acres. The 10 acre landfill area was classified for conveyance in the Federal Register, Vol. 62, No. 70, page 17853, on April 11, 1997. It was later discovered that the entrance gate to the transfer station was inadvertently located outside the original classified 10 acres. To remedy this situation, classification for conveyance under the R&PP Act is amended to add 2.5 acres to the 10 acre classification, for a total of 12.5 acres. The 2.5 acres has been examined and found suitable for conveyance for recreational or public purposes under the provisions of the Recreation and Public Purposes Act, as amended (43 U.S.C. 869 et seq.).

Per 30 U.S.C. 188(d), Marathon Oil Company timely filed a petition for reinstatement of oil and gas lease NDM 95212, Mountrail County, North Dakota. The lessee paid the required rental accruing from the date of termination. No leases were issued that affect these lands. The lessee agrees to new lease terms for rentals and royalties of $10 per acre and 16\2/3\ percent or 4 percentages above the existing competitive royalty rate. The lessee paid the $500 administration fee for the reinstatement of the lease and $163 cost for publishing this Notice. The lessee met the requirements for reinstatement of the lease per Sec. 31(d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188). In accordance with the National Environmental Policy Act of 1969 and the Federal Land Policy and Management Act of 1976, the Bureau of Land Management (BLM) Burns District in Burns, Oregon, intends to amend the Three Rivers Resource Management Plan (RMP) with an associated Environmental Assessment (EA) that also analyzes effects of undertaking the Greater Sage-grouse Habitat Improvement Project (GSHIP) located in Harney County, Oregon. The objective of the proposal is to improve sage-grouse habitat and reestablish once open sagebrush habitats encroached upon by western juniper. The BLM also intends to consider allowance for harvest of downed western juniper trees south of U.S. Highway 20 and west of Oregon State Highway 205 for fuel wood, posts and poles, and for commercial harvest of juniper boughs for use in holiday decorating. Allowance for harvest of downed juniper trees and juniper boughs would amend the Three Rivers RMP. By this notice, the BLM is announcing the beginning of the public scoping process.

We are approving, on an interim basis, an amendment to the West Virginia regulatory program (the West Virginia program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). West Virginia revised its Surface Coal Mining and Reclamation Act to effect changes concerning the special reclamation tax and other issues. The tax provisions of the amendment are intended to increase and extend the special reclamation tax, and create the Special Reclamation Water Trust Fund for the purpose of designing, constructing and maintaining water treatment systems on forfeited sites. We are approving the reinstatement of the seven cents per ton special reclamation tax, its increase to seven and four-tenths cents per ton, as well as the creation of the Special Reclamation Water Trust Fund, on an interim basis, with our approval becoming effective upon publication of this interim rule.

We, the U.S. Fish and Wildlife Service (Service), announce our 90-day finding on a petition to reclassify the Argentine population of the broad-snouted caiman (Caiman latirostris) from endangered to threatened under the Endangered Species Act of 1973, as amended (Act). We find that the petition presents substantial scientific and commercial information indicating that the petitioned action of reclassifying the broad-snouted caiman in Argentina from endangered to threatened status under the Act may be warranted. Therefore, we are initiating a status review of the broad-snouted caiman to determine if reclassification of the population in Argentina, as petitioned, is warranted under the Act. To ensure that the status review is comprehensive, we are requesting submission of any new information on the broad-snouted caiman since its original listing as an endangered species in 1976. At the conclusion of our status review, we will make the requisite recommendation under section 4(c)(2)(B) of the Act and issue a 12-month finding on the petition, as provided in section 4(b)(3)(B) of the Act.

In accordance with Section 202 of the National Environmental Policy Act of 1969 (NEPA) (42 U.S.C. 4321 et seq.), the Council on Environmental Quality's regulations implementing the NEPA (40 CFR 1500- 1508), and applicable agency guidance, a Draft Programmatic Environmental Impact Statement (PEIS) has been prepared on the leasing of geothermal resources in 11 Western States and Alaska. The Department of the Interior, the Bureau of Land Management (BLM) and the Department of Agriculture, the Forest Service (FS) are co-lead agencies for the PEIS, and the Department of Energy (DOE) is a cooperating Federal agency. In accordance with the Energy Policy Act of 2005 (Pub. L. 109-58, August 8, 2005), the agencies' goal is to make geothermal leasing decisions on pending lease applications submitted prior to January 1, 2005, and to facilitate geothermal leasing decisions on other existing and future lease applications and nominations for geothermal leasing on Federal lands. The planning area encompasses about 530 million acres of land with the potential for geothermal development in Alaska, Arizona, California, Colorado, Idaho, Montana, New Mexico, Nevada, Oregon, Utah, Washington, and Wyoming.

The MMS proposes to incorporate the Eleventh Edition of the American Petroleum Institute's Specification for Subsurface Safety Valve Equipment (API Spec 14A), into the regulations. The rule also proposes that lessees and operators provide supporting design verification information for subsurface safety valves intended for use in high pressure high temperature environments. The MMS proposes to incorporate the Eleventh Edition of API Spec 14A because it updated the design validation and functional testing requirements, incorporated new design changes, and corrected ambiguous areas open to misinterpretation. These proposed changes would ensure that lessees and operators use the best available and safest technologies while operating in the Outer Continental Shelf.

The GMP/EIS will prescribe the resource conditions and visitor experiences that are to be achieved and maintained at the Memorial over the next 15 to 20 years. To facilitate sound planning and environmental assessment, the NPS intends to gather information necessary for the preparation of the GMP/ EIS and obtain suggestions and information from other Agencies and the public on the scope of issues to be addressed in the GMP/EIS. Comments and participation in this scoping process are invited. Participation in the planning process will be encouraged and facilitated by various means, including newsletters and public meetings. The NPS will conduct public scoping meetings to explain the planning process and to solicit opinion about issues to address in the GMP/EIS. Notification of all such meetings will be announced in the local press and in the NPS newsletters.

Under the provisions of 30 U.S.C. 188(d) and (e), and 43 CFR 3108.2-3(a) and (b)(1), the Bureau of Land Management (BLM) received a petition for reinstatement of oil and gas lease COC68788 from Gunnison Energy Corp., and SG Interests VII, LTD, for lands in Gunnison County, Colorado. The petition was filed on time and was accompanied by all the rentals due since the date the lease terminated under the law.
